Legal, Ethical, & Wise: Holder's DoJ Defends Policy of Unilteral Assassinations of American Citizens

The left is showing its strong objections to this policy and its legal defense by saying absolutely nothing at all.

That'll show 'em!

More: Reason recalls that that President Kill-List is a Nobel Prize recipient.

What else is in the news today regarding the most transparent administration in history? A report documenting that 54 countries around the globe have played along with the CIA when it comes to torturing suspects in such a way that the U.S. can pretend it doesn't do that sort of thing anymore.

There is a darkly comic aspect to this, I suppose: Here's a president who once taught classes in constitutional law and swore up and down that America doesn't torture, that he was against "dumb wars" waged by his predecessors, that he was more transparent than a glass of triple-filtered water, and who won a goddamned Nobel Peace Prize! And he turns out to be not just a little iffy when it comes to being constrained in his willingness to break all sorts of rules but downright godawful.

The notion, that the the drone-strike memo shifts the burden of proof to the target rather than the government, is a throwback to the 1919 Jallianwala Bagh Massacre of which killed at least 400 unarmed men, women and children.

148 Congress authorized the use of military force against Al Qaeda in 2001, citing the authority of the War Powers Act.

Either repeal that AUMF, or repeal the War Powers Act, or amend the Constitution to declare the form of war declaration you imagine is extra valid.

Once upon a time, say, 1990, the country paid for aircraft to carry nuclear weapons to be thrown at cities of the President's choice with less statutory justification than any drone strike. American citizens served in the Wehrmacht and the Japanese Army. Nobody cared about their due process rights. The Army of the Potomac had no judicial findings in support of orders to shoot anybody at Gettysburg. When Washington rode out against the Whiskey Rebellion with the army he was not going to wrestle people down and restrain them for indictment by grand jury. He was going to kill them if they didn't give up.

This is another example of libertarian handwringing over the actual American experience as somehow clashing horribly. awfully, immorally with a past that never existed.

Here's the thing, there does need to be a way, after debate and through law, to declare war against a non-state actor. Then it would be all good, fair warning and all.

In all seriousness though, the problem of course is how to spin criticism of this without coming across as soft on terrorism. Not because you are soft on terrorism but because: "'Shut up', Obama explained."

Just because the people blown up so far deserve a special place in hell, doesn't make it a good policy.

You do understand the difference between Americans who have taken up arms against the US (against whom Bush authorized drone strikes regularly) and Americans who might, maybe have joined up with Al Qaeda, we think.

Right?

You do get the difference, don't you?"

No difference at all, just as bomb strikes on factories full of women and prisoners captured from Allied armies, making ball bearings, were equal to the entrenched troops of the Herman Goering Division.

There was a state of war, recognized by Congress and the President, and the authorities delegated y the President determined it was useful to the war effort to bomb them from the air.

236 Well, I don't have a problem with drone strikes taking out American traitors, albeit with a couple of big caveats. One, the event has to occur in a foreign country, with a hostile or uncooperative government, such that one can not simply send in a detail of troops to arrest the bastards. The second being that there is ample evidence that the American subjects of such strikes are in fact willfully aiding and abetting foreign terrorists in their activities, and aren't simply hostages, idiot tourists, or idiot journalists. Having said that, though, if idiot journalists or idiot tourists happen to be within the kill radius when a drone takes out Al Qaeda fearless leader #228, too bad, so sad.

Biggest issue, though, is that Obama and his minions cannot be trusted to make such decisions honestly and fairly.

All good points, although a depressing theme emerges: Americans are never so good at killing as when we're killing each other.

It occurs to me--not for the first time--that one of the reasons Republican politicians at the national level are being so...meek (for lack of a better word) is because they're afraid of getting people riled up. They've weighed the cost:endure four more years of radical socialism, rampant corruption, and usurpatious power grabs by the Executive branch, which can (hopefully, presumably) be rolled back in a future Republican administration, orconfront and (possibly) attempt to impeach the President and trigger a constitional crisis, with all of the potential upheaval and risk that entails.

I think they went with b.

That and I'm not sure even "Constitutional Law Professor" President Obumbles is capable of making the necessary distinctions needed to actually truss these things out.Even if you're calling for the collapse of America, it seems to me that we give a pretty wide berth of free speech in this country, and I see no reason why we should resort to drone strikes as a way of silencing that speech even though we don't like it.So you'd have to resort to determining when you cross the line between "speech" and "incitement." (similar to Brandenberg.) So far those cases have been pretty clear cut I think (does anyone really mourn Al-awari or whatever his name was?) but as those cases get more and more narrow, I expect that King O'Bumbles is going to error on the side of "kill him." which is not something I want on principle alone.

That's not the point and you know it.

With George Bush (remember him? The evil, but retarded, chimpanzee reincarnation of Hitler who somehow outsmarted Democrats for 8 years?) there was a clear line of when it was okay- has this person actively taken up arms against the United States, and can we prove it?

With TFG, that line doesn't exist. It's if they "believe" the person may be a threat. That's a whole-fucking-lot of "grey area."

289 The problem with the use of drones is ... just about everything.

There are constitutional issues, ethical issues, intelligence issues, legal authority issues, miltiary issues, tactical issues.

Ultimately, the President may be correct and right. The problem is that none of these issues have been debated or thought out or given to the American people.

The President has far more leeway when he is dealing with enemy combatants, some when dealing with non-citizens, but very little when dealing with citizens.

The use of drones against American citizens is a serious matter, and should be properly vetted.

I highly doubt that the authorized targeting is done 'without any

Obama is dumb but not that dumb.

That's not the point and you know it.

With
George Bush (remember him? The evil, but retarded, chimpanzee
reincarnation of Hitler who somehow outsmarted Democrats for 8 years?)
there was a clear line of when it was okay- has this person actively
taken up arms against the United States, and can we prove it?

With TFG, that line doesn't exist. It's if they "believe" the person may be a threat. That's a whole-fucking-lot of "grey area."

Posted by: AllenG (Dedicated Tenther) Channelling Breitbart at February 05, 2013 04:16 PM (8y9MW)

Additionally there's the question of "who gets to decide that this is sufficient intelligence." I suspect we could placate a lot of people by simply putting some sort of tribunal to handle it, but concentrating it in the executive branch is disturbing to say the least. But any sort of tribunal like that would come with culpability, and they don't want that. As it is they can cite secret memos and pass the buck to "Ghost-y McNotarealperson" whose position and title just happen to be classified.
(Again, none of this applies to anyone you find on the field of battle. If the dude's shooting at you, clearly you get to shoot back.)

Why, unemployment was just NIFTY for saving the planet!

I guess now they're trying to ignore the staggering unemployment numbers and instead make it look like people working LESS is a good thing. Despite teh fact that businesses that are cutting back their employees' hours are being besieged by left-leaning idiots who call it "unfair." 362 We bombed Schweinfurt on the GUESS that a reduction in ball bearing production would cripple the German army. It wasn't a "threat", and Ike didn't have to prove it to anybody. It didn't kill armed combatants. The shift workers were no threat.

Posted by: Chris Balsz at February 05, 2013 04:24 PM (v89sD)

It was not a guess. Albert Speer confirmed after the war that had the strikes been repeated several times, German industry would have ground to a halt for a considerable length of time at a critical juncture in the war, summer '43. It might have shortened the war by perhaps 6 months because German industry could not decentralize ball bearing production or find alternative technology fast enough had we been able to press home the attacks.

As it was, the US 8th AF was mauled because it lacked the long range fighter escorts. It lost 60 B-17's on that one raid alone and could ill afford any more losses. They repeated the attacks in October along with a strike on the Messerschmitt plant at Regensburg with similar disastrous results. Daylight ops were called to a halt in order to take stock, and then build up strength in the air campaign to interdict Normandy before the invasion.

369 Killing Americans = Fewer Americans = Healthier Planet

Lazier Americans could help, too:

Want to reduce the effects of global warming? Stop working so hard. Working fewer hours might help slow global warming, according to a new study released Monday by the Center for Economic Policy and Research.

A worldwide switch to a "more European" work schedule, which includes working fewer hours and more vacation time, could prevent as much as half of the expected global temperature rise by 2100, according to the analysis, which used a 2012 study that found shorter work hours could be associated with lower carbon emissions.

The Center for Economic Policy and Research is a liberal think tank based in Washington.

Didn't Obama argue that Terrorism was a law enforcement issue? That makes terrorists like Al Quaeda gang members, right? 442 Hmmm. Are we sure Ambassador Stevens wasn't "accidentally" killed in a drone strike? Like, a "collateral damage" sort of thing?

448 "That was DURING a declared war. All's fair, remember?
Were are the drone attacks occurring? Pockeeestahn? Are we at war with them? Didn't they say the war is over and Alkaida is on the down slope? No more terrorism, just man caused disasters?
Exactly what rock are you living under?"

Congress, citing the authority of the War Powers Act, authorized military strikes on AQ on Sept. 14, 2001. Yes it's a declared war. End it or celebrate it.

"It was not a guess. Albert Speer confirmed after the war that had the strikes been repeated several times, German industry would have ground to a halt for a considerable length of time at a critical juncture in the war, summer '43. "

That makes it a GOOD guess.

"What if an American citizen went to Germany during WWII and joined the Nazis, not taking up arms but rather a propaganda man. Could we target him for elimination?"

Of course.
Just as a cargo ship flying the Stars and Stripes entering a Japanese port in 1945 would have been torpedoed by the US Navy.

Dude, you are either naive or you have no idea how this administration works.
1) When the Obama administration executes "someone" and deliberately does not disclose the name of the target, it's likely you will never "find" that person(s).
2) The Obama administration has not even released the DoJ white paper, much less the internal DoJ memos covering drone strikes on US citizens. All we have at the moment is NBC's copy of the DOJ white paper. And you know how reliable NBC is.

Nothing darkly comic at all. Obama (and his entire ilk) are lightweights or worse, irresponsible clueless ones, and they of course trashed sensible policies (including drone strikes and enhanced interrogation) as is their fashion for every policy of the "other" side.

Once in office, though disastrous irresponsible actions and policies came naturally to them, they of course continued with some of the policies, fearing more attacks on the US "on their watch". Duh.

A darkly comic hypothetical would be an entire unit of sophisticated AQ terrorists poised to wipe out the families and friends of Reason editors/authors/readers. But US intel has found them out, and is poised to drone-strike the ringleaders before the plot can be executed.

Damn! This particular AQ cell is composed ENTIRELY of US citizens! What to do! What to do! The dumbest, least vexing conundrum in the history of minimally vexing conundra. Hit them. Duh.

To the bizarre little kids at Reason, the constitution is not just a suicide pact, it's a guarantee of the "right" of US citizens to wage war on their country and fellow citizens. Hmm, not really comical at all.

Arabic, no.

As far as Mediterranean, it depends on how you classify it. I've got Italian female relatives with moustaches, but not full-on ZZ Top beards.

458 This pains me to say it, but the memo is correct. What's more, it was probably the same guidelines that the Bush Administration operated under. The memo specifically limits the justification to Americans in foreign territories where capture is not feasible. The memo does not justify drone attacks on US citizens in US territories.

459 It's terribly ironic that so many of the putative "conservatives" of the Internet (cough) appear on this subject to bejust as weak minded and just as effeminate as the left. 466 THIS is the left 'not saying anything'?

http://www.emptywheel.net/

Just go down the list of entries. Every second one is an indictment of the drone killing power.

And there's lots more to go with that: there are articles on the DAILY KOS, articles at SLATE, articles at SALON, articles at what's left of FIREDOGLAKE, at LAWYERS,GUNS&MONEY, at the lawyer site BALKINIZATION; they've all criticized Obama for this, condemned him, damned him even for imitating Bush the Yute [How much more can you ask, yet?].

So Ace: you're dead wrong.

And you're dead wrong for one of two reasons ... or maybe both:

1. Ace, you're just crappy at research. I know, I know, you actually have to go to lefty sites and click them on and [shudder] read them, or at least the headlines; but you're not even putting out that minimal effort.

2. You're somehow hoping, I'm serious here, that somehow the left is going to do the Republicans' dirty work and get the DEMs to go after him.

Or, as I said, both; I think both.

You're as transparent, emasculated and delusional as the Congressional Republicans, Ace.
