Senators propose making illegal that which is already illegal and has been so since 1968, and punishable by 10 years in Federal prison [Purp]

Imbeciles, the whole lot of them

A commenter nails it dead on with all proper legal cites

Apparently "lawmakers" who are completely ignorant of current law.

18 USC 922(d)(1)-(9) makes it a crime to transfer to a prohibited person.
18 USC 924(a)(2) specifies fine and up to 10 years in prison for doing so.

25 I'm convinced they don't care about whether or not someone picks up a gun and kills someone. It's doesn't affect them because they have armed bodyguards. But they see stories about women and youths (demographics that typically vote democrat) being some of the fastest growing segments of gun ownership (gun owners typically vote republican). That affects them. That's what they are afraid of. They're poisoning the well, making it harder or less attractive to own guns, therefore less likely they'll vote republican. They're afraid someone'll pick up a gun and vote republican.

66 Jane D'oh (and others who are getting depressed):

Here are some things to resist the regime and make you feel like there is hope.

1. Find ways to keep them from taxing you. They have not yet figured out a way to tax you for coupons, buying at sales, growing your own food, buying scrap silver and hoarding it, or helping your kids. Do this stuff. It denies them tax money and you live better and can save some money.

2. Find ways to get cash without having to report it. The best of this is garage sales, and you will also be helping people get items they need cheaply. Stash the money in your home.

3. Think of ways to entertain yourself and your family without giving money to the media/democrat machine. Play board games, watch old movies, go to the library. Take hikes or go fishing (bonus is free supper).

4. If you feel at all inclined, go to church. You might have to shop for one which you are comfortable with, but it is really worth the effort.

I really want people to figure out ways that TFG cannot influence your lives. The more immune we are to his evil maachinations, the better we will feel.

Why would they even want to bring up 'Gun Trafficking' after the Fast and Furious fuckup?

Are they going to try to incorporate the UN treaty language that used gun trafficking as a cloaking device for infringing on our 2nd Ammendment?

Are they going to try to slip in a Federal Registry as a way to crack down on gun trafficking?

This is one to keep an eye on.

101 Jane D'oh, the parents may not care a whit, but look what good you are doing for the children!

That time you help them at church might be the only stable influence in their lives. Your volunteerism isn't about the parents, but the children!

God bless you for doing that!

Texas locations are kind of like tools in a toolbox. You have to choose the right one for the right job.

I live in the DFW Metroplex, and I love it. But nothing brings me peace like West Texas (Eastland - Abilene mostly, but points west of there, too). Love the food and fun in San Antonio. And where would we be if we didn't have Austin to complain about?

Posted by: BCochran1981 - Credible Hulk at March 04, 2013 10:29 PM (GEICT)

129 Consider two things:

1) the sheer number of laws on the books these days pretty much assures duplication of effort (or reinventing the wheel, whichever trips your trigger), and...

2) politicians seem not to have any awareness of computers - see their shock and denials of things caught and posted on YouTube, Breitbart.com, and other sites. Therefore, they are incapable of using said internet to search for pre-existing laws.

Or, alternately, they're either stupid as bricks or they just don't give a crap.

Posted by: Nate at March 04, 2013 10:30 PM (guneC)

130 AllenG, what is the story? Broadly speaking that is.

It's a fantasy piece, but the setting is specifically non Tolkenian. You won't find a single dwarf or elf about the place.

The story itself is about the third son of a Baron who is sort of thrust into the role of saving the world.

As with many (most) fantasy stories, I think the rules of the world are what make it interesting. For example- the non-human races are all based on one of the 4 physical elements (in the book you've only met one of those races, but others are mentioned). Also, humans can only work magic through long and laborious processes- so most of their magic is focused on creating items of use, rather than casting massive spells to destroy opponents or change the weather or what-have-you.

136 AllenG

My big regret after leaving Texas is that I never made it out west. :-(

My favorite is Matagorda Beach. You can drive on the sand and it's relatively unknown so it's still clean.

But, if you want a day trip or overnight trip or weekend trip, you need to go to Rockport. Spend the day at the beach, have lunch at Copano Bay (it's a upgraded gas station!) and dinner at the Boiling Pot. The tables ate covered in butcher block paper and you can draw on it while you're waiting for your food. They just dump a pot of blue crab, corn on the cob, red potatoes, and crawfish onto the paper. No silverware!

Very kid friendly.

Posted by: L, elle at March 04, 2013 10:33 PM (0PiQ4)

137 Ook? See my post recent post. Matagorda beach is so much better.

Posted by: L, elle at March 04, 2013 10:34 PM (0PiQ4)

138 Well that is a bit broadly. Saving the world. A dragon has decided the whole planet is a bauble to collect. Or perhaps magic is fading and a sacrifice is needed, a human one and your hero who has never been good at magic decides perhaps losing magic is not a terrible thing.

So you have the likes of Ifrit/Djinn and Salamanders. Avatars of Wind and Fire respectively. Could be interesting.

JRR had pretty much poisoned the fantasy world realm until Harry Potter came along.

Posted by: Anna Puma (+SmuD) at March 04, 2013 10:36 PM (h4Bce)

139 I don't see how they could strengthen any of the gunrunning aspects of US law. Any variation on it is very illegal and felonious right now. There really are no loopholes.

The 1968 law was actually quite comprehensive. Everything that came after it was pretty modest nibbling around the edges, one sentence adding another case or exception here or there, upping a penalty and such.

The core of it is virtually unchanged.

142 Posted by: Anna Puma (+SmuD) at March 04, 2013 10:36 PM

Yeah, it's a very broad explanation. My problem has been trying to get my description more specific without being spoilery.

As for the non-humans, actually you won't find Ifrit or Djinn either.

The fire people are called "Igni" (or Fire Apes) and they look sort of like scarier orangutans. They literally burst into flame when they get mad enough.

The primary supporting character is an Igni.

My air guys (if I ever get around to introducing them- possibly in another book) are very insect like. The earth guys are probably the most "standard," in that they kind of look like golems. They have a twist, though. And the water guys are communal-intelligence shape-shifter things.

I could give you the long-form briefing if you wanted it.

Posted by: AllenG (Dedicated Tenther) Channeling Breitbart at March 04, 2013 10:44 PM (nUH8H)

143 Sure BCochran, sure.

AllenG, well you don't have to get too specific. I understand.

There is a La Quinta about a mile or so away for $86/night less. Not counting tax. And the Anatole charging $17/day parking fee.

What is the definition of firearm?

From the ATF website:
http://www.atf.gov/firearms/faq/firearms-technology.html

18 U.S.C. Section 921(a)(3), to include (A)
any weapon (including a starter gun), which will, or is designed to or
may readily be converted to expel a projectile by the action of an
explosive; (B) the frame or receiver of any such weapon

Posted by: @PurpAv at March 04, 2013 11:07 PM (/gHaE)

147 So, technically, something like a hairspray powered spud gun is actually a real gun as far as ATF is concerned.

150 ‘Sec. 933. Forfeiture and fines

‘(a)(1) Any person convicted of a violation of this chapter shall
forfeit to the United States, irrespective of any provision of State
law--
‘(A) any property constituting, or derived from, any
proceeds the person obtained, directly or indirectly, as the result of
such violation; and
‘(B) any of the person’s property used, or

152 I had the misfortune to work as a state employee for 28 years. I interacted with the state legislators and their staffs on an almost daily basis. In my considered opinion, the average legislator/staffer loses 10 IQ points for every year they serve. I had the staff of one legislator call on me to explain the provisions of a new regulation. The new regulation's proponent was that legislator and his staff had drafted the original bill. Legislator's, as a class, are "impulse lawmakers" who never bother to try to understand the situation before clammoring for a new law.

Posted by: Michael M. Keohane at March 05, 2013 06:47 AM (9jVGo)

153 You REALLY need to read the actual bill. The way straw purchase is defined, if you buy any firearm "with the intent to transfer it to any person" then that is a straw purchase and carries a 20 year sentence. No limitations on time. The only exceptions are raffles and gifts. That means that if you buy a gun and decide to flip it, whether it's in 2 days or 2 decades, that's a straw purchase under this bill. This bill aims to make every single gun non-transferable in a private transaction.
