San Diego Chief of Police: We Can Disarm America "Within a Generation"

As the goal is admitted, let us have no more discussion of these ridiculous diversions.

The goal sought is disarmament, period. Accomplished bit by bit. But none of those bits are "reasonable" or "common sense" as they are admittedly simply elements of the intended goal, which is complete disarmament.

If the goal isn't worthy, then none of the steps towards it should be undertaken.

Posted by: Brandon In Baton Rouge at January 28, 2013 03:11 PM (e0xKF)

82 That is what "Universal Background Checks" are all about. Registering every gun sold, given or inherited in a master file. YOU also have to pay for the transfer background check, basically a tax on gun transfers.

Then if your gun is not in the file you will be accused of having a stolen gun.

Register, then take. UBC must be stopped, it is not benign.

NYPD cops are only issued either true double action only guns or striker-fired autos (like Glocks) with artificially heavied triggers to simulate a double-action pull. In fact this modification to the Glock is actually called a "New York trigger".

There is one exception that older cops who originally qualified with other guns can still keep them. So some desk-job sgt can keep his 1980s issue snubnose.

1911s were never standard issue for NYPD cops (ie ever) and I bet this guy doesn't qualify to carry one under the rules everyone else has to follow.

The problem is Trust can not buy guns, only people with an id can. There is no real way to transfer a gun already in possession to a trust. You need some proof of the transfer. That would mean selling the guns to the trust. The trust can not get approve for the sale.

See it's a circular argument. A bill of sale to the trust would not remove the name of the last owner, UNLESS that owner had an Id. This is why there are FFL's that own the guns before you buy them.

No, its a loophole for the NFA (national firearms act). You can also use an LLC, but you'd have to pay a tax. They've been in existance for over a decade. They key would be to put in a clause removing perpetuities (say placing the trust under Florida law)

2014: Dems take the House. Outcries about voter fraud go nowhere. A few prominent conservatives publicly declare the time for deciding issues at the ballot box is over. Most Republicans call them dangerous radicals. Militias start to form in most red/purple states.

2015: Gun confiscation measure passed. Several violent stand offs occur, militias start opposing federal actions. Obama declares a state of emergency. Most establishment Republicans join the "Democrat-Republican Unity Party"

2016: 22nd Amendment repealed. President declares martial law.

Nah- they wouldn't go door to door to bust in and confiscate them. They'd just make sure that you could never carry or use it without fear of arrest.

Any firearms people didn't turn in would become illegal and thus black market guns. But don't worry- I'm sure that the criminal element would never get involved in the black market.

I think it sounds like a clever lawyer scam. Presumably, the Trustee would be the person with ID. And the Trustee is going to be the lawyer. Jefferson and others didn't think it would last two generations.

What's amazing to me about the Founders is that, unlike pretty much every intellectual movement that came after, the Founders didn't think they had the answer to everything.

They thought about structure and figured that almost every new idea was a bad idea because...it wasn't new.

The big problem with all of these Left-wing movements is that they all agree that things need to "change" and they all have in mind what the change should be. However, it's all different.

I will tell you its routine for NFA goods. A lot of people place their NFA items in the trust in the first place, and many gunstores here in Texas have a lawyer they will refer you to or have a form sitting by. I think the ATF just checks the trustee's info. The NFA check is also way more streneous than a regular check, so if it passes that, a regular check is no problem at all.

Anybody think this fascist blackshirt has any intention of disarming himself or his troops.

Ask yourself this. What is the justification for arming police any
differently than civilians? (Moreover, what is Feinstein's
justification for allowing RETIRED cops to have greater rights under the
Second Amendment than anybody else?)

Under our Constitution, a police officer’s right to use a firearm is
governed by standards that are identical to those that govern a
civilian’s use of a firearm. A civilian police officer has no lawful
right to use a firearm that is greater than, or is any different than, a
civilian’s right.

Supreme Court authority about this is monolithic. A police officer
may only use deadly force to defend himself or another from a
significant threat of death or serious physical injury. That is
precisely the same standard governing a civilian’s use of deadly force.
Given that the standards are identical ,then it only follows that police
officers have no right or necessity to be armed in any way superior to
civilians. If a police officer or Secret Service agent "needs" an M-16
to defend himself or others from a significant threat of death or
serious physical injury, then so do I.

Please, push back on this. I’d be interested to hear the counter-argument.

251 In the four years since Barack Obama was first elected president in November 2008, an estimated 67 million firearms have been purchased in the United States. That’s more than were sold in almost seven years before his first election.
December 2012 saw a record-shattering number of requests for criminal background checks on prospective gun buyers — more than 116,000 of those from Kansas and Missouri alone.“Since Obama was re-elected,” said Gary Jessup of UT Arms in Kansas City, Kan., “it’s been off the chart.”Nationwide, more than 2.7 million of those checks were recorded for December, according to statistics kept by the FBI. Since late 1998 when federal law began mandating such checks for prospective gun buyers, the only other month that exceeded the 2 million mark was November 2012 — when Obama won a second term.

252 @236

I have no desire to have any Class Three shit. I thought this idea was for transferring guns to an LLC and then having the Trust own the LLC. I see no way you can purchase a handgun in the state on NC in an LLC.

If you have a Class Three license, you are basically a dealer. Setting up and LLC to become a dealer would be the norm. How does that help me? I don't see how. I am not going to get fingerprinted, etc to get a Class Three license.

256 There's no direct link to the interview that I could find. The video at the linked article is a different interview, in which he doesn't say anything about disarming all Americans.

All I could find about the controversial statement was this summary: "San Diego's Lansdowne, who plays an active role in the western region of
the International Association of Chiefs of Police (IACP), said in the
interview it may take a generation, but guns will eventually be taken
off the streets through new laws."

This is pretty vague. Did he say *all* guns would be taken off the streets, or just some of them? He seems to be concerned about military-style assault rifles (yes, I know this is hard to define), but not handguns, shotguns, etc.

It seems to me that he probably didn't say what people are claiming he said.

Its not a class 3 license. Paperwork is the same. You can use a trust, or an llc.A lot of people go the trust route. The sample I'm looking at has regular guns and a special section for NFA ones to be owned by theLLC.Why couldn't you buy a regular handgun and then transfer it to an LLC? Class 3 is more stringent, so if it works there, ergo it should work for regular firearms.

Posted by: Jollyroger at January 28, 2013 03:58 PM (t06LC)

259 Yeah, total disarmament is the goal. We, who Ace once described as "gun dick strokers" have always known this. This knowledge is the source of our radical opposition. I'm glad so many who could not see this perviously are now enlightened.

260 Buy it in your name, transfer to the LLC. Have a receipt. Done.

Posted by: Jollyroger at January 28, 2013 03:49 PM (t06LC)
That was my point earlier. Having a receipt from the LLC will not get my name off the gun. The burden, if anything is done with the gun, will be on me to prove I sold the gun. Trust me, I know how to own shit in LLC. ALL my cars, boats and other toys are in my LLC's name. I highly recommend that for your cars especially. They can not run a trace on my LLC to see who is driving or whether or not I have a CC.

Of course, the same twits who'll gladly talk up WSB's free stance regarding their vice of choice always dismiss this by telling you that WSB famously, drunkenly William Telled his wife with his pistol, and hid behind his family's money to evade the law. As if that delegitimizes the separate sentiment and ends the subject. God forbid they reply the same about Ted Kennedy necessitating strict car control.

264 260 Billy Bob,

Billy Bob if you are the controlling officer of the LLC the LLC has ownership of the firearm you carry.

You seem like a savvy guy talk to 2 groups.

1) an armed personal protection company and see how they handle company guns for carry and what laws are involved and

2)an indoor range that rents guns.

You are either adding unnecessary complexity to the paradigm or not in NC only way to find out is to ask or hire a lawyer.

Posted by: sven10077 at January 28, 2013 04:02 PM (LRFds)

265 Lansdowne believes that the shooting in Newtown, Connecticut weakened the gun lobby's power and has opened the door for new gun control legislation. "We broke the NRA," Lansdowne said off-camera.
By broke I guess he means doubled their membership.

And even though the Chief Kelly in NYC conceded that most of the crimes are committed overwhelmingly by illegally possessedhandguns he still supports the AWB and puts the blame on the high gun related crimes in NYC to other states and their ability to sell these devil tools.

Posted by: polynikes at January 28, 2013 04:04 PM (m2CN7)

266 @260
What are you trying to get out of exactly? As of right now there is no restriction on transferring guns. Do it now, they pass someting later, you're grandfathered and they can't come after you with an ex-post facto law.
The llc owns the weapon, and say if Feinstien wants to prohibit transfers altogether, so what? Just transfer ownership in the LLC. It will last for perpetuity. (Yes I am a lawyer)
If you want out of any kind of background check, head to MLK blvd in any major city, there are probably a few guns you can buy FTF.

There's been conjecture--and I believe it--that Burroughs deliberately nailed his wife between the eyes with that little party trick. Burroughs was a slimy, lowlife pedophile--something anyone would know about him if they bothered to read a single random paragraph from, say, 'The Wild Boys'. In his thinly-veiled autobiographical novel, 'Junkie', Burroughs pretends to be a desperate, streetwisejunkie living on the edge. In truth, his family (old St. Louis money)bankrolled his depraved adventurism his entire life. He was always the tourist, free to leave and go whenever and wherever he wanted.

I was a Literature major in college. In an attempt to winover the professor, an enthusiastic Beat afficionado, I did a make-or-break term paper on Burroughs which required that I read everything he wrote. Wanted to take a shower afterwards. What an asshole. What a slimeball. What a sleaze.

270 @266

It has never occurred to me to put guns in an LLC, for the reason I mentioned earlier, it will not remove my name from the gun. I also have personal property tax concerns. If I transfer the guns to the LLC, they will have to list the property and pay property tax on them. Listing them might be a wise move to prove that the transfer really did occur, but now I am paying no property tax on them except the standard rate for my personal belongings in my home.

I'll have to work on this. I also might not want to list guns on an LLC tax return that currently are completely invisible. By trying to get some of my guns invisible I might be shooting myself in the foot by making others visible.

Sometimes cultures
and values collide. Then a choice must be made,
whose is the superior culture?

Upon being
appointed to govern a province in the British Raj, Gen. Sir Charles Napier
ended the Hindu practice of suttee which was the practice of burning a man’s widow alive on his funeral
pyre. The local Hindu leadership
complained about the prohibition of suttee and Sir Charles gave a reply for
the ages on what happens when values and cultures collide. One, or the other, must give way:

“You say that it is your custom to burn widows. Very well. We also have a
custom: when men burn a woman alive, we tie a rope around their necks and we
hang them. Build your funeral pyre; beside it, my carpenters will build a
gallows. You may follow your custom. And then we will follow ours.”

And THAT was
the end of sutteei.

So too, I
fear, will it be with this collision of cultures and values. Molon labe.

By all intents and purposes, for a regular non class 3 weapon, saying you sold it makes it invisible. You don't report anything else to anyone. If you want invisible from inception, buy face to face from an individual.

Posted by: I Callahan at January 28, 2013 04:43 PM (pTlmk)

282 Contained in the newly signed NY SAFE Act (gun control law) is the requirement that a widower/widow place all
firearms owned by a deceased with "the authorities", to be held while a
sale is arranged by the administrator of the deceased's will. The
spouse and/or family of the deceased are NOT permitted to inherit any
firearms. So, if not voluntarily turned in by the family, the
authorities would have to confiscate that property. ( I think the family is prohibited from buying any of the guns as well)

The
rules regarding the sale of the firearms in these situations are (purposefully) unclear, but what is clear is that if the firearms are not sold legally
within one year of the death of the owner, the state destroys the guns,
and the living spouse/family will NOT be compensated a single penny.

284 With all due respect to Andy Cuomo, if it isn't registered, it doesn't exist. It appears NY gun owners have figured that out already. I'm guessing most of the ARs will not be registered in NY. They can't steal it from the estate if they don't know about it.
