But.. I think Monday's terrorist attacks in Boston have made an extremely important point that is applicable to gun control. And that is: If someone wants to kill a bunch of people, he will do it no matter what the "law" says about it.

Parading a bunch of grieving parents around has seemed to work quite well up til now - but apparently not well enough. And that's good. Because, as much as I feel sorry for those parents, someone needs to say it: background checks wouldn't have prevented their kid's deaths. The only prevention may have been the very remote possibility that members of that community would have recognized Lanza's instability. The federal government couldn't have helped them.

and one more thing: Fuck you Democrats who have no shame leading these people around Washington D.C.

I understand Begich, Heitkamp, etc issues as they either are up for re-election in pro-gun states or are from strongly pro-gun ones but in general it seems like the most restrictive part of the bill would be to impose criminal background checks at gun shows and through internet sales - which doesn't seem that ridiculous even in the context of ensuring gun rights are protected. If such checks are in place for most gun sales it seems to make sense to have them included during sales through other mediums. Is it the slippery slope concerns that make people opposed to it? Or is it the fees associated w/the background checks? (125 dollars is certainly a significant tax - though i suppose that wouldn't be a sticking point on such an amendment)

Note I'm not talking about the moronic arguments about Newtown/protecting babies made by some of the amendment's supporters - this type of bill and likely any that even democrats would propose would have had no effect in reducing the likelihood of such tragedies.

Not sure where you got this info or if I'm misreading it but....there are background checks at gun shows and an internet sale of a gun must be shipped to a FFL dealer where a background check is run when the purchaser picks up the gun.

That's probably true - this type of amendment likely wouldn't prevent criminals from getting guns so would effectively be taxing/adding bureaucracy to law abiding citizens.

I'm sure Toomey must have thought it would have some minimal effect on getting gun in the hands of criminals or at least would have driven black market prices higher (making them prohibitive for some).

This is all Federal law.

Any weapon sold across state lines has to be delivered to a registered gun store for pick up.

A registered gun store is required to keep an inventory log book recording the make, model, serial number, and buyer of the weapon. The BATF goes through these books with a fine tooth comb during audits. Any screw ups can result in jail time. Falsifying the books will be found out and also punished.

Then when you the customer walks in. You have to fill out a brief form that says among other things you are not a felon and you are the end user. Felonies will prevent a sale going through. Owner runs a quick check to see if you can purchase weapon. If he gets no hits, then the sale can proceed.

Now the gun store goes to a gun show. Guess what, all those Federal laws still apply at the gun show.

The only 'loophole' is between two private citizens at a gun show or garage sale or even the local classifieds. Still the smart seller will keep records of whom they sold the weapon to. Just in case. But that is the only existing 'loophole' and what Manchin-Toomey tried to peddle would not have really closed it.

I generally agree with you on that - but in the case of guns there's already regulation during the sale when you're buying from an FFL dealer. It seems from what you and others have intimated in the thread that if you don't have an FFL that selling to another citizen is illegal? so then these background checks etc would redundant and be a case of extra bureaucracy instead of enforcement.

I can't speak for other states but my home state (Indiana) does not allow private sales without going through an FFL. I can give/bequeath my firearms to my children or spouse or as a gift to anyone as long as I have a 'reasonable' belief the recipient is not a felon or a wife beater or drug addict or mentally unstable, etc., but can't sell them outright.

The 'loophole' the anti-gun people are so worried about doesn't exist where I live. Probably doesn't exist anywhere else, either.

Interstate + Intrastate sales are regulated by the govt by requiring FFL in order to sell/manufacture

Those selling w/o an FFL are doing so illegally and the required checks, etc are being imposed on them

In that case it seems the amendment would be redundant - tell me if I'm making a mistake. Also I"m guessing the govt is invoking a commerce clause/wickard argument to regulate intrastate sales?

have to route the transfer through a dealer. Recommend reviewing statutes in IC 35-
47-2.5 which is the chapter regulating the sale of handguns in regards to a private sale
or purchase. The department also recommends exchanging receipts to document the
transfer.

With respect to the private dealer reference here is the FFL description:

Private sales between unlicensed individuals who are residents of the
same state are allowed under federal law so long as such transfers do
not violate the other existing federal and state laws. While current law
mandates that a background check be performed if the seller has a
federal firearms license, private parties living in the same state are
not required to perform such checks under federal law. State laws
however can prohibit such sales.

A person who does not have a Federal Firearms License may not be in the business
of buying or selling firearms. Individuals buying and selling firearms
without a federal license must be doing so from their own personal
collection.

Nah - for regulatory legalese its actually pretty clear. Only interstate sales are regulated for both groups (FFL and non FFL holders) while intrastate sales are only regulated for those who want to run a business for profit like you said - then it's up to the state. I guess the amendment would extend it to all groups - which would have an effect on what I'm guessing are a lot of states (like Indiana).
