Good Morning Morons. Today is Saturday, February 02, 2013. Today is Groundhog Day. The celebration began as a Pennsylvania German custom in southeastern and central Pennsylvania in the 18th and 19th centuries. It has its origins in ancient European weather lore, wherein a badger or sacred bear is the prognosticator as opposed to a groundhog. It also bears similarities to the Pagan festival of Imbolc, the seasonal turning point of the Celtic calendar, which is celebrated on February 1 and also involves weather prognostication and to St. Swithun's Day in July.

5 Looking at the forecast for Punxsutawney, Pennsylvania today it appears that it will be overcast and snowing all day. So they will not have a late Winter. It will be partly cloudy here today but I don’t have a whistle pig anywhere around to check. But what is really funny is it is colder here right now than it is there.

24 And to close out the “news” a kinda “on this day” thing. Today is the 100th anniversary of the opening of Grand Central Station (Terminal) and I thought it would be interesting for the Morons to recount an episode as to why it has reached 100.


In 1968 Penn Central, the then owner, wanted to demolish the terminal and build a huge new skyscraper. The city of NY through its “historical” Landmark Preservation Commission said nyet. Penn Central sued. It went all the way to the Supremes in Penn Central Transportation Co. v. New York City. Unfortunately for Penn Central and for freedom in the US, the court was then even more liberal than it is now. They came up with some more bullshit that further eroded private property rights in the US.

Unlike the governmental acts in Goldblatt, Miller, Causby, Griggs, and Hadacheck, the New York City law does not interfere in any way with the present uses of the Terminal. Its designation as a landmark not only permits but contemplates that appellants may continue to use the property precisely as it has been used for the past 65 years: as a railroad terminal containing office space and concessions. So the law does not interfere with what must be regarded as Penn Central's primary expectation concerning the use of the parcel. More importantly, on this record, we must regard the New York City law as permitting Penn Central not only to profit from the Terminal but also to obtain a "reasonable return" on its investment.

What was this “present use” bullshit? The owners of the property wanted to use it in a different manner to further maximize their return and the government prevented that. In effect, the government said we will tell you how to use your property even though the new building would meet all other zoning codes. The “doesn’t interfere with Penn Central’s primary expected use” was an outright lie. Further more, it is not the business of the courts to determine what a “reasonable return” is. This ruling was pure bullshit justification to satisfy Jackie Kennedy.


So what was the outcome? Penn Central shut it down and went bankrupt. It became an open toilet and hangout for bums and grifters in the heart of Manhattan. Eventually the MTA took it over and is running it mostly now as a tourist trap. I am sure NYC maintains that it is a profit center and I am also sure that it probably cost the NYC taxpayer millions of dollars, not counting the lost tax revenue from the building that would have been there.


So everyone keep that in mind when you read all about this wonderful building today. It was one of the early regulatory “takings” and SCOTUS shit all over private property even then.

This might be a lightning rod but Grand Central Terminal is one of the city's gems. It generates income for its tenants as well as ancillary businesses in the area because it is a major tourist destination.

It's also one of the most beautiful structures in America, as was the original Pennsylvania Station which was demolished in 1963 before it could be saved.

There were many factors involved at the time, most notably the fact that private passenger railways were becoming extinct as was the Penn Central, which arose out of the ashes of former industry titans and rivals NY Central and Pennsy RR. The buildings would have been sold off anyway and in this instance, I think it was the right outcome.

I don't think we will ever know if GCT makes money for NYC or not. I wouldn't trust the accounting of MTA any more than I would trust Obama.


What we do know is that the trains can't even make money selling liquor. I am sure that any city run enterprise would be the same way.


But regardless of whether it is making money or not, the city had zero right to tell the owners they could not shut it down and use it for something else without condemning the building and paying for it under imminent domain.

Agreed, Vic, on all your points vis a vis the government. But the terminal is such a great place, considering how horrible it had become.

Undoubtedly, had the owners of the building had their way, it would have been demolished or so altered as to have destroyed the character and beauty of the structure. Not saying it would not have been within their rights to do so, but it would have been a terrible loss, as was Penn Station; Madison Square Garden is hideous. What would have been fair was purchasing the building from PennCentral Corp for the fair market value.

Anyway, it's a real ticklish situation.

55 I worked at a book store as a night and weekend manager for a few months right before law school trying to save up a little extra money. I remember thinking, OK, retail sucks but hey this is a bookstore, as good as it gets in a mall, right? Umm, actually no as it turns out.

I had an employee that stole from the till, the regular store manager just put on headphones and angrily slammed things around while she was stocking, someone once peed in our corner trash pail, people regularly damaged books themselves and then asked for a discount, and even the main reason I wanted to work there -- the books, themselves -- turned out to be a crushing disappointment.

Can't disagree with you, Vic.

The whole "preservation" thing is emotional. No compelling reasons other than keeping something beautiful and/or historic around to enjoy. No profit motive or anything like that.

I hate to see it handled by the government, anyway. Just grabbing someone's property (for any reason) without full compensation is abhorrent. But my emotional side tells me that the alternative can be worse. And, frankly, since much of the "profit" in demolishing a structure like GCS could well have come in the form of tax credits, gimmes from the city and possibly other unearned subsidies, I say fuck 'em.

Don't put me in the Choom Boy "you've made enough money" crowd, Vic. I do think that free people need to behave responsibly, though, whether carrying a weapon, driving a car or owning something iconic.

"Essen" is straight from the German -- a language that frequently delights and amazes. There are two words for the verb "to eat" -- essen and fressen....and the difference is......humans essen and animals fressen. It's sort of like "to dine" and "to snarf".

My favorite one, though, is that the more common ways of saying "woman" are female ("die" -- pronounced "dee") for married women......and neuter ("das" -- pronounced "dahs") for single women. It's "die Magd" -- roughly, "the Maid" -- but "das Mädchen" (the maiden)....or "die Frau" (the Mrs.) -- but "das Fräulein" (the Miss).

The other neat thing about electronic medical records is that it enslaves the doctors as well as the patients. Doctors also can't focus on the patient because the computerized record-keeping keeps distracting them from the patient. If they don't do all the required e-work, they will get a visit from HHS. After all, since we are all paying for your care, the health czars need to understand your needs, comrade! One GCT anecdote: I did a photoshoot there post 9/11. Not knowing any better, I started to set up my tripod down on the main concourse ... and a couple of uniformed NYC cops were on me in a New York microsecond. I was lucky not to get arrested. Turns out you can use a tripod, but only with permission from the Stationmaster and only for a very specific window of time. So I did that and got the shot done late on a weeknight when the building was mostly deserted, and came away with one of my all-time favorite photos. A great building, one of my favorites in NYC.

209 It's sunny in my part of PA too, though it's supposed to cloud up later, and snow. Not that I'm going anywhere. I've laid in critical supplies of beer, and smokes, (roll your own....6.50 for a whole carton. I love it). Not for the super duper bowl....which is like...bleh, but for my planned Kerbal Space marathon. I've been to the Mun so many times now, it's immediate vicinity is cluttered with bits and bobs of previous missions....empty fuel tanks, and the like. I even have a stranded Kerbalnaut on the surface that I still need to rescue. (I sort of oopsed on the lander's eva ladder, and the poor little Kerb can't get back inside.

You're overlooking the cost of maintaining a building that old and out of date in so many ways.

It is very expensive to retrofit many of the utilities and other upgrades that we take for granted. Even in Ancient times like 1968 they were having problems.

Heat, A/C, electric, communications, water, sewerage etc are difficult if not impossible to route in an old structure especially one such as that.

The cost to heat and cool it alone would require it's demise.

I'm quite sure, as Vic said, that they lose money on it every year.

Besides, if someone wants to preserve architectural history, they are quite free to purchase the building and preserve it on their own.

Why do liberals always think it's ok to saddle someone with the costs of their whims?

Ace is losing a fair amount of potential revenue with the way Amazon is linked to here.

Up until recently, I was the full time at home care giver for a 100+ year old family member.
Alzheimer, diabetes, breast cancer and bed ridden except for when I physically lifted and carried her.
I found that many of the items that we needed could be found on Amazon, and at a very good price.
Plus, it would sometimes become a challenge to be able to simply get out and to the store.
Amazon was a lifesaver,
And I would have loved to share some filthy lucre with the head Ewok.

That is correct. However, HIPAA, (I think that's the right spelling) makes it illegal to deny you ACCESS to any electronic records that they hold.

This goes for x-rays, other diagnostic tests, Doctors orders ( but not their personal notes) and other hospital records.

This is also true for your family doctor. If they transmit even one electronic record (which they most always do) they are covered under this law and must turn over copies to anyone requesting them.

They ARE allowed to charge reasonable fees for the production of those records. For expendables, like paper or xray film (although most hospitals now have xrays on disc) and the labor required to fill the request.

They may tell you that they can't unless the doctor agrees but they're wrong and usually the doctor will agree to release anyway. However there is little penalty for them to refuse so if they become recalcitrant, you may have little recourse.

HIPAA- the health privacy act is there to prevent your doctors or nurses from telling your friends and neighbors that you in the hospital, or have recently been in the hospital and why you were there. It does not stop the hospital or clinic from giving that information to the government (if you have Medicare, Medicaid or VA benefits) or your insurance provider. When you sign your consent to treat, this is part of the consent.
Here in the great state of Texas, the hospital is required to notify the state if you have a communicable disease (most of which used to referred to as Venerial Diseases) but also others like small-pox, chicken-pox, tuberculosis. Depending on the disease, the state may be contacting you and those with whom you have been in contact. I imagine this in the case in most other states as well, but can't say for certain.
The scary truth- the hospital I work at does electronic charting via the internet to an off-site server. I hope that they have some nice encryption-even so, I imagine that it is vulnerable to hacking.

Last year, I had a little fucking ninja mouse hanging around the shop, climbing over spare parts. He'd snake all the peanut butter from every trap. Nightly. After about two weeks of feeding the little bastard, I changed tactics. I set up a long narrow box with two traps so that he would be forced to climb over one trap to get to the bait in the other.

Worked like a charm, although he had this really odd surprised look on his face in the trap.

There are always more. I have an unfinished basement, and the ceiling is fully insulated....the little bastages were nesting in that. I pulled it all down, dropping a couple nests of pinkies to the floor...disposed of those by stepping on them, then trapped the entire house.

Oh, and a trick that works well when using peanut butter....tie a bit of yarn on the trigger pan, and smear it with peanut butter. They'll tug on that, and reliably set the trap off, instead of just licking the peanut butter off without triggering the trap.

I've got an AK-style Russian sniper rifle that shoots .308, a VEPR II, but I have been wanting an American style that could take the same round..223 is a great round, but .308 is a real man's round. And amazingly, even though the rounds are a bit more expensive than .223, you can still actually find them available in some places.

Though I think those that try to justify pirating entertainment and software as some sort of noble endeavor are dolts, I'm enough of a hypocrite to do it myself when it's Hollywood I'm trying to not give money to. Torrents are my friend.

I'm now glad I used a cracked version of Quicken to do my taxes. Stealing? Yea. I guess I have a flexible morals issue. I'm trying to feel bad about it but am having trouble.

347 Is out too late in the day for a Caturday Tail?

A couple of years after two barn cats had started us off with seven kittens, wild momma #3 showed up. She had been an occasional visitor which we hadn't seen for a while, when she showed up with her brood of five kittens, then died, when they were barely weaning age.

Three of the kits were identical, all white, except Beauty had a faint gray streak across one side of the top of her head, and Grace had its mirror, so we could tell them from Snowy.

One  got stepped on early, in our houseful of kids and kits, and that was the end of Beauty.

Snowy was the only cat I ever had to go scrape off the road. We know a service truck came by while we were gone that day. We figure curious Snowy got on the truck, then jumped off just outside the gate, and, I hope, died immediately. One of our sons had 'specially taken to Snowy after a previous white cat had met an untimely end. That was hard.

Not long after that, Grace's gray streak disappeared. No longer needed, I guess.

Grace long outlived her four siblings. She developed cancer common to white cats, but lived with that several years before it got bad. She was old. She had that waddling hanging-down belly some old cats get. A really nice cat. Left white fur everywhere, of course. The price we pay.

When we buried her last year, it was the end of a long chapter which had begun with that stray dying mama bringing us her babies. The last of that brood of five, And the last of the white triplets.
