Hostess, Union Agree to Mediation To Forestall Shut Down

Cold dead hands, cream-filled goodness, some assembly required.

RT @CNBC BREAKING: Hostess and Bakers Union agree to mediation, preventing shut down.

Update to Rubio Story: Allah points out that 58% of Republicans, 39% of Independents, and 41% of Democrats think God created man in current form within the last ten thousand years, and those percentages increase when you include those who think man evolved but with divine guidance.

Which means, as he says, that if Democrats were asked this question point-blank, they'd have some political liability too, as Darwin might look great on a bumper sticker but he wouldn't look so good on a political platform. But the media never asks, because the media never asks Democrats wedge-issue questions. Democrats are allowed to vaguely drift along with their chips on multiple numbers at once, while the Republicans are forced by close questioning to place their chips on only a single number.

The judge isn't stopping the legal process, just seeing if the Union is willing to really negotiate as a last chance to save the existing company. Hostess has been trying to reorg and when the Union went on strike, moved from reorg to liquidation. Unless the Union concedes, not much will likely change and the company will be sold to someone else or its assets liquidated.

No- the bankruptcy had already been filed, back in January. What had to happen now was Hostess had to return to court and ask permission to begin liquidation. The judge essentially said "Nazzofast, Guido."

Apparently the Bakers union didn't even file a protest to the negotiations before they went on strike. So- the court 'requested' they meet and attempt arbitration. We'll see what happens. Either it was the ultimate bluff to the union, or the board at Hostess put on their best honey badger and are truly prepared to shut it down. Either way, the union is not going to do well here.

The baker's union already got management to petition for liquidation due to striking.

If the union doesn't make some serious concessions to get things at least close to the last contract they were offered, management can tell everyone that the bakers didn't negotiate in good faith.

"The snack giant endured $52 million in
workers’ comp claims in 2011, according to its bankruptcy filing this
January. Hostess’s 372 collective-bargaining agreements required the
company to maintain 80 different health and benefit plans, 40 pension
plans and mandated a $31 million increase in wages and health care and
other benefits for 2012.

Union work rules usually required cake and bread products to
be delivered to a single retail location using two separate trucks.
Drivers weren’t allowed to load their own vehicles, and the workers who
loaded bread weren’t allowed to load cake. On most delivery routes,
another "pull up" employee moved products from back rooms to shelves." WSJ
It may be that working is a bit to hard for union members.

99 These union thugs are another wedge issue that he could have used to win Wisconsin as a swing state and to differentiate himself from the union-owned Obama. But I didn't hear too much of it.

Then again, since we did win the election but for (a) voter fraud and (b) the GOP's woeful inability to protect themselves from it, who cares.

It's not a question of if there was voter fraud. It's a question of how much voter fraud there was. I'd say at least 500K in the lost swing states alone.

Exactly, obama was weak on both sides of this debate. He did jack shit for immigrants his entire presidency, just before he needed another election. Rather than try to come up with comprehensive reform that made sense, while democrats had total power over government, they did jack shit. How is that good for immigrants??

On the other side of the coin, blue collar workers, union members, and blacks could have been persuaded on this issue as well.

Illegals take a lot of jobs that unemployed black americans could do. They take a lot of union jobs.

Can we just get a damn limited government conservative who believes in strong defense and fiscal sanity, that is not a mormon and otherwise holds conservative social norms as his own belief but that is not fucking running around saying that it is his job to enforce personal beliefs on anyone.
Limited government answers all questions, especially when running for federal office.
Abortion: personally against it, but it is a matter for the states to decide, I have no say in the matter as a federal official. But people's tax money shouldn't fund it given the significant religious and moral objections to the practice.
Gay marriage: up to the states to decide. Period. Personally against the idea of gay "marriage" as I believe marriage is an institution meant for rearing children and the nuclear family. But fine with civil unions or whatever property rights/contractual construction needs to be done to make sure that someone's partner can visit them in the hospital or other basic concerns, etc.

There you go. abortion and gay marriage done and done. Jacksonian conservatism.

yeah, what's fishy about 2012 was that DNC experienced no blow back whatsoever, in the most persuadable swingiest part of the country.

Oh sure, they lost 7 million votes from 2008 (because the illegals self deported, voter id laws, and death of FDR loving old fuckers) ...

BUT

In swing states like Wisconsin and Michigan and Fl and Va and NC there was no blow back whatsoever.

I looked at Michigan numbers and saw that somehow the same exact numbers showed up and voted over the 1.9 million GOP/Inds that put the Republican governor into place in 2010. That is, in a state with 5 million registered voters, the GOP would only have to pick up 600K more votes than 2010 in a year in which the tide was turning against obama and in which the base was depressed.

But nope. Every available voter voted for obama. Golly. Same in Wisconsin. Except there's an extra 500K voters who were so fired up to vote for the first time ever in a state that was picked clean of voters in 2008, 2009, 2010, and 2011.

You don't get the concept of "good faith" and "administrative remedy" if they don't at least attempt moderation (and the unions will agree for the same reason) then they will not be judged by the judge to be acting in good faith desperately trying to come to an agreement and just can't. Proceeding into liquidation in bad faith gives the judge ammo to bone them in liquidation.

Ultimately unions will cave on this one because the optics are so bad and the management has pretty much put the cards on the table and they aren't bluffing, the question about that caving is by how much and how fast.

What I fully expect is that moderation is completed and an agreement is reached but takes too long
and CH 7 gets amended to be caused by insolvency rather than failure to
restore production.

Even smellier are the obviously rigged turnouts that give the smell test failing Obama whatever, Romney 2 ( a number thrown out to make it appear random but is actually not random). People who do forensic accounting are acquainted with these lying types of numbers.

You have an election in which certain swing states were 5 point Romney leads, with Red polling stations being filled with lines of people for hours. But that never showed up in the numbers.

You have new first time GOP voters, first time newspaper articles endorsing the GOP, but no resulting turnout?

I am not in the US anymore, but when was the last time any of you saw a commercial for Hostess? When was the last baking innovation? what promotions do they have? They had become one of those brands, like ovaltine, tang,.. that had a glory period and now live off the nostalgia of parents that remember to go to the isle in walmart and buy something from their shrinking shelf space

It comes in cycles. The UK was just tired of the conservative party and wanted to go liberal for a bit. She knew it before the votes were counted.

I think, like the UAW, the problem is not just the cost, but the union rules and inability to fire people. My guess is that management realized that the only way for the company to survive was to start over.

Looking at it from that direction, everything is a construct, since math is what we use to explain virtually any hard science.

My whole thing was that physics existed long before the Greeks. It's just that as time passes and our understanding becomes sharper, that's where the changes in the laws come from. Physics is as it ever was, it's just that 5000 years ago the math didn't exist to explain it, however crudely.

165 it smells and the Allen West recount shows how shoddy it all was.

But apparently, demanding an honest vote count is "icky" or something.

Fucking lemming party.

------------

More than the lack of advertising, they're just so expensive. Little Debbie and TastyKake are tons cheaper, at least in my area (we just got TastyKake here and every time I see it, it's "on sale" so that may change). I have never seen Hostess products at places like Family Dollar and Dollar General which are really growing in this economy, and I'm not sure if that's a mess-up on their part, or just that they're too expensive. But, then having a union labor force means the product is just that much more expensive.

"Twinkies! Ding Dongs! Ho-Hos!

Union contracts have to go!"

A counter union protest march jingle.

169 Romney conceded like he wanted to beat traffic home.

Fucking Lemming Party.

From the Allen Recount "“Then there is Gertrude Walker, the 32-year-veteran election supervisor of St. Lucie County, who has spent much of the last two weeks explaining why her office completely botched the count. She admitted that her office had acted in ‘haste’ in issuing election results, and that ‘mistakes were made.’ Among her mistakes was failing to count 40 of the 94 precincts under her jurisdiction on Election Night — and then counting the other 54 twice. Indeed. On Friday, her office announced it had ‘discovered’ 304 additional early votes left in a box. None had been counted. But Walker wasn’t available for comment. She has been hospitalized for unknown reasons.”

So, failing to count 40 precincts and counting the other 54 twice.

Multiply that by thousands of similar corrupt monkey goons across the country.

170 but - among the GOP - the only crazier thing than not knowing how old the earth is is discussing voter fraud.

171 Answer: But, then having a union labor force means the product is just that much more expensive.

Question: What are things you will never, ever, hear a union member admit to.

173 "Update to Rubio Story: Allah points out that 58% of Republicans, 39% of Independents, and 41% of Democrats think God created man in current form within the last ten thousand years, and those percentages increase when you include those who think man evolved but with divine guidance."

And 86.2% of all statistics are pulled right out of somebody's ass. Love to see the methodology behind those numbers. Personally I think the giant turtle that holds up the four pillars that the earth is supported on is way older than 10000 years. But you can believe what you want.

174 no, 173, it's only crazy if you're a republican.

175 Why are we worried about Rubio getting questions from the MBM that no Dem would get?

I read yesterday that the miracle whiteboard would trump them all. Just whip it out and explain how the budget works and the lefty reporters spontaneously burst into flames

Just remember though .. with the power of the whiteboard comes great responsibility

176 Boy, I wish the Republicans would stop this spontaneous injection of abortion, creation, God, rape, etc into political dialogue. Why do we keep bringing this stuff up? It's not like a bunch of news jerks are just randomly bringing up this stuff. Hope Rubio is ready for the question about Black Liberation Theology.

178 I still haven't figured out how somebody's belief about the age of the earth affects their ability to design an electrical circuit orinvent new polymers. I'd personally like to know why a dogmatic belief in an unverifiablehistorical claim is used as THE litmus test for scientific ability.
