Good question. Now as a Dentist I could probably get away with it for a long time if I did not participate with any Insurance Companies and just took cash or checks ( not a bad idea actually) and flew under the radar. It can be done. And since she was in academia, she never really did anything.

I have my concerns, but I don't plan on pre-emptively shitting myself until at least one debate.
Romney is a strong debater. He bested Gingrich in that Florida debate. When the pressure was on, he came though.
As of right now, the race is essentially tied. Both candidates probably have 47% percent of the vote. Now one of them needs to sway four of the last 6%. I firmly believe they'll head to Romney. If they don't back Obama right now, what reason could they find to do so in the next 5 weeks?

Accidents of any kind -- not just car accidents -- have always been a major cause of death in the overall population, but for suicide to be a greatercause of injurious death than car accidents is a major shift.It not only says a lot about the mental health of the country, butit also says a lot about how Americans use their cars. The Daily mail story cites enhanced seat belt and underage drinking enforcement as leading indicators of why deaths in car accidents have decreased, but I think those are only a part of the story. I think Americans are driving less, pure and simple. Gas is too expensive, for one thing. For another, too many people are out of work and don't have a commute. Speaking from a personal perspective, the weekend drives I used to take up to the mountains or out to the Connecticut River valley region have been abandoned. I just can't afford it. And I'm sure I'm not the only one.

That's the problem with having a position of "authority." People assume you are ethical. It should not be a foregone conclusion - but it usually is. Does anyone here seriously ask for a doctor's med school diploma and license before they book any appointment?

No, we trust "government" to make sure that happens.

It's nice when I see all that stuff hanging on the wall when you walk in, but we all have a general assumption, unless you live in Third World shitholes like Detroit or Southeast DC, that you are who you say you are.

Yet another questionable practice.

45 The Warren UPL issue is actually a huge thing. Professionally I must be very careful to make clear that I am not licensed to practice and that I cannot give out legal advice to clients, even when I know the answer. If I were to do so, then that would be UPL and I could potentially face criminal charges. The internet mandatory disclaimers of I'm not your lawyer, I'm not licensed to practice in your state, I'm not giving specific legal advice to you aren't really jokes, even though I try to couch it that way. They really are mandatory to make clear that I'm not a licensed practicing attorney and I'm not representing you. Hell, yes, it's ass covering but there's a reason for that. That reason would be that in many jurisdictions UPL is a crime.

State bars guard their ranks very jealously indeed. I'll give an example, last I knew you couldn't practice in NJ courts, even if you were licensed in NJ, unless you maintained an actual, physical office in NJ. A PO box or some pooled storefront where 20 lawyers share one receptionist didn't count. It had to be an actual office. I can't remember all the details, but I know there was a big stink a few years back about corporate legal counsel providing advice to their client without actually being licensed to practice in all the various states/Federal bars. It's a Serious Thing indeed.

Now, it's possible that Warren was being admitted pro hac vice on a case by case basis. That would explain her representation without being admitted to the state bar directly. Even so, it's appears this is right on the line of what is and isn't permissible.

Mitt Romney is a man who has made a lot of money through his business ventures, and continues to make a lot of money through investments. Yes, by a strict interpretation of the law, he may have paid more than required in income taxes. However, is that really more than the almost inevitable costs associated with one or more audits over the last 10 years? Or was he, in essence, paying a premium on de facto audit insurance?

NATIONAL SECURITY
Obama: “Let’s stop playing politics with our military. Let’s get serious and reduce our deficit and keep our military strong. Let’s take some of the money that we’re saving because we’re not fighting in Iraq and because we’re winding down in Afghanistan — use half that money to pay down our deficit; let’s use half of it to do some nation-building here in the United States of America.” — July 23, before the national convention of the Veterans of Foreign Wars in Reno, Nev.

Romney: “We have two courses we can follow: One is to follow in the pathway of Europe, to shrink our military smaller and smaller to pay for our social needs. The other is to commit to preserve America as the strongest military in the world, second to none, with no comparable power anywhere in the world.” — May 28, at the Veterans Museum and Memorial Center in San Diego.

DOD BUDGET
Obama: Calls for $2.8 trillion in defense spending from 2013 through 2017, with placeholders totaling about $180 billion in contingency operations from 2014 through 2017. This reflects a $487 billion reduction in planned spending, as ordered by the 2011 Budget Control Act. More cuts are possible if Congress and the White House can agree on deficit reduction. The Democratic Party platform for 2012 suggests that defense cuts would be part of such an agreement, without providing details on the size of such cuts.

Romney: Pledges to reverse Obama-era defense cuts, so his five-year defense budget would be at least $487 billion bigger, or roughly $3.3 trillion over 10 years. Also proposes to boost defense spending to a level equal to 4 percent of the nation’s gross domestic product. The 2013 budget, $613.5 billion including regular and contingency spending, equals about 3.5 percent of GDP. A budget that is 4 percent of GDP would be about $641 billion. He has not said how he would pay for the additional costs.

FORCE SIZE
Obama: Five-year plan proposes a 7.2 percent reduction in the active-duty force by the end of fiscal 2017, largely by returning the Army and Marine Corps to their pre-9/11 sizes. The Army reduction would be 12.8 percent, leaving an active force of 490,000. The Marine cut would be 9.9 percent, leaving a force of 182,100. The Navy would face a modest 1.9 percent reduction, to 319,000. The Air Force would shrink just 1.3 percent, dropping to a force of 328,600.

Romney: Promises to stop all active and reserve personnel reductions, leaving the Army at 552,100, the Air Force at 328,900, the Navy at 322,700 and the Marine Corps at 197,300. Also promises to add 100,000 more people to the active force, although he has not described how the extra personnel would be distributed among the services.

PAY AND BENEFITS
Obama: Proposes 2013 and 2014 pay raises equal to average increases in private-sector wages but would cap military pay raises starting in 2015. The raise that year would be 0.5 percent, followed by raises of 1 percent in 2016 and 1.5 percent in 2017, according to plans provided to Congress. Also proposes increases in Tricare health insurance fees for retirees and proposes fast-track procedures for overhauling military retired pay by appointing a commission whose recommendations would have to be accepted or rejected by Congress without changes.

Romney: Has said nothing about military pay raises or retired pay, but opposes Tricare fee increases for retirees. The GOP platform supports compensation sufficient “to attract and retain quality men and women” and pledges that compensation commitments “shall continue and not be reduced or otherwise diminished while in service, or upon separation, or retirement.”

AFGHANISTAN
Obama: Proposes cutting the number of U.S. troops to about 68,000 by October and closing out U.S. combat operations by the end of 2014.

Romney: Shares the goal of fully transitioning operations to Afghan security forces by the end of 2014 but says the U.S. “should evaluate conditions on the ground and solicit the best advice of our military commanders.”

SOCIAL ISSUES
Obama: Repealed the ban on service by openly gay troops and allows same-sex marriages to be conducted on military bases. Women remain barred from serving in front-line ground combat units, but the Army and Marine Corps are sending some women to ground combat training classes.

Romney: Opposed repealing “don’t ask, don’t tell” while troops were engaged in combat operations but has since said he would not try to reverse course. The Republican platform includes support for a “religious freedom” initiative guaranteeing the right of troops and chaplains who oppose homosexuality on religious grounds to be able to voice their opposition without fear of punishment. The GOP platform says it supports opportunities for women in uniform but would continue to ban them from direct ground combat units.

IRAN
Obama: Says the U.S. “won’t countenance Iran getting a nuclear weapon. My policy is not containment; my policy is not letting them get a nuclear weapon.” Says Iran having a nuclear weapon could lead to a “free-for-all” in the Middle East that would be “very dangerous for the world.”

Romney: Would “use every means necessary to protect ourselves and the region.” Says Iran should not be allowed to build or possess nuclear weapons. “We must not delude ourselves into thinking that containment is an option. We should employ any and all measures to dissuade the Iranian regime from its nuclear course, and it is our fervent hope that diplomatic and economic measures will do so.”

89 Dave, any idea why Rasmussen over samples dems by two when his own party affiliation poll shows it R 37.6-D 33.3? I would assume there's some reason, but nothing that I can make sense of. Also, I pulled up the history of party affiliation. Do you have the party affiliation for the 2010 and 2008 elections? I think I heard 2010 was evenly split and 2008 was D+8 or so. The November party numbers on Rasmussen were R 36-D 34.7 in 2010 and R 33.8-D 44.1 2008. I'd like to see some historical evidence on how his party affiliation compares to election results.

That Legal Insurrection article is great if only because it points out how easy it is to be tripped up on the whole unauthorized practice problem. I would agree that this at the very least looks bad. I read fairly quickly so I'm not sure if the filings were checked on a case by case basis for pro hac admission but it's important to recall that electronically available public filings are fairly recent and that information may not be readily available.

As far as the doesn't anyone check, many jurisdictions now require that the signature block for the attorney contain the bar id number. This allows the court and opposing counsel to check license status very quickly. That being said, the court and counsel pretty much assume that if you are practicing before the court, you are able to do so.
