NBC Lies; Claims "Mistake" In Zimmerman 911 Editing Due To Constraints Imposed By Fast-Paced, Information Dense 3 Hour Long Today Show Gabfest

That's enough of a lie right there. The Today show is not a 22 minute nightly broadcast. It's a 3 hour waste of viewers time in which wasting time is feature, not a bug.

That's like me saying that I completely mistated the plot of a movie in an 1800 word review because I just didn't have the pixels to spare.

But this lie is also disproven by the fact that the exact same edit, in print form, ran on an NBC Website before it aired on Today.


Les Jones shows us that on March 19 an NBC team in Miami ran the same problematic edit in the print version of their Trayvon Martin coverage:

On his call to police, Zimmerman called Martin, a junior at Krop Senior High School in Miami, “a real suspicious guy.”

“This guy looks like he’s up to no good … he looks black,” Zimmerman said, while calling police from his car. He said Martin was wearing a gray hoodie and had “his hand in his waistband.”

The bylines for that story are Christina Hernandez, Jeff Burnside and Edward B. Colby. And don't be fooled by the April 2 dateline at the top - the dateline at the bottom is Mar 19 and the Jay Carney "we here in the White House are aware of the incident" quote is from Mar 19.

Um, were they trying to save precious pixel space on a website?

What was the excuse for this first deceptive edit?

Can't be the same excuse Today offers.

Here's the NYT's media reporter, Brian Stetler, offering his Skeptical, Cynical, Hard-Charging, Dig Up Every Juicy Story reporter's intuition on the matter:

‏to me, the simplest explanation is a time-pressed producer cut the audio to save precious seconds in the segment.

This sums up media bias in a nutshell.

If you assume that liberals are Good, then you assume there's no point digging into a story where liberals are accused of malfeasance because you have already decided it's very unlikely there's a story there.

You'd be wasting your time. Liberals are Good. There is no point questioning their motives-- its just a great big waste of your time to do so.

On the other hand, you know where the juicy stories are likely to be -- that's right, those damned conservatives.

So "flood the zone" on that type of story, because you'll probably find something, right? And if that results in flood the zone coverage of conservatives and airy dismissals of any suggested malfeasance by a liberal, Oh well!

And also -- if you spend weeks and weeks investigating conservative malfeasance you were pretty sure was there, but it turns up a dry hole -- oh well, publish it anyway. Like the NYT's attempt to smear John McCain with an affair. Nothing there, but print anyway; just insinuate what you can't report.

Or Bush's TANG records. Nothing there, but this shifty, oddball character says he just came across "TANG records from 1971" via a secret unnamed source. Print it!

Hey, you've worked two hours a day, four days a week on this for the past five weeks! you're not going to squander this actual 40-hour workweek just because the story came up bust-o!

More NBC won't even say that anyone's been fired.

So why do we think he was? That Mark Stetler guy says so, but he also believes in leprechauns and faeries, so.

I've edited a lot of audio...

Assuming this wasn't a guy with a goddamn razor chopping up tape like it was 1975, they used some sort of digital audio editing program.

You open the file.

You place your cursor at the spot you want to start cutting.

You place a marker there

You go to the next place you want to cut, you place a marker there too, and you probably label the markers so you know what the hell it is you're cutting out.

Then you trim. And then you join the two remaining pieces, it might do it automatically, then checking to see if the joining is clean and doesn't have any weirdness.

All in all, this takes about 10-15 minutes.

The guy who cut this must have listened to it at least 10 times to make sure of what he was doing.

There is absolutely no fucking way this was a mistake. They tried to make it sound like it was one continuous piece of audio!

If there were some missing syllables or words, then that's perhaps a mistake...

That's not what it is...these assholes.

It takes 10-15 minutes to get the non-edited files together, make sure you have the right file, check the file name you're saving the new file as, do the cut, check it and recheck, save the file, give the file to someone, or email it, or whatever.

It's not like they just pulled that shit together immediately, in raw form, that's impossible from what we know was the real audio.

Yes, but that doesn't necessarily mean "malice" in the way we would normally think of it. If I understand correctly, if you know that what you're about to say about someone is a) wrong and b) likely to hurt their reputation, it's defamation. It doesn't matter why you're saying/writing whatever, just that you know it's wrong, and that it's likely to hurt their reputation.

So, in this case, I would expect a decent attorney to say, "Thank you for that public admission of guilt. Our settlement terms are 21 million dollars and a formal, lead-the-show broadcast apology. Or we'll see you in court."

When I was little, my Dad and I used to watch the Today show in the morning as he got ready for work. The guy who read the news was a man named Frank Blair. I remember each week Blair would announce the week's casualties in Vietnam. As read them there was a primitive graphic listing the killed and wounded and the number for each. At the time I was about eight or nine and I remember thinking, it looked like the football scoreboard from games on TV. I also remember my Dad saying, "They shouldn't do that. It's not right."

Some things never change and NBC News is one of them.

They did play a part in defusing the crisis however. The Soviets suggested, amongst other things, that they might withdraw their missiles from Cuba if we withdrew our missiles from Turkey. But that was after the fact. Kennedy did not want to do that publicly, even thought they were slated to be withdrawn anyway. However he did promise to withdraw them 6 months after the Soviets withdrew their's from Cuba but only thru a private and informal assurance.

And they showed it over and over again, long after the "moment" of supposed time pressure was past, and they couldn't be bothered THEN playing the complete tape? Obvious malice; they never wanted to air the extended version of the tape. And that's contrary to every standard news practise; usually they initially go with whatever they can scrounge up, then as more information comes available, you see the longer, more complete versions of videos. They deliberately ignored the longer version because it totally undermined the story they wanted to tell.

No, but seriously people: this is STRICTLY about protecting NBC (and the fired producer) from potential liability to George Zimmerman -- and make no mistake, this is one of the very, very few cases in U.S. defamation law involving a public/semi-public figure that would make for a strong plaintiff's case -- and nothing else. If and when NBC has to reveal the name of the producer in order to shield itself, you can bet your ass they will. But not until such time.

As things stand, NBC is still in a shitton of trouble and any admission of INTENTIONAL malfeasance on the part of an agent of the network would be a bullet in the head as far as litigation is concerned: it would get the plaintiff (Zimmerman) over the single toughest hurdle a litigant faces in these cases, namely proving actual malice. So of course they're going to pretend it's all just an accident. They're facing a suit for millions of dollars (because man, proving harm here is gonna be easy-peasy-lemon-squeezy) and they don't want to simply hand the winning case to Zimmerman right off the bat.

It's remembered because there is usually a strong emotion with the intial headline. It has to be something that can tug on your heartstrings, something that everyone can identify with, in this case, the death of a teenager.

Pretty much all of us know someone who died in a car accident in high school.

Pairing emotion with misinformation, such as we are seeing in the Zimmerman case, is a recipe for disaster. That's why you can't get through to some people: they can't control their emotions. And this story is playing on that. How many pictures do you see of a more recent TM? Why is the ratio so low compared to the smiling pic of him as a 12-year old?

If Zimmerman's legal team is at all aware of their own existence, they'll win. It's almost enough to make me wish I was a lawyer.

I hope Zimmerman's lawyers are thinking big. IANAL and do not pretend to be one.
They need to push for a huge punitive damages award. they can justify it by pointing out a continuing series of "mistakes" by NBC.
examples: The "white racist" Teaparty member who was actually a black man. Perry's "racist" fauxpas, The MSNBC commentator that marched in Sanford. This tends to show that they are reckless and have a continuing behavior.

I am suggesting a punitive damages request in the billion dollar range. This is the only way to make these idiots stop and never do this again. Until the clowns in the boardrooms at GE and Comcast feel the financail pain (and Disney, etc., feel FEAR), this will not stop.

The radio geniuses moved the Minneapolis St Paul Conservative / Rush station from FM to a piss-ant AM signal. I live 45 miles from the city and cannot get the AM station at home. In the car it fades out in the rain and under the power lines (even at noon); At sundown it goes away, so no Jason Lewis either.
They put the sports station on FM, so it can compete for a segment of that audience with the other sports stations instead of dominating the conservative radio segment.

Nothing is to prevent him from claiming that, but 1.) it's almost certainly not true, realistically speaking; 2.) it doesn't matter anyway.

That's the thing, and that's why NBC is sticking hard to the official line that "this was just a horrible accident." You see, even if this was due to the fuckup of one NBC producer, the network as a whole is STILL LIABLE under the law of agency. The producer (presumably a salaried employee and not a contractor, performing a core function of the network's news division) is an agent of the network as a whole, and is presumed to be acting on its behalf; therefore NBC is liable for anything he does so long as it does not fall "outside the scope of his duties" (a technical term that does not mean "doing shit that ends up blowing up in our faces" but rather refers to torts committed completely outside the scope of an agent's official duties, like say this producer getting drunk and mowing down a bunch of pedestrians during nominal work hours).

Given that NBC is going to be on the hook for the actions of its agents acting in due course, the question therefore is going turn back to the core question of 'actual malice' (the very high standard a plaintiff has to meet in a defamation case against a public figure, which Zimmerman arguably now is). Normally that's a bar that is way too high to ever meet, because hey: how can you evidentiarily PROVE that a defendant acted in actual malice? Well I'll tell you a pretty fucking great way to do it: by demonstrating that they had to make a concerted effort to edit the 911 call to omit exculpatory evidence and then crossfade to create a seamless sounding recording. THAT is dynamite evidence going towards proof of actual malice.

And that is why NBC simply cannot afford, for legal reasons, to say anything other than "this was a regrettable error, our bad." Anything beyond that helps get the plaintiff that much closer to meeting the burden of actual malice without having to waste a penny in discovery or other litigation costs.

Prediction: if Zimmerman isn't charged with a crime, he will immediately bring suit against NBC, and NBC will settle the case very quickly rather than go to court on it.

Smerconish is just horrible, he was actually trying to defend Obamacare "from the right" by listing all of the left's talking points. I don;t even know who else in on that station.

I don't know what Rush's or Beck's ratings were in Philly, but they had to be high enough that another local station would put them on. When I listen to Rush at work, I use the WABC internet feed.

I have Sirius/XM as well, but just in the car (I really, really hate commercials. Especially radio commercials). The "Patriot" channel is ok..they carry Beck and Hannity..,,they carry Andrew Wilcow during Rush's slot, who is great argument guy but sometimes unlistenably obnoxious... and the morning guy, Mike Church, is a neo-confederate Paulbot. Cam and Company, geared toward gun owners, is the night program.
