11 Good morning, ‘rons and ‘ronettes. Up here in northeast Massachusetts, we got rain rather than snow, thank heavens. I don’t particularly like being wet, but I hate being cold and at least you don’t have to shovel rain.


Today is the birthday of Marlene Dietrich, the sensuous German actress who first shot to fame as cabaret singer Lola-Lola in the von Sternberg film The Blue Angel. Her iconic Weimar Republic costume of stockings, garters and top hat was inspired by a male cabaret artist whom Dietrich admired.


Although she was bisexual, Dietrich wasn’t particularly enthusiastic about sex for many years. At a young age she had been seduced by her music teacher, but found the experience completely underwhelming; so much so, that after the birth of her daughter, Dietrich instructed her husband that they could continue to live together as man and wife, but they would no longer have sex together. However, when Dietrich did mature as a lover, she took to bedroom frolics with eagerness, using a daily vinegar and water douche to keep clean and never insisting on a condom because, as she told her daughter, “it makes them so grateful when you tell them they don’t need it.” During her life, her conquests included Gary Cooper and Jimmy Stewart, the writers Erich Maria Remarque and Mercedes de Acosta and also – among many others - John Wayne, JFK and George Bernard Shaw. Her name was also linked romantically with Joan Crawford and Claudette Colbert, but there doesn’t seem to be any evidence for those affairs other than wishful thinking.


Yul Brynner was also one of her lovers, but the affair ended badly. Many years later, when Brynner was dying of cancer, Dietrich clipped a picture of his ravaged frame from the National Enquirer and sent it to her daughter with the scribbled note: “Goody, goody! Serves him right!”


One story that made the rounds for years was that, after the war, Dietrich personally searched for her sister, finding her as a prisoner in the Bergen-Belsen concentration camp. As it turns out, the sister and her family actually ran a movie theater catering to the camp’s officers, and it took all of Dietrich’s clout to keep them from being arrested as Nazi collaborators.


But let me end with a better story. Many years after the film was made, cartoonist Al Hirschfeld saw Dietrich’s 1930 flick Morocco.* He asked her, “Marlene, at the end of the movie when you kick off your shoes and follow Gary Cooper into the desert – how did you get that wonderful expression on your face?”


Dietrich was never one to concern herself with “art” when it came to making movies. “I just did what Joe von Sternberg told me,” she shrugged. “I counted from twenty-five backwards!”

In other news, some close friends of ours who are Dims and who we see but once a year had some very unkind things to say yesterday about FEMA's "help" after their property in VT was damaged by the remnants of Hurricane Irene in 2011. It seems that their ne'er-do-well tenants got their FEMA bucks almost immediately and in copious amounts. Meanwhile, they have languished in bureaucratic hell for sixteen months over the disposition of their storm-damaged structures.

All the while I was hearing this, I was smiling quietly. Some lessons just have to be administered personally...

I don't really care about Ann Curry. I quit watching "Today" years ago. However, Lauer is a visible NBC presence and I like it that one of their Big Stars is being mocked and insulted on the streets of New York.

I also like that he is hearing sarcastic comments about his $25 million dollar salary, since NBC has been in the vanguard of promoting Obama's class envy stuff.

Furthermore, this article was quoted on my Indianapolis radio station and I am sure elsewhere around the country. I encourage people to talk about it and stir up the dim bulbs. Let him (and NBC who has a lot of money invested in him) get a taste of the lynch mob attitude that has been stirred up by Obama.

Actually, the scans of the issue were around last week on torrent sites. The series ends, for now, with issue 700. During a recent storyline, the extremely decrepit Dr. Octavius took advantage of Spider-man hacking into his network that was connected directly to his brain. This was necessary because his body was so far gone. He took over Spider-man's body but has access to all of his memories, allowing him to fool anyone who knows him that he is Peter Parker. Whether he has managed to avoid any telepaths or can fool them too isn't covered yet. Charles Xavier is freshly dead and Emma Frost has had her powers scrambled. A time traveling teenage Jean Grey is now around but she doesn't have a good grasp on her freshly awakened powers yet. There are the Cuckoo Sisters, and Mentallo, I suppose.

Meanwhile, Peter Parker, stuck in Octavius' failing body, makes a bid to set things right by recruiting some of Octavius' henchmen, who happen to be long running Spider-man foes. The attempt fails and Doc Ock is defeated by Spider-man. At least, as far as the public knows. But accessing Parker's memories has forced Otto to confront the fact that both of them had a lot of bad stuff in their childhoods but Parker became a far better man than Otto. So he promises a dying Parker in his discarded body that he will continue as Spider-man. But Otto is still intensely ego driven and also swear to be a better Spider-man than Parker.

So the series restarts with The Superior Spider-man #1.


I'm expecting this to be like the Knightfall arc in the Batman books many years ago. I expect it will turn out there was no body transference, just a strong personality imprint in both directions. Eventually, Spider-man will think of himself more and more as Peter Parker and his personality will fade away just as he was achieving his goal of being better than Parker at being a super-hero.

They've been resurrected plenty in reality bending stories. Like the Flashpoint arc that lead to the reboot of the DC Universe last year. In the new reality, created by the Reverse Flash altering critical moments in history, it was the child Bruce Wayne who died in the mugging and Thomas Wayne became the Batman while Martha Wayne went nuts and became the Joker.

A temporary throwaway reality but it was a fun 'we can do whatever we want' lead-in to the reboot.

Okay watching CW Philly news this morning.
There is a school named Imhotep and they are celebrating Kwanza. Right, a school named after a very smart ancient Egyptian celebrating a modern holiday.
On Christmas night in Kensington area of Philadelphia another reason for SMOD. A woman passed out in the street in front of a Dollar General. Witnesses said the boyfriend tried to rouse her but left her in the street. Later on a black SUV driven by a Hispanic woman ran the passed out woman killing her.

They did not have 60 votes to force it through so they were forced to use "reconciliation" which meant it expired automatically after 10 years. Some Democrats (2) actually voted for those tax cuts but "moderate" Republicans like McCain, the darling of the MFM, voted against it. McCain, Snowe, and Chaffee were the three Republicans voting against it.



It was a 50-50 tie in the Senate and it took VP Cheney voting yeah to force it through.

While Mandela was imprisoned, police arrested prominent ANC group leaders on 11 July 1963 north of Johannesburg. Mandela was brought in, and at the Rivonia Trial they were charged with four charges of the capital crimes of sabotage, which Mandela admitted.

The charge sheet at the trial listed 193 acts of sabotage in total. They were charged with the preparation and manufacture of explosives, according to evidence submitted, included 210,000 hand grenades, 48,000 anti-personnel mines, 1,500 time devices, 144 tons of ammonium nitrate, 21.6 tons of aluminum powder and a ton of black powder. Republicans always seem to forget that our policies are actually the popular ones. Democrats only successfully run against them when Republicans are too timid or too clumsy when defending them.

That was why we couldn't get 60 votes in the Senate for the original Tax cuts. George Bush was supporting them as a stimulus measure ('let's get the economy going again') which was correct as far as it went, but allowed Democrats to say, "Oh, but once the economy is going again, we need to go back to 'more reasonable' rates."

When Reagan wanted cuts, he was able to force the Democrat controlled House to vote for his cuts, albeit with some compromise.

The result of that mindset has been chronically-high unemployment, a stagnant economy, entitlement programs crumbling under their own weight, soaring healthcare costs, and an absolutely devastating national debt that will be hanging around the necks of our children for the rest of their lives.

It’s not that the president doesn’t recognize these problems. Of course he does. I just don’t think he respects Americans enough to take action. Think about it…If our president can do so many things wrong in his first term, fail miserably to achieve every predicted outcome he put forth at the beginning of his presidency, show no interest in addressing the biggest threats to our nation, and still be rewarded with re-election, how can he possibly respect us?

You misunderstand. All of the stuff in Flashpoint arc was temporary. It was a means to an end, which was the reboot. It was much like a Star Trek episode where a messed up time line gives them an excuse to stage a fabulous battle with all kinds of damage and death. Typically, such an episode ends with the time line reset and nobody remembering what happened. DC did it a little differently in that the time line got reset but when rolling infinite sided dice you'll never get the same result.

The current DC Universe is very recognizable with a lot of tweaks here and there, such as characters that were formerly in separate continuities being brought in. Not every choice has worked but nobody bats 1.000. Some of the ideas have been pretty effective while still retaining a familiarity to anyone who read the version that appeared twenty years ago.

If you were a judge and made such a ruling you wouldn't be on the bench much longer. The Question was an obscure character damned few people ever heard of before DC acquired the Charlton IP. The version written by Denny O'Neill for several dozen issues was far, far more widely read than the Steve Ditko version. (Despite the hipster following, Ditko has never had a solo hit.) Up until then, the character was the answer for a Watchmen trivia question. IP law is pretty clear and DC can do what they want. Some things become problematic. Captain America was originally on ice for less than twenty years and plenty of people he'd known before were still around. But nowadays his time frozen has stretched to around 60 years and growing. The only survivors from before are either very elderly or enjoy special circumstances ala Nick Fury, Namor, or the Original Human Torch.

Similarly, Tony Stark couldn't receive his nearly fatal injuries in Vietnam anymore. (And remember when Flash Thompson was a Vietnam vet?)

Such is life when your mythology is a moving target that has to keep up with the times. Nor is it like older mythology was cast in stone across the centuries. Just about every old story you ever heard from before Guttenberg made books widely available was greatly mutated from its origin. Did you know Maid Marian as a figure of legend predates Robin Hood by over a century and only became part of the Robin Hood mythos when somebody decided their version needed a love interest?

And then there are financial interests. You don't get to do comics very long if they don't sell. And they don't. Without movies and TV there would be damned little comics publishing anymore. So there are occasional annoyances when they force changes on a long running series to make it more recognizable to people who know the character primarily from a movie. Iron Man brought in the whole Arc Reactor thing that had never existed before the movie. At some point it was just there and became a plot device. But that hasn't stopped good writers from doing good work with the character.

Want stories that never change? Don't look for it in a comic series that runs for decades, unless you want to read about Peter Parker applying for SSI benefits.

Vic, each circuit is assigned a particular Justice for purposes of considering emergency relief. For example, here in the Fifth Circuit it is Scalia which is one reason why those about to be executed seldom get let off the hook at the last minute.

Note there are more circuits than Justices, however, so some have to double up (there are only nine Justices of course, but 13 circuits -- the 1st through 11th plus the Ct. Appeals for the Federal Circuit and the D.C. Circuit Ct. of Appeals).

This emergency review process is separate from the certiorari process you are referencing.
