I'm less upset with Morgan than Dempsey. I expect Morgan to be a pussy because (a) he's on CNN and (b) he's a liberal. It's Dempsey's criticism that's the issue. It is such fucking bullshit that I can't even believe he said it.

These guys are not active military. They are either retired or discharged. (All of them honorably discharged BTW)

You don't give up your right to speak if you've ever worn a uniform. Nor did I note any of these guys standing in front of a camera IN uniform. If they had been, Dempsey would have a point. They weren't...so he doesn't.

When you add all this up, the point of Morgan's guest is correct. Dempsey serves under the Obama Administration, so its logical to expect him to minimize politics in order to keep the military out of the political line-of-fire. Yes he serves the Constitution, but practically he also serves an Administration as a very senior military adviser. Which makes it all the more incredible that he didn't just say, "That's politics. I'm in the military. The military doesn't 'do' politics."

Ironically, it's Dempsey who mixed politics and the military.

1. the Chairman of the Joint Chiefs commands nothing. He is the head of the Joint Chiefs, who themselves command nothing, and only head up the administrative end of their respective service, and act as advisers.
2. Are appointed to that very political position directly by the POTUS and serve at his pleasure.
3. The current CJCS was in fact appointed by Obama.

I worked with his staff directly in Iraq and ran into him on several occasions when he was the CG of the 1st Armored Division. I thought very highly of him.

I think the difference is the implication that someone in uniform gives up that right for all time. That's not true. While on active duty, yes, and someone above noted that until 55 due to possible recall. But absent that? Those who have served have just as much right to call the SCOAMT a SCOAMT as the rest of us. Hell, I would say more so.


Also, and forgive me if I'm wrong, I thought that restriction was for statements made while on duty. There's no restriction against bitching over beers. It may be stupid because of the DWS hair mess of military politics to do so, but it's that's more a de facto restriction than de jure. Like I said, I could be wrong on that.

For officers it is absolute. You can be charged under article 88 for any statement that becomes public. You are bound by this while active, in the reserves at any level including inactive reserves, or retired. The only way to end out is to fully resign your commission.

If your commission is still held by the US at any level, where they have not dropped you from rolls (e.g. If yo get out after your 4 years active you choose to leave you still have 4 years inactive before you can fully resign) you can be charged. For retirees you have to be dropped from rolls (I have no idea when this occurs) before you are 100% clear of ART 88. The US has a habit of maintaining inactive officers on rolls forever unless they specifically resign. Mostly because if they drop they're done, recalling them becomes nigh impossible.
