Remember Jose Padilla?

In reference to media silence on Americans being dispatched according to the President's pleasure.

Hey, Washington Post. Remember Jose Padilla?

The presumption must be that U.S. citizens can rely on the federal courts to oversee their prosecutions. And Mr. Padilla's abhorrent disappearance into limbo should come to be remembered as an aberration never to be repeated.

Hey, ACLU. Remember Jose Padilla?

In an era of popular movements in Egypt, Syria, Burma, and elsewhere, the United States cannot afford to lose further its credibility on human rights.

Hey New York Times. Remember Jose Padilla?

While the ruling was in the particular case of Mr. Padilla, the decision's larger message -- that there are constitutional limits on the president's power to deny basic civil liberties in the name of fighting terrorism -- is one that protects the liberty of all Americans.

All of you. Your convictions and principles aren't as weighty as the pixels they're fancifully painted with.

"You have to understand that the government was asking for 30 years to

The Wall Street Journal said in an editorial that "the lawyers suing for Padilla aren't
interested in justice. They're practicing 'lawfare,' which is an effort
to undermine the war on terror by making U.S. officials afraid to pursue
it for fear of personal liability." In January 2012, the Fourth Circuit

Sentence ruled too lenient
On September 19, 2011, a three-judge panel of the 11th court of appeals
threw out the 17-year prison sentence imposed on Padilla, ruling that
the sentence was too lenient, and sent the case back for a new
sentencing hearing. The Court said, "Padilla's sentence of 12 years

81 the Law of Armed Conflict (LOAC) applies. If you are an unlawful combatant, then the Geneva Convention does NOT apply to you.

A lawful combatant wear a uniform, does not hide among civilians, and fights for a nation under a flag. An unlawful combatant wears no uniform, hides among civilians, fights for no nation under no flag. All memebers of Al Qaeda are unlawful combatants. The Geneva Convention does not apply to them. Having violated the LOAC, the protections of the Geneva Convention do not apply to them.

GITMO was created because the SCOTUS in case law had started to erode the concept of the protections of the Constitution being reserved for citizens. The administration knew if they brought Padilla here, they would be haranged to try him in civilian court. If they brought any of the GITMO prisoners here, they would have to bring them to civilian court. But if they kept these unlawful combatants at GITMO, they could try them in military courts. So Padilla was put in GITMO. After being harranged with lawfare, the Bush administration brought him here to be tried in civilian courts, because he was an American.

That is why they will never close GITMO. And Mr. Constitutional Scholar President is a fraud. But we knew that

It's an ironic reference to the whole Templars / dynastic europe / conspiracy thing, boiling down to the Carolingian and Mervingian dynasties. Back in 1991 or so I came up with it because "everybody" in our little circle was into that stuff, but I changed it from "Meroving" to "merovign" because the former sounds dorky.

The Merovingians were the losers and basically scrubbed out of power, BTW.

Very shortly the original meaning was irrelevant, and it simply became the name I was known by. A lot of people know me by no other name.

grew up around them. I know. My reaction to Zombie's "prairie fire" expose was "I thought everyone knew that." I *think* I saw a copy of that when I was young. Similar stuff certainly. Hey, Man, Kill the Pigs!

Normal kids out grew out of that at once time. Hell, I even read Steal This Book when I was a teenager.

I'm thinking Little Billy Ayers was ID'd as a useful idiot early on, was encouraged in his false beliefs, and set up with his teaching career by prominent Leftards. When I found out he was in cahoots with foreign governments in pursuit of his goals, I was convinced this happened.

The big Californbia gun forum is full of arguably pro-gun Democrats who hold to every other leftist meme, down to pretending that confiscation can never happen and eeebil Wingers are paranoid.

I'm of two minds on the matter.

1) the hypocrisy is too much make them live up to their feigned rules and the Constitution is inviolable....

2) the Founders themselves were playing games with the Plain meaning of the document relatively out of the gate see Barbary War authorization of force against "stateless" pirates so kill em all and let the law catch up.

I'd personally like to see renewals of letters of marque, tacit but subtle backing of filibustering, and the use of purely punitive warfare for safe harbors of Stateless Actors....

I don't have the answers other than the media pretending "shoulda had a better daddy" is a serious answer is criminally stupid.

Correct, another part of what pisses me off is the rumor is Bush had a 3 man team who vetted clients for his retirement seminars.

The professional Israel haters on the left like to imagine that the actions of Mike Harari and the Operation Wrath of God Jury were beyond the pale, BUT Israel's actions were if anything more ethical than Obama's.

I'd be a lot calmer about this is there were a 12 man review team made up of six politicians 3 from each party and 6 career intel/LE types to review evidence at a minimum.

As it stands there is no safeguard beyond Barry's non-existent conscience.

246 Kerry: U.S. cannot retreat from world stage
By Matthew Lee - The Associated Press
Posted : Wednesday Feb 6, 2013 19:05:14 EST
WASHINGTON — Secretary of State John Kerry vowed Wednesday that the United States will not retreat from the world stage due to budget constraints or the complexity of global challenges.

Speaking after being ceremonially sworn into office by Vice President Joe Biden, Kerry said his military service in Vietnam taught him the cost of failed diplomacy. He said he was committed to working for peace but would not shy away from defending America, its values or ideals if they come under threat from “extremism, terrorism, chaos or evil.”

I have never tried that, but I will!

I do that with currants in scones though. Well, I use rum, but it's almost the same.

Vodka works well for that, too.

It helps a lot in keeping the cookies/scones/baked goods from drying out.

I was just reading an article about a group of gunmen in Acapulco who were robbing and raping tourists because they wanted to have some fun. There is nothing that can be done with rabid animals like that other than putting them down.

I have no problem with dispensing with rabid animals regardless of how many legs they have. You can't have a civil society unless you contain the uncivil.

253 -If citizen Padilla has been represented in court, tried and convicted of treason then he gets smoked like the POS that he is. If he's actively being hunted by his own government without being charged and tried that's entirely different.

Posted by: CrotchetyOldJarhead at February 06, 2013 09:43 PM (32Scy)

277 If Jose Padilla is still alive, who is buried in Grant's Tomb?

Posted by: Maghan McCain at February 06, 2013 09:39 PM (+s5ze)

Seriously? Do you know how old that tomb is? You expect *anyone* to know that?

Man, history is SOOOOOO confusing!

Posted by: Ezra Klein at February 06, 2013 09:44 PM (bxiXv)

278 Yeah if you hung out near campuses in the late '70s at all you got proof they had serious America haters in their ranks....they were VERY pro private ownership of guns right up until about '86.

Posted by: sven10077 at February 06, 2013 08:29 PM

That's a bad sign. It's an alarm bell for how things stand now. Way beyond the Winter Palace.

279 Jose Padilla, an American Citizen having taken arms up against the United States and acting in concert with AlQaeda, is spotted by a drone amongst a truckload of known AlQaeda soldiers, including one leader, speeding across Yemen's Hydramaut.

Blow the truck away or not?

If this were my administration?

If that's the case for this 'experiment,' I would have already informed the Pentagon to only bring me cases that have already gone through a military court and reviewed by at least two Federal circuit judges, in camera, in order to make a determination of the status of the combatant.

If either judge or the military court determine that the accused had not clearly and willfully acted against the US and her military forces, then no.

If neither objected, he's an ex-lifeform.

280 If Padilla was overseas in a combat zone plotting I would not care if they made a Pollack painting with his remains

Sven10077 - I'm not advocating that some GOP president actually use the JEF protocol, I'm simply drawing the analogy of its use by someone other than the JEF.
And I'dbe careful about using the word 'never'. History is full of examples of politicians leveraging bad policy and laws to attain power.

Posted by: CrotchetyOldJarhead at February 06, 2013 09:53 PM (zEeUf)

282 I have no problem wit Padilla rotting in a military brig or prison or even executed after a military tribunal. He is an unlawful combatant, regardless of his status as an American citizen. The 16 year old kid was not an unlawful combatant. He was a non combatant. I do not think he was the target of the drone. The dude he was with was. And that dude was an unlawful combatant. I object to the faux outrage and double standard of the left

Posted by: thunderb at February 06, 2013 09:56 PM (Dnbau)

283 281 CrotchetyOldJarhead,

I am ethical enough to attack my own party for overreach. Case in point Harriet Miers Bush's vanity SCotUS pick. I used what meager influence I have to express my displeasure with it.

I could not stop Ogabe from getting two vanity picks in, because 'well double standards are the left's ONLY standards."

I do appreciate your intonation to caution and assure you I am quite aware of the temptation to purple.

I'm wary as hell of "great men" no matter which set of clowns they run with.

284 I'll just reiterate the point that nopolitician has stood up andopenly challenged the constitutionality of the AGs decision and the JEF protocol. We have truly reached the slope.

Posted by: CrotchetyOldJarhead at February 06, 2013 10:11 PM (jNNPU)

285
"We have truly reached the slope."

As far as Iam concerned at this point, anyone who can vote for a Democrat for anything above dogcatcher, orread most newspapers without puking, might as well stand up and say "I am a fucking traitor and proud of it!"

That's the way I see them. Are we going to pick up therecall ballotstoday, the torches and pitchforks tomorrow, or the AR-15s someday?

286 The Founders expected the President to have the powers of the King of Prussia in the saddle, once Congress authorized a state of war upon the target.

The Founders expected war to be a temporary frenzy for a definite end that nobody wanted to endure forever.

The Founders did not intend for us to create a trillion-dollar permanent emergency.

People trying to limit the constitutional war powers of the Executive branch, in order that the permanent war is softened by some form of due process, are entirely missing the point.

The war is not supposed to last three decades.
We're supposed to win it.
Instead it's becoming another federal bureaucratic quagmire that exists so we can feel we did something.

287 I never liked Johnson, Nixon, Ford, Carter, kinda liked Reagan 'cepting for the whole drug war that he ramped up, Bush, then Clinton, Bush2, and now the JEF . ALL of them have eroded the Constitution, and probably more behind them, but I can't speak for that personally. Pisses me off, but what can we do? I've gotten old enough that I just spunk in my wife's tight chasm, but what do the kids do today? We HAVE reached the slope, and it's been inevitable. We let it start. Not because of lack of God, or morals, but because we forgot what the Constitution was about. And forgot to be ruled by it. The Founding Fathers wrote this in, the Churches rule morals, and the Government keeps it's hands out. Boy, I bet you hate ME now.
