Lois Lerner Will Plead The Fifth Tomorrow, Rather Than Answer Questions About IRS Partisan Targeting

From the LA Times.

Oh, don't bother looking for this huge scoop on their website. They have buried it, and I do mean buried, at the bottom, well under "Sports," in a little "Politics" headline scroll.

Since they have no interest in advertising their scoop I don't know why I bother citing them at all. But I suppose I must maintain appearances, even if the LATimes no longer feels required to.

Lois Lerner, the head of the exempt organizations division of the IRS, won’t answer questions about what she knew about the improper screening – or why she didn’t reveal it to Congress, according to a letter from her defense lawyer, William W. Taylor 3rd.

You cannot plead the fifth to any question that does not include the potential for self incrimination. So if you are asked about anything of a non-criminal nature - e.g. to state the color of your shoes - you cannot plead the Fifth, at least not without facing contempt charges.

So, if and when Lerner avails herself of her Fifth Amendment protections the whole "no crimes were committed, nothing illegal happened" line of media BS and spin gets totally and permanently blown to smithereens.

She takes the 5th and Miller gets fired for not being in charge at the time. Oh my.

I ran across this job description of ole Lois'.

http://www.irs.gov/uac/Lois-G.-Lerner-Selected-as-Director-of-IRS-Exempt-Organizations-Division

In this position, she will be responsible for administering and enforcing the tax laws that apply to more than 1.8 million organizations recognized by the IRS as exempt from tax.

“Protecting the integrity of tax-exempt organizations is an important part of our enforcement program,” said IRS Commissioner Mark W. Everson. “Lois’s background, including her work for the Federal Election Commission, qualifies her for this new assignment.”

Before this appointment, Lerner had been the director of the Exempt Organizations Rulings & Agreements Division, where she was responsible for the EO determinations letter program, public guidance and technical assistance for IRS agents conducting examinations of tax-exempt organizations. Lerner came to the IRS in 2001 from the Federal Election Commission, where she was Associate General Counsel for Enforcement and Acting General Counsel. She replaces Martha Sullivan, who will retire from the IRS at the end of December.

Obtained dismissal of all criminal charges against Dominique Strauss-Kahn, the former managing director of the International Monetary Fund (IMF), who was accused of sexual assault in a New York City hotel. He also represented Mr. Strauss-Kahn in a related civil matter.
Helped obtain full exoneration for the former chief of the Public Integrity Section of the Department of Justice in independent counsel and internal investigations of prosecutorial misconduct related to the prosecution of the late Sen. Ted Stevens.
Led team of attorneys who obtained dismissal of all claims against Kenneth Langone, former Chair of the New York Stock Exchange (NYSE) Compensation Committee, relating to compensation of NYSE President Richard Grasso. The claims were brought by then New York Attorney General Elliott Spitzer.

I mean, she can use it to not hurt herself, but she cannot use it as cover for testimony that may hurt others... correct? How exactly does this apply to congressional investigations?

---

My understanding is that, by taking the 5th, she can ONLY take the 5th on any questions, even something as innocuous as "Are you left-handed?"

Any response given other than the 5th Amendment opens herself up to being forced to answer questions she doesn't want to discuss.

213 Regarding ace's earlier post about 'not under oath' and sorta on topic, I have a solution:

When an IG or other investigator wants to be sure that people are held culpable for their lies, simply bring along an FBI agent to ask the actual questions. You see, it is a federal felony crime to lie to an FBI agent, even when not under oath.

PS This is also a very good reason to not answer any questions from an FBI agent.

259 There's a rule that you can't take the Fifth having partially answered a question, so once you start answering you can be compelled to continue, at least until that question is exhausted. That's why mobsters appearing before Congressional committees back in the '50s would take the Fifth even about their names - the only sure way to use the Fifth is to say nothing.

However, Congress can grant her full immunity and force her to testify under oath.

Posted by: PersonFromPorlock at May 21, 2013 04:11 PM (5hNpF)

260 Given this tragedy, we need to enact legislation requiringbackground checks for those who wish to exercise their Fifth Amendment rights.
