In Sheep's Clothing: When Children Kill (Niedermeyer's Dead Horse)

No person wants to think of a child's life wasted. We want to see them raised in a loving, supportive home. We want to see them receive the best education. We want them to feel safe. We want these things because they contribute to the quality of adult life they will lead. Yet with sadness, despair even, we are aware that too many children do not live the lives we dream for them.

Cristian Fernandez is just such a boy.

The story of Cristian's life reads like a horror story: Born to a 12 year old girl who lived with her own drug-addicted mother, he has endured both physical and sexual abuse during his short life. It is impossible to not feel sorry for what he, only a child, has endured. Yet.... it is impossible not to mourn for the child whom he has killed.

At 12, Cristian Fernandez was the youngest person in Jacksonville to have ever been indicted for murder. He has been charged as an adult with first-degree murder and aggravated child abuse in the case involving the death of his 2-year old brother, killed in a beating while the two were unsupervised. Further he has been charged with sexual battery of his 5-year old brother (Charges were later dropped due to lack of evidence).

His mother has already pleaded to manslaughter for failing to seek help (for eight hours!) for the critically injured child who died, and will serve a minimum of 13 years in prison.

This week, Cristian was allowed to plead to manslaughter and aggravated battery and he will be held in custody in a juvenile facility until he is 19-years old. Upon his release, he will serve, with good behavior, another 5 years on probation. The pleas came after his videotaped interrogations were tossed as a judge sided with the defense in stating that Cristian, interrogated without an adult present, did not understand the Miranda Rights that were read to him. (Plea deal and subsequent press conference here.)

During the past year this case has been the source of a great deal of angst and debate: Do you throw away the keys to a child when he is only 12-years old? Can you call a 12-year old child a monster? What are the consequences of placing a child, albeit a murderer, in either an adult or a juvenile facility? How about the needs to punish weighed against the needs for rehabilitation?

Oh.... and....

Did Angela Corey seek to make a name for herself by too aggressively pursing the charges against him?

This post could go on for page after page and I might never make it any more lucid than it is now, for my head is still turning.

Take a peak at the story and let me know your thoughts, about the child, the prosecution, the protection of the public.

Maybe someone will be able to put my mind at ease about the whole, ugly, damnable mess.

12 You know, that if Obama killed that 12 yo boy with a drone, Robert Gibbs would speculate that that boy "needed a more responsible father."

So, as the spokesman for liberalism has clearly stated, that boy is disposable due to parental shortcomings.

Yup, the Great Society ain't so great. I think it is responsible for the breakdown in Black families since the Gubamint replaced the role of the father. I think it was Walter Williams who talked about how when he was growing up, 2 parent Black families were the norm. This norm was eroded away by government entitlements that encourage and foster dependency.

With the direction this counry is headed, we will all be in that same boat as the Black community. You can already see it happening as non-minority families are increasingly headed up by women who are on the dole. This will be America's new normal, not just one minority group.

We have a thug out here in the Seattle area who with his friends, beat a tuba playing, developmentally delayed, homeless man to death. They used his own tuba to beat him and bragged about it later. This kid went to juvie for less than 2 years and got released. A few short years later, he was recently arrested for shooting and killing another man at a nightclub.

105 I worked on wagon trains (the real deal) with VisionQuest for 3 years. They take in the nastiest, toughest kids adjudicated you can imagine. It was very physical, and I was a teacher. Children have remarkable recovery abilities. They can be redeemed far more that adults. Very unpredictable though. A kid that was very good, did the program right and you would think was going to make it would get out and kill someone the next week. Another kid whom you spent a good deal of time on the ground with, and was just as nasty as could be would get out and end up doing great. Bottom line kids are redeemable, and should be given a second chance. Some times you just want to strangle them but then you look at their file and want to cry for thinking such a thing. Young are a product of their environment more than genes, which come to the fore later in life.

On top of your suggestions in 44, I'm also a big fan of making welfare recipients write thank you notes. When I was in college, my school made me hand-write a thank you note every semester to the business that were providing my scholarships. I propose doing the same for welfare recipients. Twice a year, give them the name of a person who pays income taxes and isn't on the government teat, and have the welfare recipient thank them for working so hard to provide for their family. Wouldn't work for everybody, but might get through to a few people that they're not being paid out of Obama's stash, but out of the sweat of their fellow citizens. Shameful? Yep, you should be ashamed to be on welfare. Shame is not a bad thing.

124 It is a fallacy that our country's mental health services are somehow adequate to "fix" someone who is so hardwired so wrongly. Psych medications can dampen certain behaviors (if you take the meds), and counseling can perhaps temporarily alter them. Unfortunately, the ability of psychiatric professionals to accurately predict whether a given individual will commit a violent act within any given timeframe is just non-existent. I am not going to pass judgment on whether he "lacks a soul" on the basis of a single photograph taken without context, but I don't hold great hope that he can be rehabilitated and reinserted into decent society. Somehow the "adults" in situations like this must be held accountable. I don't see the collective willpower in our state or federal legislators to do that however.

128 I blame EVIL. It exists. It always has existed. It always will.
Liberalism and the expansion of the Great Society deserve some of the blame for destroying the black family, but it's a bit of a stretch toblame LBJ for this kid being a psychopath.EVIL is primarily to blame.
By the way, call me crazy, but America housed a hell of a lot of evil pre-1960.
Didn't American used to have nutters running around in white sheets blowing up innocent little black girls while they were learning about Jesus in Sunday school? Iseem to remember seeing pictures of good Christian folks laughing and smilingwhilestandingbeneath the charred remains of a black man who had been lynched and set aflame. Must have been liberal propaganda.
Still, I wonder how those evil bastardsgot that way without a liberal government to twist their minds and to destroy their wonderful households.

Unemployed people on government programs such as well fare and food stamps should be registered on a draft board. 139 Nothing breaks my heart more than stories like this. And I mean "break" like I just want the world to end because a world where we don't care for our kids better than this isn't a world that needs to exist.

But I suppose we can't quit the world.

Who asks what caused this? Who looks at this family and their neighborhood and asks what the fuck is going on that this can happen? Who wants to try and figure out what series of events and circumstances contributed to this tragedy?

No one, that's who. If Piers Morgan did a show on this every night, trying to get to the root causes of this, he and his network wouldn't be such a fucking waste.

If there was a conservative policy, a talk-radio host, a GOP platform position that led to this I would need a fucking shower to wash the association off of me.

However I don't think a push for strong traditional family values led to it.

It's heart breaking in a world of repeatedly broken hearts and it scares me sometimes to think of what our society has become.

Godspeed all of us.

Why charge the boy with 1st degree murder? Why not manslaughter? The tasks she should have been focused on were getting the boy out of his wretched inhuman situation, getting him help, and MOST IMPORTANT, keeping him away from the innocent until he is cured. What difference would her attention seeking publicity ploy of first degree murder as an adult accomplish? The kid in still in juvie custody either way.

But she decided to go on some pyrrhic crusade for glory or notoriety instead. After all, their elections are to be won.

I live 2000 miles away from FL, and from seeing her conduct in this and the Zimmerman case, I am glad I am no where near a place where a psycho, self-righteous, do-gooder like her has that kind of power.

Then in the name of holy "family ties" they are then thrown right back into that same hell. And promptly forgotten about by the social workers until they turn up dead (or missing during a finacial aid audit two years later).

169 My thoughts on the criminal justice system in general are that it is not for rehabilitation. I also do not think that it is for punishing really, but rather that it is based on the social contract and therefore it is an agreement by people to accept certain consequences as a result of violating society's rules. I think this is an important distinction because seeing the role of the criminal justice system as being to punish wrongdoing makes it into our parent, and I do not believe that the role of government is to be our parent.

In law school, I took a class on the rights of children. We had a local judge give a guest lecture, and one of the questions he asked as he began was why we send children to jail. I answered "So they can learn to be better criminals." He liked my answer.

I'm opposed, generally, to "criminal camp", especially for children. I'm not opposed to jail particularly, but I think we really need to reform it. But it's hard to reform something when there is no consensus on what the purpose of it is. Reforming the prison system would mean taking the time to look at it and understand it, and it's not a fun job. So people avoid thinking about it because it's unpleasant to think about.

But that makes it really difficult to change the status quo.

170 154. Point being, adults are rarely going to turn it around but the young are incredibly resilient and do. You just have to get them through their 20s. And not locked up with the hard core, they just learn to be one. VisionQuest has the right idea but the execution was poor, the help is not paid enough to attract enough real good people. I met some real solid people though, nothing stronger than a mature black women, bank on it.

172 I had a friend who was a juvenile probation officer in Los Angeles for twelve years. He said that the majority of his kids were from one-parent homes and that usually the mothers would expect him to help "raise" their kids when they came to see him. He did manage to help steer a few to turn around their lives, but without a stable home environment, the kids were screwed.

178 I wonder if there is some progressive-socialist who will explain away Christian's mal-adaptation with these words, "she should have had an abortion.' If one or more has, Margaret Sanger smiled each time.

Corey sounds like another Janet Reno. Must get the conviction and damn the consequences.

Christian's horrible life is something I would expect in 'Lord of the Flies' or as a zombie emerging from a pet cemetery. Alas its reality and if one is truly honest and objective then one must find the causes, minor and major that lead to this, and dedicate one's life to changing things. When it comes to children, yes it is each of our's responsibility to be our brother or sister keeper.

Posted by: Anna Puma (+SmuD) at February 10, 2013 06:36 PM (VpkjW)

179 Interrogation of children isn't that complicated. Normally, minor children, or those under 16, depending on locality, should be accompanied by a parent, or in this case (since mom was a defendant for the same crime) an impartial advocate. The advocate is there to ensure that the child really does understand their rights. The advocate is not an attorney.

Can a 12 year old really give consent to waive rights? I don't see how.

Los Angeles' DFCS has a HORRIBLE reputation in removing children from the homes of abusive parents. Even with complaints being lodged, they wouldn't follow up and within a year or two, the child was either worse off or dead.

Perhaps during the day they hid in the rubble, inside cellars of the shattered houses, in the sewers among the rats, or perhaps they did not exist because they weren't dogs but ghosts of dogs who materialized with the darkness to imitate the men who had killed them."

212 To no one in particular, all the talk about "single motherhood," if referring to the mother of this boy, is troublesome. She was raped at the age of 11 or 12. That is not her fault. Yes, this entire family is screwed up but I'm not fond of laying all this dysfunction in her lap alone. And for the record I do agree that single motherhood is a huge problem. I just don't think this particular girl *chose* to be a single mother at age 12.

Someone said above the boy is doing well in juvie. Two thoughts came to mind. He could be a sociopath, in which case he's just adapting to his current situation and biding his time. Or, if he's not an actual sociopath, he may be responding positively to the first real structure and safe environment he may have ever known. The problem of course is that there's no real way to tell which type he is. Thus the dilemma about what to do with kids like this. There are no good answers.

I remember one toddler playing in the toilet with his pacifier. I cleaned it off and gave it back to "mom," telling her what he was up to. Five minutes later the kid had it back in his mouth, and she could give a shit. Absolutely no care at all. But if something happened to him, oh law suits would be coming quickly with ambulance chasing lawyers and the poor aggrieved single loving mother in tow. A study of world history (need the long lens) shows that civilizations, after about 200 years go down. The system gets to bloated, the folk to apathetic. We have been lucky enough to have lived in the greatest time and place in human history, which is a history of mostly misery and the life of an ox. The system is going down, and with the assholes running the show now, it will not be long. But I have lived an good life and have no offspring. Sad, and I do love, but this sucks.

250 A merciful society would put this boy out of his misery. He is damaged beyond repair. Tragic.

This is how the editorial ends:
The family’s tragedy can only be tempered if it helps us recognize the importance of prevention programs.

Lives can be saved and tragedies averted if the programs now in place are expanded and improved.

But of course. And when "the programs" are expanded and improved, and the same thing happens again - and it will - then what?

The story is disgusting, but I very much doubt that, given our sensibilities, anything can be done to preclude a repetition of it. Does Singapore have stories like this? I suspect not (or not as many, per capita), but I very much doubt that anyone here would support a Singapore-style "program."

A typical argument against the profit motive is that it doesn't allow for the parties to the exchange to bear all costs of the exchange. Those costs not borne by the parties to the exchange are referred to as "externalities". I agree with you that this argument is wrong, but I think it's because the problem of externalities has absolutely nothing to do with the profit motive. These are simply two different issues that haters of the profit motive conflate to try to make it look like some system other than capitalism can adequately capture those externalities and require the parties who created them to bear them.

As if.

255 JohnJ 227, you missed the point. I'm all for the profit motive. But look up the term Externalities, spelling not so much. Some things in our system don't get enough attention and this is one. Still, by far the best system ever, natural, spontanious, as it should be. But there are some things the government should do. But the closer, more local, the better. On that wagon train, local, rural folk (in TX) often Christian (we could not push it) would come out and show those kids some real love, it mad a difference. Good thing I am an engineer now, when you get older your emotions are on your sleeve. And engineers are very practical and funny. Some of my classroom memories still make me cry, I worked with the dammed.

256 Okay, but the desire to better one's life has absolutely nothing to do with the problem of externalities. People who aren't motivated by a desire to better their lives also create externalities.

The problem with externalities is that they aren't borne by those who create them. This problem has absolutely nothing to do with the fact that people, in general, act to improve their lives.

So the solution to the problem is to have those externalities borne by the people who create them. The solution isn't to stop them from acting to improve their lives.

257 rehabilitation is progressive rubbish, I feel bad for the kid, but he is a threat, a menace to society, there is no power on this earth that can repair him, or fix what he has done, only God can help him...send him to the waiting room in the Sky before he kills again, because he will.

258 I'm with ya John, but I am talking about the technical term from Economics, macro. Hell I am a lurker, not a commenter, but this one hit a nerve. And notice, we are all alone. With that I bid you a smiling fair-well, catch you nest lap.

259 As far as I am concerned, the way to deal with this kid is to treat him as if had used up two of his three strikes. Once he's released on probation, any act of violence on his part, other than bona fide self defense, should result in a visit to Old Sparky.

260 What we need to do is to put a 30 foot steel wall around the remains of Detroit and then put the kids like this inside forever. Just drop off some pallets of food at the gates every day and let the inmates figure it out themselves.

262 Yes six months to a year after his 19th birthday the newsies will be bleeting about how the system failed and how did he get set loose on society to kill and maim again. I feel for him but he is not fixable, the agent who created the FBI behavioral sciences division once stated serial killers are made not born and here is a prime example of that. I don't understand why we don't sterilize these women and men who continue to have children and abuse them over and over again. He should be locked up for the rest of his natural life.
