17 This illustrates how screwed up our immigration laws are. Yes we do need some damn reform, but not what the gang of 8 asswipes called for. Obama’s drunk driving uncle is an illegal alien who was ordered deported 21 years ago. Because he violated that order he gets another immigration hearing and if it goes like the last Obama relative illegal he will be granted a green card. Once order deported illegals should be detained until arrangements are made and then they should be escorted to their home country and left. And if they somehow escape deportation there should be no more “hearings”, only deportations.

You know what? I turned my stinkin' anti-v software off ages ago. Between the performance hit and the blocking of legitimate sites I just don't think it's worth it.

I have purchased meds over the net for almost ten years from a legitimate company and in the last year the anti-v site wouldn't allow me to visit them anymore. F*ck that. Some group working for a US drug company probably all made a claim to the anti-v company and got them blacklisted.

Long-time California raisin farmers Marvin and Laura Horne have been forced to experience firsthand the costs that America’s regulatory state imposes on entrepreneurs, especially innovative members of the agriculture industry.

No longer do farmers enjoy the ancient right to sell their produce and enjoy the fruits of their labor. Indeed, Horne v. U.S. Dept. of Agriculture exemplifies the extent to which all property and business owners are made to suffer a needless, Rube Goldberg-style litigation process to vindicate their constitutional rights.

In this case, the USDA imposed on the Hornes a “marketing order” demanding that they turn over 47% of their crop without compensation. The order—a much-criticized New Deal relic—forces raisin “handlers” to reserve a certain percentage of their crop “for the account” of the government-backed Raisin Administrative Committee, enabling the government to control the supply and price of raisins on the market. The RAC then either sells the raisins or simply gives them away to noncompetitive markets—such as federal agencies, charities, and foreign governments—with the proceeds going toward the RAC’s administration costs.

Believing that they, as raisin “producers,” were exempt, the Hornes failed to set aside the requisite tribute during the 2002-2003 and 2003-2004 growing seasons. The USDA disagreed with the Hornes’ interpretation of the Agricultural Marketing Agreement Act of 1937 and brought an enforcement action, seeking $438,843.53 (the approximate market value of the raisins that the Hornes allegedly owe), $202,600 in civil penalties, and $8,783.39 in unpaid assessments. After losing in that administrative review, the Hornes brought their case to federal court, arguing that the marketing order and associated fines violated the Fifth Amendment’s Takings Clause.

After litigating the matter in both district and appellate court, the government—for the first time—alleged that the Hornes’ takings claim would not be ripe for judicial review until after the Hornes terminated the present dispute, paid the money owed, and then filed a separate suit in the Court of Federal Claims. The U.S. Court of Appeals for the Ninth Circuit proved receptive to the government’s reversal. Relying on Williamson County v. Hamilton Bank (1985)—the Supreme Court case that first imposed ripeness conditions on takings claims—the court ruled in a revised opinion that the Tucker Act (which relates to federal waivers of sovereign immunity) divested federal courts of jurisdiction over all takings claims until the property owner unsuccessfully sought compensation in the Court of Federal Claims. In conflict with five other circuit courts and a Supreme Court plurality, the Ninth Circuit also concluded that the Tucker Act offered no exception for those claims challenging a taking of money, nor for those claims raised as a defense to a government-initiated action.

The ruling defies both law and common sense. It stretches the Supreme Court’s ripeness rule beyond its moorings and it forces property owners to engage in utterly pointless, inefficient, and burdensome activities just to recover what should never have been taken in the first place. Having filed an amicus brief that supported the Hornes’ successful petition for Supreme Court review, Cato has again joined the National Federation of Independent Business, Center for Constitutional Jurisprudence, and Reason Foundation on a new brief that urges the Court to affirm its plurality decision in Eastern Enterprises v. Apfel (199, which held that an unjustified monetary order is inherently a taking without just compensation. Any ruling to the contrary imposes a pointless burden on property owners, particularly when the government initiated the original proceeding.

We argue that the Ninth Circuit’s overbroad reading of Williamson County stretches the ripeness doctrine beyond any sensible reading; it allows the government to initiate a claim and then block an important constitutional defense on the fallacious notion that it has been brought prematurely. We advocate a rule that is more compatible with the history and text of the Fifth Amendment—that the most natural reading of the Takings Clause demands that compensation be offered as a prerequisite to government action. Indeed, from the time of Magna Carta, just compensation has been required before property was seized.

Moreover, just as the Court wouldn’t permit the government to seize property without some prior “due process of law,” it shouldn’t permit the government to seize property without prior “just compensation.” The Court has no reason to treat takings claims with less deference than rights anchored in other constitutional provisions.

Horne will be argued at the Supreme Court on March 20.

J.J., don’t even get me started on the fishing regulations up here. Gloucester has been screaming at the feds until they’re blue in the face, but the government is convinced that Georges’ Bank and Stellwagen have been criminally overfished, and that of course a paper-pushing bureaucrat in DC knows more about fishing than some brine-soaked, Mickey D’s-eating peasant. If they had any balls, the fleets would give the government the finger, go out fishing and force a showdown with the Coast Guard. But, this being Massachusetts (and New Hampshire is now basically Massachusetts North), they’ll all whimper “thank you, sir, may I have another?” and skulk away.


So. RIP Ed Koch. He had his moments, but he was too close to the Donald Manes machine to be as independent as he liked to pretend he was. Still, at least he was Democrat who loved America more than the Party. There are what, about three of them left?


And RIP Patty Andrews. The sisters were almost exclusively known to the public through the 13 low-budget B movies they starred in at Universal, cheaply shot quickies that, as one of them said, had them looking like “the Ritz Brothers in drag.” Shooting schedules were rarely longer than ten days and the sisters had to come up with their own choreography, which is why so often Patty and Laverne just sway in the background as Maxene tries to goose the number along.*


If you were like a lot of people and checked out the Boogie-Woogie Bugle Boy number from Buck Privates on YouTube yesterday, you’ll see, in the cramped performance and static camera, the secondhand cheapness that characterized Universal musicals and so demoralized the sisters.


For one movie, they were lip-synching to the song Pennsylvania Polka. Maxene was concentrating on the dance more than the song, and made a mistake in the lyrics. Realizing that anyone watching the movie would know she’d flubbed, she called a halt. “Why did you stop? It was going along beautifully,” the director said. “I made a mistake in the lyrics and was out of sync,” Maxene explained.


The director pointed to a young man standing just off the set whose job it was to catch mistakes. “Well, he didn’t see anything. Don’t stop like that again. You’re costing us money.”


The sisters swung into the polka again, and once again Maxene flubbed the lyrics and stopped the number. This time, it was Patty who pointed to the fellow just off set. “He didn’t say a thing– how do you know you made a mistake?”


So Maxene walked over to him. “Young man,” she said, “you saw I was wrong. Why didn’t you stop me?” The fellow just looked at her for a moment before he answered her with a long burst of German. It was then that Maxene – and everyone else on set - realized he couldn’t speak a word of English!


It turned out that he’d escaped from Nazi Germany and had been given a job in Universal’s music department.

I often have insomnia and because of the dearth of radio stations which have decent reception at night, I often find myself listening to that stupid Coast to Coast AM program.

That show is a menace. First of all, the host is left-wing and subscribes to the usual Truther crap.

However, if he would stick to UFO's and ghosts and such, it would be tolerable. What really gets me is that he gives a platform for false and dangerous information, such as curing cancer by diet alone, ethanol is GOOD for your engines, doctors know that there are cures for diseases but want to keep business so they don't tell anyone, etc.

These are all authors or "experts" which the host interviews with the critical scrutiny of the White House press corps interviewing Obama.

In addition, crazy people have their craziness reinforced with the call-ins, who have wild tales which are accepted without question.

The show is flat-out dangerous, and because it is the only thing many people can listen to while driving overnight or working the graveyard shift, wacko ideas (including political ones) are spreading across the country while we all sleep (well, except for me, the insomniac).

Hilarious (to me) story I heard years ago from a guy who worked the Saudi oil fields. Guy said that whenever he flew home, the usual number of Muzzies would also be on the flight with their wimmins, dressed in the usual all-concealing potato sacks. Except that about the time the plane cleared Saudi airspace, one by one the burka-clad females would get up, wander off to the lavatories, and emerge later wearing, um, "Western" garb. That is, sprayed-on tight jeans, low cut blouses (to let the boobehs breathe I suppose), no scarves of any kind, etc.

With 3 kids under 3 years old, they both work their asses off to pay their share of the premiums and the copays and deductables. If they both quit their jobs, they would have far more money and no medicals bills to worry about.

176 Hi Tami.. doing better. I was on the ONT last night for a bit to catch everyone up. My MRI showed a piece of disc sitting on a nerve and he was going to go in and remove that piece and all would be well. Only problem was, he gets in there and there is NO ruptured disc. The MRI was junk, inaccurate, whatever you want to call it. It was MY MRI however because it also showed that growth on my kidney, which after unltrasound proved to be a harmless cyst. So.. there was no MRI mix up. Soo.. this guy goes in and goes "What the hell?" So he basically did some exploratory work, moved any nerve he thought could be a problem, cleaned the L5 disc up. I was still feeling that old pain the following morning after surgery, but by afternoon it was gone. I am in the so far so good category. The incision hurts and a small amount of nerve pain (the old pain) but it is basically right in the area where he operated so I am thinking this could be very normal until that area heals. I was under for about 4 hours and was sicker than a damn dog for several hours. Even just talking made me nauseous!! But feeling pretty good today. I think it worked. Cautiously optimistic!!

The reason is the same as for health costs - the presence of federal money which is artificially inflating the ceiling of "charge what the market can bear."

Consider Vioxx. Let's set aside the heart trouble for a second. Blinded controls showed Vioxx was no more effective than aspirin (or Ibuprofin, I forget which, point is, cheap stuff.) It's major benefit was that it had less negative effects on the stomach. Which was great for people who had stomach problems, but the vast majority of people on Vioxx didn't benefit from that. So instead of treating people with an equally effective and signficantly cheaper drug (asprin), doctors (and patients) caught up in the "NEW THING!" phenomonon dumped billions down the drain.
Now the heart side effects only amplified the costs.

216 I guess I also should say something about Ed Koch, given that as someone who grew up in NYC in the 1970's and 1980's I had a front row seat.

Koch couldn't carry Giuliani's jock strap (few mayors in history could), but truth be told Koch at least had the brain power to allow himself to get mugged by reality and on a few subjects to morph into a conservative.

Immediately upon taking office he slashed spending. Budgets were cut and people who didn't like it, including of course the media, were told to pound sand. And the city's finances were turned around. Then a couple of years later Koch took on the transit workers' union and told them to pound sand. And he broke the union and ended what could have been a disastrous transit strike.

Koch didn't completely clue in -- he was insouciant about how to fight crime and didn't follow up his evisceration of the transit workers by taking on the other public unions -- but overall he did a pretty good job.

I should have mentioned that the 3 year old and the 1 year old twins have all had medical problems, but nothing out of the ordinary.

Ear infections, running temperatures, all the normal childhood stuff. My daughter had some minor surgery and her husband is in the middle of some gastro-intestinal problem.

How in the fuck do people without a support system (parents) get by? The amount of money just for diapers and formula is staggering.

The HHS team that does this (usually on behalf of Medicare) is actually kinda scary. Not in a SWAT team way, but in an "wow that guy is gonna be miserable way" (Well not in this case this guy is connected. But your average plebe.)Much of the fraud we catch is huge millions of dollar fraud, so it does take a team secure and collect the information.

Will do! So far it's just the itchy tongue and a LITTLE bit of weird throat feeling and chest tightness. And I think maybe some hives. But I can still breathe, so I'm hoping it's just some other random stupid thing that protein drinks have in them that's screwing with me.

I really do hate having this stupid allergy.

And yes, for all who have kindly asked, I do have my epi pen, so no worries! And there are others in the office with me, so if I need to be zoomed anywhere they can help me.

The serious point I made after being my usual snarky bitch self was that, given the proliferation of the regulatory state combined with near unlimited prosecutorial discretion, we were living in a land that supposedly was under the rule of law but was actually ruled by whim. 295 Regarding lasik. Investigate getting only one eye done. I was near sighted, and got only my right eye, which is my master eye, done. I can see far, I can still read without glasses. I do have a hobby which requires vision to about 6 foot away (music) that I need glasses for, but other then that I"M FREEEEEE.

My M-I-L has a siezure disorder, once at the grocery store checkout she had a small seziure (not a Grand Mal).My wife just calmly sat her in her walker and I continued to pay the bill. Meanwhile, the checker (and now security) were freaking out. They seemed concerned that we were so calm about it (you think they'd be happy we were calm.)Stunningly they couldn't even cope with the 1 thing I asked for when they said "Do you need anything?! Like an ambulance?!" and I asked for a chair. Couldn't get that, they kept insisting on the ambulance .

Years ago the back cover of an NRA magazine was an ad by a major handgun mfgr. (can't remember which) listing all of the federal agencies they supplied handguns to. The list of agencies covered the back page and included lots of agencies I never thought would have anybody armed.

I also saw a show several years ago where the FDA or some other fed agency was harassing some sausage maker to replace all of the the equipment his father had used to make sausage for over 50 years. The stuff was a real hit in the neighborhood and all of the restaurants carried it because it was huge seller. Trouble was, the govt passed a regulation saying the sausage had to be heated five degrees hotter during manufacture. They were coming armed for a final confrontation with the guy but he had already snapped and was armed and waiting. The end result -- a government sponsored blood bath.

2 problems with that: #1, you pay the fine even if insured if you don't have a "qualified" plan, no plans bought since 2010 are eligible to be grandfathered in.#2, They tried that in Massachusetts, which has the same "qualified plans" rule. A national insurance company came in and started marketing unqualified plans, basically $5000K deductible major medical plans. They marketed them as "unqualified", and part of the paper work required to sign up was acknowledging that buying this plan meant one would still have to pay the "uninsured" fine. Still, the cost of the plans plus the fines was many thousands of dollars (sometimes $10K or more) less than what "qualified plans" cost, and there was HUGE demand for these policies. The Mass. AG went after then with their huge lawfare teeth bared for basically "Defying the will of the people of Mass. as expressed through the duly elected legislature" and drove them out of the state. Look for insurance companies to try and stave off bankruptcy by offering "accident only" plans when January rolls around, and look for the same thing to happen to them.
