Story Correction: Clinton Did Pay Military in 1995 Shutdown, But...

Corrected: This story was wrong as written. It's below, but here's the scoop.

First, the Air Force Times did get this wrong, leading to the confusion, which got picked up by Mike Flynn.

But like I said-- that story gets it wrong. Here's why the troops got paid on time in 1995:

A frequent question is how this compares to the last government shutdown in 1995-1996. There were two shutdowns at that time, one of five days, from November 13 through November 19, 1995, and one of 21 days, from
December 15, 1995 through January 5, 1996. The first shutdown was not long enough to affect pay checks, and DOD was not affected by the second because defense appropriations were enacted on December 1, so funding was available.

So, the draft guidelines should be about the same as under Clinton.

The difference isn't the procedure, but that Clinton was a responsible enough president to strike a deal on defense so that our troops would get paid.

Whereas Obama intends to hold them hostage.

Sorry for the mistake. I have to note, defensively, the Air Force Times got it wrong, which led Flynn to get it wrong, which led me to get it wrong.

I have to thank two people for getting me the right story: First, the indispensible Morgen at Verum Serum, who alerted me about 20 minutes ago that he thought the story was wrong, based on his quick googling of a Congressional Research Staff study on the 1995 shutdown.

And then, Gabe Malor, who really clarified everything with the information now printed above.

Also, I want to thank vets like USADawg who wrote to say they remembered getting paid on time every week in 1995. Yup, you're right -- but because of the deal Clinton and Gingrich struck.

The original, errant story is below. It's in error, and I'm sorry.

But there still is an important takeaway: It would in fact be Unprecedented, as Obama likes to say of himself, for a President to refuse to reach a deal to keep the troops paid during a shutdown.

Summing up: In 1995, in a time of peace, Clinton signed a bill ensuring troops' pay.

In 2011, fighting three wars, one of which he claimed to enthusiastically support and another he started, Obama is threatening to not pay troops in the field.

I had been confused about this. First, I read the military would get paid.

Then, starting last week, I begin reading that the troops wouldn't get paid. They'd earn money, but wouldn't get paid money. Until the shutdown ended.

So, why did the story go from "get paid" to "not get paid"?

Apparently, it is within the executive's power to define "essential" and "non-essential" personnel during a shutdown; non-essential personnel can be furloughed (or at least not paid until the shutdown is over).

But it seems Obama is taking the position -- for political reasons -- that the military is "non-essential." They can't be furloughed, but he has decided (or Gates has; I rather think it's Obama's call) that they'll show up for work but won't get paid until later.

Mike Flynn, citing Federal Times, notes this is not what happened during Clinton's shutdown.

When the government was shut down in 1995, military personnel continued to report to work and were paid, but the planning guidance sent to the services and defense agencies says a shutdown this time will be different.

This is Obama's choice, then, and he's doing it because the military are among the few government employees held in high regard. So they're camera-friendly props and pawns.

But don't be fooled, then: It's Obama, and not Boehner, withholding their checks. Clinton sent out the checks on time. Obama's choosing to stick it to them to make a political point.

Notice the media's not reporting this: They went from reporting troops will get paid to troops won't get paid without explaining why the change had occurred. They didn't issue corrections for their past reportage -- which is fine, as they weren't wrong before.

But now the story has changed in a crucial way and they refuse to say why.

Because of Obama. That's why.

And that's all thanks to CDR M, who writes on his own blog that the First Lady is kicking off some kind of support the troops cause on April 12th. A week they won't be paid to defend our country.

Oh, and if that isn't embarrassing enough, Obama has schedule for April 10 to April 16 "National Volunteer Week," during a week he'll be forcibly volunteering our troops to guard the country without pay.

I think it would be a good idea to get some sort of private, charitable relief fund for the military families most in need if this drags out. I don't have much money, but I'll do what I can. 25 A federal judge already decided no pay, no work. Three Marines had their pay just stopped for no appearent reason. It wasn't NJP, finance just screwed up. This went on for months, they had to get civilian jobs and they were still doing the Marine stuff too. Finally, they stopped showing up. The three were charged with desertion, all while still not getting paid. It ended up going to a federal court on appeal where the judge sided with the three guys and said the Marine Corps failed to hold up their end of the contract and dismissed the desertion charges. No pay, no work.

64 Just for clarification. "Essential" means they have to work without pay sincethere are no funds to pay them and probably no one to do payroll, but they WILL get paid back-payafter a budget bill is passed.
Non-essential means that the employeewillgo home, and may or may not be paid retroactively after a bill is passed.
In this case all miliary pesonnel are considered essential as they should be.
However, what's interesting is that the administration is reclassifying some essential personnel as non-essential this time - including some law enforcement personnel. No one is sure why, but it's the administration's call not the Congress.

71 Even if the troops do get paid, from Obama flip flopping on this, the truth is that a lot of our troops read about this in the Stars and Stripes and other media. They are in harms way, but have to worry about their families back home because of Obama's use of extreme hardball politics.

It's too late, in my opinion, for Obama to fix this. We shouldn't order troops into harm's way and then burden them with political maneuvers.

Repubicans should avoid those talk shows with anchors that are notoriously biased. Repubics should take advantage of existing media channels created by Right wing grass-roots. There are many avenues that could be taken by a candidate willing to run an irregular campaign who has the balls and imagination to pull it off- I think "asymetrical warfare". And there are many alternatives to the traditional news shows and staid interviews for people like Boehner to make their case to the voters free from the "framing" of the State Media.

The only reason that route is not chosen is that most Repubicans are shameless camera whores.

Bank of America was one of the prime offenders, and though they apologized, big woop. These guys can't get their homes back because they were sold to other people. And, speaking as someone who has worked for the Federal government for almost 30 years, they'll take their sweet-ass time even then. If you owe them money, they siphon it out of your paycheck the next week. If they owe you...not so much.

The House passed that bill twice and Reid set it up to fail. As for today, Hoyer demanded a "clean bill" but he lost that vote, though Reid will surely try another time. I thought Ace made clear that in past shutdowns, failing to pay the troops hasn't been an issue.

When it became an issue, the GOP put it in the continuing resolution.

The GOP House did vote to fund the troops. I'm not really satisfied with that, but let's put the blame where it belongs while asking the GOP to pass a bill funding the troops, with no additional aspects to give the left cover.

336 Does anybody have any recollections about how the shutdown in '95 hurt the GOP? It didn't hurt them politically, they retained power in 1996. It damaged Gingrich personally, which isn't that bad because he's pretty much an a-hole anyway.
The worst thing it did was make them afraid of their own shadows, but even with that they got a lot of stuff done because the public still wanted smaller government, it showed in the polls, and Clinton just took credit for everything they did.

Some scrunt was whining on Twitter yesterday about having to be furloughed--as much as unpaid leave sucks, she still has a fucking job to go back to in 2-6 weeks. I've been laid off twice since Barry's Coronation, and I'd much rather have had a month off knowing my job would resume at current pay levels. I imagine most people who've been laid off or had their hours reduced feel the same way.

To weigh in, if I may--I don't think some of the House Democrats do, actually. 15 of them broke ranks today to vote for this bill and for all Hoyer's bravado, he has been upset with Pelosi lately and I think he wishes to avoid this. The Senate Dems and the Pelosi side are more entrenched on the issue, though Obama has wanted this the most.
The thing that's still strange to me is that Treasury stated last month that they want a shutdown. Now, I'm no conspiracy theorist, but I have to admit that was odd because they usually don't weigh-in on such issues. Still, no idea if it actually means anything.

I've been off the past two days because I'm doing shiftwork and working on the weekends, but I can't see where that would have changed.

So that’s the deal and I’m, you know, frankly, I remember when I was your age I did a lot of living from pay check to pay check and so I hope this thing doesn’t happen.”

Later speaking to reporters Gates explained that if the shutdown goes through the 30th then they’d miss a paycheck. But he explained how a shutdown would affect their families at home more than it would those serving in the field.

“Now they get paid in rear, obviously, so over time they won’t lose anything, but you all know as well as I do, a lot of these young troops live pretty much paycheck to paycheck. And I start to think about the inconvenience that its going to cause these kids and a lot of their families, even half a paycheck delayed can be a problem for them so I hope they work this whole thing out.”

I was in the military during the Clinton and Bush years, and I know soldiers who love their wives, but expect them to handle the finances and the kids when they are deployed. It is extremely stressful to have to worry about these details. It is CRITICAL that they focus on their jobs.
