Hmmm: Harvard Adopted Affirmative Action Policy For Law Review Well Before Obama Matriculated There

This has been discussed, but I haven't seen a citation for it. (Then again, I never really investigated it.)

JeffB. sends this along. This is the Harvard Crimson, which should know about its own law school's policies.

In 1981, all 80-some editors except one were white, and it would be another decade before the Review elected its first black president, Sen. Barack H. Obama, (D-Ill.) Fewer than a dozen of the editors on the Review were women, although Susan R. Estrich, the law professor and Democratic political operative, served as the Review’s president in 1977.

It was then that the saga of the Law Review’s affirmative action program began, when the editors adopted a race- and gender-conscious policy by a 45 to 39 vote, to the vehement opposition of some faculty members. Several months of intense debate and negotiations ensued between the Review and the faculty, at the end of which the Review began for the first time considering factors other than merit in choosing its members.

Prior to 1981, law students could join the Review either by being among the top five students in their first-year sections—each class used to be divided into four sections—or through a combination of their grades and their scores on an annual writing competition, a process designed to preserve absolute objectivity.

But the 1981 editors felt it necessary for their admission policy to take into account the underrepresentation of minorities and women.

Under their modified plan, the top four students in each first-year section would still be elected to the Review, but the fifth spot would be reserved for the top-scoring minority student among the top 25, and if no such minority student existed, the fifth spot would go to the woman with the highest grades.

Two days after the adoption of this policy, three editors—including one woman—resigned in protest.

In response, the Review’s leadership convened to reconsider their plan, opting for a non-quota system that would merely take race and gender into consideration. But despite the modification, the Review continued to encounter opposition from students, alumni, and most importantly, from the faculty.

It has changed a bit, but we don't know when it changed:

The Review’s selection process has also markedly changed since the disputes of 1981. McGrath said that “the writing competition is [now] the central part of the process.”

Today, 14 editors are selected with equal weight on grades and writing competition scores and 20 on the basis of the competition alone.

The remaining seven to nine spots are filled on a discretionary basis, which McGrath wrote “can be used for [the] affirmative action program.”

And this new policy, which is also heavily A-A, is supposed to represent a limitation on the use of race factors that had existed before the implementation of the new policy -- that is, before this, race factors counted for more.

Obama entered Harvard Law in 1988 and graduated 1991, meaning he was either there for one Affirmative Action regime or another, slightly-better-disguised one.

So Trump could be right that his grades weren't good, despite the Law Review credential.

One thing, though, is the magna cum laude honor, which is semi-independent of the Law Review one (though, often, they go together, being both largely based on grades -- usually).

While I have heard of AA for law review, I haven't heard of it for the magna honor. (Or cum, or summa-- whichever.) Usually this is based simply on grades, and this being the second-highest academic accolade. But who knows -- Harvard might have automatically made anyone on Law Review magna or better, or might have added a special AA element to this too, or maybe some kind of special circumstances thing ("He did thirty hours of work in a soup kitchen or community organizing" or some weak crap like that).

Easy Magna? Where I went to school, magna was reserved for the top 5%. When Obama was at Harvard, it was much, much easier to grab that accolade -- only after he graduated did they institute a policy limiting magna to 10% and cum laude to 30%, which means, of course, before he graduated the honors were given out much more freely.

How freely? This freely:

Under the old system, 76% of Harvard Law grads earned honors, the school said."

So when Obama graduated in 1991, all he had to do was graduate in the top 76% of the class to get a cum laude honor. The article doesn't specify, but I expect that the cutoff for Magna Cum Laude was 50%. Which means a C student could graduate with a Magna Cum Laude.

Yes, I suspect that too. That sounds plausible to me -- if three quarters (3/4ths!) of your class is getting the "with honors" accolade, then magna is going to be 50% or 40%. "Magna" could have meant as little as a B- average, which is easy-peasy in a school notorious for grade inflation (Harvard men should compete against Yale, not each other, sniff, quaff cognac, adjust bowtie).

So, in summa: When Barack H. Obama attended Harvard Law School, it was during a period when it was possible for him to get on Law Review with the least true academic achievement in the school's history (with stronger-form AA in effect), and also required the very lowest academic achievement in the school's history to get the magna honor (or any other honor); so much so that the school revolted against awarding these honors to virtually anyone who graduated and instituted a hard cap on the percentage of students receiving them.

No wonder he won't release the grades, and no wonder Harvard has them on lockdown.

Yes of course; I'm not highlighting that, though, because that case would be hard to prove. You can know someone's grades; it's much harder to know why they got the grades they did. You could only "prove" this, or, rather, evidence this, but a meticulous study and backgrounder of each of Obama's courses and the tendencies of each professor grading him.

One way to figure out if some chicanery happened here is to compare his grades in his core coursework (the first year regimen of Contracts, Torts, Crim Law, Constitutional Law, Property, and Procedure) with his later grades in his electives. If there's a sudden rise in grades, it's because he did poorly in the required, more objective coursework and "flourished" in the electives, where he got to pick and choose between tough and easy professors.

If his later courses seem to be light and fluffy, and suddenly his grades improve, there's good evidence for Alamo's hunch.

By the Way: None of this means he's dumb. He's not dumb. Not if testably dumb, anyway; dumb in worldview and assumptions, but I'm sure he'd get 110-120 on an IQ test.

However, the accolades we're talking about here are offered as evidence that he's more than simply above-average in intelligence. The stuff we're talking about here has the implication of "genius," and that's certainly how Obama's been sold.

Law Review didn't used to be some kind of social-engineering fakey honor. It used to be reserved for the top-graded people in a class, and all taking pretty much the same damn courses (the rigid first year curriculum where I think you get exactly one elective all year or something). That, and, in some schools, a blind writing competition -- no name attached, your identity (and race) carefully hidden behind only a number assigned to your paper.

Similarly, when I think "magna," I think "top of the class," and go with my own experience that it really means "seriously, the top of the class, not the top 50% of the class."

Obama may have had outstanding grades and may have earned every inch of the Law Review and magna honors. But the fact that his grades are kept as state secrets, while only the honors themselves are mentioned, makes me think we're looking at C+/B- situation here.

Like -- about the same as George Bush (and about the same as Al Gore and John Kerry, not that the media ever talks about their lackluster academic performances).

Genius? Now that I know there are alternate pathways to these honors besides genius, no, I'm not willing to even entertain the idea of "genius" until I see the evidence.

These honors, it turns out, are easily procured at Harvard Law.

Let's see the grades, the SATs, the LSATs.

Obama's IQ Is 116. Hah! This guy guestimates that based on tangible proxy evidence, which is right in the middle of where I figured it would be.

Now, this guy is not just completely making things up. He knows, because there are records of it, that Obama was not a National Merit Scholar, or National Merit Finalist, or the lowest subcategory, "Outstanding Participant." (This seems to be an honor conferred by the College Board (the SAT people) primarily if not exclusively based on SAT scores.)

Since Obama did not make the list for any of those automatically-conferred SAT-based recognitions, we know his SATs must be below those thresholds, setting a hard upper cap on his possible SAT scores.

We can then figure his highest, likeliest IQ score, because the SAT is just a modified version of the old Army IQ test. Current IQ tests and the SATs are both derived straight from the old Army IQ test, testing pretty much the same things and in pretty much the same ways. Different scoring system, but same ultimate term of comparison -- how you rank compared to the general population, expressed as percentile.

Not dumb, but I never thought he was dumb -- just not a genius. 116's a perfectly respectable score, but no one goes bragging on it and claims to be a genius at 116.

No on ever says, "I'm a mere 30 points away from qualifying for Mensa," for example.

Good catch on that National Merit thing.

49 Law School also has grade inflating tricks if you know how to work them.
A lot of people in my class took a few seminars instead of the lecture classes because they knew although one had to write more, the grade was subjective, the class was smaller, and the seminars grade curve was always higher than the lecture classes were.
I heard somewhere where Harvard doesn't have (and may not have had at the time) a forced curve. If true, it would make it way easier to score higher grades and would explain how 75% of the class graduated with honors. In law school.

In my Law School, minority students were specially partnered
with a “mentor” – usually a ‘professor of color’ or dean who acted as an
advocate for the student with other professors and shepherded the student
through classes. There was something of
a row after it was learned that a black student was having her outline ‘reviewed’
(wink, wink, nudge, nudge) by the black professor who taught the class a week
or so before the final examination. Of
course, after the 1L year in most Law Schools students can pick whether they
study Corporations, Federal Taxation, and Securities on the one hand, or Women
and the Law, Race and the Law, and working in a clinic on representing the
indigent and other fluff for credit on the other hand.



The long and the short of it is that there are ample
opportunities for race-based shenanigans which don’t require the addition of
points to test scores or augmented class rank to make a significant difference.

Additionally if minorities wanted additional time on a test
at my school- they only had to request it. They didn't have to
demonstrate a reason, ie disability.





I don’t have knowledge of such a policy applying to
minorities exclusively, but it was rather liberally applied and extra time was
granted to students without a diagnosed disability. What’s neat for those students is that if you
can take what is supposed to be a 3 hour exam over 8 hours, of course you have
to ‘eat,’ and your ‘eating’ or other assorted ‘breaks’ weren’t proctored.



My buddy was pretty pissed when he heard about one student
who was able to finagle “extra time” due to a made up, undiagnosed disability –
he said “but you don’t get extra time
. . . in life.” Maybe you had to be there, but it was a lot like the kid who said the Emperor was naked.

301 I went to a university just outside Boston during the time period that Obama was at Harvard. During that time there was a huge scandal at Harvard. Many, if not most, professors were simply awarding everyone a grade of "A" on the basis that they were smart enough to get into Harvard so they must deserve it. The scandal made the Boston papers several times.

And BTW, Michelle Obama admits to being an affirmative action admission at Yale. She got in because of her color and her brother's position on one of the athletic teams.

I'm going to have to take slight exception to this (my bona fides: I work in the testing industry). The SAT has mutated so much over the years that the two tests are no longer really comparable, and haven't been since before I took the test (1982). The emphasis has now been placed more on writing than reasoning, and the two tests bear less and less resemblance all the time. Even when Bambi would have taken it they were hard to compare without some pretty fancy statistical manipulations. (Which is why I'm skeptical of Mensa's LSAT-to-IQ conversion, because the LSAT is coachable and, at least in theory, only tests reasoning ability.)

In my case, here's my history and credentials:
I have a measured IQ of 130. Not spectacular, but top 3% - however, there's still about 200,000,000 people in the world smarter than me.
I graduated 112/203 in High School
I had a 2.89 undergrad GPA at a less than spectacular college.
I graduated my army office course 51 out of 65
My ACT score was 23 (never studied)
My problem wasn't a lack of potential, which is what the IQ score measures - intelligence potential. My problem was LAZINESS. I never studied. Not in high school, not in college (when I interviewed to get my MBA from a good program, I estimated I had spent maybe a total of 100 hours on under grad class work away from class, just writing the papers and such).
And, I think that is what Obama's deal is too. He's just lazy. I'm sure his IQ is higher than mine, but he, like me, has never adequately developed it so what ever it was is pretty wasted.

Well, I have always argued that he is a dim bulb because he went to law school, not in spite of it and that he's perfectly intelligent when compared to law school graduates.

It ain't rocket science.

The 52 % don't want to know the truth. That they were conned by a very slick campaign. That some of them voted for the black guy out of white guilt, or because it was time for "the first black president" and he seemed to fit the bill.

Meanwhile, McCain was open about his subpar performance at the Naval Academy. Bush's grades weren't treated like a national secret. Crap is kept hidden about Obama and all these supposedly open-minded liberals are fine with it.

I don't want Trump to get the nomination, but I love what he is doing now. Drawing attention to things that should be questioned. I see him as the willing scapegoat. Taking the flack so that attention is drawn to these issues, and some later candidate can benefit.

Right. They dumbed them down the year after I took them, apparently. (Lucky me, I got the hard tests!) Still, if you're rocking above a 1500 on them you're demonstrably intelligent.

Also, the proliferation of boot camp-like "test prep" courses (which didn't exist -- or at least we didn't know about them -- back when I took the PSAT/SAT) probably skews things as well.

I always took my standardized tests fairly 'cold,' not because I'm some badass or anything, but because I'm arrogant and lazy. Turned out well enough, I guess.

--Me too, although it was mainly because my family could not afford those courses. in '99, over 5 years after having taken the GREs, I did buy a Kaplan book for the GMATs. The stakes getting into an MBA program were higher, so it was worth a paltry investment, although I should have ponied up more for the one with the CD since the computer format --the first time I ever took it digitally after all those times sitting at a desk with #2 pencils-- threw me off. I still got a 710 though.

502 SAT is not even close to being an IQ test. It is mostly based on knowledge, not reason.

I did OK (but not great) on my SAT, but mostly because I went to a terrible school system where college bound meant you had to write a one page paper your senior year.

I scored 99th percentile on the LSAT though. That is a true IQ test and is accepted by Mensa as such. No prior knowledge necessary, just logic, reason, and reading comprehension.

Barry O seems to care a lot about the prestige element of schools, and I can't see him passing up the Ivies on the first go-around if he had an acceptable score to get in.

Factoring in AA, I'd bet that anything over 1200 was good enough for him to have his pick of east or west coast schools. If he had a west coast bias I'd expect him to have picked Stanford or UCB, more likely one of the Ivies.

I suspect his SAT Verbal/Quant score have big differences, with him doing well on the verbal but not well at all on the quant, which probably dragged down his overall score.

Hold a gun to my head and I'd guess an IQ somewhere in the 125 range, probably with a strong verbal/quantitative difference.

Son applied to 11 schools last year and not one of them wanted the writing section. You sent them the college board report but most even let you report your highest math and highest verbal from any tests taken. The private high school which has classes to review the sat and see where improvement is needed doesn't even go over the written section.

Wow, that's old! The deal was that he hadreferred to his "uncle" who was in WWII. It made no sense, because his father's family were in Kenya, and his mother was an only child. It turned out, however that his "uncle" was actually a great-uncle, and I think he appeared at the inauguration.
The rest of the story was that this "uncle" had liberated Auchwitz, but that was liberated by the Russians. Maybe it could have been a sub-camp of Auchwitz, but I'm not sure that this works either (it's still over in Poland). I suppose it could be that he liberated some other camp, but I'd put at least even money that it was just BS.

Let's face it: American Education consists of 2 parts. There is learning and there is the GAME of learning. What you'll be graded on is your ability toplay the game and has no reflection on what you actually have or have not learned.

In High School, College and Grad School I've always been labeled a "C" student. At each level I've finished by testing in the top 2% of my class on SAT, GSAT and afterwards in private practice. I have peers at each of those levels that now come to me for advice and direction. But along the way I was never interested in kissing a teacher's ass or playing the game well enough to get high grades. I had classmates that would live or die for their ability toget the magical 4.0. All I wanted from any class was the actual mental stimulation that came from learning.

If you're in education (ie: a teacher) and that offends you, then it's time for you to confront the realities of your institutions. The relationship between institutional grades and actual real life performance is vague at best and inverse in many cases like mine.

Reality: Obama sucks as a President because he was over sold to begin with and believed in his own myth. He would suck just as much had he actually achievied the academic honors awarded him. His lack of academic distinction only highlights the lie of his awesomeness which was sold to the public by the MBM.

And BTW: my experience with Mensa members is that most of them could test on any given day anywhere from well over 140 to down around 95, depending on how much coffee they've had that day, and/or how well that day is going for them. Consistancy is not a requirement for membership. They only have to ace that IQ test once to get in.

543 I was a National Merit Scholar. I don't remember what was on the SAT because I was busy eyeing the future Mrs. Prole across the room. But I will say I had taken IQ tests before and don't remember the SAT as being particularly close to those in content. But that was a long, long time ago and the memory fails.

You should also take the National Merit thing with a grain of salt. I think when I took it the test was normalized based on race and location. You had to be in the top 0.5 percent of your group but the group was not the population of all students in the US. I think they went by state and then by race so the top 0.5% of each race in a state were the recipients.

I remember walking to the parking lot after we received our scores with a black guy who had made it as a National Merit scholar who scored far, far below what I did... or what anyone in our AP class did for that matter. It wasn't like he was disadvantaged either. His parents were professionals and he had gone to the same schools as the rest of us. That was my first run-in with pure, unadulterated racism against either whites or blacks (and I grew up in the South). You don't forget stuff like that. Everyone has that moment when they figure out the game is rigged.

So I guess the point is that if you are talking about a hard cap for Obama's IQ based on the National Merit thingamabob then that cap is a lot lower than you would expect.

I received no National Merit recognition whatsoever. IIRC, there's also a grades component and since my grades have always been mediocre (because I hated school and didn't do the work they assigned), I didn't meet their minimum criteria.

All that is to say that National Merit status doesn't really tell us very much unless we know the grades as well (or whatever the other component is).

The Vox Populi analysis doesn't make sense. Percentile scores go down the more self selective the test gets. He has a 1310 SAT guy equating to a 98 percentile LSAT.

I know a guy who sometimes comments as "Prufrock" who scored markedly higher than 1310. The guy is a National Merit Scholar. The percentiles went PSAT 99.5, SAT 99.0, GMAT 95. I can't imagine that LSATs are less self-selective than GMATs, or at least not to that degree. Also, "Prufrock" is evidence that these tests measure the ability to take these tests and little else. He has spent much of his life with his head up his ass.

All of which brings me back to GWB 2000's best line, "the soft bigotry of low expectations". If we weren't norming scores and changing standards then the accomplishments of the genuinely accomplished would not be questioned, no matter what the melanin count.

I don't want to climb on board with callling someone stupid or dishonest just because they mispoke once - especially during something as intense as a presidential election. It's unfair when we're on the receiving end, and I don't want to become the people I hate. Lot's of people call a great-uncle "uncle", but the "Dad" thing geos a step beyond.
I was just trying to clarify where that whole story apparently came from that's it's not complete fiction.
That being said, it seemed obvious to me at the time that Obama was not especially concerned about getting the facts right (in general), and that, yes, he was "borrowing" his relative's patriotism for his own use. Further, I noticed the quickness and ease with which he spun the truth so far that it was no longer recognizable (that would include the "Daddy" part). There's always at least one master spin doctor at work, and I absolutely despise them. They never get in realtrouble because they're masters at telling their bosses (who act like liberals, and often are)what they want to hear.

Since I posted I've had it clarified that the National Merit thing is based primarily on PSATs, with SAT performance checked to make sure the PSAT score wasn't a fluke or cheating or something.

I suppose there's a grade component.

In your case the 1220 PSATs might not have flagged you as in the hunt, so your later SATs didn't help.

The "converter" puts my IQ at 117, and those online IQ tests usually put it around 130-140, depending on my level of caffeine and how much I give a shit. I don't have a 4-year degree, but I do have 2x AS degrees, plus plenty of licenses and certfications that let people know that I really DO know my shit when it comes to computers and electronics.

I know that there's 50 states, I can pick out most all of the countries in the world on a map, I can do measurement conversions in my head, and I know that Barry Soetoro is a fraudster that needs to be run out of DC on a rail after getting tarred and feathered for destroying the US economy.

What one should expect with the IQ of high-level politicians is something around 120. 570 Yeah, I'm sorry but I have to say the 116 thing is crap. I believe I have found the story (it looks like maybe there was suppose to be a link, but it malfunctioned).
The guy starts off with an average score for Harvard grads, and then adjusts to a different test, then adjustsfor race(not completely justifying how exactly he determines the adjustment), then converts to an IQ. So it's a whole string of calculations, each with its own dubiousness - especially if youstart to question if statistics for blacks are the same as statistics for biracial. What you end up with is a very crudely determinedestimate for the IQ of the average black person at Harvard, and I kinda doubt that the math being done follows legitimate statistics.
That being said, my kid went through the whole SAT deal this year. I saw some statistics, and found them pretty remarkable. Blacks really do score WAY lower than everybody and anybody else. I forget the number, but I think it wassomewhere around 100 points for each separate test, or a full standard deviation. (Go ahead and try to explain how ingenious the test-makers are, in how they can"bias" tests sothat black peoplewill dopoorly, but not theother minorities. Those test-writing elitist academic types are always such racists!!).
I think if Obama were white, you could probably come up with a rough minimum IQ, but once you throw in the A-A factor, the range of what you could be looking at is probably pretty broad, anda minimum number is probably not possible to reasonably suggest.
But the idea that he's some sort of ubergenuious because he was president of the HLR has been sufficiently de-bunked. If anything, his completelack of publishing suggests he was far below average for people holding that position.I get no sense of "braininess" from him. Since most A-A students are significantly less qualified, it's reasonable to expect (not assume) that he would rate significantly lower than other Harvard grads. If you figure most white Harvard types have IQs of at least around 130, it would make perfect sense for his IQ to be, say,somewhere around 120 (to be generous), give or take 10, but you really can't say thatwith any real confidence.
But we really already knew that the supergenius part of his cult of personality was crap anyway, didn't we?

The point was that Ace, and the person he quoted were making estimates of Obama's IQ based on his not making SAT based recognition. My point was that his failure to achieve those recognitions is not necesssarily indicitive of his not having a high IQ.
