Supreme Court Sides With Trump on Injunction; Orders Full Ban on Refugees Under Trump Order Until They Decide Case on Merits

Apparently the Supreme Court doesn't think this is the slam-dunk case that the Ninth Circus does. Story at the Washington Examiner.

Meanwhile, Seattle's mayor has resigned after a fifth man accused him of sexually abusing underaged boys.

And Kid Rock may announce his Senate plans tonight.

No. Kennedy yesterday put a temporary stay on the 9th circuit's injunction that nullified Trump's ban on refugees. Today, the entire SC, including Darth Bader, unanimously put a full stay on until they hear the merits of the entire travel ban case.

This was all Trump's DOJ asked for. They didn't ask for a stay of the injunction on deciding who is a close relative. No one seems to know why, however, my guess is that they will simply call them refugees.

If they just ticket them, well, how can you ticket someone without an ID, and when you are not allowed to ask for ID because of sanctuary.

So what we have is CA being overrun by third world immigrants and adopting third world police tactics to deal with it. Seems pretty inevitable when you think of it.

Either they conform to our society, or we will have to conform to theirs.

It's a good point, but there's another aspect: even if the pedophile didn't murder the kid, a lot of people (*cough* liberals *cough*) would be reluctant to convict him if the punishment were that draconian.

That was also one of the main features of the Sandusky case. Sandusky found his victims through a charitable organization, which he'd started himself to help underprivileged kids. Kids who wouldn't have anywhere to turn for help, and who would be easy to dismiss if they tried to talk to the authorities. (It makes perfect sense, actually.)

One of the big scandals *there* is that nobody ever went after the charitable organization, who must have been at least as complicit as the Penn State administration.

So SCOTUS put a preliminary injunction on the 9th circuits preliminary injunction against enforcement of the EO?

::scratches head at fed rules of civil procedure::
Posted by: Harry Paratestes at September 12, 2017 08:01 PM (wmaTe)

I think it goes like this. The 9th circuit issued a mandate against the Executive Branch EO travel ban regarding refugees and close relative definition and the DOJ went to the SC for relief from that mandate. Justice Kennedy oversees the children at the 9th circuit and yesterday he personally put a stay(stop) on the mandate and then referred it to the entire court as he can only put a temporary stay when acting alone. The entire court today rubber stamped the stay along with Kennedy, which means Trump's EO can proceed forward until the court rules otherwise.

The case against the travel order moved from the 9th to the SC last June when plaintiffs ran to the 9th circuit and picked apart the new travel ban. The 9th had placed a temporary injunction against the new travel ban in it's entirety, then the SC stayed that temporary injunction, but added the unfortunate little phrase, "close relatives" which even some on the SC said was a door for court mischief. And it was. Plaintiffs ran back to the 9th to complain that refugees were NEEDED in CA and Hawaii and they were being hurt by not having refugees and close relatives mean everyone.
9th then put a mandate on the travel order that refugees could not be banned and close relatives means everyone.
The DOJ went back to the SC and the first paragraph has happened.

The legal eagles I've heard from are simply aghast that a lower court would dare challenge a higher court's initial ruling in this manner. Like this is how lower court judges get sanctioned.

189 Re executing pedophiles. I've mentioned this before, so forgive the rerun but the Supreme Court has mooted that, saying basically the death penalty requires a life to be taken. Applying the death penalty for some crime less than taking another life is "excessive".

They way the word these things, it's not completely general, and there are still federal statutes that apply the death penalty for treason and espionage (remember the Rosenbergs).

But they haven't been tested under the new doctrine, and the way the last one (which Kennedy wrote, BTW) was worded, it's a good bet they would fail when challenged.

The history was that some states had the death penalty for rape (usually very severe, brutal forms of it). The Supremes threw that out in the '70s after the death penalty was reinstated.

So, some ofthe states responded by making rape of a child under 14 (puberty trying to define roughly) as death penalty worthy. The SC threw that out in 2008 with that Kennedy opinion.

Me, I would apply the death penalty for rape of a prepubescent child. Post puberty up, just severe jail time and all that, sort of a scale based on age differences and brutality of the crime. But a child, kill their ass if proven.

The strategy will be like gay activist Peter Tatchell in the UK.

He doesn't argue directly for the right for him to boink preteens. He instead argues to lower the age of consent. He argues that it is sexual oppression to prevent young kids from having sex with each other, that this is psychologically damaging, traumatic! We are oppressing them! And therefore we must lower the age of consent to 12 or so. And then, presumably he'll swoop in.

Just keep doing everything we say.

We'll give you status updates as to whether we are free of imminent catastrophe.

But until then, it is vital that you obey everything we say. Otherwise you could endanger us all.

Tropical cyclones are a crucial source of water in Texas, so. that's just one more thing that's really sucks about Harvey. Rain with a name is what fills the reservoirs and aquifers.

Instead of heading inland and raining where we need it Harvey just sat there and flooded areas that didn't need any rain.

That reminds of something funny, years ago. There was this old store, something of a local hangout, run by this lady and her daughter that was the stuff of legend. I could write a book about the antics there.

Anyway, one morning her grandson was driving to school, and came down to get gas. There was two ways you could pull in, and pulled in the long way, and promptly ran out of gas before he got in reach of the pump. Had he come in the other way, he would've been okay.

Well, in frustration he started cussing. He said every bad word in the book.

His grandmother heard that and had enough. She bellowed out (which she could) in voice that could be heard for a mile of better, "Rodney!!! Quit that Godamned cussin' before I whup yo' ass!"

This is the great question that they never answer.
What is the perfect temperature for earth?
Is there a seasonal variation and, if so, what's the perfect allowed variation?
Where is the perfect temperature measured (Death Valley or Antarctica)?
What instrumentation system will be the reference standard (noting that about 70% of the earth's surface is water and essentially not instrumented)?
Can satellite system global temperature measurements be used as the reference (noting that such measurements have only existed for the past few decades)?
Etc.

And Terry Francona is one of the genuinely nice guys in baseball, too.

521 I hope "specs" Bluebell can fit the 5-sided space Jooo cookies into the cookbook

I hope the USSC issues a ruling in a manner which shitcans the Leftifada practice of getting district judges to scrawl nonsense in crayon and declare the ruling effective nationwide.

I would love to see that, some kind of hammer that just demolishes those douchebags and their careers. Something so heinous judges think three times before acting up like that again. I just can't imagine how that might take place.

Probably all just glad they're not on the city's football team.

523 I keep hoping that policing my ear hair will bring much needed rain. Has not worked so far.

524 Its been a lifetime since the Indians were this good, so yeah I bet they are in a good mood. Although they were pretty good in the 90s for a short period of time, too.

527 >>Oh yeah. I'm making twice as much as the cobs. Don't tell them though.

To be fair, as far as I can tell they usually produce some content.

529 Seattle is up on Texas.
And hey look! The mayor is there with the Pikes Place Market Cub Scout Troop #13. Looks like they're having a bang up time!

531 Stop bashing brother Seattle mayor. For all you know he, like the rest of Democrat party, may have converted to Islam thus rewarded by Allah per Quranic verse 76-19 Surat l- insan (Man) taken literally by the good mayor : "They (brother mayor et al) would be served by immortal youths who look like scattered pearls". Oooh baby.

'rons , 'netts, and lurkers beware your Islamophobia is showing.(sarcasm)
