Full Decision: Thanks to Gabe.

Basics of Decision [ace]: Two statutes discuss residency, one for voter eligibility and one for candidate eligibility. Voter eligibility can be proven by "constructive" residency-- that is, you're not really residing in the area, but you maintain a home there and intend to return to it. This is a more lenient standard.

Another statute requires a candidate to "reside in" an area (Chicago, here) for a full year before seeking to be eligible to hold office there.

Rahm Emmanuel argues, basically, these statutes say the exact same thing and the test of whether or not he's a candidate should be the exact same as the test for determining if he can cast a valid vote for a candidate.

The court finds that's not right, because, in the test for candidate eligibility, it specifies first that the candidate must be eligible to cast a vote and, further, that he must "reside in" Chicago for a year before the election. The court finds it makes no sense if that Part 2 of the test simply means the exact same thing as the Part 1; it must mean something different, they figure, since the test consists of two separate parts.

So they find that second part requires genuine, bona fide residency and not mere "constructive" residence for voting purposes. And there they find Emmanuel fails the test, easily. He clears Part 1 of the test (he can vote there, because he has constructive residence there) but not Part 2, which requires, they say, actual residency. Or else, again, why have a Part 2 at all?

99 Perhaps I'm just being too cynical, but I am guessing that this is part of the plan. Somewhere along the line, someone decided that it shouldn't look TOO easy for Rahm to become mayor, don't make it TOO obvious. So they decided that the appellate court would rule against him, then the State Supremes would have a tough, close decision in his favor. So he gets to stay on the ballot, but it was honest and fair and legal and oh-so-close not at all corrupt or anything. Then the election will be semi-close-ish just so that we all get to continue believing that Mayor Rahm "won" the election fair and square.

I could spend all damn day talking about the things I hate about Chicago...but at the end of that day I have to admit that I really came to love the place when I lived there. You're damn right that they get what they deserve for being so deeply in thrall to The Machine, but still...it's a truly lovely city, with IMO the most beautiful skyline in the United States and a truly exciting diversity that isn't so insufferable up-its-own-ass in the way that NYC and Cali can be.

There really is something to be said for the Midwest, and this comes from a kid who was raised as a Washington DC whelp.

But yeah, ultimately I'm a fatalist. I'm not sure that city (or state) can be saved. Maybe it's just as well to speed along with the inevitable burn-down.

Yeah, I think this is true. The Chicago-Downstate relationship is, if you can believe it, FAR more toxic than the NYC/Upstate one, which gets all the press. They've both learned to dysfunction together, and I kind of think that having four years of Mayor Braun turning the city into an unliveable, unmanageable hellhole might be the only way to "bring the pain home" in such a way as to make people realize the consequences.

I can't emphasize how much better a city Chicago is than New York.

There are exceptions to the rule that one must RESIDE in the city for a year prior to running for election, I believe serving in the military is one of the exceptions. I think Rahm has floated this exception as applying to him because he was "serving" in the WH.
What has the big shots in Chi-town worred about this has nothing to do with Rahm. In fact they would be fine with Mayor Carole or Mayor Geri if it comes right down to it. Why?
Because the City of Chicago REQUIRES city workers to live within the city limits. Period, end of story. They chase cops firemen teachers all the time, checking out their legal residences and firing anyone who isn't living in the city. Because those city workers are the backbone of the city's middle class. And the big shots know that they cannot have a functioning city with the small number of rich big shots, and the huge number of entitled "community organized" layabouts.
If Rahm gets the ok to stay on the ballot and then wins, those city workers are going to make a beeline for suburbia and cite Rahm as their proof.

This is all the dissent had to say about the recent amendment to the code for those away on military service:
The majority attempts to support its creation of a completely new candidate residency standard with an exhaustive (or, rather, exhausting) discussion of section 3.1-10-5(d) of the Municipal Code regarding the military exception. The candidate here was not in the military and did not attempt to claim an exemption under section 3.1-10-5(d). Nevertheless, while the majority spendsfive pages of its opinion on a subsection of the Municipal Code that has no applicability to the present case, the majority does not write a single sentence explaining how if defines 'actually resided in.' It is patently clear that the majority fails to even attempt to define its newly discovered standard because it is a figment of the majority's imagination.
That'scomplete bullshit. If the pre-amendment code had permitted those who were called away on military service to count that timetowards the "residing in" requirement, then there never would have been a need for the amendment. This isby far the strongest argument for majority's position that "residing in" means actually physically residing there. Again, thesupremes are going to have to come up with a good explanation on this if they reverse.
