Supreme Court Takes Up Arizona Immigration Law Case; Kagan Recuses

Honestly, I think she's just recusing herself so she can not recuse herself on ObamaCare, and then say "But I recused myself before!"

Anyway, she won't be deciding this one:

In its notice, the court said Justice Elena Kagan had recused herself from the decision to take the case.

Justice Kagan has come under fire for not recusing herself from the decision to hear challenges to the new health care law.

Note that they were very careful to balance power, so no single branch could dominate... yet the Supremes really have no check upon their power, or legal authority. There is no oversite of the Court, and no authority to over ride their decisions, no matter how silly.
But then, the Founders did not envision them as being the Only Arbiter of Constitutionality... they thought the STATES would be the 'check' on Federal Power... which sadly ended during the Civil War.

I agree. Court picks are long term problems, so this 'let's teach the party a lesson' idea is a bad idea because the consequences aren't just during the president's term.

Had Mccain won, he would have probably had a mixed record on appointments. Romney in particular has a horrible record on appointments, 75% of them being liberals. But both are way better than Obama's.

Also, Kagan has a habit of reclusing herself from cases, as she has only been on the bench for 10 out of the 25 arguments the Supremes have heard this year. Which makes sense because she worked on many of the cases which the Supreme Court is holding hearings on, but you can be damned sure that she won't miss the Supreme's hearing on Obamacare - no matter the cost.

If SCOTUS throws out a badly written law, it can simply be re-written.

If SCOTUS throws out a law than can never pass the test of Constitutionality, Congress and the states can write and pass an amendment to make it Constitutional.

'Cuz 10 out of 25 so far seems to me like Ms. Kagan is - like her appointer - voting "present" on an awful lot of stuff.....
Perhaps an amendment that a President cannot appoint someone who is currently serving so "close" to his/heradministration would not be out of line?

106 If I ran the zoo, Supreme Court justices would be term limited (12 years, maybe?) and there would be some limit on how many justices a President could place on a court per term.Throw in some kind of temporary appointment mechanism to cover unplanned openings (deaths, sudden illness, etc.) and I would think this idea would get bi-partisan support.

The administration got some inkling of which way Kennedy might vote, and concludes that he will side with the non-ass-clown wing of the supreme court. The admin quietly told Kagan to recuse.
This is a triple score for Obummer.

-the repeal of the bill at the hands of conservative supreme court energizes his liberal base.
-he gets to caterwaul about how the rethuglicans forced a centrist purer-than-driven-snow judge to recuse using underhanded techniques.

Because the lower court ruled it UnConstitutional, and the Court therfore must overrule the lower court... which a 4 to 4 tie does not do... as it takes a Majority to 'overrule' the lower Court decision...
