Court Of Appeals Throws Out ObamaCare Subsidies On Federal Exchange

flaming_skull2a.gif

Consider this a place holder until Gabe comes along to do a happy dance and break it all down.

(Background on the case here)

So basically anyone who gets their ObamaCare on the federal exchange, which is a lot if not most, can't get subsidies. This would be a death blow to ObamaCare.

This will no doubt be appealed either to the full Court of Appeals, which Obama has packed with his appointees or directly to the Supreme Court.

Either way, John Roberts just threw up in his mouth a little bit.

Basically what happened here is the law says subsidies can only be paid to policies written on state exchanges. Obama then rewrote the law to include the federal exchange because...he wanted to.

This became a big deal when the states didn't create exchanges or they imploded due to poor implementation and more people were forced on to the federal exchange than anticipated.

Liberals maintain the omission of subsidies on the federal exchange was simply a drafting error. Opponents maintained it was a deliberate choice in order to provide incentives for states to create their own exchanges. Either way, the appeals court ruled today that law says what it says (subsidies for state exchanges only) and not what Obama's IRS says it says.

Added: Administration will go for the en banc review before the stacked full court.

I'm hoping/praying for a moment where so many things in it are unconstitutional that it's repealed as being entirely unconstitutional, which it is, but for whatever reason(s) -- all of which have been thoroughly hashed out here -- it just couldn't quite be scrapped in its entirety. I'll take the slow way if that's what's required. As long as it falls.

31 And Obama packing the Appeals Court with hard left liberal fascists is yet another reason why it really does make a difference whether the President is Republican or Democrat. Nobody pays attention to judicial nominations below SCOTUS, Presidents almost always get their way there.

The people who always scream "what difference does it make" when it comes to the two parties almost always totally ignore judicial nominees.

Or they cherry pick. A Repub who appoints 10 liberals among 100 appointments is far better than a Democrat who appoints 98 hard left liberals among 100 appointments. But people who enjoy freaking out always want to ignore that and claim there's no difference. None so blind as those who will not see.

35 If John Roberts entire purpose is to have virtually any legal or political authority in the country other than the Supreme Court come up with any sort of final disposition of ObamacCare, then quite frankly, I do get it, and I would support that. It remains a theory, and only John Roberts or his shrink knows, but I realy get that he might be desperately trying to avoid a Roe v. Wade of the left, where the entire left gets to build a thirty year movement wrapped around "evil conservative Supremes denying us our health care and unicorns that we are entitled to".

65 Wiki gods -- not helping my confusion
---
The United States Court of Appeals for the District of Columbia Circuit (in case citations, D.C. Cir.) known informally as the D.C. Circuit, is the federal appellate court for the U.S. District Court for the District of Columbia. Appeals from the D.C. Circuit, as with all the U.S. Courts of Appeals, are heard on a discretionary basis by the Supreme Court. It should not be confused with the United States Court of Appeals for the Federal Circuit, which is limited in jurisdiction by subject matter rather than geography, or with the District of Columbia Court of Appeals, which is roughly equivalent to a state supreme court in the District of Columbia, established in 1970 to relieve the D.C. Circuit from having to take appeals from the local D.C. trial court.

My money's on both. Given this won't sink PlaceboCare before the next election, or even before 2016, the political pressure will get to them to fully-embrace PlaceboCare.

Had this decision happened before January 1, or if El PRL weren't already caving as fast as they can on PlaceboCare, I would be more positive.

Now, past all of the glee and gloating, this is exactly what you can expect when something this complex is created and not properly debated and discussed. The "pass it to see what is in it" is going to go down as one of the most clueless and arrogant statements ever made by a politician. If ObamaCare continues to be delayed and taken apart piecemeal like this, then I cannot see how it can survive as much of anything - certainly it won't ever be able to come close to the promises made (I would have said intent but at this point I cannot even fathom what the exact intent here was or if there was even one specific intent rather than a jumble of competing intents).

Anyway - this really is flaming skull worthy.

289 FYI -

Almost all appeals from trial court decisions in federal circuit courts of appeals are heard by a three judge panel, as was this one.

Sometimes the full circuit court of appeals will, after the three judge panel's ruling, vote to order a rehearing before the entire circuit court of appeals, rather than let the three judge panel's ruling stand.

If the three judge panel's ruling is allowed to stand (ie, the full circuit doesn't rehear the appeal), then such ruling can be appealed to the US Supreme Court. If the full circuit rehears, then no appeal to the Supremes is allowed until the full circuit's decision is made.

THAT IS A FUCKING LEFTIST LIE.

So this is the court applying the fucking law as written. And fuck the IRS.

295 >>Judge Harry Edwards, a Jimmy Carter appointee, said in dissent that the ruling "portends disastrous consequences."<<

And so we should simply ignore the law as written and correctly interpreted.

The court has no authority to make that kind of judgment and as a result ignore the law.

THis is exactly the attitude which has destroyed our nation and given the courts power reserved solely for Congress.

If the people want it fixed- so be it.

It is NOT up to a judge's discretion.

That would be Hillary denying it!
I know SCOAMF wants to support Lizzie Warren.
Anyone thinks it's a coincidence it's breaking now?

I'll never forgive Obama for appointing John Roberts.

Me too. Those Citizens United and Hobby Lobby decisions were awful. Like Jim Crow and the Holocaust and stuff.

All of the other judges Obama has appointed vote correctly 100% of the time, so how did he screw up appointing a guy whose record is 90% wingnut? Makes me sick.

Not sure the SCOTUS will even take it up as the Dems have the 6 to 3 majority.

Posted by: Guy Mohawk at July 22, 2014 11:53 AM (cbUUP)

383 Wow, a flaming skull greets me first thing.

However, I have no illusions about it: by the time this gets appealed, the SCOTUS will come up with some other bullshit reading of the Constitution to keep it on the books, thus eating out our substance with illegal laws while perpetuating a government that was never designed by the Founders to be this intrusive or expensive.

We lost control of our government many years ago, if we ever had control of it at all. The proof lies partly in this illegal law, which never should have seen the light of day. Add to this the massive illegal spying on all of us that is clearly prohibited by the Fourth Amendment and that whirring sound you hear is all the signers of the Constitution spinning in their graves at how we the people have allowed their plans for us to unravel.

Who the hell assured you of such a thing?
And if you ever believed that, you're a child.

The point is that today Dems appoint 100% leftist judges 100% of the time. Republican appointees can fall all over the spectrum but at least some WILL be like Clarence Thomas, Scalia, or Alito.

Without the GOP there would be NO conservative justices. There would be no constitutionalist voice even in dissent.

390 There really is no "gray" here, either we have judges that believe we are a nation governed by laws and not by men or we're a banana republic.

The idea that "Obama didn't intend it to be like this" as a defense is absurd.

I'm actually a bit optimistic the Supreme Court is going to go our way on this.

you see that clown Earnest in the presser today? I'll summarize: "we're just gonna go ahead and keep doing what we're doing. You tribbles are too ignorant to be thinking about all this convoluted legal stuff and we don't want you to bother being educated so just stfu and move along."

Posted by: TangoNine at July 22, 2014 12:55 PM (x3YFz)

393 So the tyrannical administration says they will break the law.

What did Miss Lindsey say about Obama breaking the law next time? Didn't he mention the dreaded I word?

I'll believe it when I see it of course.

But it doesn't hurt to remind her that (s)he drew the line in the sand.
