If Obama Can Ignore The Law Requiring the Deportation of Illegal Aliens, Why Can't He Ignore the Law Requiring Asylum Hearings?

Obama's defense for the border chaos is that a 2008 law, signed by President Bush, requires that illegal immigrant children be granted an asylum hearing before any possible deportation.

However, given that Obama has already decided he has the power to not enforce laws requiring deportation, why can't he ignore this one too?

Why can't he "borrow" the power from Congress to temporarily suspend this law given the crisis?

And as a matter of fact, he already is ignoring this law, vis-a-vis child immigrants from Mexico.

From the LA Times:

Most of the minors are being held in Border Patrol stations in Texas and Arizona, and in emergency facilities set up by the Department of Health and Human Services on military bases and other sites. About 11,000, however, were from Mexico and were swiftly bused back across the border, as the law allows.

It must be noted that it is Obama's lawless decision to stop enforcing the deportation law as pertains to children which is causing the flood of children at the border.

Conn Carroll suggests that if Obama is determined to aggrandize his alleged executive powers to the absolute limit, he might consider doing something helpful along the way.

Incidentally, NBC and CBS actually troubled themselves to notice that Obama was still refusing to visit the border, despite having four fundraisers scheduled in Texas.

Border patrol agents should just stand and watch as immigrants walk over the border and ask to be arrested.

45 I commented over the weekend on the new Democratic talking point.

To wit: that Obama would of course end the immig-vasion, and send this flood of illegal aliens back home, if it weren't for that darn federal law signed by GEORGE W. BUSH which ties his hands.

And, yep, Bush did sign just such a law. An "anti-human-trafficking" law requiring due process in a court proceeding before deporting any illegal minor.

It's instructive to look at the antecedents of the law. House sponsors? Berman and Conyers. Senate sponsor? Biden. So pretty much obvious hard-left Democratic mischief making from the get-go.

Why then would Bush sign that?

Remind yourself that Bush was an enormous amnesty proponent from even before he was in office, and he tried to sneak amnesty through every single year he was in office, without fail.

So, when this bill showed up on his desk, literally in the last three weeks of his Presidency, when everything was quiet, half the staff had left already, and no one was paying attention to him any longer (media focus having shifted to the ridiculous "Office Of The President-Elect"), it appears that Bush had a moment.

A moment where he realized that, yep, this was a stealth amnesty enabling bill. But it was one last chance for him to contemptuously flip the bird to the anti-amnesty people who had been blocking him for eight straight years. So he went on and signed the thing.

Or, alternative explanation B is stupidity rather than malice. That Dubya the incompetent drugstore cowboy fucked everything up yet again with his habit of rushing to implement actions whose consequences he was not able to comprehend. Take yer pick.

85 What needs more focus is the role of Mexico in this. The illegals in question are crossing Mexico's southern border and travelling 1,000 miles. This couldn't be happening without Mexico letting it happen, and it's been escalating over the last two years. From what I hear, Mexico is usually strict in how it handles illegals. So why hasn't our President been calling Mexico to account? This puts the lie to the spin that this isa human refugee problem. The law Bush signed didn't apply to Mexican illegals and presupposed that the White House and Mexico wouldn't conspire to open the floodgates from the rest of Central America.

I've said it before, I'll say it again.

The entire "well Bush signed this" doesn't make a lick of sense anyway.

Go head and hand wave away the fact that the base disagreed with him on it.
Wave away that it was a democrat bill that he signed at the end of his last term.

So we're giving it a huge bump just for the sake of argument:
The conditions on the boarder have changed pretty rapidly since 2008. (Yes, we know Obummer is responsible for a lot of that, set that aside.)

We've seen a doubling each year the last few years of the number of minors crossing the border.

So even if it was a good and supported idea at the time (it wasn't), it sure is hell is a disaster now.

But...Bush.

119 Answer is pretty easy to this one: it's the difference between not enforcing a law, and taking an affirmative action contrary to law. Deportation is a legal procedure and an immigrant would have the right to petition a judge if Obama was deporting someone in violation of a law. There's no standing for the rest of us taxpayers when Obama fails to enforce the law regarding the border.

122 In news of WW3:
Popular culture in Japan: Bilious | The Economist http://econ.st/1pLobBR

IN A Tokyo nightclub Scramble, a rock band, is at full kilter, belting out songs full of nationalist bile. In "Kill Koreans", Rariko, the band's lead singer, calls South Korea a "filthy" country and says Koreans are trying to humiliate Japan by lying about war crimes. Flag-waving fans chant along to her hateful lyrics.

Scramble is a fringe attraction in a country where snarling xenophobia remains rare. Yet popular culture in Japan is increasingly taking up nationalist causes. Several bands have penned songs about territorial disputes with China and South Korea. The most popular film of the year eulogises wartime kamikaze pilots. Bookshop shelves in Tokyo groan with a category known as kenchu-zokan: "dislike China, hate Korea".

..

The board of the national broadcaster, NHK, includes revisionists such as Naoki Hyakuta, a novelist who denies that the Nanjing massacre of 1937-38 ever happened.

Mr Hyakuta's phenomenal success is a sign, says Rariko, that the tide has turned against Japan's "masochistic" view of its history. Younger Japanese like her are fed up living under the opprobrium of events more than 70 years ago.

125 Why should he recognize any limits on his power? I'm being serious. Why? Let us presume that he does not pay overly much attention to such things as Constitutional limits and the long term affect on the American political and jurisprudential landscape.

Since those barriers do not exist, why shouldn't he act as Emperor? What is there to stop him? That is an actual question, not a rhetorical one.

The Democrats in Congress, specifically, the Senate, prove daily that they will rise and fall with Dear Leader. There do not appear to be any Democrats who will go to Obama and tell him that he must stop what he is doing or else he must go. Thus, the primary tool with which to curb such excesses has been removed from play.

Since impeachment is a non-starter, that leaves judicial recourse. The problem with that is that it is slow. While I can think of a few situations were speedy certification of an issue up for appellate review would occur, that is for a judicial definition of speedy. Think months, not days or weeks. The situations in which it is measured in days do not bear contemplation.

So. I put it before the Horde. Why shouldn't Obama act as Emperor?

I despair, I despair.

137 "What needs more focus is the role of Mexico in this. The illegals in
question are crossing Mexico's southern border and travelling 1,000
miles. This couldn't be happening without Mexico letting it happen, and
it's been escalating over the last two years. From what I hear, Mexico
is usually strict in how it handles illegals."

Mexico is strict in handling illegals if those illegals indicate an intent to settle in Mexico. If those illegals indicate they're bound for Gringoland, hey, no problem.

Very few gringoes realize it, but there is a Hispanic leftist movement of long standing in the USA -- often supported with tax money -- which has as an explicit policy goal to restore the mythical Hispanic homeland of "Aztlan" by severing the southwestern states from America and restoring them to Mexico.

And, the Aztlan movement are extremely direct about their intent to wage demographic warfare and simply outbreed everyone else to accomplish this goal, with said breeding push being funded via welfare by the hated gringoes themselves.

Ya think there aren't people in the Mexican government who are tickled at the thought of getting back that huge swathe of valuable land which they have convinced themselves was "stolen" from them by gringo treachery?

Successive Mexican governments since the 1970s have quietly supported and encouraged the Aztlan movement. View recent developments in that light.

Yes, the "volatile food and energy categories" are left out when tabulating inflation.

Good news for those of us who can take it or leave it when deciding whether or not to eat, drink, drive, travel, run appliances, and light/heat/cool our domiciles.

Note that this particular shitweasellery is not new. It goes back ages. And the "conservative" Republican establishment, even when it has had consolidated power in its hands, never moves to restore sanity to federal economic metrics.

As I've mentioned Mother in Law has a traumatic head injury from years back.

One result is poor memory, it's really odd poor memory, but there you have it.

It's not always that she forgets things, it's that sometimes she remembers old things (like her old address) instead of the up to date information. Sometimes she gets it right though. It's weird.

Anyway, one of the more recent things she forgot was the current price of bread. She likes to feel independent so Wife and I took her shopping while we were staying with her and she about had a conniption because she thought that $0.75/loaf was "high priced." When she saw what bread actually was she refused to buy it thinking they were scamming her. (To make matters worse, I was on a diet at that point, so I needed whole grain bread, which was more expensive.)

It took a while but we got her to realize what prices were.

Oddly: she knew that milk was over $3/gallon.

194 Why do the zombie hordes not attack each other? They're reduced to mindless meat eating reflex, zombies are meat, why do they not eat each other?

Depends on what kind of zombie.

A scientific zombie's main job is to be a vector for the disease. The hunger merely gets them biting people and is the reproductive drive. Yes, they'll cannibalize a human, but in most cases the human will escape and become a zombie themselves.

A necromantic zombie is bound to the will of its summoner. They won't attack anything but the summoner's will.

A demonic zombie is possessed by a demon.

If you're running against the second coming of Jimmy Carter, who has produced Carteresque gas price increases, why in the world would you not run the same type of ads that Republicans quite successfully used against Carter in 1980, pointing out to voters how much gas prices went up on the watch of the incumbent?

Instead, as campaign advertising, the GOP ran gauzy autobiographical moments about the Mittbot 3000. For fuck's sake.

231 Further to comments above about Mexico and the Aztlan movement, the Right should recast our national dialogue. We don't have an immigration problem or even an illegal immigration problem so much as we have a Mexican border problem. No bill in DC will address this if the White House won't defend the border.Obama now asks for $2.0 billion but none of it will go to defend the border. This is important optics because Hispanics are not necessarily a monolithic voting block. They won't all sympathize with illegals from Mexico and Guatemala, if it's explained the right way -- even some legal Mexicans and Guatemalans who are already here won't.
Obama Co may have overplayed their hand here. Many intelligent people I know are still oblivious to this issue, because of how it's being reported. But that won't last until November.

Posted by: torquewrench at July 07, 2014 02:22 PM (noWW6)

D'Souza addresses this very issue in America. He interviews the requisite community organizers and university professor who agree that we stole the land from the Mexicans and it should go back. He then points out that we won the Mexican/American war, which included all of Mexico. We then proceeded to give all of Mexico back after war along with quite a few American $$$ while keeping the parts whose citizens wanted to remain in the US, such as Texas, New Mexico and Arizona.

The way I read (skimmed over) the law is that they have 48 hrs to determine if they're the victims of "severe" trafficing, but if they are unable to do so the non-Mexican minors are placed into HHS custody.

So yeah- they're supposed to get a hearing in 48 hrs, but the law allows for exceptions when that isn't feasible.

As I sat there happily nomming away, another friend said "Wait, I thought alex was morally opposed to eating vegetables?" The BFF responded "She is. But in this case the broccoli is merely a convenient cheese conveyance device." I just nodded my agreement whilst hoovering up the rest of it.

But you're right. Those of us who questioned Choom Boy's legitimacy to be President will remember 2008 for the same reason: we were "birfers," tinfoil-hat-wearers and general malcontents. Poppin' Fresh was especially snarky when anyone got off the reservation and suggested the Mocha Messiah should be investigated and impeached.

In less than a year, all the "ooooh, Bad Optics!" types like Buchanan and the crowd at Tepid Air, NRO, Rude State et. al. will have gotten caught up on reality and will be yammering for Issa to investigate the Mocha Messiah.

At which time it will be too late. Which it probably is now.

In fact if you combined the aromas of a fresh brewing pot of coffee with that of a bacon cooking on the stove with some crunchy garlic bread being baked in an oven some would say you have created a little slice of heaven hear on earth.

Another seldom appreciated historical point.

The institutional left always shout about USA THE COUNTRY BUILT BY SLAVES ELEVENTY without noting that slavery was all over the Americas, including Brazil (where the overwhelming majority of slaves were shipped) and Mexico.

Funny thing though. There were once a whole lot of African slaves in Mexico. Now there are only small rural remnants of Afro-Mexicans here and there.

385 It's not just that Obama has the de facto power not to enforce the asylum hearings law, it is that he has to positively violate the supreme law of the land in order for this even to be an issue. Beyond his general duty to "take Care that the Laws be faithfully executed" (Article II section 3), he is also required by the Article IV section 4 "guarantee clause" to enforce the borders, at least from any large scale illegal incursion:

"The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence."

It is only because of Obama's refusal to enforce the border that these unaccompanied children are here in the first place. By granting "permisos" to asylum hearings he is actually encouraging the invasion that he is enabling and he might be successfully sued by the invaded states.

At the least they ought to undertake their own border enforcement and use Obama's refusal to enforce the laws and protect them from invasion as their justification. AZ was semi-successful in its legal defense of previous measures to enforce the border and Obama's collapse-the-border gambit changes the legal circumstances much in their favor. Time for them to up the ante on the other side.

Posted by: LASue at July 07, 2014 03:49 PM (ytSri)

392 No doubt the White House is behind this. Protein wisdom's website last week had a report about a 2011 document from Janet Napolitano's DHS, about how best to handle a sudden influx of 50,000 illegal alien kids. Keep in mind that in the past, a typical year usually saw no more than 5,000 UACs cross the border. Yet somehow the Obama administration began planning, years ago, for a dramatic, unprecedented, and sudden flood of illegal alien kids.

Are they psychic, or has this invasion simply been in the planning stages for years? My money is on the latter. Soros, LaRaza, all the usual suspects are likely in on it.

393 If these kids and young men are truly fleeing El Salvador and Honduras because of "danger," why keep fleeing through 3 or 4 countries ?
++++++++++++++++

They aren't fleeing "danger." That is simply what they've been coached to say, so that they can claim "refugee" status.

Initially, over 90% of the illegal aliens were reporting that they had come here because they'd been told they'd get amnesty ("permisso") if they did. Only after there was a public backlash did they start claiming that they'd come here because they were "afraid." They have been coached by the people responsible for this invasion (LaRaza, Obama admin., etc.).

It's the same as when the illegals were marching in the streets a few years ago, waving Mexican flags and demanding amnesty. The coverage pissed off Americans, and the word went out to carry American flags instead. Now every amnesty march/parade features lots of illegals carrying American flags. It's all PR bullshit, to con LIV American voters who don't pay attention.

398 Daily Caller has interesting commentary on a Major Garrett story about a recent private meeting Obama and ValJar had with immigration advocacy groups. A close reading shows that Garrett was used to spin that Obama was pissed at Republicans and would use his executive powers to fix all the problems including "to secure the border." As if the Republicans are responsible for not securing the border. Mehthinks Obama's plan is to say that if the Republicans don't give Obama $2 billion (which will be used to permanently resettle recent illegals) he'll say that he was denied the funds necessary to secure the border.
What's interesting is the groups that were at the meeting. Center for American Progress! Which just posted to its website a glossy 42 page report on "What the President Can Do on Immigration If Congress Fails to Act." Also present were the SEIU and the AFL-CIO. I would have thought that an open Mexican border is not in the interest of the dues-paying members of these unions. What am I missing? La Raza was not invited only because its President had dissed Obama by publicly calling him the Deporter-in-Chief for not having acted unilaterally without Congress back in March. ValJar doesn't forget such slights.
Interesting times ...

399 I took a quick look at the Center for American Progress paper "What the President Can Do on Immigration If Congress Fails to Act." This was obviously co-ordinated with the White House and is a road map to what we can expect from Obama. In addition to just not enforcing laws ( "The executive branch has virtually unfettered discretion in deciding how and whether to enforce the law against individuals.") it promises to expand "deferred action" beyond DACA "to other individuals with compelling equities ... as the lawful, just, and necessary response to a crisis."So never waste a crisis, and if you need to .... create a crisis. The CAP paper also pointedly repeats the misleading Homeland Security statistic that over 2 million have been deported under Obama's watch. That's because Homeland Security started counting those turned back at the border as deportations.
