SCOTUS to POTUS: You're Not Very Good At This Whole Law Thing, Are You?

A child rapist/murderer and the President teamed up last week to ask the Supreme Court to stay the rapist/murderer's execution in Texas so that Congress could have time to consider legislation that would invalidate the murderer's conviction. (As if that would ever pass Congress.) They believe that international law was violated because the criminal was not advised of his right to contact the Mexican consulate when he was arrested. You see, the criminal is an alien.

The relevant background details are here, but I will mention, as a preface to what what you're about to read, that last year, in a separate case, the Supreme Court ruled that, while international law is violated when an alien isn't advised of this treaty right to contact his consulate, domestic law is just honkey-dory with it because Congress never implemented the treaty. So that guy was executed. Since then, Congress has done nothing to implement the treaty.

Cue the smackdown (PDF).

The United States and JUSTICE BREYER complain of the grave international consequences that will follow from Leal’s execution. Congress evidently did not find these consequences sufficiently grave to prompt its enactment of implementing legislation, and we will follow the law as written by Congress. We have no authority to stay an execution in light of an “appeal of the President,” presenting free-ranging assertions of foreign policy consequences, when those assertions come unaccompanied by a persuasive legal claim.

Ouch.

I think this answers your question.
"Texas is not bound by a foreign court's ruling,” Katherine Cesinger, press secretary for Gov. Perry's office, said in a statement. "The U.S. Supreme Court ruled in 2008 that the treaty was not binding on the states and that the president does not have the authority to order states to review cases of the then 51 foreign nationals on death row in the U.S."

According to Barky executing this
illegal alien scumbag "might have profound international
consequences".

Mexican criminals shooting at US agents from across the border "might have
profound international consequences", but that doesn't seem to matter, does
it?

Mexicans coming across the US border with their drugs and guns, killing
Americans "might have profound international consequences", but it
still happens regularly.

Mexicans illegally entering the US and taking American taxpayer dollars in the
form of free healthcare, food stamps, welfare, etc. "might have profound
international consequences", but Obama does not stop it.

Mexican gang members murdering US citizens in our cities"might have
profound international consequences", but it goes on every day.

So, just shut the fuck up, Barky, and the same to the worthless piece of shit International
Court of Justice. This is a matter for
the state of Texas, and the US Supreme Court has already ruled in its favor.

How are states supposed to know if a foreign national rapist/murderer IS
a foreign national? I thought the federal government was suing AZ for
asking.

Medved had a lawyer on from some Acorn front group. The lawyer opposed the new laws requiring photo ID to vote because, gosh darn it, registering requires getting off your backside and to the precinct and that's darn hard for some folks. And even if the government furnished a national ID, he wasn't comfortable with it unless 100% of all voters had one, which will of course never happen to his satisfaction. And finally, he insisted that all naturalized citizens should get to vote, whether they can read English or not, or even are non-vegetative. He did not address how exactly one would verify a naturalized citizen if photo IDs are not used. Medved was ready to strangle him by the end.

That's Justices Breyer, Ginsburg, Bison-Face, and Bob Costas talking.

For 16 years, Leal has exercised his right to file appeals and motions so extensively, one judge in federal district court called his case "one of the most procedurally convoluted and complex habeas corpus proceedings" he ever reviewed.

Well you probably aren't smart enough to be traveling abroad. Because that whole "notify of your rights" thing? A lot of countries don't. He's just going back and looking for procedure rules he can use to keep away from the needle. In the end his argument has nothing to do with either rights or justice.

The other thing is that I doubt any country that was corrupt enough to be falsely charging you would be breaking its balls to find a legal precedent to justify their not letting you contact the consulate.

“And then, Jose Manuel Miguel Xaviar Gonzales, I further command that such officer or officers retire quickly from your dangling corpse, that vultures may descend from the heavens upon your filthy body until nothing shall remain but bare, bleached bones of a cold-blooded, copper-colored, blood-thirsty, throat-cutting, chili-eating, sheep-herding, murdering son-of-a-bitch.”

182 How CNN reports it:

Mexican national and convicted murderer Humberto Leal Garcia Jr. has been executed by lethal injection in Texas.

The Obama administration and international leaders had asked for a reprieve on behalf of the inmate.

What makes Leal's conviction unusual is that he was not informed about his right to contact the Mexican consulate upon his arrest -- a right guaranteed under a binding international treaty.

Leal, 38, was convicted of raping Adria Sauceda, a 16-year-old girl in San Antonio, and then strangling and bludgeoning her.

According to a Texas official, Leal's final words included: "I am sorry for everything I have done."

206 Attorney should've seen to it.
The "right" to see a consul official was a lot more valuable in the abstract than it would have been in practice. The attorney probably figuredthat the Mexican consulate wouldn't give a rat's assabout a jackhole murderer whohad grown upin the U.S.Even if they could find some soft-headed Mexican consulate bugger to make a stink, it would have goine absolutely nowhere. Texas would not have backed down. Then Leal would have exercised his "right" without gaining a benefit.
Better to pull out the argument at the last minute as a flimsy excuseto try to get a stay. And that's exactly what he did.
This was all strategic.

Generally seeking forgiveness first involves an act of contrition. e.g. excepting just punishment as decreed by the sovereign. That did not happen here so I cannot be sure how much of "I am sorry" is "I am going to be executed" But I will give him benefit of the doubt, crime of the guilty is to be punished, and that has been done, sin of the penitent is to be forgiven, which is a judgment only God gets to make. To the extent he was truly remorseful, may God have mercy on his soul.

"An attorney for Leal, Sandra L. Babcock, criticized the court's decision. 'Today the United States stumbled in its commitment to the rule of law. Mr. Leal, tragically, will suffer the consequences. ... his right to consular assistance was violated. If he had had the assistance of the Mexican consulate at the time of trial, Mr. Leal would have had a meaningful opportunity to show that he was not guilty of capital murder,' a statement from Babcock said."

Not guilty? Did she listen to her client?

From San Antonio Express-News:

“'I have hurt a lot of people,' he said. 'Let this be final and be done. I take the full blame for this. I am sorry and forgive me, I am truly sorry.'
Witnessing his execution was his attorney Sandra Babcock, his sister and three friends."

325 Not very smart are you? USSC could not rule in favor of the feds - there was no rule of law to consider! No, in this case, the feds are not very good at this whole law thing. They were again trying to get the USSC to be activists judges - something that could both have them impeached and removed from the bench as well as disbarred. They, of all people, are not the fools Obama and his ilk would like to make them! You however are - your so stuck of the arse of OBAMA and his ilk you forgot to think about what you rail against.
Oh yea, did you forget to mention that the wonderful treaty you speak of was actually written in the1963 and never ratified by any Congress ever! Although brought to the floor by the Congress several times since then, it wasnever passed into law. However, the USSC did rule in 2008 that this very same treaty was non-binding because Congress failed to ratify it. Check your calendar - that would be a fully democrate Congress and Senate at that time. So why do you think they chose to do nothing about it then? Hmmmm?
Oh yea, that would be the war on terror, now wouldn't it.
What a dip chit!
