Biden: President May Impose Unilateral Law, Trumping Constitution

Own it. Say what you mean.

"The president is going to act," said Biden, giving some comments to the press before a meeting with victims of gun violence. "There are executives orders, there's executive action that can be taken. We haven't decided what that is yet. But we're compiling it all with the help of the attorney general and the rest of the cabinet members as well as legislative action that we believe is required."

Same guy who railed against signing statements for subtly proposing to change the law but without the constitutional process for changing the law. Mr. Platinum Coins, Mr. Fast & Furious, Mr. Executive Action on Guns.

See Drudge for a headline that gets to the point.

76
As an aside,
I have to deal with this shit in my daily life, people who are convinced "doing something!" is better than "doing nothing!" (or alternatively, time trials, wait and see, stepping stone appraoches.)
It drives me nuts, because often "do something now!" results in a bad outcome, whereas a more measured approach would have avoided that.
And yet, the people are OK because "well we tried to do something, what was your plan?!"
It's maddening.
Take my particular instance. I have a disabled mother in law, brain injury. Despite our best attempts to handle things she still refuses to admit that she really doesn't walk well. As a result, she falls, a lot. We've taken precuations to mitigate problems, but short of strapping her into a wheelchair (which we've actually considered, but it has quite a few downsides.) we can't do much.
Occasionally she'll get a bruise, sometimes on her face (she has a habit of faceplanting on the bathroom counter because she refuses to use her walker in there.) My wife and I take a measured approach of assessing the problem, working to mitigate any damage. Since the treatment for even a broken eye socket is "don't fall on your face." we tend to avoid hospitals without an express goal (i.e. "this needs stiches"). (Also past experience has shown us that 99/100 we'll go in, sit forever, they're run tons of random and unneeeded tests charge us a shitload then send us home saying "try not to fall on it.)
Other family members though are in the "DO SOMETHING!" camp. They run to hospitals and demand in patient rehabilitation, despite the fact we've tried this, she'll look good for a few weeks, but even with extensive followup it really doesn't stick (for a whole vareity of reasons.) Plus everytime she goes into these rehab places, they fuck something up with her meds and she starts having siezures again.
We point this out to the family memebers (the harm is greater than any concieveable benefit) but they just scream louder "but we have to DO SOMETHING." Doing something is, apparently, it's own end.

I see parallels here to the gun control issue. I don't think your average american really wants to take away gun rights, but they get caught up in this notion of "DO SOMETHING!" that plagues our culture. I don't know how to solve it. If anyone does let me know.

157 We point this out to the family memebers (the harm is greater than any concieveable benefit) but they just scream louder "but we have to DO SOMETHING." Doing something is, apparently, it's own end.

When the late lamented BFF was in the hospital, her family, who had more or less ignored her existence for a decade or so, was freaking out that Something Must Be Done. They said all kinds of vile things to and about me because I tried to calmly explain to them she was in stage IV of a rare cancer with over 60% liver involvement and the only thing that could be done was to keep her as pain free as possible and that was being done. No, she did not want aggressive treatment because it wouldn't help. No, there was no surgery or chemotherapy or radiation that would help. Yes, she was going to die and it could not be stopped. They were in a frenzy about liver transplants and aggressive treatment and moving her to a larger hospital. They were adamant that Something Must Be Done.

You know what it was actually about? Attempting to deny the reality of a 39 year old woman going from hey I've got this flu I can't shake to dead in about six weeks. That was too horrible to contemplate so it was obvious that it was just that the doctors and I were lying to them and weren't doing everything that could be done. It must be that because because because.

It's the same thing with gun laws. It's not that evil people will do evil things and will use anything they can get their hands on to do it. No, no, no, it's the guns and the violent video games and lead gasoline and chemtrails. Anything, anything at all other than cold, harsh reality slamming home that life isn't fair and bad things frequently happen to good people. No, that's not it. If Something Is Done, then none of those bad things happen.

Magical thinking. All of it.

I don't want to bring it up but the President and Harry keep mandating that I do.

It takes 66 Senators to remove a President from office. That means it takes 34 Senators to keep him. Just 34 of 100.

Only 34 Senators have to put ideology ahead of the Constitution and the law, and we have not only a full blown Constitutional Crisis, but a fully functional dictator.

Valid point, but if there were ever a "Reality in the face thing" you'd think it'd be what I described. This isn't a sudden problem that crept up out of no where (no disrespect to your loss, but it came and happened very quickly).
I can understand how during a sudden change in situation someone could not be brough to the reality of the situation fast enough (Kubler-Ross style I suppose)
But this....
I'm unclear how someone can hold together the congetive dissonence for so long and not be swayed by the presence of bad things happening.
Let's be clear, in my case we did soemthing once (into rehab) bad shit happened, (seizures) with minimal (or any) gain. And they went and did it again just a few weeks ago.
Guess what, bad shit happened (seizures) with no gain.
The gun control thing is more or less the same.
We tried this one, bad shit happened (crime) with little to no gain. Yet here we go all over again, because DO SOMETHING!

The rafts were the $150 kind you can get at Wal-Mart.

Oh oh oh oh can someone help me up on the really high soap box? Thank you.

So what's her name, the slattern who wrote Prozac Nation, just published this incredibly meandering piece about how she fucked up her life. Well, that's not what she thought it was about but it was. But I wanted to punch a kitten when she started blathering on and on about working for one of the premiere Big Law litigation firms and how all it involved was preparing binders and sending binders to other people who sent you their own binders and then all those binders got stored somewhere in New Jersey and no one ever read the binders.

I was screaming at the monitor "This is why Romney referred to binders! That's what things are kept in you miserable fucking pathetic twat!"

I bet not a single person who read that piece and clucked disapprovingly about her life and who also voted for TFG had one synapse fire that her use of binders was fine but Romney's was the most hilarious thing ever.

Bummer.
Fortunately, I didn't inherit anything from my Dad and Uncle, so I saw no need to report that, either.

Makes me wonder, though, how many nonexistent guns are floating around.
Mythical recent conversation:

Wife: "How old is that thing, anyway?"
Me: "Late 1930's, I think. Unregistered .38 special. I have unregistered bullets for it, too."
Wife: "That's good to know".

273 255 They are testing the waters for how much resistance there is to this.

They are also setting the environment up for the Dems of the Senate
to look like they are "moderating" from what Biden is threatening.

Right now, we're tilting at windmills. We have no idea exactly what they're planning on doing and how.

Working ourselves into a panic is counterproductive. They want to portray 2nd Amendment supporters as "extreme". Don't give them examples to cite.

I take the view: Bring It On. Go ahead. Issue the most restrictive, extreme and unconstitutional EO your little brain trust can envision.

Embrace the hubris, Obama. And the resulting failure.

If my first prediction about backing off is wrong, I have a second.
I don't think TFG will just randomly start spouting off EOs taking or banning guns. He knows they won't stand up after the NRA gets judges involved.
Rather as I said yesterday, we'll subtly switch this to a "public health issue" and the EOs will focus on "education" and he'll authorize someone (HHS?) to "educate people" on the dangerous of guns. Slowly winning Public opinion until their's enough on his side to change the laws.

282 Just for discussion, I was talking about revolutionary topics with my very good friend who is Reserves (multiple deployments overseas) and now a cop.

I said the basic line that if it got to the point that 'the masses' rose up against (or fought back against) the government, that many/most of the police/military would be 'on our side.'

He said, "No. I wouldn't be." And that stopped me cold and I had to think about what he was saying and why.

Long story made short: Police and military are protectors of order and stability. Unless and until the anti-government forces become a clear majority of the people (by numbers and support) and have a path toward governing for the future (seriously, what is your plan for the day-after-the-revolution?), the police/military will defend their existing chains of command - the 'current' legitimate order.

This needs to be honestly factored into any revolutionary fantasy/preparation. Don't hide from reality folks, it's what gave us Obama pt II and is putting us in this situation.

Americans favor the 2nd Amendment by a large majority, last I checked - particularly VOTING Americans. When the time comes, we flood our congressmen with calls and eMails. This is where impeachments begin, if that's what it takes.

Note that it puts Harry into a tight bind. Reid won NV in part because the NRA was behind him. Harry is a gun guy, and has supported some of the nicest ranges in the world.

Manchin got in because of his gun-ads. Sure, he's talking "sensible" laws right now... he has to show obedience. But if sensible means anything other than "nobody can buy a gun that is sold as an Assault Weapon, by name," or something equally inane... he's going to have real issues.

Don't bite the hand that feeds you, boys. At least in this one case, that hand is actually the Constitution - who knew that congress critters would ever have to even read it?

The House won't support anything new; if the Senate won't then even "Executive Power" will be a dead end.

With the possible exception of an "assault weapon" ban (and there it's a close split), neither public opinion or a congressional majority agrees though.

If he wants to issue an unprecedentedly overreaching EO, let him expend political capital on it. Let the Dem Senators and House Reps from purple districts in non-coastal states try to defend it. Let the people see the Emperor naked after it gets struck down.

Not sure I see it that way. And I am not, unlike my prior post, hinting at contingencies here: the following is strictly in the abstract.

My oath is to the Constitution of the United States. I will support my chain of command under almost all circumstances, but I have not only the right but the duty to refuse an illegal order.

Now, the catch is, if I refuse an order on the grounds that it's illegal, I'd better be friggin' right. More than that, I'd better be prepared to be nailed to the wall, and have it confirmed belatedly, if ever, that I acted properly.

How all this shakes out in the event of an armed insurrection could get very, very complicated, as officers follow their different interpretations of duty and everyone's a bit too busy to debate who's right.

So, hoping it doesn't come to that.

342 Long story made short: Police and military are protectors of order and stability. Unless and until the anti-government forces become a clear majority of the people (by numbers and support) and have a path toward governing for the future (seriously, what is your plan for the day-after-the-revolution?), the police/military will defend their existing chains of command - the 'current' legitimate order.

I think it comes down to the oath to defend teh country against all enemies, "Both foreign and domestic."

I expect if you're a member of the military or the police who feel that you've been commanded to do something that you feel is traitorous to your country -- such as opening fire on other Americans who have done nothing except demand their rights be respected -- then you'll side accordingly, and vice versa.

Whatever may happen, it's far from certain how anyone will turn.

More? salt, sugar, flour, baking powder and canned evaporated milk in 5 gallon buckets. Rice and beans in 5 gallon resealable buckets. 10-20 pounds of wheat flour will feed a family for a two weeks.

362 Most every time the government has made inroads on the BoR they have done so by targetting or coercing the cooperation of businesses.

Since businesses are public and known, they are a convenient and easily accessible target. Since they have to have government approval/cooperation to operate, they are easily intimidated into acting as the government's enforcer.

They do it with taxes, they do it with freedom of speech and "civil rights laws".

Business ALWAYS caves because the loss doesn't appear to be enough to be worth the owners livelihood.

This is where they will strike first. Few people paid attention to the details about FnF. After Holder et al got caught, they issued orders specific for the border states to limit sales and retain records that they did not have congressional authority to do but what FFL license holder will argue with the BATF? To do so puts you on a short list of targets for harassment and if you fight it, even if you win, you lose.

My guess it will be ammunition will be required to be signed for and logged and/or made illegal to possess if no ownership of a weapon requiring that ammunition is owned. They can also limit or shut down online sales.

P.S. Hate to be like this but all those who recently bought guns in this panic; it won't help. In fact they now have an up to date list of firearms owners and even if you have other weapons bought earlier, they also know that many people who buy a gun already own more than one.

You may get a letter from the BATF notifying you of any new requirements and telling you to comply. Just ignoring the letter will be enough for them to make you a target and initiate a search of your premises. (violation of the new rules makes you a lawbreaker and gives probably cause for a search warrant)

That's if their bothering with superficialities like the 1st, 2nd, 4th and 5th amendments by then.

how we burned in the camps later, thinking: What would things have been

example in Leningrad, when they arrested a quarter of the entire city,
people had not simply sat there in their lairs, paling with terror at
every bang of the down-stairs door and at every step on the staircase,
but had understood they had nothing left to lose and had boldly set up
in the downstairs hall an ambush of a half a dozen people with axes,
hammers, pokers, or whatever else was at hand? After all, you knew ahead
of time that those bluecaps were out at night for no good purpose. And
you could be sure ahead of time that you'd be cracking the skull of a
cutthroat. Or what about the Black Maria sitting out there on the street
with one lonely chauffeur - what if it had been driven off of or its
tires spiked? The Organs would very quickly have suffered a shortage of
officers and transport and, notwithstanding all of Stalin's thirst, the
cursed machine would have ground to a halt.

Author of Prozac Nation is Elizabth Wurtzel. Went to Harvard. Is depressed. And an addict of something. She maybe growing up a little bit, from wiki
In January 2009, she authored an article at The Guardian,[17] arguing that the vehemence of opposition demonstrated in Europe to Israel's actions in the 2008–2009 Israel–Gaza conflict, when compared to the international reaction to human rights abuses in China, Darfur and Arab countries, suggested an antisemitic undercurrent fueling the outrage. In her words,“But to communicate with anyone I think of as right-minded (and left-leaning) in any other part of the world [i.e. outside the US] is to experience the purest antisemitism since the Nazi era. In fact, in Europe right now, it is de rigueur to liken the current regime in Israel with the Nazi party, and to view the experience of the Palestinians as a form of ethnic cleansing. Hamas and Hezbollah are thought by the French and British to be social welfare organisations, and Israel is viewed as a terrorist state.”“...with all the troubles in the world, with the terrible things that the Chinese do in Tibet, and do to their own citizens; with the horrors of genocide committed in Darfur by Sudanese Muslims; with all the bad things that Arab governments in the Middle East visit upon their own people — no need for Israel to have a perfectly horrible time — still, the focus is on what the Jews may or may not be doing wrong in Gaza. And it makes people angry and vehement as nothing else does. The vitriol it inspires is downright weird

430 Re 282 and the followups regard Military/LE vs gov't.

I'm just trying to be honest, or conservative, as it were. For those that say most will take their oaths seriously...it's all how you define that.

Or put another way, say 10 people with arms rise up against the US Federal government, will 60% of the Military/LE say, "Yup. Guess the revolution is here after all! The Gov't really is illegitimate and it's time to take up arms, join those brave 10... (checks tv) 7... (checks tv) 3... (checks tv) that last guy hiding in the woods and overthrow the gov't."

It will take a seismic event - a revolutionary-level event - to get people to actively join a fight of that life-changing magnitude. Living a guerilla lifestyle. Regardless of oaths they've said or even oaths they take seriously.

Ask yourself, Mil/LE folks out there, how big (safety in numbers) will the revolution have to be before you actively join with the (winning) side?

They knew that Spys could not open EVERY piece of mail.... so it was pretty safe...

The 'key' to the net... is Key words... its easy to sift though lots and lots of Pages, comments, and email, looking for specific words... which then flag it... and if a pattern emerges will bring it to the attention of a human...

So.... be careful of WORD USAGE... there are terms that are being scan'd for....

In living my life, I try to stay in the day and deal with the problems in front of me--as Christ enjoined me to do. I don't entertain war movie, action herofantasies or pretend I'm anything other than a middle-aged commercial artist with twoadult children. My hair and beard are gray. I'm a combat airborne infantry veteran, a former weapons squad leader, but that was almost 30 years ago. I can no longer run like the wind for miles or hump a ruck all day or see a target in detail at 300 meters. That said, I can still hit the black offhand and standing at 100 meters with my SKS and achieve fist-sized groups center-mass at 5-7 yards with a pistol. I boxed as an amateur when I was young and studied martial arts for years (kempo and aiki-jujutsu). I'm not special. There are millions of other (older) veterans with similar backgrounds.

If the federal government unlawfully attempts to confiscate my firearms and violate my 2nd Amendment rights, I will make them work for it. Not much of a plan, I know, butI'm not a survivalist/prepper type who stays up late at night trying to prepare for every contingency--which often sounds like wish-casting and fantasy since real life typically plays out at complete odds with whatever plans we make to deal with it. So no, I don't give much for my chances if things get ugly, but it isn't about me. It's about the survival of the Republic. It's about freedom.

I had tears in my eyes on election night but I will be damned if I am going to give up. Just recharging with other things and distractions. I can assure you by the next election I will be a political junkie once again. Will never, ever give up. I pray daily for protection from the wrong turn this nation has taken, for protection against these policies, for protection of our great military, and for the nation to remember God again.

I also believe that there are not 1/2 of the American public who are as liberal as their votes and are that different from us. 1/4 of those people were ignorant, ill-informed due to the complicit media hiding the truth from them, and vote for what is "cool." Many of that group are now freaking out as their paychecks are less due to the Obama increase in taxes. Let him fly his freak-flag. Let's get this over with.

In addition to his headline, Drudge also has up a link today by a shrink who works for FOX News. He thinks the rampant narcissistic behavior in youth today is due to the social media addiction. I think he is correct. It is not the guns, it is the people addicted to attention (and the mentally ill who are not getting treatment or institutionalized). God help us, as our government has failed.

It's all in the schools. You should see the indoctrination they pump into the teachers. That usually goes straight into the students unfiltered.

The younger they are, the more they develop instinctive emotional reactions against conservative phrases and concepts. It's not directly political, but it's control over the attitudes towards the language in which politics is conducted.

President Obama's friend and mentor Bill Ayers has already done the math. Ayers had a solution for those 15-25 million (his estimate) of those who refuse to be reeducated.

More realistically, if the federal government imprisons, fines,and/or otherwise ruins, say,10,000 people prominent in their communities or among their social/professional groups--those whom corporate marketing departments call 'Key Opinion Leaders'--then millions would fall in line. That's simply human psychology at work, and it works. Tall wheat gets the scythe.

531 Just pointing out the obvious...
Trying to disarm a populace en masse would be impossible. Attempting this would be purest folly. Trying to do so by force would be an act of Total War.
If only a couple percent of gun-owners resist such an effort, the military and police forces would be significantly outnumbered.
The vast majority of subjects supporting such a civil war live in geographically-concentrated areas, that are heavily-dependent on a constant inflow of water, food, electricity, and gasoline from far-flung provinces. Those are some awfully long and fragile supply lines. Even a sporadic and largely incompetent guerrilla campaign against infrastructure would quickly make the cities all but unlivable. A breakdown of order within the strongest bastions of Administration support would necessitate the redeployment of military and law enforcement assets to contain the crisis. Which makes control over the hinterlands and logistical support even more tenuous.

You'd have to be a nuts to even contemplate kicking this hornet's nest.
I don't think the Democrats (or Leftists) are overconfident (or desperate) enough to try it. Yet. They'll try to lay groundwork, but I doubt they're willing to go to the mattresses. (When the government has to start making hard choices about which debts to honor, all bets are off.)

And of course, the "what happens after" is a horror story that I don't even want to contemplate.

I argue Congress cannot retroactively make things illegal to own, and that the government cannot by fiat make property less in value. There must be due process, and compensation. It cannot simply being the Chef Executive telling the ATF "kill all who oppose".

Two things to remember: (1) President Obama's only political defeat so far has been his loss to Bobby Rush in a 2000 congressional bid; and (2) Obama, as he once admitted, 'believes his own bullshit'; that is, he is a committed ideologue who genuinely believes he is destined for historical greatness. Further, he has never taken ownership or admitted to making any mistakes whatsoever. A textbook narcissist, he believes any failures of his administration are becausesomewhere, somehow, somebody failed to understand or follow through on his directions.

Napoleon invaded Russia. So did Hitler. MacArthur very nearly crossed the Yalu River--and would've if Truman hadn't fired him in time. Lee made a frontal assault against a heavily fortified position at Gettysburg that would--by necessity--expose his troops to intense artillery and musket fire from three directions while traversing over a mile of open ground. Custer rode into Little Big Horn even after his scouts had told him there were thousands of Indian warriors waiting for him.

So yes, it would be foolhardy and destructive for the President to drive a significant number of Americans to the point of militant resistance. Your point?
