It Came From The Senate: Rise of the Filibuster

Here's a cool little chart showing the rise of the filibuster (and cloture votes) over time.

And what really stands out is the fact that regular filibusters are a very recent phenomenon - with the vast majority happening since the 1975 rule change reducing the cloture requirement from 2/3 to 3/5.

And note that 'filibusters' these days are really just mere filibuster threats - since no one actually stands and talks for 21 hours anymore - which I view as a form of pansy-ass cheating.

risefuilibuster

Interestingly the filibuster itself was a historical quirk of the rules never envisioned by the founders:

In 1806, the Senate, on the advice of Aaron Burr, tried to clean up its rule book, which was thought to be needlessly complicated and redundant. One change it made was to delete something called "the previous question" motion. That was the motion senators used to end debate on whatever they were talking about and move to the next topic. Burr recommended axing it because it was hardly ever used. Senators were gentlemen. They knew when to stop talking.

That was the moment the Senate created the filibuster. But nobody knew it at the time. It would be three more decades before the first filibuster was mounted - which meant it was five decades after the ratification of the Constitution. "Far from being a matter of high principle, the filibuster appears to be nothing more than an unforeseen and unintended consequence of the elimination of the previous question motion from the rules of the Senate," Bondurant writes.

Is Regents of the University of California v. Bakke (1978 ) why Barry became a Kenyan?

Bookworm has a theory on why Obama suddenly turned into a Kenyan when he started applying to colleges and stayed one when he began publishing books.

Now that we know that Obama marketed himself to publishers as a Kenyan, though, we're beginning to suspect that the papers hide, not only academic mediocrity, but the same Kenyan identity Obama was using to market himself in the publishing world. The question, of course, is why would Obama pretend to be African? After all, when it came to college admissions, wasn't being black good enough for affirmative action purposes?

Obama's problem, though, was that he came of age at a very specific time in the annals of affirmative action. To appreciate this, you have to know that Obama, who graduated from high school in 1979, must have started looking at colleges in 1978.

When it comes to college admissions, 1978 isn't just any year. It's a very special year. It was the year that the Supreme Court decided Regents of the University of California v. Bakke (1978 ) 438 U.S. 265.

Bakke is the case where the Supreme Court narrowly ruled that pure race-based admissions were unconstitutional. And for a year or three afterwards the entire college affirmative action structure was thrown up in the air.

With that decision, Obama, who was a self-confessed slacker in high school, suddenly lost his e-ticket to a good college. He couldn't know then (nor would it have mattered) that the various concurrences in this deeply divided opinion would eventually open the door to colleges and universities making race a "factor" in admission, so much so that this "factor-ness" eventually created a whole new quota system.

My best guess is that, denied an opportunity to use quota systems to parlay a lousy academic record into a quality college admission, Obama searched around for other means of bypassing his academic failings. It was this search that led him to announce that he was Kenyan.

When the going gets tough, the clever become 'the other'. Which particular flavor depends on how high your cheekbones are and how dark your skin is. And how little integrity you have.

Letter To a Son on His Marriage

You've heard all the jokes that have been rousted around by all the "unhappy marrieds" and cynics. Now, in case no one has suggested it, there is another viewpoint. You have entered into the most meaningful relationship there is in all human life. It can be whatever you decide to make it.

Some men feel their masculinity can only be proven if they play out in their own life all the locker-room stories, smugly confident that what a wife doesn't know won't hurt her. The truth is, somehow, way down inside, without her ever finding lipstick on the collar or catching a man in the flimsy excuse of where he was till three A.M., a wife does know, and with that knowing, some of the magic of this relationship disappears. There are more men griping about marriage who kicked the whole thing away themselves than there can ever be wives deserving of blame.
You know better than many what an unhappy home is and what it can do to others. Now you have a chance to make it come out the way it should. There is no greater happiness for a man than approaching a door at the end of a day knowing someone on the other side of that door is waiting for the sound of his footsteps.

Love,

Dad

P.S. You'll never get in trouble if you say "I love you" at least once a day.

11 Obscure Regional Phrases We All Should Start Using

Well the only one I can actually recall hearing is whoopity scoot.

2. Feel Like a Stewed Witch
In much of the South, after a rough night's sleep or a little too much hooch, you might wake up, stretch, rub your head and declare that you feel like a stewed witch, a wonderful phrase that means pretty much exactly what it sounds like: pretty icky. A variation on this theme is to feel like a boiled owl.
6. Democrat Hound
In parts of New England, calling someone a democrat hound suggests he's an otherwise intelligent animal who has taken up the wrong scent, like when a rabbit hound chases a fox.

Turns Out Prolonged Low-level Radiation Exposure Has Little Risk

"A new study from MIT scientists suggests that the guidelines governments use to determine when to evacuate people following a nuclear accident may be too conservative. The study (abstract), led by Bevin Engelward and Jacquelyn Yanch and published in the journal Environmental Health Perspectives, found that when mice were exposed to radiation doses about 400 times greater than background levels for five weeks, no DNA damage could be detected. Current U.S. regulations require that residents of any area that reaches radiation levels eight times higher than background should be evacuated. However, the financial and emotional cost of such relocation may not be worthwhile, the researchers say."

But, but, but I was told that all radiation was deadly and caused immediate mutations.

And the occasional super-power - which is why I'm thankful for above-ground nuclear testing in the 50's which gave all the men in my family incredible mega-bladders.

Anthropologists working in the south of France believe they have discovered the oldest example of cave art on a 1.5 metric ton block limestone.

The carvings date back to 37,000 years ago in the areas of Abri Castanet and Abri Blanchard - both sites where some of the earliest examples of mankind living in the European continent have been discovered.

And what could be so important to early men that they would journey into dark bear-and-lion-infested caves to carve and paint rocks? Well keep in mind that these were men after all:

Those of a weak disposition look away now, as one painting, showing a circle with an attachment, is believed to depict a lady's sexual organs.

Man Steals Own Bicycle Back After Spotting it on Craigslist

So someone stole Danny Lesh's bike and the next day he found it listed on Craigslist. The police wouldn't help him so he set up a little sting himself:

After haggling over the Craigslist price, Lesh says, he asked for a test ride. The vendor agreed, and Lesh pedaled around the block back to the waiting cab. He tossed the Cannondale in the trunk and rode off. The vendor called about half an hour later, demanding Lesh return the bike and threatening to notify the police himself, though it appears that call never materialized.

danny-lesh-bicycle

A friend of mine in L.A. once had similar situation happen to him. He sold a motorcycle to a guy and dutifully mailed in the DMV change-of-owner form. But the buyer never registered the bike and then started regularly getting parking tickets all over Studio City which all came to my friend since he was still the owner of record.

Well after a few months of fighting the DMV and courts over the tickets, he noticed a pattern in where and when the tickets were being issued. So he and his brother began prowling the area keeping an eye out for the bike. And sure enough after a few days they finally found it - parked illegally of course. So they rolled it up right into their truck and took it home. And they never heard another word from the guy or the police.

Me: "No you're not, if you thought you were being cheated, you wouldn't hand over $50 for it"

Me: Should we tax everybody to pay for this incentive, when only some people benefit from the new invention?

Speaking of regional sayings, my Dad, raised in the Tennessee-Virginia-Carolinas area (Grandpa was a preacher and moveda lot), occassionally tells the tale of when he first met my Ohio-raised mother's parents. the meeting wasn't going particularly well, IIRC, and so Dad decided to tell a funny story, to wit:
There were once five crows that were flying along and saw a prune pie laid out on a windowsill to cool, so they flew down and ate it right up before the farmer's wife noticed them. Them they all flew off a little bit and perched on the handle of one of those old-fashioned water-pumps . After a few minutes one of them took off, and flew north for about a hundred yards, and then, boom, fell out of the sky, dead as a doornail. The other crows took note of this, and one of the remaining four took flight immediately, took off and flew south in the opposite direction as fast as it could go. It got a hundred yards, and, boom, it fell to the ground dead. the remaining crows saw this, and two also took flight, one going west, the other east. They too got only about a hundred yards before they fell out of the sky dead. the last crow, still sitting there, decided that his only choice was to go straight up, so he took off and climbed higher and higher, until he got about a hundred yards above the ground, and them immediately fell dead. the moral of the story: Don't fly off the handle when you are full of prunes!
Mom's family didn't get it either.

77 I used to ride out to Curry's produce stand on my Schwinn with 4 bucks my mom gave me to buy produce. You selected the Vegetables and made your change from a White Owl cigar box. I went off to College in the Piedmont of North Carolina, later when I came home for summer , I read in the Record that some body stole that cigar box with the produce money. Curry's stop selling produce and some SOB went out with the money and became a Congress Appointee.

204 Vice President Joe Biden admitted to a group of supporters in New Hampshire this afternoon that the President would have been able help the economy "much, more" if the Tea Party hadn't taken the House.

Biden showed the audience the Obama campaigns chart of job growth during the President's first term in office and accused the Tea Party for stalling the recovery, because of the debt limit fight.

"Imagine where we'd be if the Tea Party hadn't taken control of the House of Representatives," Biden said adding that they were "a group set on obstructionism."

"They have one overwhelming goal: prevent President Obama from a second term, with no - apparently no care of the consequences to the economy," he said. Biden insisted that the president persevered in spite of their obstruction and demonstrated "important progress" that could be measured.

So i say sure, i won't call, and the next day they roll up in their truck with all my stuff. Maet, great ONT fodder. I appreciate your efforts.
Item 1) Gotta give Ronnie top billing. More common sense wisdom from that guy than anything I've heard from aany president in my lifetime.
Item 2) From the sidebare story at the DougRoss Journal, It's good to see the MM's getting props for their lunacy. Check it out if you haven't already.
Item 3) The guy at liberal logic has great stuff but is infested with abusive libs. I went to his site and there was almost no conservatives posting. I think it is because comments are posted to FB with your name. He could really use some support.
Item 4) Greg Gutfield does a bit on most over used phrases. My personal most hated and over used hyperbole is "There is nothing worse than" followed by a mildly bothersome situation like waiting at the Post Office. Trust me there millions of things worse than your stupid, inconvenient, avoidable and boring situation.

There's something I always do when I go to a job interview. I approach the interview with the mentality that the company needs me more than I need them. In other words, I ask the interviewer questions like "Why do you like working here?" and "What's your favorite part of your job?"

It's not being cocky, but it portrays an aura of confidence and competence. I've gotten every job I've interviewed for since 1995.

Whut?

The Iliad gives Andromache of Troy a real character. Same with the Odyssey toward Penelope. Herodotus - writing after, but independent of, the Bible - also has plenty of strong female characters. Good heavens, Sappho wrote a whole poetry-compilation by herself.

And that's just the Greeks in their literature. Hittite and Roman law both offered a wide range of rights to women: Hittite queens retained their authority after the king died, Roman women owned property and ran businesses, both Hittites and Romans had female priests, and on and on.

Let's not chest-thump TOO much about the Bible.

So, Linda S. 351 And that's just the Greeks in their literature.
Hittite and Roman law both offered a wide range of rights to women:
Hittite queens retained their authority after the king died, Roman women
owned property and ran businesses, both Hittites and Romans had female
priests, and on and on.

Let's not chest-thump TOO much about the Bible.

Posted by: Boulder Toilet Hobo at May 22, 2012 11:53 PM (QTHTd)

The Torah predated the Greeks by centuries - a millenium or more by certain counts. Not including the Micaenians (sp? grrr) ... I don't know if you include them as "Greeks".

Interestingly, The Hittites were totally forgotten by history, recorded only in the Torah. People didn't believe that the Hittites had even existed until some time in the 18th century(?) - something like that - when archaeologists found Hatushi or Hatussa or whatever their main city was called. Stories of the Hittites were regarded as nothing but Biblical fables. Kinda neat, I always thought.

Not to take anything away from the Greeks or Romans who were as impressive as all hell. There was little on Earth to ever compare with the explosion of human genius among the ancient Greeks.

352 I received a phone call yesterday morning from a wonderful young gal, a 36-year-old mom out of LA County. She’s one of our UPS customers that we deliver overnight raw milk to her house. When the CDFA was in here the other day on our recall, they demanded to have all our delivery addresses for overnight UPS delivery. We screwed up and [inadvertently] gave it to them, they got it from one of our secretaries here. The LA County health department started calling her, six or seven times, demanding that she give up her raw milk from her own home to the health department.

She refused, then they showed up at her house and demanded that she give her raw milk to them. She was getting ready to call 911 for the sheriff’s department and have them removed from her front doorstep, and she was threatening to use her camera to take a picture of them and post it on Facebook for harassing her over her raw milk… The investigators left after she told them she was not going to give them the raw milk and to get the hell off her property.

This is what’s going on, it’s like food Nazis, it’s incredible what these people are doing, trying to collect food from people’s houses, that have not made them ill!

anyway, my friend and I (and a bunch of other women) were like rabid dogs picking through all of them. I got a the cutest little jean chanel purse.

360 Mike, the point is that the Iliad and Roman Law - and the Greek tragedians - were all ignorant of the Torah. So whenever the Bible was written (and I'm a skeptic as you may be aware): it has no bearing on Greek and Latin law, custom, literature, or culture - until Christianity.

The Ptolemies I'd noted as a special case here, especially the later ones like *the* Cleopatra. They'd ended up ruling over Egyptians. The Egyptians were well aware of the Hebrews and their scripture by then. One of their priests, one Manethon, wrote quite the antisemitic screed, under the Ptolemies. This seems to be a reaction to the Exodus story. So arguably some of the Ptolemies - especially the later ones - MAY have been influenced by the Jews they met.

Still. Even to the extent they had "feminists" in Egypt, that's more likely from a long Pharaonic tradition of female kings, dating back to Hatshepsut; much less likely from Cleopatra following Torah (!).

365 Obama’s war on coal hits your electric bill

These are the first real, market prices that take Obama’s most recent anti-coal regulations into account, and they prove that he is keeping his 2008 campaign promise to make electricity prices “necessarily skyrocket.”

The market-clearing price for new 2015 capacity – almost all natural gas – was $136 per megawatt. That’s eight times higher than the price for 2012, which was just $16 per megawatt. In the mid-Atlantic area covering New Jersey, Delaware, Pennsylvania, and DC the new price is $167 per megawatt. For the northern Ohio territory served by FirstEnergy, the price is a shocking $357 per megawatt.

As for Booker, my hope is that the pushback won't turn him into just another faux centrist who won't risk offending his base. 492 The United States Senate did not create the filibuster. It has been around for as long as there has been debate. And the founders knew this.
And the historical numbers are unreliable. A Senator did not stand up and say, "Here begins my filibuster." There have always been any number of delaying tactics and motions. So, one can't merely look at the congressional record and count filibusters.
I have not read the underlying law review article, but keep in mind it is merely presenting one side. It's not as if this never occured to anyone in the last 200 years.

Apple is a special case -- they have what amounts to a cult following. They'd have to do a series of major boondoggles to shake the faith of that core constituency.

It wouldn't be too hard for them to lose the non-cult customers who tried an Apple product randomly without being a fanboi. If Apple has to fall back onto its cult following, then their market share for any given area caps around 10%.

I don't think they did anything wrong. Everyone should have known (1/100th of due diligence would have been enough) that it was total bullshit.

But, if they hadn't raised the float by so much they could have easily supported the price. It was the extra shares that made it too heavy to support (or prop-up, if you prefer).

I think the Fecesbook investors have nothing to complain about outside of NASDAQ's trading problems, which were absolutely inexcusable and should serve to bankrupt NASDAQ.

But, like the greedy shits who thought they deserved the peak value of their sham Enron stock (which was never real) they Fecesbook assholes will probably get money from all sorts.

It would be like tossing gasoline onto the Facebook conflagrations that go on now, because some FB page owner would have no control over the 3rd party commentary.

Of course all the FB users would sign up instantly so they could deface and retaliate against each other or offer support to their friends pages...

...PROFITS? Wouldn't need a huge expensive data center since the whole deal is text based. Initially a few T1 lines could probably handle it.

It would be interesting to find out. But, whatever the problem was, it was totally inexcusable on NASDAQ's part. However, it is interesting to note that much the same sort of problem just occurred with the BATS IPO a few months ago (not on NASDAQ). AAPL even had to halt trading a bit because of some effects of that screw up.

532 This is way off track, but since my investment in FB is a total bust, I had to think of other things to take my mind off it. Here are two Obama memes that I would love to see a good journalist investigate as a means of comparison to the performance of Bain Capital:

1) Team Chicago has put out ads showing workers that were laid off by companies due to Bain's "vampire" capitalism. I'd like to know, in comparison, how many workers have been laid off by the "green tech" companies that went belly-up or moved operations offshore AFTER receiving stimulus and/or DOE funding. Start with the 1,000 or so that were laid off by Solyndra.

2) From the statistics I have seen reported, Bain had a success rate of about 78%. Of the 22% of the companies that failed, I'd like to know how many failed due to unions that refused to negotiate in order to save the company and, as a consequence, how many total jobs were lost as a consequence of union intransigence. Start with Ampad and GST Steel. I'd also like to know how many years were added to the lives of these 22% (that were in bad shape to begin with) because Bain stepped in with financing. It would also be interesting to see the non-union/union correlation to the successes/failures.

I know the MSM won't do it, but maybe Ace knows someone who knows someone...

542 I might have engaged in some erroneous extrapolation- I remembered the 22% fail rate, but here's more from a WSJ article- 1/9/12 by Mark Maremont, in reference to the 77 businesses in which Bain invested while Romney was there:

"Among the findings: 22% either filed for bankruptcy reorganization or closed their doors by the end of the eighth year after Bain first invested, sometimes with substantial job losses. An additional 8% ran into so much trouble that all of the money Bain invested was lost."

560 Pre, in this economy, your looking at learning the resturant business from the inside, starting at dishwasher. Other options, go overseas and teach english, enlist and find yourself while blowing stuff up, or work on a campaign and see whee it goes.

If you really want to teach, enlisting will teach you how to learn, then how to instruct. Plus, most decent school systems will have a hiring kicker for vets. If your not up to humping a 60; you could fly a desk in the air force. Lots of remote history courses are availible in the military as well.

598 liberal logic in action: Linear, No Threshold (LNT)
LNT is the idiotic "scientific" concept that something is deadly at some high dose then it is deadly all the way down to zero on a linear (straight) line. It just takes longer or kills a smaller percentage of those exposed.
Mercury poisoning, along with all the other dangerous metals is a classic example. The human body requires small amounts of many otherwise poisonous metals (not mercury of course). In the case of mercury, it is essentially harmless to the touch. There are also (at least) two general forms of mercury, one is imminently harmful, the other is pretty benign. EPA makes no differentiation.
With the EPA and LNT water must be banned. Same for oxygen. It is a scientific fact that too rich an oxygen percentage will cause oxygen poisoning. Too much water (100%) in the atmosphere will kill you. They have to be banned under LNT. Liberal logic on display.

I'm reading this thing, trying to make sense out of it—particularly the part where Aaron Burr, who shot Hamilton in 1804 or 1805, is adjusting Senate rules in 1806.

I suppose it's possible sure doesn't seem likely.
