Sean Davis: You Don't Need the Nuclear Option to Confirm Neil Gorsuch. You Just Need to Strictly Enforce the Rules on Debate as Written.

The rules as written require that people actually, you know, debate to keep debate open.

However, current custom -- just habit, which has no force of precedent -- is to allow Senators to not bother with an actual talking debate at all, and just refuse to vote against cloture -- keeping "debate" open without bothering to actually have any debate or speeches.

Sean Davis recommends simply enforcing the rule as written -- and making the Democrats debate during the period they want to keep "debate" open -- until they get tired and bored and then call the vote for Gorsuch.

The rule actually says that Senators are only allowed to speak twice during the same legislative day. And a legislative day can be extended for as long as the Senate deems fit. So, extend the day to accommodate each Senator's two speeches, and call the vote.

In English-English acronyms that are pronounced like a real word are written with just the initial cap (you'll see "Nato" in British newspapers for example); while acronyms that are pronounced by saying the letters separately (like NCAA or the RAF) are written in all caps.

118 The 60 votes are only needed to invoke cloture w/o resorting to what they call the "nuclear option" which technically is only supposed to be used for monetary bills (Byrd rule). I've done some surface level research into the claim, and it hangs by a single man: Strom Thurmond.

Strom Thurmond went Democrat, Dixiecrat, Republican. There wasn't a single other prominent Dixiecrat who did that, and they all started as Democrats.

All of the smearing done on that line is because of that one man.

------------------------

Nah, leave it. People who know what they're doing when they filibuster (ex. Cruz and Paul) can be pretty hilarious and entertaining when they're up there. Sure, it'll make the thing take longer if the Dems decide to filibuster Gorsuch for real. But eventually exhaustion will set in. That's the point of the rule being discussed here. Since you eventually need to step aside (you'll fall asleep standing up if you don't), even if the entire Dem side of the Senate digs its heels in, they'll eventually be forced to quit due to the need to cycle in replacements and the maximum two times they'd be allowed to speak.

Also, deciding what's "on topic" can be subjective. With a sympathetic press, a future Dem Senate Majority Leader could rule all kinds of things "off topic" no matter how "on topic" we might think they are.

Disagree. From Sean's piece.

>>Rather than current practice which allows 41 senators to indefinitely prevent a final vote without ever lifting a finger or uttering a word of debate enforcing the two speech rule would require the obstructing senators to proactively and continually debate to delay a final vote

Now we can argue forever over rules versus common practice but the reality of the situation is this would be a change to common practice which will be interpreted by the media and the left as "going nuclear" which in turn would allow them to do whatever they want when and if they get power. They have always operated this way and always will.

So skip the middle man. Go nuclear and stop pretending that by playing by the rules the Dems will.

It's not an acronym. It's an abbreviation for Na[tionalso]zi[alismus]. They say that Gestapo is a postal abbreviation for Ge[heime ]Sta[ats]po[lizei]. Maybe Nazi is similar. Zip codes are simpler, though.

185 The filibuster is dead, it just don't know it yet. The only reason Republicans would have to keep it is a notion that the Democrats would let them use it without nuking it themselves. Well, Harry Reid disabused them of that notion. If we had real leadership instead of McConnell, it would be dead for legislation as well as nominations (and we still might end up there.)

By showing the left's willingness to get rid of it, there's absolutely no reason for the right to keep it. They'll never ever let us benefit from it again. Pull the trigger already.

213 The reason the left is going bat-shit crazy is because they know it will tear their world apart. They know that they are not going to be able to cover up the fact that actual education of our young stopped long ago and was replaced with simple Marxist indoctrination. Common Core lies about the history of Western Civilization and our own national history are designed to turn out ignorant, compliant Marxists. Reading instruction using phonics was replaced, time-tested math instruction discarded, logic and deductive reasoning and the scientific method ignored.

Leftists are convinced that minority kids are incapable of learning, and use that as the unspoken rationale for the fact that their instructional system is a complete failure. They know that the jig is up, their jobs are on the line, charter schools are better, and they will soon be shown for the incompetent fools that they are. They will have to admit that they are wrong, and THAT they can never, ever do. It would collapse their worldview.

Time to enjoy the fireworks.

Plus, as mentioned above, it was previously used on a very important signature piece of legislation that the Dems are proud of.

In fact, a thought occurs to me. Given that the Dem leadership seems to be losing it (Pelosi apparently very literally stated that the president is Bush in a news conference just recently), it might be possible to use this to chip away at black support for the Dems. The article mentions that the method was used to get the Civil Rights Act passed. It might be possible to get stressed and sputtering Dem leadership to attack the Civil Rights Act when they invariably try to fight back against this.

271 Being able to claim that the "nuclear option" wasn't used seems like no gain at all. Dems don't really care about us going nuclear, in the sense that once they get back into power, they're not going to treat us any differently if we showed restraint now. In fact, the Dems (and the MSM) will accuse republicans of using an "alt-nuclear option," and most people won't understand the difference or won't care. The narrative will be: the GOP is changing the rules/doing something weird/scary/abnormal. But as others have pointed out, this will blow over pretty quickly.

It sounds like the Senate will be frozen while they wait for all the speeches to finish. I don't know if the Senate has anything important to do. I suspect it does. Maybe this could be made into a positive by accusing Dems of "shutting down" the Senate and being obstructionist.

Accusing them of obstructing Sessions himself isn't going to win us points with the public (i imagine they don't give two shits about Jefferson Beauregard, other than they don't like coastal elites looking down on him for being from the South). But accusing them of obstructing America's business by shutting down the entire senate - that might sting. All of the Dems who get up to make those speeches are going to be creating video records that could be used against them later. The speech by itself wouldn't matter, but if it can be put in the context of: "this idiot is tying up the senate, preventing the nation's business, and listen to what he's saying, he's saying nothing meaningful, it's just blah-blah-blah, what an asshole" then it might hurt them.

283 Rather than current practice which allows 41 senators to indefinitely
prevent a final vote without ever lifting a finger or uttering a word of
debate enforcing the two speech rule would require the obstructing
senators to proactively and continually debate to delay a final vote

Now Senators can just say "I'm not going to vote for cloture" and go home and they are considered to be "filibustering". This rule would force them to actually, you know, filibuster when they want to filibuster, with a limit on the number of times they speak-2 per "legislative day" (which can be as long as they want). At the end of everybody's two times speaking limit, they would no longer be "filibustering", and a floor vote would be called. No cloture needed. Cloture is a vote to end a filibuster, this just makes them actually stand there and do it for as long as they are able.

Now we can argue forever over rules versus common practice but the
reality of the situation is this would be a change to common practice
which will be interpreted by the media and the left as "going nuclear"
which in turn would allow them to do whatever they want when and if they
get power. They have always operated this way and always will.

No, it is not. It is a return to the actual rules of the Senate, something that we as rule of law folks should support. Right now there are a bunch of precedents in place which allow Senators to be lazy. This makes them do their jobs and actually debate.

320 What's made clear, if the way McClintock wrote in Imprimis is done, Senators would be limited to two speeches, period, on each question/bill, they would have to stay on topic - no reading the phone book and most importantly all other Senate business would suspend until the speeches were over and a vote taken. That last part was undone in 1970 and has led to all the filibusters since then because there is no price to pay for the blockage.

337 A top Senate Republican is warning that the Senate could work around the clock as they try to confirm three more of President Trump's nominees.

Senate Majority Whip John Cornyn (R-Texas) stressed that how late the Senate is in session is up to Democrats. Absent a deal, he said lawmakers will stay in Washington through Saturday.

"We can do it cooperatively so we can burn time when we're out of session or if they won't agree to that, we can stay in session 24 hours," he told The Hill, asked about the schedule for the rest of the week.

Senate Republicans want to confirm Sen. Jeff Sessions (R-Ala.) for attorney general; Rep. Tom Price (R-Ga.) for secretary of Health and Human Services; and Steve Mnuchin for Treasury secretary.

Unless both sides can get an agreement to speed up debate time, a final vote on Sessions will take place on Wednesday night, Price early Friday morning and Mnuchin on Saturday.

Maybe, maybe not. The left is going *nuts* about Trump. If Schumer burns himself out trying to stop Trump's early stuff, then he's going to be in sad shape when Trump sends the next nominee through.

More important right now, imo, is finding the citizens who are actually paying attention (like Scott Adams) and getting them to think, "You know, Trump isn't really a nut-job like everyone keeps saying he is. But boy, his opponents sure are crazy." Gorsuch will help with that. Then later down the line, possibly just as the Dems are starting to calm down (which might very well be exhaustion-induced...), Trump can submit a more controversial nominee and get the frothing started all over again.

Posted by: Ignoramus at February 07, 2017 02:46 PM (SIY7D)

McConnell could either change the rules and nuke the filibuster OR actually make everyone follow the rules... either way, it works for me. In fact, making them follow the rules might even be more entertaining as the speaker cannot leave the floor for any reason (even bathroom breaks).

393 I just don't get the hand wringing of using the nuclear option. Blame harry reid and get it over with. The objections appear to be
1) it's crazy and unprecedented! Well so it was when harry reid killed it for all nominations they weren't currently having. You can bet if there had been a SC opening at the time it would have covered that too.
2) but some day democrats will be in charge again! This is the worst argument. So what? They will kill it on their own then anyway. Entire point being back to #1 that there used to be a filibuster for lower nominations too, until there wasn't.

The argument appears to be that if republicans keep what's left of the filibuster that the dems destroyed, the democrats won't be able to remove the rest later. Does that fly with you?

394 Make those old fuckers talk till they drop. It's a poor fitness test for office, but at least it's some type of test.

3) The Republicans of the Senate are chicken shit, with only a few exceptions.

Posted by: DFCtomm at February 07, 2017 04:55 PM (62aJM)

396 AHAHAHAHAHAHA, that's rich. The Senate following rules and laws. Who comes up with this stuff?

Posted by: Dr. Mr. Badman at February 07, 2017 04:59 PM (cfjq1)

397 Standing and talking for hours on end is a fairly good weapon against the decrepit oldsters that the Senate is full of. Maybe we'll get lucky and a few will die from the exertion.

Posted by: DFCtomm at February 07, 2017 05:02 PM (62aJM)

398 Small correction:

"However, current custom -- just habit, which has no force of precedent -- is to allow Senators to not bother with an actual talking debate at all, and just refuse to vote against for cloture --"

Posted by: nick at February 07, 2017 05:04 PM (rwvJu)

399 Er, ... it should read "for cloture"

Posted by: nick at February 07, 2017 05:05 PM (rwvJu)

400 "Tell her that it must just be time to give up on politics in
general. Tell her that voting doesn't matter, and that she should just
stop wasting her time."

I always do that with millenials that I can discuss things with , and it's a surprisingly easy sale, since it's basically what they all believe anyways, especially now. Sure, it would be nice to have them on the right, but trying to sell that more often than not gets at least some of them to pitch a fit and get all pissed off. BUT if you just quietly tell them it's hopeless, the game is stacked against you, nobody on any side is really looking out for you, it all sucks, they are all crooks, give it up - they lap that shit right up.

And I view getting them to stay home on election day just like a win.

401 Reid made the Donks extra lazy. By sitting on House legislation the Senate became an adult day care. At $175000/yr + perks. I'm sure they spent all that time day trading and chasing interns.

402 "Sorry, when one side has signaled that they have completely left rules,
procedure and precedent behind, I'm not willing to be only team that
plays by the rules. You don't fight fire with rules, you fight fire with
fire."

If you can defeat fire with the rules, you fight it with the rules! Why? Because fighting on the same level may win you the day, but it doesn't win you anything more than that. Those wins evaporate quickly.

BUT if you can stick to principles and rules while the other side has lost all of theirs, and STILL win - that is how you create a majority that holds together for 2 or 3 generations.

We aren't playing to win for just this session - we're playing to win the 21st century. Really.

Posted by: Tom Servo at February 07, 2017 05:34 PM (YsaNw)

403 It's not custom or habit. In 1917 they changed the rules to have a supermajority [first 2/3 then changed to 3/5] to invoke cloture. In 1970 they changed the rules to have a "two track" system when when a Senator filibustered they could bypass the filibuster and go onto other business. This second change is when the filibuster became the potent weapon it is now.

404 "The argument appears to be that if republicans keep what's left of the
filibuster that the dems destroyed, the democrats won't be able to
remove the rest later. Does that fly with you?"

That is not what's important - what is important is the message to take to the public in the 2018 and 2020 elections. And if McConnell is able to do this in the way outlined in the piece above, than that message will be - When Democrats had the opportunity, they just threw away all the rules to get what they wanted, and that is what they will always do. But when Republicans had the opportunity, they found a way to win and yet still remain inside the rules, because that is how we roll.

Tom Brady found a way to do it. That's why he isn't just a winner, he's a Champion.

Posted by: Tom Servo at February 07, 2017 05:38 PM (YsaNw)

405 Ok, so the Republican Senate will never actually do this.

Here's a real question: How long will it take to fill Sen. Sessions seat after he's confirmed AG? How much will it hurt the confirmation process for Gorsuch to have that seat vacant?
