Charles Grassley: The Memos James Comey Illegally Leaked to His Buddy (To Leak to the NYT) Are So Sensitive That I Could Only View Them in a SCIF

Grassley has written a letter to conspirator Rod Rosenstein, demanding answers to questions about Comey's lawbreaking, but of course Rosenstein will ignore these questions, as he ignores all questions about the DOJ's and FBI's behavior in this matter.


This Committee has previously written to the Department of Justice and the Federal Bureau of Investigation about the memoranda that former Director Comey created purportedly memorializing his interactions with President Trump.[1] My staff has since reviewed these memoranda in a Sensitive Compartmented Information Facility (SCIF) at the FBI, and I reviewed them in a SCIF at the Office of Senate Security. The FBI insisted that these reviews take place in a SCIF because the majority of the memos are classified.

Of the seven memos, four are marked classified at the "SECRET" or "CONFIDENTIAL" levels. Only three did not contain classified information. FBI personnel refused to answer factual questions during the document reviews, including questions about the chain of custody of the documents I was reviewing, the date that they were marked classified, and who marked them as classified.

According to press reports, Professor Daniel Richman of Columbia Law School stated that Mr. Comey provided him four of the seven memoranda and encouraged him to "detail [Comey's] memos to the press."[2] If it's true that Professor Richman had four of the seven memos, then in light of the fact that four of the seven memos the Committee reviewed are classified, it would appear that at least one memo the former FBI director gave Professor Richman contained classified information.[3] Professor Richman later read a portion of one of the memos to a New York Times reporter.[4]

When the Committee contacted Professor Richman seeking copies of the memos Mr. Comey had provided him, he refused to provide them, did not say how many he had received from Mr. Comey, and refused to say whether he retained copies.[5] It is unclear whether any of the memos reviewed by the Committee were retrieved from Professor Richman. The Committee has accordingly not determined which of the seven memos Mr. Comey provided him.

We (by which I mean good, sane people) finally have a few moles embedded within the legal apparatus at the highest levels, but we can't expect them to just up and start indicting everybody right away, much as I would love to see it.

As I said yesterday, one of the greatest untold scandals of the Obama administration was the actions Obama and Holder took to completely cripple the various Inspector Generals throughout the government. Unlike what most think, they are the real watchdogs of the Executive branch and have been since the OIG law was first implemented in 1978.

They are the Internal Affairs branch of the Exec branch and Obama tried to prevent them from having access to the documents and people they needed to do a real investigation with actual grand jury authority and the ability to recommend charges. One of the people who fought the hardest to have the powers restored under Trump and Sessions is Michael Horowitz, the Inspector General of the Intel community and the guy who has not only been running a much bigger investigation than Mueller or even Congress but has been the guy turning up all the evidence we have been seeing.

He has had these documents and many, many more for months and he is due to deliver over 1 million documents relating to his investigation into how the FBI and DOJ handled the Hillary email investigation and the circumstances those groups operated under to start an investigation into the Trump campaign.

But he is also likely to have found a lot more including the FBI abusing the FISA 702 process to spy on Americans long before the Trump campaign started because they were.

That's what Devin Nunes was told back in March when he went to the SCIF at the White House and was shown the level of corruption that has been going on for a long time under Obama.

This is an enormous investigation and has largely been ignored by the media and, ahem, here for coming up on 1 year now. I was not a bit surprised that the DOJ is now relooking at the Hillary email investigation because the IG has been reporting to Rosenstein and Sessions for a long time now.

340 When it was classified is the issue, and by what authority. When it was marked is of secondary importance, but relevant. Jim Comey, as FBI Director, had Original Classification Authority ("OCA"). He could have marked them as classified, and as an OCA that would have the legal effect of making them classified. He likely didn't mark them as classified, given his intended use, but they might have been classified anyway if under existing approved classification guidance they were classified. In that case, his failure to mark them as such isn't legally dispositive. They were still classified, just miss marked.

On the other hand, if the memoranda were not classified pursuant to approved classification guidance, but were instead later classified by another OCA, that raises other interesting questions. But it would likely mean that the memos, when handed over to his pal, were not in fact classified documents.

Fortunately this is a knowable thing. If properly marked now, the footer will say what the classification authority was.

If the former scenario proves to be the case, this might put Comey in a similar posture as General Petraeus - with the distinct difference that the good general wasn't trying to disseminate classified information through a cut out to everybody in the whole world with a goal of sabotaging POTUS. He just gave it to his mistress, and there is no indication it caused any actual harm. Didn't keep him from being prosecuted. Oh - and who was the FBI director then? Oh yes, James Comey!

By his conduct, in contrast, it seems pretty clear Comey was trying to maximize harm. That raises an inference of scienter, and raises a logical question of whether Comey deliberately miss marking classified documents in an effort to cover his tracks in leaking them to the press? If so, we've got a criminal statute for that.

Note that as an OCA, the FBI Director also has the authority to declassify previously classified FBI documents. At trial, in his place, I'd argue a mere process foul. Not much of a violation, perhaps, if I had the authority to scwrall "declassified by:" and sign my name before handing it over, and perhaps a court might find that as an OCA I had constructively declassified it despite my failure to observe an administrative nicety. But that would be up to the judge and jury.

He was also the acting Assistant Attorney General for the National Security Division of the DOJ. This is the group that signs off on FISA warrants.

Not with being prosecuted and sentenced. With Obama, I think the worst thing that could happen to him is to lose his delusions of grandeur and not have the welcome mat rolled out for him for meetings with interesting Italians, etc. Prison would make him a martyr and a symbol of white oppression.
