Happy Thursday.

Just one thing this morning because you're going to be hearing about it all day and it's long. Notre Dame's Manti Te'o, this season's football program super-star, apparently made up the existence of a girlfriend that he then claimed died tragically at the beginning of the season. The story hoodwinked journalists for about six months before coming apart yesterday.

It's kinduva crazy story.

3 Good Morning Morons. Today is Thursday, January 17, 2013. On this day in 1781 Colonial troops under General Morgan defeat the British under Bloody Tarleton at the Battle of Cowpens in SC. This is said to be the turning point in the war. It led British General Cornwallis to Yorktown where he was surrounded by Washington and cutoff by the French Navy.

26 63% of GOP voters think the congressional Republicans are out of touch with the base? So says this Rasmussen poll. Generally I don’t like polls but my gut tells me if anything, this poll undercounts.

As recent polls have indicated, voters in the Republican party are becoming more conservative, and the Republican leaders in Congress are seen as not being as conservative as the party's base.

Rasmussen Reports surveyed 1,000 likely voters between January 13 and 14. The margin of error is +/- 3 percentage points.

Note that is 1000 likely voters which sounds like a pretty good sample. But hey, its just more of those Far Right Tru-Cons (FRTC) who refuse to allow compromise in preventing worse bills from getting through.

28 WaPo bemoans manufacturing “recovery” is going to non-union plants. Hahahahaha, yes there may be some companies opening new plants, but the rate of those vs the ones closing or laying off workers is low. So there is no recovery. But yes, I imagine that they will favor non-union plants for obvious reasons. I also am willing to bet that a lot of small business startups which are the bulk of US employment will keep their numbers below 28. Republicans and conservatives are not the only ones who are punished because “elections have consequences”.

33 VDH talks on the balance between the first and second amendment. A thoughtful article but he gets several things wrong.

Many liberals believe there is no need to own semiautomatic assault rifles, magazines that hold more than ten bullets, or even semi-automatic handguns. They argue that hunters and sportsmen don’t need such rapid-firing guns to kill their game — and that slower-firing revolvers and pump- or bolt-action rifles are sufficient for home protection.

Change that to ALL liberals and add that what they really want is confiscation of all guns, except theirs.

[1] Liberals counter that, just as free speech can be curtailed without infringing on the First Amendment (you cannot yell “Fire!” in a crowded theater), the constitutional right to bear arms is not infringed upon by the banning of semi-automatic, large-magazine firearms or by current prohibitions against heavy machine guns.

The “yelling fire” in a theater is a widespread myth. There is no ruling that you can not do this. And the first amendment is not as clearing and unambiguously written as the second. Yet we continually blister the second and enlarge the first. Why is that? Because the MFM is protected by the first. The actual court cases involving the first is that people who do stuff like “yell fire” in a crowded theater can be held accountable AFTER the fact, both civilly and criminally. Just as people who use guns criminally or recklessly can be held accountable both criminally and civilly.

42 Hello, 'rons and 'ronettes. Thanks for the morning briefing, Gabe and Vic.

Today's subject is a house. Not just any house, but the house at the center of my favorite movie: the house of forgotten silent movie queen Norma Desmond at 10086 Sunset Boulevard.

Sunset was originally written as a comedy about a faded star who makes a successful comeback. But director Billy Wilder was looking for a darker tone, and it wasn't until he hit on the idea of a silent star living in her secluded world coming into contact with someone from modern Hollywood that he found the right motivation. The role of Norma Desmond was offered to Mary Pickford, Norma Shearer, Greta Garbo, Pola Negri and even Mae West* before someone remembered Gloria Swanson. Montgomery Clift was originally cast as Joe Gillis, the hack screenwriter who becomes Norma's kept man, but the relationship between a wealthy older woman and a hungry young man was too much on the nose for the 30-year old Clift, who was having an affair with the 46-year old singer Libby Holman. The role - and immortality - went to William Holden.

Of course, a proper film queen needed a proper film house - in Joe's words, "A great big white elephant of a place. The kind crazy movie people built in the crazy Twenties." The SB team found it at the corner of Crenshaw and Wilshire: the Jenkins house at 4201 Wilshire Boulevard. Standing on two acres of land, the house was built in 1924 by William Jenkins, the US consul to Mexico, for $250,000 (those were the days!). Boasting 25 rooms, the house was Jenkins' home for only a year before he returned to Mexico. The house itself remained empty until 1936, when billionaire J. Paul Getty purchased it as a gift for his wife.

When you watch the movie, you'll notice that the defining feature of Norma's house is a swimming pool - "And of course she had a pool. Who didn't then? Mabel Normand and John Gilbert must have swum in it ten thousand midnights ago, and Vilma Banky and Rod La Roque." But the real house didn't have a swimming pool. So when the house was rented out to Paramount, Mrs Getty agreed to let the studio install one, on condition that, if she didn't like it, they would fill it in. As it turned out, she kept the pool, but since it was essentially a fake with no drainage or circulation, it wasn't really practical.

While outside views of the house and pool were shot on location, the interior, grand as it was, proved to be too small for Wilder’s cameras, so designer Hans Dreier recreated it on the Paramount lot. He was responsible not only for replicating the rooms (the tiled floor that Norma and Joe dance their New Year's Eve tango on is an exact duplicate of the one in the Getty house), but also for the odd furniture, the wheezing pipe organ and Norma’s sumptuous gondola bed, a real one which had once belonged to the famous French dancer Gaby Deslys.

After shooting wrapped on Sunset, most everything was taken apart and repurposed to other films. Norma's ballroom made one last appearance in 1951's A Place in the Sun, with Elizabeth Taylor and – amusingly - Montgomery Clift. The house itself was given to Getty's wife in a divorce settlement, but like Mr Jenkins 30 years before, she didn't live there, and by 1955 the house was an abandoned wreck, its gardens overgrown and its fake pool filled with trash - perfect, as it turned out, for the deserted mansion that James Dean, Natalie Wood and Sal Mineo make their hideaway in Rebel Without A Cause. In 1957, the house was torn down and the land cleared for Getty Oil Company headquarters, a 22-story steel and glass bit of ugliness now called the Harbor Building.

All that's left are the ghosts. And Sunset Boulevard.

Hope you all have a wonderful day. And check out my book, The Director's Cut: A Theda Bara Mystery, available on Kindle and at the Amazon and Barnes and Noble websites.

*West refused the role because, she reportedly said, “Mae West never plays a character over 30.” She was in her late 50’s at the time.

Paramount didn't need the pool for long; in the movie, it's seen with waterin (I think) four shots (SPOILER ALERT!): first, when you see Joe's body, again after it's filled, then when Joe falls into it after Norma shoots him and then finally when his body is pulled out. Easy enough to do within the space of a week, if Wilder set the shoot schedule up that way. So far as I know, it was never fixed.

Right now it seems as though the main thrust of King Barry's 23 Edicts is to patch a gap in Obamacare regarding invasion of privacy and data collection of the guns of patients. This suggests (a) the Fascists know they can't do what they want in an open and above-board fashion (despite the hysteria shown by Northeastern cross-dressers), and (b) they know that unless and until our side tells them government at every level is about 10x too large, they will eventually get what they want, if they just build it in to the rules.

75 TFG blinked on the EOs because it would have generated embarrassingly serious impeachment calls...and...there isn't much he can do by EO that would be acceptable to Congress. You can only power-grab so much before your own party balks. Fail.

The doctor thing has been around once before and it flopped bigtime. Doctors aren't interested in that sort of crap. The few that are would get tired of hearing "none of your damn business" pretty quickly. If they make it some sort of mandatory bullshit to get treatment it would generate massive civil disobedience and legal challenges. The Legacy would turn into something like Lyndon Johnson's.

It looks like after all the shameful exploitation of tragedy and children dies down, this train is going over the Bridge to Nowhere.

76 Fox was just talking to one of their BS house doctors about mental health people ratting out some of their clients to police if they thought they were a danger to themselves or the public. Interesting that some are “calling” for that now as that has been the actual law for a long time.

On another note in that same topic saw some libtard metal health guy being interview by Megyn Kelly yesterday on that. His position was that these people have a “right” to privacy and their conditions should not be released. So once again, the rights of me and mine take precedence and the rest of you can go to hell.

My position on the mental health issue is not as straightforward as what the NRA wants because I see them doing sort of the same thing the libtards are doing and I think they need to be careful. In the past the court has ruled that “rights” can not be denied except through due process and the right to keep and bear arms required due process, including conviction of a felony fro crimes, and in the metal health area certification by a court that a person was unfit to have weapons.

That is where we need to keep this issue. And Lautenberg’s domestic violence misdemeanor BS was shotdown.

Somehow I doubt that Reid will allow it to the floor. I've been thinking about Reid's antics and it occurs to me that he probably doesn't much enjoy being Obama's rodeo clown. I think there is a good chance that TFG's folks in Chicago have made it their business to learn every sordid detail of every shady deal Reid has ever been party to and they use that information to keep him dancing to their tune.

180 Although some are calling Obama's Executive Orders rather toothless, I fear that based on his Alinskyite background and lust for power that we will see the "death of a thousand cuts" implementation of many many "small" changes in the interpretation (not the wording) of the many existing gun laws. The will and rights of the people never mattered to this bunch, and besides, Obama has already stated unequivocally that "a majority of the people" and "all reasonable" gun owners agree that very restrictive gun laws should be enacted. Using the "ends justify the means" and "if it saves only one life" as a foundation for enforcement from an unrestrained Eric (My People) Holder's DoJ and Janet Napolitano's DHS, I think this will turn out badly for us.

Posted by: J.J. Sefton at January 17, 2013 08:48 AM (XkWWK)

259 The “yelling fire” in a theater is a widespread
myth. There is no ruling that you can not do this. And the first
amendment is not as clearing and unambiguously written as the second.
Yet we continually blister the second and enlarge the first. Why is
that? Because the MFM is protected by the first. The actual court cases
involving the first is that people who do stuff like “yell fire” in a
crowded theater can be held accountable AFTER the fact, both civilly and
criminally. Just as people who use guns criminally or recklessly can be
held accountable both criminally and civilly.

http://is.gd/cceNuU

Posted by: Vic at January 17, 2013 06:59 AM (53z96)

***Got to call you on this. The prohibition on yelling "fire" in a crowded theater is no myth. You are confusing prior restraints and subsequent penalties. Absent a crystal ball, it is impossible to put a prior restraint on someone yelling "fire" in a crowded theater and so the law does the only thing is practically can, it tries to deter prohibited speech ("fire" or libel, for example) by punishing it when it occurs. The law "chills" the bad speech in the nomenclature of the subject.

First Amendment law is full of examples of where courts strike down regulations merely because they might chill permissible speech. Here's one analagous to what Comrade Cuomo enacted the other day for ammunition -- require all ink and newsprint purchases to be registered with the government.

The MFM would be in court challenging such a regulation in an instant complaining about the chilling effect.
What concepts from the First Amendment will be applied to the Second will employ brigades of lawyers for decades.

300 Hey seriously "they did try" CT and Blitzing in to a hostage situation is not quilting I know you guys know this.

The skill of western CT forces is amazing.

Even Ivan is not as crafty and SOCOM work and their special forces guys are pretty lethal.

The game of shoot/don't shoot with that much speed and chaos.

If Algeria had really given a damn they would have called mossad or us or the uk or France or Germany.

They didn't so a bunch of guys who lack the hard edge needed tried and fucked up...
6 of one a half dozen of the other.

Does anyone else find it funny that Mikey two shot Bloombaum doesn't seem too bothered his cops tend to shoot 70 rounds at a time hitting less than 20?

Nah no biggie 'that's their job"

There's got to be ONE conservative guy out there who can hang out with these ladies, it's strange to me that we don't see them associated with any single righties. 310 Islamist militants have told a Mauritanian news outlet that Algerian military helicopters strafed the gas complex where they are holding hostages, killing 35 of the foreigners and 15 of the kidnappers.

The spokesman for the Masked Brigade, which had earlier claimed responsibility for the assault Wednesday on the gas complex deep in the Sahara desert, said Thursday that Abou El Baraa, the leader of the kidnappers, was also killed in the helicopter attack.

The information came from the Nouakchott Information Agency, which has often carried reports from al-Qaida-linked extremist groups.

The militant spokesman said the kidnappers were attacked by Algerian helicopters when they attempted to leave the complex.

The Algerian government would not immediately comment on the standoff and the Associated Press was not able to independently confirm the information.

I'm trying to plan for a vacation to Michigan this summer, so my wife can see her family (and so the kids can see their MI grand-parents), but we'll be driving.

I had a couple of questions about the route we'll be taking, though.

We want to head up through St. Louis (so we can stop and go up to the top of the arch), but both Google and Bing maps want us to take US 69 up through OK until it hits I-44. So my question on that is what kind of road is US 69? Is it some two-lane highway (not fun if I experience a breakdown).

Also, what would the Tolls on 1-44 (The Will Rogers Tollway) be from US69 to the MO State Line?

Then, on the IN part- we'll apparently also hit a toll road when we scoot through IN, on I-80, basically from the State Line until it merges with I-94, and I'm wondering what the tolls would be on that, too?

Oh, and for any MO (especially St. Louis) Morons- If I were going to get a motel around the St. Louis area, where would you recommend. Based on what I've seen around here, St. Louis proper would not be good for my blood pressure (since I'm not transporting my firearm across State Lines).

The slogan comes from SCHENCK v. UNITED STATES.
It misses part of the actual quote from Holmes which goes like this:

The most stringent protection of free speech would not protect a man in falsely shouting fire in a theatre and causing a panic.

But that is really not the point, yes it is pre-censoring. Rulings AFTER this one (which in my opinion was bull shit) have said the US can not pre-censor speech. That was done in the infamous Pentagon Papers trial

So there is no case that "prevents" you from yelling fire in a theater. What if there is a fire? In any case all the government can do is hit you if they can show reckless disregard and victims can sue you; AFTER the fact.

They're allowed to graduate from Ranger School if they can do a single push-up. Which reminds me.....

I was once the "sponsor" (read that "babysitter") for an Egyptian Captain when I went to the Basic Airborne course. He was the living embodiment of why Arabs don't win wars.

After about 50 attempts at proper technique for existing a C-130, the instructor (who was patient beyond words) tried to talk to explain the technique another way in the hopes that the wayward Captain would "get it." He kept walking away. The Black Hat kept chasing him down, and you know what Mohammad's response was (yes, they're actually all named "Mohammad.")?

"In my Army you must request permission to talk to me!"

My response was, "We're not in your fucking Army. Listen to the Sergeant or go home without the wings."

Returning home without graduating...very haram.

375 Notre Dame's Manti Te'o, this season's football program super-star, apparently made up the existence of a girlfriend that he then claimed died tragically at the beginning of the season.

Can we just go ahead and start referring to him as "the future Democratic Senator from Hawai'i." He's well on the road to establishing some impeccable credentials. Somehow, he's going to emerge from all of this as the poster boy for identify theft and online shenanegins, because the alternative is for the MFM to recognize what a bunch of non-vetting, pure dollar-seeking dumbasses they really are.

The Russians had those intervening decades to hone their skills. And plan options. After Afghanistan and Chechnya. And they still managed to gas their own hostages into early mortality.

I think WWIII 1986 had she happened would have cured the world of their hunger for conflict for 30 years.

No nuclear exchange or controlled nuclear application with a nice pile of about 14,000 heavy and 650,000 lighter military vehicles scattered over three countries would do that.

Of course the mess would have taken probably 5-10 of those years to even start cleaning up.

Not really, there's no reason why he would have to have a serious girlfriend. If he was gay and he didn't want people to know all he had to do was have a girl hanging from his arm on occasion, he wouldn't have to settle down with someone. I don't think this has anything to do with gay/not gay. But I do think it would be easier to "fake it" with a fake girlfriend. St. Louis you say,
I may know something about that actually, just saying.

Some of this depends on your exact route and timing (i.e. are you just going up in the arch on your way through, planning on spending a day here, etc.)
STL City proper actually doesn't really even have much in the name of Motels anymore (all the less expensive places having bolted to the County). So unless you're planning on staying at the Millenium for $$$/night, pass on that.
If you're really coming up I-44 and want to stay over a night in The St. Louis Metro area, you'll be coming right through Fenton (Where the old Chrystler plant and Maritz is located.) Right off the highway there there's tons of Motels supporting all the business around there (the Chrystler plant may be gone, but Maritz and some of the others are still big.) Specifically starting around where MO-141 hits I-44 (There's two Dury Inns and some other Hotel right there.) Through about I-270 and I-44. That still puts you about 30 minutes or so out of STL City proper (which may be a good thing.)

Traveling down 44 much farther you won't start hitting much until the Colleges. SLU actually owns 2 hotels, (well an actual hotel and a converted hospital they use to funnel grant money to the university by mandating speakers stay there.) The "Hotel Ignacio" is supposed to be niceish, avoid "The Water Towner Inn" at all costs (my old offices were in the same building, it's a distater of a mess.)

If you plan on taking the Bypasses around, There are Hotels in St. Charles of course. And there's tons of hotels near the airport (which if you're coming up 44 would require you hopping over at 270 and heading pretty far north.)

435 ** Bloomberg is on CBS. He just said that if you can't hit a deer in two shots you don't need to be hunting. **

I agree with this. As a pro-gunner I am absolutely on board with it. I agree that sometimes you get unlucky and some others need a finishing round, but all else being equal, if you can't even *hit* the deer on the second shot then IMO you need at least 12 months of supervised target practice before they let you out in the woods again.

That being said, this bears absolutely NO relation to the weapon you choose to go hunting with, whether it's a .30-30 lever-gun with half a dozen rounds or an M14 with twenty.
