The Soviet Union had constitution with lots of "rights". That didn't matter because it also had a ruling class that believed only in its own right to do what it wanted.

America is developing a similar ruling class.

Government by "juice" plus a "living" or disregarded constitution is two thirds of the Soviet System. The other part is nationalization of the economy, and they're working on that.
