IG Report: NSA Analysts Deliberately Violated Surveillance Guidelines Multiple Times

They say, of course, that this was only due to some "overzealousness" in desiring to defeat terrorists.

Maybe. I can't help but think there was some overzealousness to simply intrude, say, on someone's ex-girlfriend's current boyfriend.

I mentioned in the podcast (with special guests Chelsea, Chelsea, Chelsea, Chelsea, Chelly, and Chelz) that I could almost support giving the NSA wide latitude if one condition were present:

That accidental violations would be punished by serious discipline -- say, two months off with no salary -- and that multiple accidental violations would be punished by a firing, and that intentional violations would be punished by a prosecution.

That, in theory, could keep this very dangerous and worrisome ability in check.

But it's only a theory, because as John Kerry and Eric Holder and Barack Obama demonstrate on a daily basis, The government never fires or disciplines anyone, no matter how serious or deadly or constitutionally-foul their transgressions.

Everyone's back to work at State. Lois Lerner continues drawing a paycheck and she's not even working. Her "punishment" is an extended paid vacation.

That that, huh?

So we're left with a very unsatisfying choice between "Let the NSA run rampant" or "Let terrorists run rampant."

And so it goes in America, a country which once had a government, but now is a government that has a country.

Some National Security Agency analysts deliberately ignored restrictions on their authority to spy on Americans multiple times in the past decade, contradicting Obama administration officials’ and lawmakers’ statements that no willful violations occurred.

“Over the past decade, very rare instances of willful violations of NSA’s authorities have been found,” the NSA said in a statement to Bloomberg News. “NSA takes very seriously allegations of misconduct, and cooperates fully with any investigations -- responding as appropriate. NSA has zero tolerance for willful violations of the agency’s authorities.”

The incidents, chronicled in a new report by the NSA’s inspector general, provide more evidence that U.S. agencies sometimes have violated legal and administrative restrictions on domestic spying, and may add to the pressure to bolster laws that govern intelligence activities.

The inspector general documented an average of one case per year over 10 years of intentionally inappropriate actions by people with access to the NSA’s vast electronic surveillance systems, according to an official familiar with the findings. The incidents were minor, the official said, speaking on the condition of anonymity to discuss classified intelligence.

The compilation of willful violations, while limited, contradicts repeated assertions that no deliberate abuses occurred.

Army General Keith Alexander, director of the NSA, said during a conference in New York on Aug. 8 that “no one has willfully or knowingly disobeyed the law or tried to invade your civil liberties or privacy.”

I'm reading Bob Novak’s Prince of Darkness right now, and I’m in Carter years. He says Carter was a straight-up habitual liar, making up all sorts of claims to buff up his policy expertise. He wrote about it in the Evans & Novak column of the time.

Then, to top it all off, after an interview between Novak and Carter, Carter started telling other reporters that it had all been sorted out, Novak had apologized for making the accusations.

Which was also a lie.

It's not just us that are being lied to, it's the FISA court as well. Is it the WaPo story that quotes a court order where the Court is Not Amused about being misled severely in the past about the scope and nature of the surveillance that the Court authorized? Yeah. I've been kicking around ideas to come up with some kind of workable solution for the need for surveillance and the need for oversight and the need for secrecy. When the head of the committee that is supposedly in charge of oversight has not even been given a copy of a report on breaches of security, why the hell should I believe that saying closed door sessions of Congress will work?

Nothing will be perfect and somethings will be more imperfect than others and thus oversight is the key. But yeah, oversight with no punishment is basically useless.

I'm convinced these guys are all so old and out of touch their brain is stuck on the GOP of the 1950s. They think all the cries of alarm coming out of their constituents are just the same old thing they've always heard. All enlisted military intel sorts start as privates or the other service equivalents (usually at E-3 because our technical schools are so long; E-1 is the lowest rank). If there was nothing that popped up in his background check that indicated his gender issue or that he was a homosexual, then he was good. (I would think homosexuals that young usually havent had enough time to have so many partners that it would come out--no pun intended--in a background check. Snowden's access is far more unusual.

BTW, when I was stationed in then West Berlin in the 80s, we had two defectors.

You know, every profession has its code of ethics (except maybe lawyers), and for spy agencies, this one seems pretty basic.

It's like, you don't have to concern yourself too much with your dentist using his spooge mung instead of flouride solution. It's Dentist Code of Ethics Rule #1. But even if the dentist is doing things like, say, cancelling your appointments because he's hung over, or wants to play a round of golf, or is drilling the dental hygienist instead of you, if he gets caught, that's a big deal. He could lose his license. Or worse.

I'm not willing to give agency spies a light sentence on this one. Overzealous? Fine, go be overzealous in your new job as mallcop. I'm sure there are some kids trying to peek into the ladies' changing rooms who need to be escorted to the bus stop. Go do that. Leave the national security stuff to the pros.
