Report: Obama To Extend Individual Mandate Deadline
Administration Denies

It begins with a reported 6 week delay in the deadline to buy Obamasurance (why not?).

But it was not immediately clear Wednesday whether the adjustment to a cornerstone of the Affordable Care Act would need to be approved by Congress or could be done by the Department of Health and Human Services administratively.

As the law stands now, individuals are expected to begin the application process via HealthCare.gov by Feb. 15 to avoid a financial penalty. But under the prospective change, individuals will be expected to have started enrollment by March to avoid incurring the penalty.

Last week only extremists who probably should be charged with sedition believed in delaying anything about the ACA, now it's going to be official Obama administration policy.

The reaction from the GOP should be interesting. Will they support this (rhetorically, no way Obama goes to Congress for this) or will they insist that Obama live by his words of the last few months.

Here's the administration's veto statement on the employer and individual mandate bills the House passed (pdf).

H.R. 2667 and H.R. 2668 will undermine this security for tens of millions of Americans with pre-existing conditions.

H.R. 2667 is unnecessary, and H.R. 2668 would raise health insurance premiums and increase the number of uninsured Americans. Enacting this legislation would undermine key elements of the health law, facilitating further efforts to repeal a law that is already helping millions of Americans stay on their parents' plans until age 26, millions more who are getting free preventive care that catches illness early on, and thousands of children with pre-existing conditions who are now covered.

Now, a little more than a week after the end of the shutdown over delaying these very provisions, Obama is going to do it himself.

The reaction of the GOP will be interesting. Will they use this as a chance to show the American people that the federal government simply can not do everything for them or will they simply say give them power so they can deliver goodies in a more effective way?

What seems to have happened is that while the open enrollment period runs through the end of March, you had to buy insurance by the middle of February to avoid the tax/penalty. So you could have purchased insurance during the designated time period and still not have complied with the law.

Believe it or not, no one realized how stupid this was until a week or so ago. So what the administration is saying is as long as you buy a policy before the end of the first open enrollment period (Oct 1, 2012-March 31, 2014) you won't be penalized.

It's not so much a delay as confirmation that this bill was poorly drafted and no one really understands what's in it.

"Children" of 26 staying on parents' plans? WTF? They aren't children, and the rational choice for them and for society is to have minimal catastrophic plans, which would be CHEAP if health "insurance" were actually insurance.

Pre-existing conditions. Some welfare programs are both noble and sustainable (very few). Any pre-existing condition bullshit is welfare, not insurance (OK, play with high-risk pools etc. all you want, but do not call wealth transfers and welfare and subsidies anything other than that. And again, if the insurance industry were allowed to attack this problem instead of jump to the idiotic whistles of the do-gooders (including many "conservatives") then there probably would be cheaper solutions.

Preventive care. First, ina non-strangled health care market simple preventive care would be much cheaper, easily within reach of most, easily subsidized for the reast. Second, so-called preventive care does NOT end up saving much money or changing health outcomes as people think. Studies have shown a rather pronounced lack of financial improvement, in fact.

So, that's nice. We've got lots of un-facts and lots of nonsense being touted as "successes" for this catastrophic law. Par for the course in today's dumbed-down, greedy, ignorant, rudderless, one-partyAmerica.

Pre-existing conditions, ipso facto, are not "insurable". Anything "done" about them will be a transfer payment (cough cough), welfare. Fine. An actual safety net, the sort almost everyone supports, and which can be implemented in a sustainable and non-destructive way, is exactly this sort of thing.

Guvamint can "help" only insofar as it (1) gets out of the way in terms of fedeal tax code and federal regulation and state-level regulation that makes all health care much more expensive than needed, incl. that for serious chronic conditions (2) enables extraordinary measures such as cooperation/semi-cartel behavior by insurers in collaboration with feds/states to set up high-risk pools.

So Jeepers, let's take your incredibly tiny focus and make it more serious by applying it to the ENTIRE law: why the fuck does taking care of comparatively limited issues for a small minority of the populace justify wholesale destruction or massive inflation in the rest of the already strangled market-place?

None of these things areimproved by "Obamacare", all are made much worse. Brilliant!

I'm "blaming" the GOP because we had control of Congress during most of the 90's and the Presidency/Congress during most of the 2000's but what did we ever do to address healthcare? Absolutely nothing. Which is a big reason why we got ObamaCare which could lead to single payer.

I think conservatives could have crafted something that points a solution in a free market direction, but uses the government as a backstop in severe cases, that way 90% plus would use private health insurance instead of going through the government. Instead, we ignored it because there's never going to be a "pure" conservative solution to health care. So we let people plow into MediCaid, and now have ObamaCare that's destroyed private health insurance. The end result being 100% government health care.

Seamus, I believe the serious numbers for uninsured are actually a small fraction of 47 million. Remember, the only meaningfun number is for those who 1) actually want insurance 2) do not get it primarily because of cost. This is a very small number, as it excludes most younger 20-somethings.

And, of course, the most important reason even the very small number cannot afford it is because, in the first place, of government interference. I recall two decades ago, in the shithole of DC, being able to get a very cheap (for that time) catastrophic plan on a private basis. Those plans climbed in price as all the govt. dysfunction was piled on, and now are basically gone because they are truly ridiculous in what they cost vs. what they provide.

And Romeo13, absolutely not, no tax breaks for health insurance. The break for company plans is one of the original sins that has ruined the health insurance market. As with just about everything else that makes the code thousands of pages, the tax code should be silent on health insurance.

Enough of the dumb social engineering! Let adults make their own decisions. Stop preventing price discovery in medical care. There is absolutely nothing essentially different with medical care than with any other private good or service. If anything, medical care is OVER-consumed, on average. Not entirely an artifact of tax/govt. interference, some medical culture there too, but get the tax code the hell out of everything, starting with the frankenstein currently called "health insurance".

Lawlessness.

Lawlessness. It's key. The constitution and law are what were put up to hem in the idiocy of the populace and its worst representatives, for a reason. As those guard-rails have been bent and damaged - and in recent years, to be realistic, basically discarded - so has the idiocy of the worst of the populace and their reps been allowed to start ruining the country.

So in my taxonomy of lawlessness, these alterations (even if this one has been withdrawn) of law by presidential decree (right, we don't have those, but there's no other way to describe several previous actions by this admin.) are in the Executive category. The brilliant inter-locking system of checks and balances designed by the founders is not working because the players aren't playing, and the system's not self-enforcing.

If only we had a serious opposition party, they'd have jumped on this absolutely essential issue long before now.

At least I've got kiddie football.
Stinky son just home - I drive carpool to, not from, as to avoid the stench. He made all his kicks and gets to kick in playoffs. But, coach won't let him kickoff because in sixth grade he is still using onside kicks, which hardly ever get recovered.
My boy kicks deeeep, then tackles the receiver.

323 Obviously my educational grounding, work background in the IC and degrees do not afford me the answer to how the executive branch can override a law passed by Congress to be selective in how they execute federal law (especially one that the SCOTUS has ruled is just another tax law). Can someone help me on that? I am not asking for those who want to make snide comments. I want to know what constitutionally is applicable. If it is illegal under federal law, then why hasn't Congress reacted and squashed this? Anyone?
