You've probably heard the news that so-called "data crusader" Aaron Swartz killed himself over the weekend.

What you probably haven't heard is that the guy was a real douche. Sure, he was an idealist. But you know who was also an idealist? Joseph Stalin.

Idealism is only laudable when the ideals aspired to are laudable.

2 His theft from MIT's jstore has interesting twist to it.
Jstore contains mostly thesis papers.
The thesis is considered by most in public domain.
At least that's what my experience has been: whenever I needed someone's full thesis and it was sold on Jstore, I simply emailed the author and asked for a copy, and in 100% cases received their complete and unabridged thesis in PDF free of charge. And each of them thanked me for the interest.
Just saying.

3 Your mistaking public domain with free distribution.

When I finished my dissertation I had to agree to a "distribution" deal with one of JSTOR's affiliates.

The university "published" 5 copies I think, all of them at the university's library. All other printing and distribution rights were reserved to the university's distributor, a subsidiary of JSTOR.

So, while I retain the right to send you my dissertation, I don't retain the right to sell it, say, on Amazon. That right was part of the deal I made when the University "published" it.

4 That has no bearing! The material is still available for free from the author as long as anyone wants it. Jstore is only making a buck when one looking for the dissertation is too lazy to email the author or too impatient to wait until they read their email and reply back.

Accusing the 'hacker' of 'stealing' materials available for free would be like accusing someone from stealing water from someone with a bucket selling river water on the river bank. You can buy water in that bucket, but you can just walk to the river and get the same water for free.

5 Actually, HerWrath, some of us restrict access to our dissertations or theses because of contracts, content sequestration due to pending patents, or agreements made with individuals or organizations as part of our research. In which case dumping material from JSTOR or any other university thesis repository is theft and can have repercussions for the author.

This is exactly the same issue as we had in Newtown, CT. --NO amount of hiding tools or mental stroking will make it safe to live with an insane person. Was he smart? Hell yes! Did he have delusional ideas? Probably.

I'm sorry that he didn't seek help earlier, but let's not beat ourselves up over the fact that he was acting like a jerk and that he was chided by the courts. He was old enough to wear the big boy pants. The consequences are his to deal with.

I will not coddle his ilk.

You are saying that copyrighted material in your dissertation is a justification to restrict access. But Jstore is not restricting access - they sell the PDFs for $29 a piece regardless of the contents.

I have not come across a restricted dissertation yet, but if I received a response from the author that they could not provide it to me as they considered their dissertation restricted for distribution due to pending patent applications or contractual NDA, then Jstore selling me that PDF for $29 would be in compliance with your idea?

I feel this is flying over your heads, you are just not getting the grasp of situation Schwarz was put in. Did he trespass on Jstore computers? Hell yeah he was trespassing. Did he steal anything not freely obtainable elsewhere? Hell no.

(Do I give a rat ass about Schwarz? Hell no. I am just debating a logical problem.)
