BREAKING: Obama To Institute Portion Of DREAM Act Via Executive Fiat

flaming_skull2a.gif

More details soon but it looks like "young" people who came here as kids will get work permits, no path to citizenship.

Stand by for details.

Constitution? Never heard of it.

Politically it's brilliant desperate. It will energize his base and force the GOP to talk about being anti-DREAM Act and anti-illegal immigrant. ("Brilliant was my insta-reax but it's not. To be clear, it shows how weak Obama is. He's blowing off white working class voters but he's going to lose them anyway. He needs to rally his base to hold what he has. This will do that. Of course like most base rallying moves, it will rally the other side's too.)

Added:

"Young" is now defined as "Under 30".

The Obama administration will stop deporting and begin granting work permits to younger illegal immigrants who came to the U.S. as children and have since led law-abiding lives. The election-year initiative addresses a top priority of an influential Latino electorate that has been vocal in its opposition to administration deportation policies.

The policy change, described to The Associated Press by two senior administration officials, will affect as many as 800,000 immigrants who have lived in fear of deportation. It also bypasses Congress and partially achieves the goals of the so-called DREAM Act, a long-sought but never enacted plan to establish a path toward citizenship for young people who came to the United States illegally but who have attended college or served in the military.

Congress rejected the full on DREAM Act and this more modest proposal was basically the Rubio plan that was going to be introduced as legislation at some point. But who needs Congress, right? They just get in the way.

My reaction to this?

In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.

-Stuff Jefferson Actually Wrote, 3rd Edition, Revised.

I'm sure high unemployment swing state voters will be thrilled with millions of new workers now competing against them.

1:15 eastern Rose Garden announcement.

This will also step on Romney's bus tour a bit. It will be interesting to see how Mitt reacts. My guess? He won't very much. He'll stay focused on jobs and the economy.

2 This is outrageous.

Under the president’s “deferred action” executive order, students in the U.S. who are already in deportation proceedings or those who qualify
for the DREAM Act and have yet to come forward to Department of Homeland
Security (DHS) officials, will not be deported and will be allowed to work in the United States.

I disagree. If you frame it right, you can actually split the Latino vote into two groups......those that followed the rules and those that did not. To the one's that followed the rules, you can explain that these "young people" broke the law, did not wait in line like you did, did not put in the work that you did and are now being rewarded like you were without all the hard work and effort you put into. Obama insults you with this action.

If these young illegals are that smart they will figure this out. Getting a work permit now will just make it easier for the next Administration to find them and deport them.

All Romney should say about this is that is is another example of Obama abusing his power and not working with Congress on a solution as a leader should. Part of the reason Obama is doing this is an attempt to tar-baby Romney and get him to counterattack in a way that makes him and Republicans sound racist and mean. They should not take the bait.

He has, in essence, just deemed Congress unnecessary. And, because it suits his ideological goals, Harry Reid will just bend over sit back and take it. And Boehner is too much of a wimp to press the issue in any case.

Marco Rubio and Lynn Graham need to come out and force-ably oppose this. He can yammer on about agreeing with the results, but ends do not justify means. He needs to say this is a brazen run around the Constitution and Congress and that even those who agree with it must stand against a SCFMT to oppose this executive action.

Romney can then point to their response...say the Constitution has parameters we should follow...defer to Congress as the place this should be addressed, not executive fiat...and then reframe to the economy.

And addressing this doesn't have to do with jobs and the economy? It's a pretty easy tie-in.

He hasn't lost much ground among hispanics, so this whole thing is solely about energizing the base. Mitt could easily use this to further erode blacks' support of Obama since the loss of min wage jobs hurts them disproportionately higher.

I'm not seeing the political brilliance of the move personally, but there's no guarantee Mitt is going to exploit this.

The first.... by executive order..... is the legalization of marijuana. Its high time we called a truce on the War on Drugs.

Anyone from a legal immigrant family is keenly aware of the timeconsuming hurdles and legalities that have to be observed. Anytime I've gotten into these discussions with pro-illegals, I remind them how my parents had to comply with the law in order to become resident aliens and eventually naturalized. The compliance included medical screenings and immunizations. We're not too thrilled with the notion that so many can "jump the line" due to political expediency.

Executive Orders (EO) are not enforceable until Congress
approves and adopts the measure into the Code of Federal Regulations. I know
this, since my fellow co-workers and I tried to use another EO to protect our
jobs last year and we were told by our lawyers and the Department of Labor,
that since Congress had not validated the EO and approved steps to implement it,
we were SOL and could not use the EO to keep our jobs.

This is just another PR stunt to try and support his
diminishing support among Latinos

201 Honestly, let's not give Obama too much credit on any brilliant political moves, because near as I can tell he has made none in the past 3 years. Not one move of his can be called politically brillian. In fact, judging by the 2010 midterm elections, I would say most were politcially devestating. Nor are his speeches or statements politcally brilliant, again judging by his declining poll numbers every time he speaks, they are usually political pitfalls. Obama and his staff are just flat out bad at politics. His best political move was probably the debt ceiling vote. But there was no political brilliance there. We are upset with the GOP for not taking advantage of the situation. But Obama has not been able to pin any blame on the GOP (ala Clinton and the shutdown). This is an amateur. But he is also operating from an ideology not shared by the majority of the country. No amount of genius can overcome that.

Still waiting for "Escape From Detroit". In 2013, the crime rate in the United States rises four hundred percent. The once semi-OK city of Detroit becomes the one maximum security prison for the entire country. A fifty-foot containment wall is erected around the city. All bridges and waterways are mined. The United States Police Force, like an army, is encamped around the island. There are no guards inside the prison, only prisoners and the worlds they have made. The rules are simple: once you go in, you don't come out.

Here is a guy who is willing to blow barrels of political capital on gays (not just marriage, but DADT, etc.) and on Hispanic non-citizens. Both of these are either wildly unpopular with the black community or are to their general economic detriment in a serious way and still he's "on their side."

How, exactly?

Everything he does in favor of blacks is either narrow or cheap. For example, not prosecuting the NBPP. Like most "social justice", what good does it do the average person? It hurts them for several reasons, but the politically powerful-ish allies of the administration get a benefit.

Stating that he'd have a son that looks like Trayvon -- again, cheap.

But they will almost all backfire. Bush barely won as a war-time president who successfully navigated us out of a recession, had low unemployment, and prevented a 2nd attack that many expected. What has Obama accomplished. I would say that Mitt should take the summer off so that he doesn't get in the way, but he has been pretty effective at highlighting the weaknesses of Obama. It will get worse, here's how:

At some point, it will be lost. Obama's numbers will regularly show him losing by at least 5 points and even though his minions will be temporarily buoyed by his convention bounce, it won't last. The EV map will be red enough to guarantee a Romney win.

So what happens? Well, he has nothing to lose and he'll be going into legacy mode. He'll do much more of this, not with the intention of winning the election but of rallying the base and getting votes for Congressional candidates.

The rewriting of the Obama years, BTW, will be maddening. He will be socialist in retrospect and that will be spun as a good thing.

350 So, with the 1000th law broken by this administration, and the recent abundant evidences that the legal system of this nation is totally FUBAR, are we ready yet to state the obvious?

We are now subject to an illegitimate government. We have to obey the law because of the state's coercive power, but the moral obligation to obey has been torn to tatters. The law is just a tool used to beat your enemies, now. Hopefully the next Republican administration will remember this, and either lead the effort to fix it, or use it ruthlessly to smash the libtards. Eitheroption is OK with me.

Can they vote (legally) with work permits? I think not.
I honestly have mixed feelings regarding those who were brought here illegally as children...especially those who have lived as productive and law-abiding citizens since then. However, an action of this signifigance is way beyond what any one man or woman as President should ever be allowed. This type of decision is custom made for Congress, and Obama knows it. He is desperate, but even more this demonstrates his contempt for the position he was elected to, the American political system and Constitution, and the American people.
He obviously thinks he's being smart here...diverting attention from his record and the economy, where he loses. His polling must make him feel more confident framing more of the campaign on this issue and forcing the Republican's hand. Mitt has to be smart here, but the Republican campaign forced Romney to pidgeon-hole himself on immigration. The Rubio element will be interesting. Republicans need to hit back hard on both the issues of the power grab Obama has just attempted plus the effect on the economy for young Americans that the baby boomers have just been putting through college.

House Judiciary Committee Chairman Lamar Smith (R-TX) issued this statement

“President Obama’s decision to grant amnesty to potentially millions of illegal immigrants is a breach of faith with the American people. It also blatantly ignores the rule of law that is the foundation of our democracy. This huge policy shift has horrible consequences for unemployed Americans looking for jobs and violates President Obama’s oath to uphold the laws of this land.

“President Obama’s amnesty only benefits illegal immigrants, not Americans, and is a magnet for fraud. Many illegal immigrants will falsely claim they came here as children and the federal government has no way to check whether their claims are true. And once these illegal immigrants are granted deferred action, they can then apply for a work permit, which the Administration routinely grants 90% of the time.

“How can the Administration justify allowing illegal immigrants to work in the U.S. when millions of Americans are unemployed? President Obama and his administration once again have put partisan politics and illegal immigrants ahead of the rule of law and the American people. With this track record, it’s looking more likely that even President Obama may lose his job in this economy when Americans go to the polls this November.”

546 How exactly are these new no-longer-illegal workers going to take jobs away from citizens and legal residents? If they already have the jobs then they already have the jobs, all this is doing is formalizing it.

Except now, because these people are legal, their employers will be required to identify them and pay all required employment and payroll taxes and comply with all labor laws (including sexual harassment). Which means that with the stroke of a pen employers don't have as muchincentive to hire the no-longer-illegal workers. Which means that many will likely go out and hire still-illegal workers or brand-new-illegal workers who are likely at this moment getting their asses across the border as quickly as they can.

This pisses me off, not just because of his misplaced executive fiat, end running of Congress and flouting of the Constitution, but because it shits on people who are trying to immigrate to the United States through legal channels.

There are so many people who WANT to be Americans. They love the US, and they have followed the procedures dictated by federal regulations-they file with the consular section of the US Embassy in their country, they go through interviews, medical testing, financial disclosure, and paperwork out the wazoo, and they do it cheerfully, and readily. Then they wait seven or more years, because assholes who come across illegally get placed ahead of them. It absolutely infuriates me.

I am obviously not against immigration, but I am dead set against illegal immigration.

598 Don't forget that since these "children" are mostly Hispanic, they will also reap the benefits of Affirmative Action. Not only do they get to stay, but they get to go to the front of the line for public sector jobs. Limited number of seats in state colleges and universities? Well, they get to the front of that line as well.

One root of this problem is the No Child Left Behind act, which tested illegal students with the legal students. The teachers unions whined that Hispanic high school aged students, seeing that they wouldn't get to go to college, had no motivation to finish high school. Thus the Hispanic children were dropping out, and ruining the schools NCLB report. One solution is to separate illegal from legal. Another is to give the students motivation to finish college, <i>voila</i>, the Dream Act. If we eliminate NCLB the Department of Education and Affirmative Action, we would all be better off.

* Amnesty by fiat
* 23 million Americans unemployed
* Work permits for illegal aliens

Otherwise, the media is going to get away with calling this a "deportation suspension" when in reality it is a backdoor way to give illegal aliens American jobs.

Obama is doing this on a Friday because he doesn't want the American people to be paying attention to what he is doing (but he wants to be able to secretly tell Hispanics what he is doing in their media).

It should be ALL HANDS ON DECK on the Republican side of the aisle characterizing this as a blanket amnesty that will result in the loss of millions of jobs now held by American citizens.

There's no point left in voting in a system without any law.The Dog-Eater signaled how he will defend this crime against America. 605 This is how Fox words this bullshit:

Administration will begin giving work permits to younger illegal
immigrants who came to U.S. as children and have obeyed the law — a
policy shift that skips Congress, where it had been attacked by GOP as a
form of amnesty.

607 I realize we need to keep Romney on message, but he still has to address this. Someone recommended framing it in terms of jobs/unemployment and I think that is the safest way to go. Our governors, reps, and senators can tackle the other constitutional stuff (I don't think Mitt is up to the task of debating that anyway, frankly).

But I need to see some evidence that Mitt is the "severe conservative" on immigration that he claimed to be last fall.

And I do NOT want Rubio on the ticket. He contributed to this mess by showing softness on the issue and went way off message to boot.

Not so :

Reuters September 20, 2011

The Obama administration had deported about 1.06 million as of September 12, against 1.57 million in Bush's two full presidential terms.

This seeming contradiction between rhetoric and reality is a key element of debate over U.S. immigration policy, and stakes are high for 2012's presidential election as Obama faces criticism from both conservatives and liberals.

609 He is attempting to destabilize the electorate in Arizona and Texas with this Dictat. This Kingly Proclamation is also an attack against the Constitution and the Congress, both houses. It is a violation of the Rule of Law and the conceptual underpinnings of our Republic. It is Unconstitutional in all respects. It is anti-American in every vantage point you would care to place it in.

It violates our sovereignty and weakens us - the citizens. It spits on the concept of liberty by devaluing it for political gain.

The vileness of this tyrannical order is only going to be exceeded by additional violations/dictats as the days go on.

First, nothing has really changed. No one is being deported, anyway. Especially the children. Maybe, just maybe, the illegal aliens who have committed a crime.

Second, how will the labor unions react to this? I would say they will not be happy, at all. Slave/cheap labor is now supported by the Democrats. This will not only take away their jobs, but also lower the salaries of everyone. Everything the unions are opposed to.

This certainly will make the "1%" happy. All of their maids, nanny's, live-in cooks, and gardeners are now legal. Making it cool to hire slave labor, and now they don't have to hide it! They can be proud, when driving their Prius or Chevy Volt, that their illegal workers - that they pay less than minimum wage are now backed by the "cool" Preezy of the Estados Unidos.

Unfortunately, this will add to the food stamp, poverty, child homelessness, child poverty, and unemployment.

Sure, it would have been considered illegal as all hell and the most repulsive political act in American history just 5 years ago, but this nation doesn't have the guts or intelligence to defend our own Constitution anymore.

People who think that there will even be anything left by Jan 2013 are betting on the longest of long shots. You don't just recover after having allowed all these unbelievable violations of our Supreme Law. Such a nation without law is not long for this world, no matter "who gets voted in".

No, I'm a regular. I'm also a resident of Arizona and a childhood acquaintance of mine was decapitated by a cartel/smuggler in Cochise county a year or so back.

I've lived on the border with Mexico all my life except for 8 years on the northern border.

I've spoken to several persons who have been taken under fire near El Paso by Mexican Army personnel who crossed our borders. This thing happens every year, sometimes multiple times as members of the Mexican Army do contract killings for the cartels, as happened last summer just south of Phoenix.

Of course, you guys outside of the Southwest don't hear anything about this. It's embargoed nationally.

So excuse me if I have a negative disposition towards a tyrannical and aggressive Mexican Federeal Government which has, throughout the last two administrations, worked to attack our sovereignty over the Southwest. They, in violation of the Treaty Of Guadalupe Hildago in 1848 (not Veracruz, that was a different one, my mistake earlier) have taught in their government schools that the states of Nevada, Arizona, and New Mexico are actually theirs. This is not a "black helicopter" thing - it drives their emnity towards our nation.

It must be nice to not have a hostile nation less than an hour away from your doorstep, not worrying about armed, violent foreign nationals making hikes in the desert riskier than mooning Crips in LA.

So no, I'm not. What makes you think I am? Because I have such a vigorously different opinion of a hostile foreign nation you may not know is a threat?

“There is broad support for the idea that we should figure out a way to help kids who are undocumented through no fault of their own, but there is also broad consensus that it should be done in a way that does not encourage illegal immigration in the future. This is a difficult balance to strike, one that this new policy, imposed by executive order, will make harder to achieve in the long run.

Close enough. I remember I was reading Gibbon's Decline and Fall of the Roman Empire at the time. That bookincludes information about the Romans' inability to control their borders and keep the Goths out. I was driving to work and the news came on about W trying for the third time to ram this down our throats even after that had been two enormous ourporings from the public saying, "NOOOOOOOOOO!" When I heard W and the RINOs were going back for a third bite of the apple it was like a punch to the stomach. For the first time I thought that if this is Republicanism, I may not be a Republican. After the 2008 loss and seeing the RINOs turn on she-who-may-not-be-named, blaming her for the defeat instead of the top of the ticket, I decided that was the straw that broke the camel's back. Iwent down and registered as an independent.

716 Regarding the politics of this, the blog post author's first instinct was correct. In the white working class states immigration in the first instance is not a major issue. Factor workers in Ohio don't have to worry about guest workers taking their jobs. Their concern is that of the factory shutting down entirely. In the the Latino-heavy swing states, however, the Latino working class nearly is as largeor in fact is larger than the white working class. Nevadaand New Mexico are exhibits A and B. Of course in Florida theDREAM Act holds a lot of sway. If Romney takes too hard of a line on immigration he could lose Florida. If Obama wins Florida there is an overwhelming likelihood that he'll be reelected.Hopefully Team Romney will take the correct approach. That approach, FYI,should not include foaming at the mouth like a loon.

Obama's forestalled any possibility of the GOP moving on this issue until after the election, because they really cannot be seen marching to Obama's tune.

The question is how much he'll bleed for having done it in such a blatantly imperial and potentially illegal fashion. Romney has to keep the wound open.

As El Rushbo pointed out in the first part of his show today:
Team Obama is in Full Blown Panic Mode.

They're pulling out the heavy led... in June.

And look at how utterly NAKED a political ploy this is.

With five months to go until the election, will even the most a-political, non-voting Americans fail to see this as a desperately pandering move to save his chances at re-election?
And look how early it is. He's throwing a fucking Hail Marry at the beginning of the second quarter!

Yet in substantive policy terms, it's way late.
Hey, Obama: Why now? You could have done this years ago. Oh, you're doing it because Rubio told you to. Yeah, right!

The shameless desperation will be lost on no one.
And that makes it a huge mistake on Team Obama's part. They can kiss what remains of their independent and moderate support goodbye.

They have effectively ceded mainstream American sentiment to the Romney campaign. They can't win it. And they are no longer trying.

They're only hope now is to consolidate (and somehow fire up) the traditional liberal grievance constituencies while ominously suggesting that no damn racists had better try to stop them. They have to hope that White Guilt will suppress Romney's support.

It's a bad bet. But they've concluded (perhaps rightly so) that it's all they've got left.

The safe bet is that in 2012, the average American voter is not going to fear being labeled a racist if he or she dares to cast a secret ballot against Obama.

But before I go, I think the Pubs would be well-served to introduce this Constitutional crisis into US Senate elections.
1. Ask the Ds WTF do they think their constitutional duty is and whether their idea of legislating is going out for drinks and dinner and have the executive branch enact all the laws by fiat.
2. Pub candidates for Senate should make a pledge to actually introduce and pass a budget and ask Dem incumbents why they and their party are unwilling to do it.
These a-hats have a constitutional obligation to be a check on executive power and its about time this becomes an election issue. No answer the Ds can give in response is a good one. Therefore, it would seem to make strategic sense to at ask the damn question.

744 Unfortunately, these types of actions are both inevitable and
unstoppable. However, other than some single issue idiots at La Raza,
this will not help Obama and will hurt him considerably.

There are multiple interest groups that will not like this action for multiple reasons.

1) Rule of law, illegal actions being rewarded

2) Violation of clearly stated constitutional separations

3) Further pressure on tight employment for legal residents

4) People that have worked hard to get here legally to work

Obama can't be impeached because of political considerations. But it is
the last desperate act of a losing candidate. He is proving to the
electorate that he is so self centered that he will break any law to
divide and gain a partisan advantage. He is just reinforcing to voters
why they don't want to vote for him.

He is unelectable. But he is also a loser, and people see that.

cuz before, ya know, no illegal immigrant would try for a job, right? there are just million of them sitting here in the country and using the ERs and food kitchens but CERTAINLY not trying for a job out of fear of deportation, right?

...why the fuck does ace even let you post?

common conservative invective has liberals painted -- rightfully so, but with marginal political utility given the status of even the "average" conservative voter, who has Not Run A Business Either -- as an organ of bureaucratic doughboys with no understanding of the business world. given that they have no understanding of the business world, the political "logic" goes, they should *never* be allowed to offer opinions on business-centric political ramifications.

...and then conservatives who probably have just as little experience with the private sector and how it really works (no, working a p-sec job does NOT actually qualify one with any more of an understanding of the administrative characteristics of business commerce private sector at large, conservatives...) pretend that real businesses actually give a fuck about illegals.

...riiiiiiight.

the only people who care about illegals are big corporations (who are scrutinised with impunity), and it's not likely that your typical blue-collar white voter will be working for a big corporation except perhaps vicariously through some small-biz sub-contractor.

(n.b.: the industry traditionally in strong violation of this general rule, viz the auto industry, is fucking moribund.)

to be clear, the reason the white, blue-collar workers WILL turn away from obama on this constitutional subversion (as you correctly surmise) is because the immigrants have already VISIBLY "taken jobs" from, er, longer-in-the-generation Americans. the anti-immigrant sentiment in this country is not a function of some hypothetical dystopian inversion of the american job market...it's a function of What Is Happening Right Now.

thus the only practical effect that this legislation will have will be to increase the mobility of the (pro-obama) latino voter. racist or anti-immigrant hiring managers -- or those otherwise politically indisposed to amnesty -- aren't going to start hiring illegals because obama has given them the green flag. most of the people who wouldn't mind hiring illegals already have a cohort on their payrolls. corporations, natch, aren't going to replace their white-collar office fry with illegals. the constructional subcontracting and manufacturing sectors are already chock full of illegals (esp the former).

no, the president's subversion of the constitution in this case is not likely going to affect the hiring environment of the american voter.

yes, it is going to cause us problems at the polls.

why didn't y'all let rubio jump this fucking gun, again? why didn't y'all let the GOP grab the votes? did y'all really think that in the age of Reverse Colonialism, america's course could be reversed on the question of amnesty?

romney could have come out for inevitable gay marriage like cameron in england. rubio could have spearheaded the immigration reform...waving a big goddamn red, white, and blue flag at hispanics, so disillusioned with obama's destruction of our country's erstwhile economic xanadu that they are LEAVING THE COUNTRY IN NET, that says "hay y'all, look over here!"

look at how we cubans have done. we do better, on average, than you regular english-speaking white folks...even AFTER we were stat-bombed with criminal trash in the 80's. rubio's ideas are pursuant to the success of cubans in america.

even the vietnamese community is a standout example of immigrant success in america. what do these two communities have in common? they came to america BECAUSE they espoused american values (both fleeing, of course, from their respective totalitarian communist regimes). rubio's idea is to ensure that when immigration "reform" is passed, the proper american values get passed along with it.

instead, we're busy making goddamn sure we fumble EVERY play that we have a chance to intercept the narrative.

KEEP THEM FUCKIN TENT DOORS CLOSED...THAT CURIOUS VOTER RITE THERE AIN'T GOT NO TICKET!!11!1!111!11!1

Laws don't matter to this two-bit despot dictator anymore. This is shameful and injustice for people like me who came to this country legally and lived here for six years, went to business school and still have to wait another ten years or who knows when to get a green card.
Obama is the WORST president in hisotry and will lose this election...I have no doubt.
