Update: Grand Jury Report On House of Abortion Horrors Is, Crucially, a Damning Political Indictment of Rendell's Pennsylvanian Government That Deliberately Permitted Gosnell To Thrive

Update: See the long excerpt under the fold. The report is damning -- not just about Gosnell, but the entire government/medical complex that enabled and encouraged Gosnell. It specifically notes high officials have "lawyered up" rather than answer grand jury questions.

This is big.

Question (which I don't know the answer to): Are grand jury reports typically written with a sort of personal, emotional vibe? Or were the events here so repulsive they couldn't keep to a dry recitation of facts?

Really vile stuff, which is almost certainly -- like 99% -- going to make this a very real political issue and, yes, allow pro-lifers some room to restrict abortion. At least they'll be able to take a stand on what Barack Obama wouldn't, that is, the simple murder of delivered-by-abortion but very living babies.

Did I say delivered-by-abortion? Actually, it seems that usually he just induced a standard labor, delivered the baby, and killed it.

Since we're talking about a "climate of hate" and politics and such: Could it possibly be the case that politics is responsible for this? Um, according to the report, that's not even really a live question.

We discovered that Pennsylvanias Department of Health has deliberately chosen not to enforce laws that should afford patients at abortion clinics the same safeguards and assurances of quality health care as patients of other medical service providers. Even nail salons in Pennsylvania are monitored more closely for client safety.

The State Legislature has charged the Department of Health (DOH) with responsibility for writing and enforcing regulations to protect health and safety in abortion clinics as well as in hospitals and other health care facilities. Yet a significant difference exists between how DOH monitors abortion clinics and how it monitors facilities where other medical procedures are performed.

Indeed, the department has shown an utter disregard both for the safety of women who seek treatment at abortion clinics and for the health of fetuses after they have become viable. State health officials have also shown a disregard for the laws the department is supposed to enforce. Most appalling of all, the Department of Healths neglect of abortion patients safety and of Pennsylvania laws is clearly not inadvertent: It is by design.

Pretty Horrifying: It's a 200+ page read but they're short pages and it reads, yeah, like a horror movie, except it's real, and except that there will in fact be apologists for it.

This section is... well, destined to be embargoed by a media outlet near you.

Pennsylvania is not a third-world country. There were several oversight agencies that stumbled upon and should have shut down Kermit Gosnell long ago. But none of them did, not even after Karnamaya Mongars death. In the end, Gosnell was only caught by accident, when police raided his offices to seize evidence of his illegal prescription selling. Once law enforcement agents went in, they couldnt help noticing the disgusting conditions, the dazed patients, the discarded fetuses. That is why the complete regulatory collapse that occurred here is so inexcusable. It should have taken only one look.

The first line of defense was the Pennsylvania Department of Health. The departments job is to audit hospitals and outpatient medical facilities, like Gosnells, to make sure that they follow the rules and provide safe care. The department had contact with the Womens Medical Society dating back to 1979, when it first issued approval to open an abortion clinic. It did not conduct another site review until 1989, ten years later.

Numerous violations were already apparent, but Gosnell got a pass when he promised to fix them. Site reviews in 1992 and 1993 also noted various violations, but again failed to ensure they were corrected.

But at least the department had been doing something up to that point, however
ineffectual. After 1993, even that pro forma effort came to an end. Not because of administrative ennui, although there had been plenty. Instead, the Pennsylvania Department of Health abruptly decided, for political reasons, to stop inspecting abortion clinics at all. The politics in question were not anti-abortion, but pro. With the change of administration from Governor Casey to Governor Ridge, officials concluded that inspections would be putting a barrier up to women seeking abortions. Better to leave clinics to do as they pleased, even though, as Gosnell proved, that meant both women and babies would pay.

The only exception to this live-and-let-die policy was supposed to be for complaints dumped directly on the departments doorstep. Those, at least, could be investigated. Except that there were complaints about Gosnell, repeatedly. Several different attorneys, representing women injured by Gosnell, contacted the department. A doctor from Childrens Hospital of Philadelphia hand-delivered a complaint, advising the department that numerous patients he had referred for abortions came back from Gosnell
with the same venereal disease. The medical examiner of Delaware County informed the department that Gosnell had performed an illegal abortion on a 14-year-old girl carrying a 30-week-old baby. And the department received official notice that a woman named Karnamaya Mongar had died at Gosnells hands.

Yet not one of these alarm bells not even Mrs. Mongars death prompted the department to look at Gosnell or the Womens Medical Society. Only after the raid occurred, and the story hit the press, did the department choose to act. Suddenly there were no administrative, legal, or policy barriers; within weeks an order was issued to close the clinic. And as this grand jury investigation widened, department officials lawyered up, hiring a high-priced law firm to represent them at taxpayer expense. Had they spent as much effort on inspection as they did on attorneys, none of this would have happened to begin with.

But even this total abdication by the Department of Health might not have been
fatal. Another agency with authority in the health field, the Pennsylvania Department of State, could have stopped Gosnell single-handedly. While the Department of Health regulates facilities, the Department of State, through its Board of Medicine, licenses and oversees individual physicians. Like their colleagues at Health, however, Department of State officials were repeatedly confronted with evidence about Gosnell, and repeatedly chose to do nothing.

Indeed, in many ways State had more damning information than anyone else.
Almost a decade ago, a former employee of Gosnell presented the Board of Medicine with a complaint that laid out the whole scope of his operation: the unclean, unsterile conditions; the unlicensed workers; the unsupervised sedation; the underage abortion patients; even the over-prescribing of pain pills with high resale value on the street. The department assigned an investigator, whose investigation consisted primarily of an offsite interview with Gosnell. The investigator never inspected the facility, questioned other employees, or reviewed any records. Department attorneys chose to accept this incomplete investigation, and dismissed the complaint as unconfirmed.

Shortly thereafter the department received an even more disturbing report about a woman, years before Karnamaya Mongar, who died of sepsis after Gosnell perforated her uterus. The woman was 22 years old. A civil suit against Gosnell was settled for almost a million dollars, and the insurance company forwarded the information to the department. That report should have been all the confirmation needed for the complaint from the former employee that was already in the departments possession. Instead, the department attorneys dismissed this complaint too. They concluded that death was just an inherent risk, not something that should jeopardize a doctors medical license.

The same thing happened at least twice more: the department received complaints about lawsuits against Gosnell, but dismissed them as meaningless. A department attorney said there was no pattern of conduct. He never bothered to check a national litigation database, which would have shown that Gosnell had paid out damages to at least five different women whose internal organs he had punctured during abortions.

Apparently, the missing piece in the pattern was press coverage. Once that began, after the raid, the department attorney quickly managed to secure a license suspension against Gosnell. Similar inaction occurred at the municipal level. The Philadelphia Department of Public Health does not regulate doctors or medical facilities; but it is supposed to protect the publics health. Philadelphia health department employees regularly visited the Womens Medical Society to retrieve blood samples for testing purposes, but never
noticed, or more likely never bothered to report, that anything was amiss. Another employee inspected the clinic in response to a complaint that dead fetuses were being stored in paper bags in the employees lunch refrigerator. The inspection confirmed numerous violations of protocols for storage and disposal of infectious waste. But no follow-up was ever done, and the violations continued to the end.

A health department representative also came to the clinic as part of a citywide
vaccination program. She promptly discovered that Gosnell was scamming the program; more importantly, she was the only employee, city or state, who actually tried to do something about the appalling things she saw there. By asking questions and poking around, she was able to file detailed reports identifying many of the most egregious elements of Gosnells practice. It should have been enough to stop him. But instead her reports went into a black hole, weeks before Karnamaya Mongar walked into the Womans Medical Society.

Ironically, the doctor at CHOP who personally complained to the Pennsylvania Department of Health about the spread of venereal disease from Gosnells clinic, the doctor who used to refer teenage girls to Gosnell for abortions, became the head of the citys health department two years ago. But nothing changed in the time leading up to Mrs. Mongars death. And it wasnt just government agencies that did nothing. The Hospital of the University of Pennsylvania and its subsidiary, Penn Presbyterian Medical Center, are in the same neighborhood as Gosnells office. State law requires hospitals to report complications from abortions. A decade ago, a Gosnell patient died at HUP after a botched abortion, and the hospital apparently filed the necessary report. But the victims kept coming in. At least three other Gosnell patients were brought to Penn facilities for emergency surgery; emergency room personnel said they have treated many others as well. And at least one additional woman was hospitalized there after Gosnell had begun a flagrantly illegal abortion of a 29-week-old fetus. Yet, other than the one initial report, Penn could find not a single case in which it complied with its legal duty to alert authorities to the danger. Not even when a second woman turned up virtually dead.

So too with the National Abortion Federation. NAF is an association of abortion providers that upholds the strictest health and legal standards for its members. Gosnell, bizarrely, applied for admission shortly after Karnamaya Mongars death. Despite his various efforts to fool her, the evaluator from NAF readily noted that records were not properly kept, that risks were not explained, that patients were not monitored, that equipment was not available, that anesthesia was misused. It was the worst abortion clinic she had ever inspected. Of course, she rejected Gosnells application. She just
never told anyone in authority about all the horrible, dangerous things she had seen.

Bureaucratic inertia is not exactly news. We understand that. But we think this was something more. We think the reason no one acted is because the women in question were poor and of color, because the victims were infants without identities, and because the subject was the political football of abortion.

I like that part about high-up government employees "lawyering up."

Odds this will make the national news in any way except for a quickie "single isolated lone nut with no political ramifications whatsoever:" 3%.

Question: These women didn't just stumble upon an abortion mill willing, ready, and eager to perform illegal late-term abortions randomly.

Some may have heard through the grapevine, but in most cases, they were referred to this place by other abortionists who weren't willing to do the operation (so as not to jeopardize their corporation, ahem), but were plenty willing to direct them to this slaughterhouse.

So: Who referred Gosnell such a steady stream of business?

(Softcover title is Blood Money). She worked for a Dallas area abortion provider in the 70s and first half of the 80s. She states that it is indeed all about the money. The people involved care not a whit about women's rights. The book was written in the late 80s/early 90s, so it is may be out of print, but used copies can probably be found online or at a used bookstore.

One telling note: If a patient was wealthy and/or white, Dr. Kermit made a point of overseeing her treatment in person, instead of delegating it to the unlicensed high-school grads who medicated and treated the poor, black, Hispanic and Asian clientele. That may limit his ability to play the race card in his defense.

34 During (IIRC) the Clinton admin a woman whose over 18 year old son had knocked up a (IIRC) 13 year old drove the girl to a neighboring state to get an abortion. The operation was botched and while driving home the girl started to hemorage heavily. The mom abandoned her on the side of the road and she died. I believe that PA was one of the two states involved and (again IIRC) charges were never brought for any one ofthe litanyof crimes commited in this action. Mom was specifically protected by pro-"choice" politicians for from any charges for her actions.

Those who end up doing it are the incompetent, the greedy, and the sociopathic. A great overview of it can be found in Dr. Bernard Nathanson's book "The Hand of God" in which he describes in no uncertain terms his career as a doctor, founder of NARAL, and his eventual conversion to pro-life activist and speaker, and ultimately his baptism as a Catholic. It's a harrowing read but gives a good indication of the type of person who goes on in this.

There is also a new book out by Abby Johnson called "Unplanned"; she was a manager at a Texas PP clinic who was corralled into helping perform an abortion, and ended up leaving PP and becoming a pro-life speaker and Christian author.

I cant have kids either but would love to adopt. When i think of all the perfectly good babies who are killed, and then all the people willing to pay HUGE piles of money for ANY baby, traveling to the ends of the earth for orphans from far away, i just want to cry and cry and cry.
Now i did have a foster child.
I got her when she was fourteen, so dont talk to me about all those kids out there who need love in the US, who are older. But when you get them at that age, they go back to their birth families when they reach 18 and thats a heartbreaker. But they love those people and they were there first.
So i really wish more girls had the baby, then just give it up permanently and forever the old fashioned way, instead of killing it.

I went to an elite college with elite mostly rich students. Albeitly, I enjoyed the "cool" hot crowd but I can think of maybe 2 women that didn't have at least one abortion. I know several who had more than one and a couple who were going for 3 and one who was on her fourth. They would cry and mope for a week and then go right back to what they were doing. They usedbirth control haphazardly, if at all. The PP charged $250. Everyone had the attitude that pregnancy was something that was easily fixed. No one had the baby.
I was terrifed of my dad's disappointmentand my mother told me that an abortion would be something that I would never ever even in a long long life recover from. Hence, one man and that with a ring first.
I know some of the young girls are probably coerced and ignorant. But the libs keep us from telling them the truth.

My daughter was pregnant back in 2008 - about 19 weeks in, they did an ultrasound and discovered that baby Austin didn't have kidneys, a disorder they called "Potter's Syndrome" which was, their words, "incompatible with life". They urged my daughter (not quite 20 years old at the time) to travel to Maryland to have a late-term abortion, since there was no chance the baby would survive. She refused, over and over again. Even my older daughter was pushing for her to end the pregnancy. (My girls are as different as two people can be.) That baby moved, and kicked, and squirmed around right up to the time he was born, at 34 weeks. I was there when he was born, along with his daddy. There was no excitement or anticipation, it was very quiet and very quick, Austin was born alive, his little legs were fused together and he had many, many other problems. He wasn't able to breathe, and he died about an hour after he was born. But we got to hold him, and love him, and make a fuss over him, and cry over him when it was all over.
My daughter couldn't bear to end the life of the little guy she got to know over the nine months she was pregnant. I was very, very proud of her.
Seeing the photos and reading this report is absolutely nauseating. The death penalty isn't nearly enough for this murderous bastard.

Museisluse, the problem with "the morning after pill" is that it only prevents conception if the timing is perfect (just before ovulation, but early enough to suppress ovulation.) If you don't hit that window, then it causes the uterine lining to shed whether there was an implanted embryo or not. Kind of a mini-abortion.

In any major U.S. city, the illegitmacy rate in concentrated areas served by centers like this is near 90%.
Those are the ill-plannedpregnancies that went to term. Do the math and calculate the sheer volume of babies diverted to alternatives.

Your daughter's story reminds me much of what my family went through when I was 10. My mom because pregnant (a birth control baby), but my parents were struggling with the three kids they already had. The baby was due 3 days after my 10th birthday (I was hoping to share my birthday with my youngest brother). Although she had Braxton-Hicks contractions on my birthday, the baby didn't come. Nor did he come three days later on his due date. Finally, the decision was made to induce. My brother was born with a non-survivable condition called anencephaly (the brain was partially or almost completely unformed). Next week would have been his 29th birthday and it is still hard to think about what he might have become without tears.

A few months later, mom was telling me about his birth. She told me how she held him, counted his fingers and toes. His eyes were open and he turned out to be the only one of four kids born with my dad's brown eyes. The nurse asked if she wanted a cap put on the baby's head (to hide the hole in his skull where the brain hadn't formed). She said no and ran her hand over the back of his head. From the front, you'd never know anything was wrong with him. She kissed him and said goodbye to him. She also told me something that has informed my pro-life stance to this day. She said that even if she had know, when sitting in that car in the parking lot at the abortion clinic, that the baby wasn't going to survive anyway (this was in the days before ultrasounds were routine, which would have diagnosed the condition), she still WOULD NOT have gotten out of that car. "I at least got to carry him for nine months and hold him after he was born and would not trade that experience for anything."

When my other brother and his wife were expecting their first child, my mom brought out a box she had kept close for over 25 years. In tears, she told my SIL that she had kept some of the things she had made for the baby who had died, and was giving them to her grandchild in memory of the uncle she would never now.

Dante would have to invent a 10th circle of Hell for someplace deep and hellish enough to hold the people responsible for this.

Two points:
1) Barack Obama did take a stand, he stood on the side of preserving the right of doctors to perform late term abortions beyond the point of viability.
2) If you were trying to draw a distinction between what this monster was doing and what Obama was defending in Illinois, it's a distinction without a difference. In the hospital that brought the problem to light in Illinois, doctors were performing late term abortions by inducing labor for fetuses that they assumed were premature enough that they wouldn't survive delivery, knowing full well that some of them would. If anything, what Obama was defending was even more barbaric. In the Philadelphia case at least the abortionist was ending their lives quickly if crudely, in the Illinois case the medical personnel were simply setting the newborns aside in some out of the way place (a soiled linen closet was mentioned at least once) and leaving them to die of neglect which sometimes took hours.
