Judge Rules That Detroit's Bankruptcy Is Unconstitutional, Ruling That It "Dishonors" Obama

This is just the socialists attempting to avoid the natural consequences of
the monstrosity they have birthed and called "the New America."

Ruling that the governor and Detroit’s emergency manager violated the state constitution, an Ingham County Circuit judge ordered Friday that Detroit’s federal bankruptcy filing be withdrawn.

“It’s absolutely needed,” said Judge Rosemary Aquilina, observing she hopes Gov. Rick Snyder “reads certain sections of the (Michigan) constitution and reconsiders his actions.”

...

“It’s cheating, sir, and it’s cheating good people who work,” the judge told assistant Attorney General Brian Devlin. “It’s also not honoring the (United States) president, who took (Detroit’s auto companies) out of bankruptcy.”

Aquilina said she would make sure President Obama got a copy of her order.

“I know he’s watching this,” she said, predicting the president ultimately will have to take action to make sure existing pension commitments are honored.

She actually speaks of this nothing as if he were a god, or a child's conception of a god, such as Santa Claus, watching down upon us, ordering the universe.

They said if I voted for Romney, the country would be in the hands of a bizarre cult worshiping a ludicrous god, and they were right!

Is She... Right? AlextheChick says that the unions (I assume) may have inserted a provision into the state constitution which essentially puts state taxpayers on the hook for any promises city governments make:

This is the specific Michigan State Constitutional provision at play. Section 24 of the Michigan State Constitution reads as follows:

Section 24: Public Pension Plans and Retirement Systems, Obligation - The accrued financial benefits of each pension plan and retirement system of the state and its political subdivisions shall be a contractual obligation thereof which shall not be diminished or impaired thereby. Financial benefits, annual funding. Financial benefits arising on account of service rendered in each fiscal year shall be funded during that year and such funding shall not be used for financing unfunded accrued liabilities.

But that itself would be unconstitutional -- that would give Detroit voters the right to vote themselves the wealth of Michigan taxpayers.

Which seems to be precisely what the judge is saying -- Detroit spent money it didn't have, and spent itself into the grave, and now innocent taxpayers are required to make good on its contracts, despite not being parties to those contracts and despite not being under the sovereign political authority of Detroit.

But pretending that there are not some troubling Federalism issues involved in this matter simply because the judge is a mindless Obama fellating insult to every single 'ette here due to the accident of her having a Y chromosome does us no good.

I don't see a federalism issue. If one accepts the proposition that a municipality can petition for federal bankruptcy protection (and I assume that issue has been decided) then a state constititution that simply says that the pensions of public workers are "contractual" adds nothing more to the argument. Contractual obligations are what get modified or eliminated in bankruptcies.

I don't believe what Alexthechick posted has any bearing whatsoever on whether the city can declare bankruptcy. All contractual obligations can be broken in bankruptcy. That's why bankruptcy courts do. They break all contractual obligations, including to bondholders, stockholders, pensions, unions, etc, divide up the assets, set payment terms for secured bondholders, etc.

I know very little about bankruptcy and I have no idea at all about the preemption issue as pertains to a state constitutional provision vs. a state law. Really really really talking out my ass, I know that the Kelo decision permitted states to provide greater state constitutional protections for takings, which many states promptly did, so I don't see why states can't have greater constitutional provisions for protection of public pensions on a theoretical level at least. I'm not sure this is a direct constitutional conflict either since the language tries to play cute about not diminishing vs. not being allowed to be discharged in bankruptcy.

I think California has done more to achieve that, but is having a harder time overcoming its massive inertia (momentum in this case).

It was easier to bring Michigan to a halt, in other words, because it had less economic "mass." Also, I think, started stopping earlier.

However ... Michigan law does provide for cities to file for bankruptcy with the governor's approval, and the governor did give his approval for Detroit to file for bankruptcy. Apparently, what this judge is saying is that the pension guarantee in the state constitution supersedes the authorization by state law for a city to file for bankruptcy.

That places this issue squarely into interstate commerce, and under federal jurisdiction. The way to reconcile the difference between the state constitution and federal bankruptcy law is not to demand the withdrawal of the bankruptcy but to make sure that state law is satisfied within the bankruptcy through objections and motions. Bankruptcy courts consider state law all the time. If for some reason the bankruptcy court rules in such a way that the state constitution is violated there will be a problem. But until then the judge is trying to prevent what is at most a potential conflict because the bankruptcy in and of it self isn't a violation of the constituion. She ought to shut her stupid cocksucker until there's an actual conflict or controversy.

Detroit operates the way it has been doing. Any bills accrued from the date of bankruptcy forward, will be paid with funds that the city collects from the date of bankruptcy forward. In essence, Detroit's ledgers were reset to zero.

What is in question is Detroit's debts up to the filing date. A Fed bankruptcy judge will make the determination who gets paid what.

Also, all contracts with the city can be made null and void if the judge decides so.

If they have funded the pension fund then it should have sufficient monies to pay past contracts and just not future contracts which then would be protected by the PBGC.

I don't see how bankruptcy will have as great effect on the pension fund as thought, unless of course, it has not been funded appropriately for a long period of time.

Liens are secured creditors, not general creditors, and they are a different class. Each creditor gets placed in a class, and taxes are usually the highest class, then mortgage and bond holders, then secured creditors, then general creditors.


Of course, this all got thrown on its head back in 2009 with GM and Chrysler, so there is now a precedence to do whatever the Emperor wants.

532 I do consumer bankruptcy for a living and while the pensions may be exempt from the bankruptcy proceeding (and I'm not going to read all the stuff I'd need to read in order to decide for myself) that is a determination for the bankruptcy judge to decide (in other cases, pensions have not been exempt, for example the United Airlines bankruptcy -- plus, who knows with TFG in the WH -- he already disregarded bankruptcy law when he did the GM "bailout" which was basically a bankruptcy that displaced the position of secured creditors in favor of the UAW). The federal court system has exclusive and original jurisdiction over bankruptcies (28 USC § 133) so this judge cannot order the case dismissed nor make a determination that the city of Detroit cannot file bankruptcy. She *may* be attempting to issue a writ of mandamus to city officials to make them withdraw the bankruptcy filings, but the right to file is not impacted nor is the bankruptcy court bound by her order.
In fact, this is a good lesson in federal preemption (remember that idiot "social engineer"/lawyer for Trayvon Martin family on Greta a few nights back who used "federal preemption" incorrectly?) -- the federal law preempts the state law here. The MI constitution cannot strip any person or entity from it's *right* to *file* for relief under Title 11 (the US bankruptcy code); the best this judge can do is have the case before her stayed by the bankruptcy judge while the Detroit city bankruptcy is resolved.

Pensions are supposed to be funded appropriately. If Detroit has not paid into the fund in violation of the Michigan Constitution why wasn't this addressed earlier? If they have funded the pension fund then it should have sufficient monies to pay past contracts and just not future contracts which then would be protected by the PBGC.

This is a big issue in many local and state governments (particularly here in California). The funds *are* underfunded, and there are a few reasons for that.

The first and most important is that the accounting numbers used to determine how much to invest in the pension every year typically used overly rosy rate of return numbers. This meant that the pension funds were receiving barely enough money in years when the market was doing well. But when the bottom fell out toward the end of the last decade...

Another issue that doesn't get talked aboutalot actually pertains to the IRS. Employers who only had a few employees that probably weren't going to stay on until retirement (say, for instance, a doctor who employed a nurse that was only likely to keep working for him until she got married) would sometimes put money into the employee pension funds as a tax dodge. When the employees quit before reaching retirement, the money would revert to the employer. The IRS apparently created rules that heavily restricted how much money an employer could put into a pension specifically to combat this practice, and I've read in some places that this also caused some of the pension shortfalls that many people are dealing with across the country.

Anyhow,once I stop choking with laughter here, let me put you some knowledge.

1) The Constitution gives the feds jurisdiction over bankruptcy. That means that if Congress says that municipalities can declare bankruptcy, no state government can say different. Congress has said that municipalities can declare bankruptcy. Detroit is a municipality. So . . . end of story.
2) Federal courts have the ultimate say on who appears in their courtroom. If there is an argument that Michigan state law forbids the Detroit emergency manager from declaring bankruptcy, the bankruptcy court judge is entitled to decide that argument. He is also entitled to enjoin the state court judge from ordering Detroit around, and he can jail her if she ignores him. Just because he's entitled to doesn't mean he has to, and there's equal chances that he stays bankruptcy proceedings while the Michigan appellate court hears the appeal.
3) I think the judge's interpretation of state law is highly dubious (with all due respect to AtC). The law basically is that a rule against impairing contracts doesn't apply to bankruptcy proceedings.
4) Whoever it was upstream that said that a debtor can't voluntarily dismiss a bankruptcy case without the court's consent is right.
5)Finally, even if Detroit somehow cancels the bankruptcy proceedings, one of the creditors could turn around and put Detroit right back in. It doesn't have to be the debtor who initiates bankruptcy.

There is no way this thing is going away.

568 Two quick points, first state law does have an impact on bankruptcy filings. There is a reason OJ filed for bankruptcy in Florida, rather than in California. He was able to protect more assets from his creditors based on Florida law.
Second, I'm guessing that if this ruling stands it won't be too terribly difficult to get the votes to change the state constitution and give it another go.

You're right that state law does have impact on bankruptcy filings - such as the homestead exemption (which is why OJ filed in Florida -- his house in Florida is 100% exempt; his house in CA would only be exempt up to whatever amount CA law gives for it's homestead exemption -- which is not 100% of its worth, as is the case in Florida) and *usually* that impact has to do with real property located within the state's border.
As I wrote above, the pensions at issue here *may* be exempt --but that's a determination for the bankruptcy court judge, not this state judge and she most certainly does *not* have the jurisdiction or authority to order that the City of Detroit can*not* file for bankruptcy -- it can and no state law or state constitution can strip the City of Detroit from it's *right* to file for bankruptcy protection.

It can't and the issue has probably never been litigated. IIRC in CA a number of municipal bankruptcy cases could clarify the issue (haven't looked) and in AL a city pension went bust and the workers got nothing (or pretty much nothing).

The proper court ofdetermination I have no idea about as I'm a guy who just remembers random sh!t way to well. But I have this weird suspicion that if this decision is in any way valid, the voters of the great state of Michigan will find a way to change the legal landscape and give Detroit a second bite of the apple. The only thing it will have hurt is the debtors of Detroit, as it is usually better to file bankruptcy as early as possible. So instead of dimes on the dollar, they are looking at pennies.

I seem to recall Volokh explaining once upon a time that, as far as the US constitution is concerned, states have authority independent of the federal government--but cities and counties do not have authority independent of the state. By that logic--it seems to me--I can see why the state would be on the hook for the city's promises. In a real sense, the state authorized the city to make those promises, and the state never stepped in to stop them.

746 Detroit's emergency manager was interviewed on one of the Detroit news stations this afternoon and although he declined to discuss Judge Light-Socket- Hair's order as he said it was currently in litigation(the State of Michigan AG has filed a request for an emergency stay of her order with the Appeals Court), he smiled and cheerily announced that the Federal Bankruptcy Court had assigned a judge to the case today, a judge that Mr. Orr is familiar with and has great respect for his longstanding bankruptcy experience.

By the way, the city of Detroit, according to Orr, has never funded their health care pension obligations. Never. Big fat 0. How does that square with the constitutional provision?

753 I think (hope, really) that the issue she has problems with is this sentence:

"Financial benefits arising on account of service rendered in each fiscal
year shall be funded during that year and such funding shall not be
used for financing unfunded accrued liabilities."

In other words, Detroit was to have always funded their pension liabilities as they were generated. Of course, the Detroit city government did not do that (or raided the kitty earlier, like California did to CalPers.)

Now the question is, they were supposed to fund the pension but they didn't. Ergo, what to do now?

A state court should be able to block a unit of state government (like a city or county) from filing federal bankruptcy since the state is sovereign and a city is not - like a parent can prevent its minor child from entering into contracts.

She has got a REAL issue with the concept of cause and effect and since she does not have to provide an alternative, it will get kicked up stairs. What she and the Democrats want is for the bond holders to take a haircut.

I'm not a lawyer and don't want to be one either.

758 The way it works here in IL is that the 6 state run pensions, TRS, SERS, SURS, IMRF, Gen Assy, and Judges are state managed and financed. All municipal workers Except Chicago, Cook County are in IMRF. Under the state constitution these are guaranteed. However as we have seen in Central Falls RI the pensioneers took a haircut. They did not in CA because they have a system similar to IMRF. Most large cities in IL have their own police and fire pension systems, so if Rockford or Peoria file BK, the cops and fire take it on the chin, while the clerks at city hall are protected. Lets face it, besides teachers, some of the most outrageous pensions are cops and firemen. This is most likely the same in Detroit.

It's more complicated than that.

Detroit failed to make contributions towards its pension obligations for decades. It took that money that should have been deposited and spent it on more parks, more cops, more amenities in general for its citizens. So, the longest-term residents - the 20-30-year types - have reaped the most benefit out of this profligacy.

But each year, new people have moved to Detroit. Those that moved in twenty years ago got to use the extra parks and amenities for twenty years. Those who moved in last year got one year's worth. But now, each one of those residents is on the hook equally for the whole kaboodle. (Well, to the extent they have equity in their Detroit property, at least - that's really the measure of how each resident can get clobbered.)

The winners are those residents who moved away before the bottom dropped out of the property market. Those people got the high-valued houses - made higher-value to some degree by the extra amenities that the pension money bought - plus they got the use of all those extra amenities while they lived there, and then they got themselves off the hook, out of the obligation completely, even though they got the benefit of the extra cash that not paying your bills for a long time can bring.

So, many of the people who failed to object when their mayors said "let's not fund pensions this year - let's buy ourselves more toys instead" and took the toys gladly, but who then moved away in the nick of time, partook hugely more of the looting than did many current-but-short-timer residents. The first group goes scott-free. The second picks up the whole tab.

My College Job

When I was a student in the 1960s at Wayne State University, I got a job as a caseworker with the Dept. of Social Services/State of Michigan. I was an ADC worker, given a caseload of people on public assistance, and I was assigned a "zone" in an area just west of the college campus. I did not have a car, so I walked to my zone to visit the clients in my case load.

This was acutally most of the people who lived in this area, as most of them were on some type of public assistance.

In those days, women with children could collect an ADC grant until their last child turned 18. These were the days of public outrage against "welfare" and all those "lazy welfare Moms who don't want to work," "welfare queens" and other insulting references to persons receiving public assistance.

The policy of allowing a welfare grant until the last child turned 18 was a holdover from an earlier era when it was felt that mothers should be at home. I think some of the anger about welfare had to do with the changing mores in society, with more and more women in the workforce, including many with small children. Policy shifted from supporting single Moms with money grants to encouraging them to get jobs.
