The Stemberg Settlement Saga Celebrates Its Silver Anniversary, By The Usual Custom of Dragging Mitt Romney Into It

This is an update to the last post. TMZ is reporting Gloria Allred's supposed October Surprise is just a relitigation of the Stemberg divorce settlement from 1986 (yes, the year the Mets won the World Series, that long ago) at which Romney testified.

Read this. It's from a Boston Herald opinion piece (well, it sure looks like opinion) that's no longer available. You can find it by searching on the Boston Herald site for "Maureen Sullivan Stemberg." It's the fourth article down.

From 2006:

Maureen Sullivan Stemberg, ex-wife of Staples founder, sits in her $5,200 a month, 14th-floor, concierge-at-the-door, elegantly furnished Back Bay apartment and tells you she’s broke. She can’t work. She can’t afford a car, her medications, her rent, even the family springer spaniel, J.J., who she just gave away.

She produces doctors notes detailing medical woes: possible lupus, bouts of pneumonia requiring hospitalizations, a history of cancer, petit mal seizures, plus recommendations for thrice weekly psychotherapy and psychiatry. She says her insurance won’t cover mental health care.

“I’m going to be out on the street,” says Sullivan Stemberg, a tiny, 50-ish woman who alternates between an overanxious recitation of worries, and tears. “I’ve had a change of circumstances.”

And now she wants her ex-husband, Tom Stemberg, whose worth has been estimated at upwards of $150 million, to dramatically increase his support, guarantee health insurance forever and buy her another home in a concierge building. “I’m sicker and thinner every day,” she says. “I’m not asking for anything more than he did for his other wife and girlfriend.”

Now, even in 2006 Romney was planning a presidential bid, so the Herald notes the "political" angle:

Tom Stemberg, meanwhile, hailed as an entrepreneurial genius, has just gone through a second divorce and is now living with the mother of his newest child. His paternal shortcomings are evident in a letter he wrote to his then-12-year-old son with Sullivan Stemberg. “It will not be possible for you to be part of our family in the foreseeable future” because of the child’s supposed misbehavior during their divorce, he wrote, blaming the child for taking sides between parents and creating unbearable hassles, such as monthly court appearances.

Enter a political angle: That same child, the same year - 1996 - approached Mitt Romney, an early Staples money man, during a chance vacation meeting. The Wall Street Journal and Sullivan Stemberg herself say her son asked Romney for an appointment to speak about his mother’s problems, financial and otherwise.

Apparently this did not cause Mitt Romney alarm. In April, our would-be president began an op-ed article, also for the Journal, this way: “Only weeks after I was elected governor, Tom Stemberg told me that if you really want to help people, find a way to get everyone health insurance,” Romney wrote. When Romney expressed doubts, he said, Stemberg insisted, “You can find a way.”

Long story short, although Maureen Sullivan Stemberg had a pretty big settlement, in normal human terms, it wasn't a mega-settlement, and her ex-husband wound up mega-rich. And she seems to have spent a lot of it on contesting the settlement itself. And then she was hit with medical problems.

So, she wants more money.

So the 2006 version of this story was put out, it seems, to pressure Romney to pressure Stemberg to open his wallet and voluntarily agree to increase Sullivan Stemberg's support.

I mean, that is the whole point of the Herald article. It concluded:

The story is what a rich, local superstar has done, or not done, for the mother of his son who can’t support herself anymore. It’s hard for mere mortals to relate to this, I know. Still, despite the awfulness on both sides, he should give her the money.

Until then, here’s hoping Romney and other local luminaries skip the Stemberg accolades. The personal is political here, and the personal reeks.

She'd been arguing for years -- apparently "shopping her story" around -- that her husband should increase his upkeep payments to her.

But this divorce is now 25 years old.

I see the 2006 story as essentially arguing the former Mrs. Stemberg should be paid more, because, Romney.

Should a president be friends with such a heartless skinflint?, the argument seems to go.

And, Should a president be friends with someone who turns away his own son?

That last one is bad... for Stemberg. I don't really see the Romney angle, except in extremely contrived fashion.

I do not see any reason to think the six-years-later version of the story is much different.

I note there were no prior allegations of "juicy stuff" about Romney. Seems to me the Former Mrs. Stemberg's just relitigates the terms of her divorce every few years.

I'm not taking any position on the case of Stemberg v. Stemberg. I'm just asking what the hell on earth this has to do with Mitt Romney, except that he is -- as he was in 2006 -- a convenient catspaw.

It Also Seems To Me... That this is not a political story. It seems to me that the Romney Card has been played simply in hopes of pressuring Romney into pressuring Stemberg.

That's how it was played in 2006.

Again, I have no idea if the Former Mrs. Stemberg "deserves" more money or whatever.

I know the law seems pretty clear that she's not legally entitled to more. The settlement has been litigated (apparently more than once) and has been on the books for 25 years.

Hence, a series of non-legal arguments about it.

And I think the devious Ms. Allred is playing the media (and Drudge) for fools in what is simply a straight money play.

Stoke up interest by suggesting this is a ROMNEY SCANDAL and hope that that serves to open the vault.

And I Repeat... This is 25 year old divorce.

Are there really "juicy allegations" about a third party in the divorce papers?

Juicy allegations that apparently haven't been previously known?

Juicy allegations usually get passed around a spell. That's what makes them juicy.

This is Gloria Allred's Second Finest Moment. Here's her finest.

Theory 2: A reader suggests maybe Allred will claim that Romney testified falsely about the value of Stemberg's worth, or the shares he was offering her in the settlement.

First, you have to understand that a big part of the settlement was Staples shares. Maureen Sullivan Stemberg apparently sold half of these before the company went public... which was a big mistake, because the share value soared. Per TMZ:

According to an article in the Boston Globe in 2005, Maureen received nearly 500,000 shares of Staples stock in the divorce ... but sold half her shares before the company went public.

So her argument might be that Romney was testifying about the value or potential value of the stocks and gave a low valuation which caused her to sell and thus deprived her of millions.... and so pay me.

But if Romney was trying to help his friend, he would have offered a high valuation of the stock, because then Stemberg can give her less. He wouldn't claim the stocks are worth less than he knows they are -- that would just mean Stemberg has to give her more stock to make the same payoff.

This just seems to be a very bad (as it turns out) decision by the Former Mrs. Stemberg.

And, besides, Romney wasn't acting as her financial adviser, even if he did guestimate the value of the stocks. He would have been providing a valuation for the trier of fact (the jury or judge), not for Mrs. Stemberg to take as some kind of financial advice for her to act upon.

If that's the avenue of the complaint: It's not juicy and it doesn't even make any sense. "Lowballing" the value of the stocks just means that Stemberg has to give her more of it, which I'm pretty sure is not the outcome he sought.

Someone Posting as "Maureen Stemberg" on HuffPo... ...who claims to have once been married to Romney's "Partner in Crime, Mr. Staples," says she likes Obama a whole heck of a lot and Mormons not a bit.

Well, it sure does look like a shakedown. These cases are brought at a particularly sensitive time because they have such little merit that only the pressurized atmosphere of a political campaign can invest these nuisance shakedowns with Cash Money Settlement Value.

Also, Clark County (home to Las Vegas and 70% of state's voters) has 89,801 early voters in the 3rd three days, while in ’08 there was only 68,927 after the 3rd day. The Dems lead after 3rd day is 18,095, while in ’08 the lead was 23,004. While this is an improvement, early voting in ’08 was only 60%, while it will probably be around 70% this year. That means it is possible for the Dems to be in a better position with a smaller lead then in ’08, simply because there are even fewer voters left to vote. In ’08, iirc, the Dems actually did better than the GOP on election day voters.

Romneycare would have covered her pre-existing conditions and would have covered all her aliments. This line will be hard to convey with Romneycare. We all thought Romneycare would hurt Mitt but the fact that he passed this bill that covered all her aliments seems to diminish the heartlessness she may try to portray!

Her grudge is with her ex....but using the Mitt angle highlights her anger and brings her victimhood to light. She wants to embarrass Mitt by showing he stood by his friend against this mean ex-husband while she suffered. But again...did she and not the JUDGE sign off on the agreement on the divorce. I would imagine she had an attorney no? She just thinks Mitt helped him hide money from her that would have given her more. But again, she will not be related to by over 90 percent of the women. It will be the Upper East and West Sides of Manhattan with the super-rich that will think she deserved more...I mean most of those women are on their 3 or 4th marriage!

Plus they know it's not Romney doing the sealing, it's the party to the divorce, so can they can blame him for "covering up" knowing he can't do anything about it.

We're battling over OH, IA, NH, WI, ME-cd3, MI, PA.

The oppo file is opening because it has to. Obama's out of time.

Early voting is always more weighted for democrats, but he needs to change the trajectory before the media is forced to sacrifice him for the greater good like a trapped wolf gnawing it's paw off. Then it becomes free-fall.

Been looking at the numbers with Dave in Fla and think I have a decent grasp of the state of the race; hint, it's not good for Obama and I don't see the uplifting Morgan Freeman ads working.

Realistically, can Obama still swing moderates BACK to him when Romney's at 50%? Honestly, what's a viable course of action other than to just nuke the electorate. Just utterly turn the race into the analog of a WWI no-mans land where it's so fucked, bombarding mud and puddles, so off putting to moderates, that turn-out plunges on both sides to a level in which his locked-in early vote lead can carry him over the top. He's running out of options, if he's going to use the oppo, it'll be soon.

I do wonder if he has the numbers to win that kind of fight, he might. That said, conservatives are like WOPR, we'll open the silos and launch the vote even if everyone's dead.

Nevada registration in '08 is similar to '12. combined with a powerful Dem machine and a GOP civil war (the Idaho and Utah GOP are the ones who are sending out mailers and absentee ballot forms, not the Nevada GOP).

The thing about Nevada is that it always comes down to Clark County. And while it seems like Harry Reid has an awesome local machine there, I honestly don't think that he does. He doesn't have to have one.

What Reid does have is enormously blue and massively union California right next door, controlled by Democratic best buddies of his. Four hours' drive from L.A. to Dingy Harry's Neighborhood.

Every time a big election rolls round, the buses load up with SoCal union goons to head out to Vegas and make sure that things go the way Reid want them to. I would honestly bet that for a few days every major election cycle, local political volunteers are outnumbered in Clark County by out of state carpetbaggers from CA. The amount of precinct-walking, door-knocking firepower available is huge.

This is just one of those structural advantages that liberals have lucked into that are simply going to have to be dealt with as facts on the ground.

Even though the numbers are better, the Dem advantage is still huge. If they build up a big enough lead in raw voter advantage, then they will win. The Dems increased their lead in '08, so I am not so sure a surge on election day would save the GOP, particularly since at least 75% of the votes will already have been cast. If anything, the Dems are well on their way to build-up a big enough early vote "firewall" to survive anything that happens on election day.

Better than in '08? Definitely. But is it good enough? I am not convinced... yet.

A truly perceptive president would have realized that and just caved a bit on the south's demands in exchange for them not getting too cozy with the Brits who still had designs on big chunks of CONUS.

The south would have come around in due time. They knew their lifestyle was going to have to change. That was the nominal excuse. As a practical matter, slavery wouldn't have worked terribly well in those newer states anyway. Shorter growing seasons, and a winter where the slaves would have just been overhead would have muted any advantages.

One only bothers with slaves when there's some sort of economic advantage. The new states were being laced with rail and other machinery would soon follow.

It was an idea who's time had run it course. Give the dinosaurs their last hurrah before the meteor of the industrial revolution fully impacts, it won't matter in the end.

Slavery is endorsed by the Koran. That they managed to eliminate it at all is rather remarkable, although its still practiced in large chunks of Africa.

In Lincoln's day, rail and the steam engine existed. Northern mass production mills were starting to get built, hydro power and some pretty incredible (at the time) complicated flat belt driven machinery was being built.

I don't think it would have taken great leaps of imagination to see where all this was heading WRT the south and its waning institutions.

Trying to wrap my mind around the Reuters projection of a landslide victory for Obama. In their EV map, they give every toss up state to Obama, including Florida, and Virginia. It reeks of desperation.....though I do admit I hate how important the single state of Ohio plays in all this. PA might, or might not be in play, but unless I'm dead, or in jail....I'll be casting a vote for Romney on the 6th.

And depending on how this plays out...the contest could be over before the polls close in Colorado. Let's hope it plays out like that...because if/when it becomes obvious that Obama is going to have to win Colorado, the dunks will put an enormous amount of pressure on that state to get some hurried last minute votes, which will include trying to keep voting places in heavily democrat areas open longer.

It's not a 'uisance.' It's criminal...and it's anational and globaltragedy. Call it 'protection' money. From what I can tell, Stemberg was accused of child abuse and Romney testified on his behalf.

Those allegations appear to be why Stemberg told one of his sons "You're not going to be part of my new family" after the divorce because of the child taking sides and saying a lot of hurtful things during the proceedings.

Scandal, therefore can only be arrived at by getting a team of accountants and stock brokers and whatever else numbers cruncher together, gathering together relevant financial information from twenty-five years ago, and comparing that to whatever numbersRomney subitted back then?
Then, here's the tricky part, selling this as SCANDAL to people who are largely mystified by the operation of an ATM.

I'm sorry all the Obama fans will be disappointed, but this is a big fat nothingburger. Romney has already announced that he has no objection to his testimony being unsealed. I'm betting that Allred was fully expecting the ex-husbandwould fight this and that thejudge would rule against her and the Boston Globe. I suspect she thought she could "win by losing" because everyone in the country would be "speculating" about what was in the sealed court records. Unfortunately, Romney killed her October Surprise. Poor little attention whore.

And now...Donald Trump still has his nothingburger coming out today. I wonder if it will have cheese on it?

Romney's lawyer(s) have no objection to the info being released, but the ex-husband doesn't want the gag order lifted, that is my understanding.

No, it's very lame. Per the live twitter coverage, it' over the financials - not parenting.

The MSM is all over the place with this. My sources are the wife and her gf who acts as her wingman. Her son came home with a bloody nose after visiting his father so she accused him of abuse and dragged him into court. Nothing happened and he sued her for libel which was eventually dismissed.

The father sent the letter to the kid which I can't blame him if the son was fabricating abuse and causing him to end up in court.

I suspect she's bulimic and that's the cause of her health problems...her teeth are a telltale. I'm sure the insurance company doesn't cover hypochondria.
