Senator Jeff Sessions: Here's A Crazy Idea, Maybe We Should Follow Constitutional Procedures And Not Backroom Deals To Handle The Fiscal Cliff

Longtime AoS favorite, Senator Jeff Sessions has an idea that is so crazy it just might work...stop acting like a neo-autocracy and utilize the structure of our constitutional republic to deal with our fiscal issues.

This is the exact opposite of the hidden negotiations to avert the so-called fiscal cliff. Washington has become possessed by the idea that a small group of negotiators, meeting in secret, can solve the deep, painful and systemic problems plaguing this country with a single "grand bargain," produced at the 59th minute of the 11th hour. This is a siren song.

...

Instead, we have seen an endless series of secret conclaves: gangs of six, committees of 12, meetings at the White House, at Blair House, in the Capitol's labyrinth of hallways and hideaways. Meetings everywhere but in the committee room and the open air of the Senate floor.

...

What we need is more distinction, not less. On these great issues of the economy and debt, the voters have sent Washington mixed signals and a divided Congress. It is thus all the more critical that the facts and choices be clarified. The Senate is the perfect institution—created for just such a time as this—to provide that clarity and consensus.

Proposals should be worked up in committee, where senators appointed by their colleagues have developed expertise in the issues that come before them. Amendments should be offered as part of an open process to modify and perfect legislation. The debate should be brought to the Senate floor.

It may take dozens of votes, even scores, to reach a consensus. But the American people need to be in on the process and have the opportunity to voice their opinion on concrete proposals. Have we forgotten that it is their future that is at stake?

Yes. A thousand times yes.

The President is not part of the legislative branch in our system. Why the hell is he being allowed to drive the agenda like this? Yes, he has to sign, veto, or ignore a bill but that's it.

Obama wasn't very interested in being a legislator when he was in the Illinois and US Senate but now he wants to be Legislator in Chief.

This is where I think Boehner is an idiot. Why is he letting Senate Democrats off the hook in this process? You know why Harry Reid didn't pass Obama's opening offer? Because he doesn't have enough votes. Big, blue state Democrats like Shumer, Gillibrand, Durbin, Nelson, Boxer and Feinstein aren't going to vote for a tax increase on "the rich" if "the rich" is defined as $200,000/$250,000. It would capture far too many people in those high cost of living states that are "middle class" in reality.

But Boehner lets them off the hook by negotiating against himself with Obama. Let the House pass it's own plan and then let the Senate pass theirs. Make Reid carry Obama's dirty water for awhile.

Right now the game is rigged against the House Republicans. It's absolute stupidity to keep playing when you know the dealer is dealing from the bottom of the deck. Either you get up or change the dealer.

Boehner doesn't have to invent a new game, there's one with rules already written down and everything. Try playing by that for a while, we might get a better outcome.

Because no one has ever called them out. The dumb proles who routinely pull the lever for them get their marching orders from the dreaded rich who pay for protection. Wealthy Dems in NY and CA pay big money to keep the riff raff far away. They like ghettos and slums and mass transit. Bus them out.

Cap mortgage deductions so that the rich can't write off more than the average (blue state property values are higher than red state), end the deduction for previously paid state and local taxes (blue state Dems may find themselves suddenly in favor of tax reform when they hear this one), and cap personal deductions in the aggregate (aimed, again, at the wealthy Dems). Well, if that's the goal, I can see that maybe its working. I mean, that sounds crazy, but it explains a lot. The Tea Party made Boehner Speaker, and if he really doesn't want to be, then that would explain why he's mad at them and wants them to fail. I guess it would explain why, if he doesn't want to be Speaker, he wouldn't just not run for the position, because what he wants is to be Minority Leader. I guess Pelosi has a pretty cushy deal, she probably still gets Air Force jets, she's not accountable for anything.

So maybe that works. But seems like too much of a bank shot. I guess the odds that there is a Newt Gingrich type that actually wants to be Speaker are pretty low in that caucus.

88 My brother is a CPA and he told me that the plan Boehner has proposed would raise a hell of a lot more revenue than Obama's rate increase. Capping or ending deductions works. Rate increases with no deduction caps just means rich people will find more deductions to avoid or offset the rate increase.

The NYT ran an editorial yesterday squealing about the proposal to end the deduction for state and local taxes - they said it was a "punishment of states with activist governments." And got in a jab at Texas and Florida, which have no state income taxes. That right there should tell you the GOP needs to push this idea, hard.

It seems like you want to believe what they say while ignoring what they actually do.

95 I've been saying this exact thing for weeks. The good part about being in charge of the House is that the majority rules. So why doesn't the GOP pass 10 different bills with 10 different revenue enhancers, and then just turn to Harry Reid and say, "Your turn, bucko. Pass a bill out of the Senate and then we can mesh them together in the Joint Committee." Harry Reid will whine about Republican filibusters, of course, except that all of these bills would contain revenue enhancers and therefore not be subject to filibuster.

that will kill Philly so dead I almost would be curious to see it happen

You guys don't realize, if you work in NYC or Philadelphia, you not only pay exhorbitant sales and property taxes, you get to pay MULTIPLE local income taxes. In Philadelphia, I used to pay THREE of these.

If you can no longer deduct them from your federal income tax - !!!! - it used to literally take away my federal tax payment, that's how much I paid the city of Philadelphia.

The fleeing will commence.

by the by, I know a verrrrry rich NY family who is getting ready to completely move out of state, including their entire business (well, what is left of it, they've already moved manufacturing partly to Mexico). they are totally blue as blue can be, Schumer's Perfect Clients.

I'd be tempted to given on other changes if there were an *ironclad* change allowing this that couldn't be undone without a 2/3 majority.

I'll eat the loss of mortgage interest deductions and the wife's student loan interest deductions if the people of Philly and NYC have to pay local, state, AND federal taxes.

Economics is all about what's done at the margin. That is the last dollar of revenue is the most important dollar of revenue. If that $1000 is taxed at 52% in California, then people won't work for that last $1000. Oh but that's crazy, right, nobody stops working to avoid taxes!
That's exactly what I am doing. I pretty much stop working around mid to late November because anything I make in the last few weeks is taxed close to 50% when I include income tax (state and federal), Medicare tax and factor in the lost deductions if I get above a certain income threshold. And believe me tons of people structure their income in such a way that once they hit a threshold they stop working for the year.

240 It is so obvious what the winning path is. It is also obvious Boner has no intention of doing it. Draw your own conclusion.

Reid is deathly afraid of even discussing the idea of debating a budget. That is their weakness, exploit that and drive a wedge into the ranks of the enemy. Simply get the House Rs to become broken records driving the simple bumper sticker logic that if we have a budget crisis that actually passing a budget must be the first step. Since we have passed budgets every year since the founding of the Republic through the electing of Obama it can't be that crazy a notion, can it? The House has passed one and is still waiting for the Senate to do one so we can meet in conference and start the process of negotiation and compromise. Therefore we are getting out of town until that happens.

Reid would then give us darned near anything we wanted in exchange for a CR. At that point it is a 'bipartisan' consensus between the House Senate vs Obama.

I can't help but think that some real, live, common-sense leadership would have a subtle psychological effect on the 51%, reducing their numbers somewhat. That's why I was so depressed after the election (and still am, would you like a toasted marshmallow?). Having someone like Mitt in the WH (even though he wasn't my initial pick) would've done all of us good, especially compared to what's in there now.

That reminds me of the story of a laborer on a Peronist jobwho spentyears on a site, every day rolling out a wheelbarrow of straw. The guard was convinced he was stealing something, and every day tore the load apart, but never found anything in the straw.

Finally, when the job was through, on the last day the guard said to the worker, "All right, I give up. What were you stealing?"

The fellow answered, "Wheelbarrows."
