Q: Does Obamacare Impose a 3.8 Percent "Sales Tax" on Your Home?

Well contra the article linked the answer is Yes. The only good news is that most people won't be hit with it...for now.

We've been flooded with queries about this one ever since the health care bill became law. At the last minute, Democratic lawmakers decided on a new 3.8 percent tax on the net investment income of high-income persons. But the claim that this would amount to a $15,200 tax on the sale of a typical $400,000 home is utterly false.

The truth is that only a tiny percentage of home sellers will pay the tax. First of all, only those with incomes over $200,000 a year ($250,000 for married couples filing jointly) will be subject to it. And even for those who have such high incomes, the tax still won't apply to the first $250,000 on profits from the sale of a personal residence - or to the first $500,000 in the case of a married couple selling their home.

But if you own vacation or investment property though, look out:

The Internal Revenue Service says that to qualify for the $250,000/$500,000 exclusion, a seller must have owned the home and lived there as the seller's "main home" for at least two years out of the five years prior to the sale.

OWS is going to start buying distressed debt (medical bills, student loans, etc.) in order to forgive it. As a test run, we spent $500, which bought $14,000 of distressed debt. Well it's their money and they're free to give it away this way if they want.  This may help some people but I suspect OWS will eventually learn what a moral hazard is and/or run out of money.

26 Hi folks! Back from a nice dinner out. We basically have one restaurant locally that "gets it" otherwise we have to schlep up to Salt Lake.

I *loved* Advent calendars as a kid. My godparents, who were so cool b/c they treated me like a real person, would send me one every year. Loved loved loved when that big envelope would arrive in the mail. LOVED the colorful, be-glittered cardboard-y calendar. Happy memories.

Hmmm ... if it's possible to buy back $14,000 worth of debt for $500 (about 3.5 cents on the dollar), why don't debtors just ... *buy back their own debt*?

I know, I know, they're debtors, they don't have any money. But even a down-and-outer should be able to raise that kind of money.

By the way, if the OWS types want to spend their money that way, why not? It's their cash, and it's better on that than than the mischief they usually indulge in.

I believe you can take it out without penalty if you use it as a downpayment on a primary residence. But, don't take my word for it, ask somebody who actually knows (or google it). You can also move it from whatever funds or other instruments it's in and put in a cash position. That doesn't show any growth, but it also shows no shrinkage. Yet . . .

Why would you? It's already on your credit report and the original lender has already blacklisted you.

But really, lenders will contort in all kinds of ways to lend the original debtor "buy" the debt through a settlement instead, isn't settling a debt for less than originally owed pretty much the same thing?

First will have to roll the 401k into a RothIRA.
If you do a direct withdrawl, your 401k will automatically hold 20%. And then you will be taxed normally on what is left.
If you roll into a RothIRA, that 20% is not withheld but still need to pay taxes.

Second, don't buy silver first off. Pay off your debts first. Then work on building up a tenacity chest to ride out tough times, food and such. Then worry about trade/barter items like silver.

This. You can just borrow your own money from your 401K, up to half of what you have in there, excluding any company match I think. Use the money to pay off debt and then you are paying the interest to yourself rather than someone else.

Getting a girl. These are both smooth collies which will be a relief after all the fur from our rough collie (who is now 3.5 yrs).

After the election my husband panicked and almost backed out. That's actually what got him crying btw, the thought that he couldn't go ahead and get a second dog. But after he settled down and we talked realistically about it, decided to go for it. No vacations until we get a Republican president, except for places we can drive to.

I have little debt. Student loans and a truck payment. I rent a house but am looking to buy a couple of acres with a small house (cash from 401k) to be semi self sufficient if TSHTF. Could I use the money penalty free as a down payment on a house?

A couple of my funds aren't doing anything growth wise but I don't want to move it to the cash position because I won't physically have the money in my possession. Another reason to cash out and take the tax hit at this years rate.

Real debt that they might be able to squeeze money out of costs a hell of a lot more. The Poopers are buying debt that the debtors aren't bothered about (if they are still alive, real people, or in the country) and aren't suffering under.

If the Poopers want to keep doing this, let them, but it's all meaningless. They're doing it for PR not to actually relieve the debt of people who are suffering from its service. I'm willing to bet that if the Occupoopers are paying 3.5 cents on the dollar for this debt that it's only worth 1 cent on the dollar.

Glad your husband didn't change his mind about the second goggie...I have a black Lab, she's always been an only dog and my husband absolutely refused to get another dog. Then, my mom passed away this past Halloween, and I inherited her schnoodle-beagle (which is exactly what it sounds like...a mutt). Made a huge difference in my Lab...she's got someone to rough house with, and I don't find myself constantly dodging tennis balls.

155 Burnitup, as you can tell I have been looking also. Got a 401k from former employment. Thinking of converting it to a RothIRA. Then take it out of the RothIRA to put in normal savings. Ride things until I know my tax bill. Settle that and then work on the debts.

Plus thinking of selling back to dealership my GT500. Still owe on it. They say they might pay as much as $31k depending on condition. A good special selling point on mine is, I have Carrol Shelby's autograph on it. See what they offer after I clean it all up. Then decide.

So, on this OWS buys debt thing.
Here's the deal though, there buying debt at "pennies on the dollar." I'm not fianancial expert, but typically when you get debt that cheap it's because the current holder is so frustrated with collecting on it they've all but given up.
So all OWS is giving money to bankers that they otherwise wouldn't have gotten. Way to live in the irony guys. (Plus we have a system for this, it's called bankrupcy.)

You should continue to contribute to your 401K at least up to the level that your company matches- it's free money and your account will grow faster. If you're worried about erosion of the amount you already have in it, pick another fund that may have a lower return, but is less exposed to market risk- a government bond fund, for example. Stay away from target date funds- they're losers.

Not an auto industry anecdote, but aerospace. The day after the election, and I'm not kidding, _the_ day after the election, not even waiting until the close of business, Boeing's defense group announced they were going to lay off a metric fuckton of people.

Their assembly workforce is unionized, and their engineers are unionized. So they are going after the midlevel white collar managerial types. For those folks, first the company is going to roll back to 2010 headcount and then cut another 30% on top of that. Hope they have enough cardboard boxes.

Wonder how many of these people voted for Barky or stayed home?

Yes, but I keep trying to explain that "The first principle is that the principal wants to be your pal" and no one gets it. I somehow don't think your very fine example is going to help, either. It's not that any of these little things are so very hard, it's that people don't seem to have had them pounded into their heads when they were young, and it's probably too late (and too irritating) now. But it does make communication clearer, truly, it does.

Haven't been here for a few days. I'm in a rural area very close to the border and enjoying the isolation. The road that I'm on dead ends at the border and once or twice a week a silver car races down it and then tears back up and disappears. Probably collecting what was thrown over the fence.

Still taking the election hard, and don't see a heck of a lot in the future that is bright. Financially I think we're screwed.

So I was compelled to look at the foreign trucks and was happily surprised to discover Toyota Tundra is the ONLY pick-up designed and built in the United States (GM builds their trucks in Canada, Ford and Dodge in Mexico...no, Ford devotees, those F-350s that are occasionally rolled out in Kentucky so Ford can claim they build their truck in the U.S. do NOT count), and they're built by non-union workers in San Antonio.

My Tundra's at 60,000 miles now and all I've ever had to do was change the oil and rotate the tires. Still runs as quiet as when I first bought her and that's after hauling multiple loads, trips into the mountains off-road for camping or Christmas Trees and other assorted abuse. I have the 4.7 liter V-8, get 22 miles/gallon on the freeway and can pull up to five tons with very little power loss. Rides in the worst kind of snow/ice conditions as though it were a dry sunny day, and that sweet sport shifter; I can switch between manual and auto transmission on the fly.

Best truck I've ever owned...pretty sure it'll be my last, too.

Too many parents have been sold on the idea of an "experience" for their kids complete with lofty halls, housing, sororities/fraternaties, etc. Schools capitalize on this.

That's right. In inflationary times you want to build up as much fixed rate debt as you possibly can. Using the money to buy hard assets is a double win.

Frankly, at the rates today (artificially held, as they are) it is silly not to take on ungodly amounts of debt. The question is how long they artificially hold the rates down - or even drive them down further from these insanely low levels.

Being debt free is fantastic for people who are in danger of becoming unemployed or having their income drop. If you don't owe money on anything, you'd be surprised how cheaply you can live. Especially if you know how to buy cheap groceries.

Same here. Last summer I bought my first Toyota, an FJ instead of the Jeep I was looking at before the bailout. Its a great truck by the way.

Then, at the end of this summer I was in the market for a motorcycle. I wanted to buy American, but the fact that Harley is union made stuck in my craw a bit. So, I looked into Victory. They're made in Iowa by non-union workers. Turns out, they have a reputation for being higher performance and more reliable than HD. I bought mine at the end of August and absolutely love it. The weather in Minnesota is about to shut me down, but I have had a blast on it so far.

Moral of the story, the Unions can fuck off and die. I'll never give them another red cent.

i'm not sure what "other alternatives" you could possibly be talking about, unless you think everyone should be a mechanic or work in retail of join the military for life...even engineering and science degrees cost $35 000 a year, for the record, and no, sorry, taking "courses" online with scam operations like university of phoenix doesn't provide the same sort of opportunities for career-oriented job placement that a degree from a real four-year university would.

especially not in an economy like this one, where it's truly an employer's market, and even folks with high-powered degrees are in some cases reduced to seeking employment incommensurate with their level of education.

alum associations unfortunately perpetuate an in-group sort of nepotism, so even the university you attend can be instrumental in landing you a "real" job upon graduation. alums from harvard and the ivies are known for their preferential hiring of "their own", but even state schools like A&M and UT, both heavily involved in texas oil, encourage cultures of school preference that manifest as a sort of "school-choice affirmative action".

it's a hard sell to tell me that a kid entering college with a dream, who has never tried for a real job and knows no more about the job market and placement rates than what the university's Lying Lying Liars tell them, can be held fully responsible for believing what he's told.

466 I bought a used 1991 Toyota Corolla station wagon in 1999 and it's the best car I've ever owned. I don't drive much so it only has 157,000 miles on it. It runs great, but the body is dissolving. I had some body work done last year in order to pass inspection, so hopefully that will buy me a couple more years.

If I can hang on until the collapse and deflation, then maybe I'll be able to pick up a slightly used Beemer or something in trade for a can of soup.

I was in Mountain View......a bit closer....and in a building-type that failed miserably in the 1994 Northridge quake (apartments over parking). But even old building codes are better than no building codes at all. My father retired as the #3 Engineer for the City of Los Angeles, and I will firmly maintain that building inspectors are some of the great unsung heroes of the modern world, even though they can be a serious pain in the ass.

And, yes -- I really believe that even though I've intentionally thwarted them at times. I was involved with a commercial project in South San Jose that involved putting a driveway across a sidewalk.

Attempt #1 -- by the book. Passed all inspections. Had a few grading vehicles go over it, and it cracked. Inspector made us replace it.
Attempt #2 -- by the book, with added rebar. Passed all inspections. Had a few concrete trucks go over it, and it cracked. Inspector made us replace it.
Attempt #3 -- by the book until the inspector completed "pre-pour" inspection....then went back, and dug another 6" out of that MF the night before the pour. Laid in serious rebar and wire mesh. Hitler's bunker could only wish that it could have so much concrete and steel. Despite subsequent abuse, didn't crack. Only problem is if the city ever decides to run a sewer pipe through that area or something.

But then she comes home and we have to hire 24 hour nursing. The money is going to run out fast. So far she's not in the kind of pain my dad was at this point, but i don't know how long that will last. Its horrible to watch her go through this. I wish God would take her before it gets worse.

I am convinced the Prius is an ingenious marketing ploy. I know four people who own a Prius and rave about them...except all they rave about is gas mileage. That's it...no mention of comfort, quiet ride, great handling, durability, etc. etc. JUST MILEAGE! Finally, my aunt broke down and said she couldn't understand why her Prius wasn't getting the fuel mileage she was "promised". She drives on a freeway for thirty miles each way in her daily commute, right around 70 mph. I explained to her the "great" mileage only occurs at city speeds when the electric motor does most of the work; usually 35 mph or less. When I asked her what her freeway mileage was I almost spewed my soda through my nose:

17 mi./gallon.

I am convinced Toyota markets the Prius solely to deluded lefties who refuse to look at their actual mileage and just tell themselves how awesome they are. And then there's the ridiculously expensive battery...

I don't know where that comes from, but Auto statistics online are AFU. My Wild Ass Guess is that Toyotas sold about 170k out of 1.2 million total sales over the last year. That won't be continuous going back in time, but unless 1 million of those were Ladas, I don't see Toyota being a majority of anything.

It's not that big a deal, I just have a pet peeve about *really* obviously wrong ideas. Especially if I hear them a lot.

Sorry to hear that. Depending on the nature of the thing, you could attack/drain it on the theory that a minor injury is better than a major swollen injury (being sure to disinfect thoroughly).

Or just pad it adequately with a gap at the surface and try not to move too much in your sleep.

In either case, anti-inflammatories should help both the pain and the injury itself, provided you don't use them to excess.

Hope you get better soon. Also, take care to use shoes that fit. Extra socks and larger shoes might have helped.

Just woke up for no real reason and thought I would check the tail end of the ONT for a moment to put me back in a slumberous mood.

I see jimi ray is pissed because everyone is pointing out the obvious to him (that he's a dick), and DAve (another dick) has for some reason decided to ride to the first dick's rescue. That's usually not a good idea online, but what are you going to do, dicks will be dicks, after all that's their nature.

I've been noticing the upstream observation that Obama voters are inordinately angry and/or quiet this time around, which is fine by me. I hate those stupid free-loading motherfuckers, and they can be mad about the fact that they're a mob of losers being manipulated by an unethical, anti-American con man all they want. They voted for his ass, I hope they wind up eating cat food.

Big Ben has the Favre injury, huh? Too bad, the Steelers were on a roll. Maybe he'll play through the pain like a good serial rapist should. He'll have to or they have no shot against the Ravens (whose star murderous linebacker is also out).

757 Do NOT underestimate the OWS Rolling Jubilee. It's absolutely the smartest move OWS has ever made, and it is dangerous as hell. The Tea Party should look into encouraging people to do the same thing, completely transparently and without a big fuss, because if OWS is alone in this it'll get 'em respect and power.

The Rolling Jubilee and Occupy Sandy -- OWS's private relief effort -- are clear signs that OWS is pursuing power as a radical party. Why do I say this? Well, because the "tangible benefit" model is exactly what the Golden Dawn is doing in Greece, and what radical parties like the Black Panthers did in ghettoes in their heyday. Provide a tangible benefit to people in need, and they will remember you. OWS is in the process of buying voters' goodwill.

Greeks will remember that Golden Dawn helped them when the police couldn't or wouldn't help. People will remember that yeah, they've still got all of this debt, but they got a letter from OWS saying "a portion of it is paid off, and we hope that this helps a little." People will remember that they keep seeing little ads in the paper every week with OWS touting the number of people who've had debt retired or eased. People will start *asking for help* from OWS, and OWS will try to deliver what it can as best it can.

And someday, at the polling place, they'll ask for a favor in exchange.

The issue to attack on is transparency. Didn't OWS get a truckload of donations before? Where did that money go? Why should they get more money for the Rolling Jubilee? What is that money for? How much of it will actually go to debt relief, and how much into OWS's pockets for whatever reason?

This debt-forgiveness thing sounds like something that would be reasonable and fun to do. If people knew how, they could buy $500 worth of debt themselves and then forgive it, without having to give money to OWS. That approach is what the Tea Party should encourage. Personal charity is way better than reliance on gummint or OWS.
