| Top Headline Comments 7-9-12Happy Monday. The Supreme Court is still leaking like crazy, if this unsourced report-cum-analysis is any indication. The Chief Justice's late switch in the Obamacare case, along with his attempt to strong-arm Justice Kennedy into switching too, looks to leave long-term problems. BTW, I never understood why people were claiming that these leaks came from the liberals or from liberal clerks. This is very obviously coming from the conservative wing of the court, which is seriously, perhaps irrecoverably, pissed off at the Chief Justice. President Obama will give a Rose Garden speech today calling for extending the Bush tax cuts for another year, but only for people making less than $250,000. As you know, the GOP is pushing to permanently extend the Bush tax cuts for all Americans. Each time Obama went up against the GOP on this before, he caved and approved the tax cuts for all, but only after lying his ass off about it. The Romney camp raised $106.1 million last month and has $160 million cash on hand. The Obama folks haven't released their June numbers, but Democrats say that Obama was out-raised, just like in May. The interesting number would be Obama's expenses. Even though he's been making taxpayer-funded trips to avoid paying full cost for travel, the word is that Obama's already spending more than he's taking in.Comments1

Wait, people think this is coming from the left wing? I've assumed two things: first - that these leaks are coming from Kennedy and/or Scalia, possibly even directly and two - that this has fundamentally altered the relationship of the justices no matter who is leaking as leaks like this are unheard of. I've also been pondering the decision more and the more I ponder, the more convinced I become that this didn't actually decide anything. The Roberts argument, such as it is, is that the mandate is constitutional under the taxing authority. That is different than saying explicitly that it is a tax. Now, there may be such an explicit statement in the decision as I haven't reread it. But if not, then I think there may be grounds for a dec action by some entity having to start implementing the 2014 requirements now to say "well, yes or no, is it a tax?" I admit that this is because I want the Obama admin to have to go on record and explicitly state that this is a tax. Not that there still won't be those Dems who say it's not, but still. I am leaning towards Crawford's source being Kennedy or one of his clerks and the cynic in me feels the leaks are not entirely due to anger at Roberts. In terms of the leaks resulting from anger, the leaks (true or not) emphasize Kennedy's role in the process. It was said that Kennedy was visibly angry over the decision to uphold ObamaCare and we know he felt strongly enough about this case to read the dissent. As for a secondary motive, I could see Kennedy using this as an opportunity to redeem himself. It it also not far-fetched to believe ego is playing a role in all this.

I agree that this decision has fundamentally altered the relationships on the SCOTUS. We do have legal scholars on the bench, and ignoring the unconstitutionality of the decision, it was a poorly crafted, illogical and inconsistent legal argument. It has tarnished the reputation of a court that is reeling from recent bad decisions (Kelo). I am sure that at least two of the justices are embarrassed! As for the non-decision decision aspect? Nah, the law stands, and that means that we are well and truly fucked unless Romney wins and promptly signs a repeal...and then unleashes the market in health care. We have other universal service things that the government has imposed along with fees and or taxes, and they are not challenged on Constitutionality.
Electricity and phone service. But the government makes those utilities make it available to you - they don't require you to buy the product, only that you have the option. Universal service increases liberty because it increases your choices. ACA reduces your choices. Because if you don't buy it, you get "taxed." That doesn't make any sense. As per my post of earlier this week, they're still talking on the talk shows about Romney being down by 9 in the swing states like OH, with calls to retool the campaign and get a positive message out about Romney's economic plan. 40% think Obama has one, while only 27% think Romney does. How one could arrive at that conclusion is absolutely beyond me, but there it is.

Crawford's source also contradicts the Salon source in that they claim the dissent was crafted to in the hopes that CJ Roberts would return to his original position regarding the mandate. So her source does not want anyone to believe that Roberts took part in crafting the dissent even if he did.

Roberts will famously go down in history as one of the most loathsome, cowardly justices. But it does not stop there. The SCOTUS has lost an incredible amount of respect and legitimacy with a majority of the public whom it serves.
This won't subside. It will only get worse for Roberts and the court. Most people no longer trust or has any confidence in their judgment. Roberts decisions and the reason for doing so have nothing to do with the law. Any laymen reading his contra-intellectual opinion along with other expert constitutional analysis can determine for themselves his opinion has nothing to do with our Constitution. Roberts decision is nothing but abject stupidity and politics from an unelected branch of our government. Not only has Roberts disgraced the court and distorted its constitutional role, but he has displayed it is no longer a trusted, impartial constitutional arbiter. He has completed the liberal dream of a shadow government that uses the law to dilute and effectively amend our Constitution by extraordinary means. I think this election is going to be very close. Why? Moochers just about outnumber producers.
People vote their pocketbooks. Come November the voters are going to vote for the party they think will put the most money in their pocket. For conservatives that means voting for those that propose less government, enabling you to keep more of your heard-earned money. For moochers that means voting for more government. Moochers include, but are not limited to welfare recipients, government employees (but I repeat myself), government contractors, teachers, union members, government contractors, and spouses of all the above. Add in 90+% of the black population voting for Obama, plus most of the Hispanic vote and we get an enormous voting bloc for Obama and his fellow travelers. File Under Gun Control
When I had my gangrene gallbladder taken out and spent 10 days in the hospital for what should have been an overnight stay the insurance company kicked me out. I had home nurse visits for two weeks and was asked if I had guns in the house. I respond that if I did I would not tell them. So the below has some merit. FYI, I am passing this along...there are comments from two other people I have also been asked if we keep guns in the house. The nurse just slipped it in along with all the other regular questions. I told her I refused to answer because it was against the law to ask. Everyone whether you have guns or not, should give a neutral answer so they have no idea who does and who doesn't. My doctor asked me if I had guns in my house and also if any were loaded. I, of course, answered yes to both questions. Then he asked why I kept a loaded gun close to my bed. I answered that my son, who is a certified gun instructor and also works for Homeland Security, advised me that an unloaded, locked up gun is no protection against criminal attack. The Government now requires these questions be asked of people on Medicare, and probably everyone else. One of the questions on the form I had to fill out was: Do you have any guns in your house?? My answer was none of your damn business!! So it is out there! It is either an insurance issue or government intervention. Either way, it is out there and the second the government gets into your medical records (as they want to under Obama care) it will become a major issue and will ultimately result in lock and load!! The more I think about the ObamaCare decision, the less I understand it. We have an intellectually bright Chief Justice who prides himself on his writing and logic crafting a poorly written, inconsistent argument regarding the mandate as a tax. As for motivation, while Roberts has sometimes overly focused on the legitimacy of the Court, it has not stopped him from overturning laws. Also, while we know that the liberals ran a campaign against the conservatives on the Court and Roberts in particular in the hopes that it would turn his vote, the last time they tried this tactic (over Citizens United), the Chief Justice was offended*, not intimidated. Finally, as for arguments that Roberts has always secretly been a liberal, the people who know him best said/say he is conservative and my understanding is that his opinions usually sound conservative. So his decision is somewhat in-character yet out-of-character.

These Supreme Court leaks are unprecedented. I can't recall anything like this. It underscores the anger at Roberts. And it is almost certainly not a clerk, because clerk to a Supreme Court justice is the most prized law-school graduate job in America, a ticket to anywhere, and no one would jeopardize it. The leak is almost certainly Kennedy himself. If anything good comes of this debacle, it may be the conservative steeling of Kennedy. Another thing to take is perhaps Alito is solid, as apparently no one tried to flip him. (Scalia and Thomas, of course, have long confirmed their conservative bona fides.)
As for the campaign, I have to agree with the assessment of The Hill: Romney has a stronger hand, but Obama is playing his weaker hand better. $100 million on hand? What are we saving up for? I keep hearing that Obama's 'likability' numbers are high. Well, let's get them down, and that is only done through negative ads. As for the non-decision decision aspect? Nah, the law stands, and that means that we are well and truly fucked unless Romney wins and promptly signs a repeal...and then unleashes the market in health care.
What I'm trying to get at with the non-decision decision aspect is that, by leaving open wriggle room for the Obama administration to say that it's a penalty and not a tax and then turn around and say it's a tax and not a penalty, that opens the door to further litigation. If it is a tax, then that possibly brings to bear additional issues regarding the manner in which the bill was passed, possible equal protection challenges and a whole host of other issues. We got into a fight here last week about a Romney advisor saying hey it's not a tax. He has a point. If the Dems want to go out there and say it's not a tax, then, pursuant to the Roberts opinion, the mandate falls as unconstitutional. The fact that there's still an argument about this demonstrates the complete intellectual incoherence of the opinion. I will freely admit that this is somewhat dancing on the head of a pin and mainly just me being bitchy about how very few members of the press are confronting the Dems about how if its not a tax then the mandate must fall. OTOH, if Iwere counsel for an insurance company, I would give serious consideration to filingsome type ofdeclaratory judgment action asthe company is having tospend a metric fucktonof moneyto comply with something that the Obama administration is saying both is and is not constitutional. Whenever I'm at the doctor and am asked the whole do you feel safe at home questions I go into a huge rant about VAWA and privacy and how it's utterly sexist not to mention heteronormative in the actual sense to presume that only men beat women and that female same sex couples never ever have issues with abuse and I may, possibly, have nearly made a poor little PA cry once. My old doctor, bless him, added a note to my chart that I lived alone and to please not ask me those questions as it had a negative impact on my blood pressure. Though, hmmm, I suppose technically it had a positive impact as this would make my blood pressure soar. My new doctor also has a note on the file that I live alone and to not ask. She and I had a nice discussion about how she asks people who live alone, regardless of age, if they have some kind of support system that checks with them every day since bad crap can happen and no one will notice even if you aren't elderly. As a practical concern, a tax can not be 'double taxed' - and thus must be paid with pre-tax dollars - hence, if I'm reading it right, you're eventually looking at a new deduction from your paycheck while those who aren't collecting a paycheck will get it 'paid for' and the amount that was 'paid' refunded to them from those who were taxed. As for Zero's spending....I've been here in Orlando for the past several days on vacation. I see an Obama "Romney is outsourcing jobs; Obama is for insourcing!" commercial every 10 minutes. I have not seen one commercial airing yet from the Romney camp. We're talking Florida...so it has me a bit worried. I wonder when he's going to start rolling out the adverts.

It came up when we were discussing my migraines and how I once apparently knocked myself out or passed out because I was in the bathroom throwing up and came to some undetermined time laterwedged between the toilet and the bathtub. This happened early on a Saturday morning. That was one of the few times I was actually scared to be living alone since if something happened no one would be there tohelp me and no one would have known anything was wrong until a few days later when I didn't show up for work. She said yup and how she pointed out to all her patients who lived alone, regardless of age, that they needed to have someone(s) who would be concerned if they didn't hear from them via text, phone, facebook, twitter, whatever, every day. As she said, anyone can slip in the tub and smash their head. It's one of those things that single people who aren't80 don't think about. It's very difficult to attend an institution for only one year and receive a degree as generally you have to do all of your classes for your major concentration at that institution. This is why a lot of transfer students end up spending another semester or year in the transfer college/university as the transfer place, while accepting the person, doesn't accept the credit earned at the previous institution and, even if they do, they still require for the most part, all credits from the major concentration to be on their watch. When Obama repeats his class warfare rhetoric I would remind his supporters and undecideds that Obama purchased a 1.65 million dollar house and a piece of adjacent land for 105,000 in 2005. Well, I prefer his contribution over the "Shut up, that's why" or "Why do you hate America?" approach that I get from some of the most hard-core establishment types. Which pundits or bloggers are doing something significantly more tangible? Erickson gave a forum for several of the candidates to make their cases. The ones he was leaning towards did not make it. I'm not sure what else he's supposed to do, particularly given that he's more of a journalist with the restrictions that should place on his actions than a lot of the other folks out there. This makes me think of something I've been pondering for a while. Everyone knows how the original "Dawn of the Dead" was supposed to have the hidden message about the negative results of America's consumer culture, hence why the zombies were all attacking the survivors in the MALL, etc, etc. Personally I just like it because I like zombie movies, but whatevs. It occurs to me that, since zombies are popular now more than ever, the Horde could write a pretty damn good movie (or book) with the underlying theme being how the leech mentality of the welfare state will be the downfall of all civilizations. The healthy and robust are inevitably overrun and consumed by the wragged, mangy hordes that have no focus other than their own satiation. Cowards throw their courageous brethren to the zombie masses in an attempt to stave off their own death at the hands of the mindless, shambling dead, but its like feeding the animals in a National Park. They know you'll give them easy meat, and so instead of being satisfied with what they're given, they come on doubly strong in search of more, more, MORE. I have no screenwriting experience, but tell me that doesn't make a helluva lot more thematic sense than zombies attacking a mall as a critique of consumerism. File Under Gun Control
When I had my gangrene gallbladder taken out and spent 10 days in the hospital for what should have been an overnight stay the insurance company kicked me out. I had home nurse visits for two weeks and was asked if I had guns in the house. I respond that if I did I would not tell them. So the below has some merit. FYI, I am passing this along...there are comments from two other people I have also been asked if we keep guns in the house. The nurse just slipped it in along with all the other regular questions. I told her I refused to answer because it was against the law to ask. Everyone whether you have guns or not, should give a neutral answer so they have no idea who does and who doesn't. My doctor asked me if I had guns in my house and also if any were loaded. I, of course, answered yes to both questions. Then he asked why I kept a loaded gun close to my bed. I answered that my son, who is a certified gun instructor and also works for Homeland Security, advised me that an unloaded, locked up gun is no protection against criminal attack. The Government now requires these questions be asked of people on Medicare, and probably everyone else. Just passing this along for your information: I had to visit a doctor other than my regular doctor when my doctor was on vacation. One of the questions on the form I had to fill out was: Do you have any guns in your house?? My answer was none of your damn business!! So it is out there! It is either an insurance issue or government intervention. Either way, it is out there and the second the government gets into your medical records (as they want to under Obama care) it will become a major issue and will ultimately result in lock and load!! Please pass this on to all the other retired guys and gun owners...Thanks, from a Vietnam Vet and retired Police Officer: I had a doctor’s appointment at the local VA clinic yesterday and found out something very interesting that I would like to pass along. While going through triage before seeing the doctor, I was asked at the end of the exam, three questions: 1. Did I feel stressed? 2. Did I feel threatened? 3. Did I feel like doing harm to someone? The nurse then informed me, that if I had answered yes to any of the questions, I would have lost my concealed carry permit as it would have gone into my medical records and the VA would have reported it to Homeland Security. It looks like they are going after the vets first. Other gun people like retired law enforcement will probably be next. Then when they go after the civilians, what argument will they have? Be forewarned and be aware. The Obama administration has gone on record as considering veterans and gun owner’s potential terrorists. Whether you are a gun owner, veteran or not, YOU'VE BEEN WARNED! I still think the House Repubs should introduce and pass a Bill.. Saying that ObamaCare is NOT a Tax... Dems would HAVE to vote for it.... it would be bipartisan... Then, Fillibuster every bill in the Senate until it gets an up or down vote... Then on to the Prezzys desk... where he either signs it, or he owns the biggest Tax hike in History.... I'm telling you it is for families. It just makes sense. If it were for individuals, then it would be more for families, and that would not be a nice round number. To help you determine whether it is for families or individuals, ask yourself, which one brings in more tax. That gives you the answer.

In my non-finance world, it would appear to say that you buy the bond for x , when it matures, you get x minutes some amount back. Is that correct? Who buys negative interest bonds? Romney may have brought in more cash in June, but Obama has the power to give away government money and gifts like amnesty. For example, 2 of the 3 new US Patent Offices will be located in swing states of Colorado Ohio (the other will ne in CA, 'natch). He's going to be giving a lot more goodies between now and election day. Romney needs to step u the attacks, and the specifics on what he would do as president to fix the economy, ASAP!
