Breaking: Blago Holdout Retired State Employee Who Once Handed Out Campaign Literature For Relative Seeking Office;
NPR and Liberal Talk Radio Listener

Here's what Fox local news in Chicago reports:

Jurors who have been interviewed so far will not identify the juror, other than to say the juror was a female.

FOX Chicago News reported that speculation is centering on juror Jo Ann Chiakulas of Willowbrook, after a second-hand acquaintance said that she has been saying for weeks that she would find Blagojevich not guilty.

Chiakulas is a retired director from the Illinois Department of Public Health.

Contacted Tuesday night, she told FOX Chicago News she would call on Wednesday if she wished to talk about the case.

On one count at least, Chiakulas voted with her fellow jurors, agreeing to convict Blagojevich of lying to federal agents.

Note that that is not yet confirmed. It is now confirmed by CBS local news Chicago.

They actually could have reported more -- because pre-trial, they had this to say about a female "retired public health director" on the jury panel:

Juror # 106, a black female believed to be in her 60s, is a retired state public health director who has ties to the Chicago Urban League. She has handed out campaign literature for a relative who ran for public office. She listens to National Public Radio and liberal talk radio shows.

Media accounts mention the campaign literature, but they don't mention NPR and liberal talk radio. Why?

We know they read this description -- why do they end their repetition of it at that point?

The media is quick to stereotype conservative-tilting Americans and attribute to them bad motives.

Think they'll do the same here?

What were her motives for so egregiously ignoring the law to set a guilty man free that her fellow jurors had to confront her with her own oath to render a true verdict?

I am pretty accustomed by now to having my motivations questioned by the media, and having unethical or vile motives assigned to me.

How about for this cog in the Chicago machine?

You know, to date, the Tea Party has done zero damage to anyone, and yet it is castigated daily by our hectoring press.

This woman, this ward-heeler's moll, just sprung a guilty man free and cost the taxpayers millions.

Where did she get her ideas from?

I know FoxNews gets blamed a lot for all the "poison" it's putting into the body politic -- what poison did she ingest from NPR and liberal talk radio?

From where did she get the idea that it was right to spring a guilty man in the interest of some political gamesmanship?

Think it's just an oversight that they left this out there for a blogger to find?

Coincidentally, the Chicago Urban League was once headed by Cheryle Jackson, a former Blagojevich press secretary, although it appears Chiakulas left the Urban League several years before Jackson became the league's president.

I don't think that there's some direct thing going on here -- but this is obviously a highly political woman, steeped in dirty Chicago machine politics. And she knows who gets hurt and who gets helped based on her verdict.

Yeah they get a bunch of peremtory strikes (no reason needed) and then can with judge's permission strike for good reason, after questioning.

The thing is, you can get a conviction overturned if you strike too many blacks or wind up with not enough minorities. So prosecutors are reluctant to use their peremtory challenges on black people or minorities -- they try to get the judge to strike for cause but if the judge doesn't they often roll the dice on them.

Uh, no. Both parties have an unlimited number of strikes FOR CAUSE: a panelist like this with an obvious and particularized bias toward the defense should never made it on to the jury.

What you're confused strikes for cause with are peremptory strikes, which do not have to be for cause. Here in Florida, each side gets four: not sure what the federal rules provide for. And that's where the (baseless) accusations of racism generally come up.

So that's it. Slap my hands together and call it quits on him.

I tried my best. He was an old timer. I sensed he wasn't the most sophisticated of readers. I tried my level best to put in terms that wouldn't put him on the defensive -- telling him "it's bad for advertising," which is true, and avoids calling him a racist.

But no fucking rationale would suffice for him. He was determined one way or another to turn every comment into a diatribe at Archie Bunker's Place and would not stop pestering me, like a child, Why? Why? Why? WHy can't I say it? Why do you get to say something here? Why ? Why? Why?

Here's the answer; Because it's my fucking house, all right? Is that plain enough? No explanation: It's MY FUCKING HOUSE.

It just dawned on me that we can all go away for a couple of days, or spend the night doing something else but you always have the responsibility of the blog 24/7. There has to be a solution so that you and the co bloggers aren't under this much pressure. There's a lot of smart people here, we have to come up with something. I mean the blog must feel to you sometimes like a grown kid who finds out he/she can be on the health insurance until 26 so he/she doesn't get a job or anything but just stays home and watches tv and eats you out of house and home.

First, she was probably smart enough to avoid giving an answer that would allow her recusal for cause. Basically, if you are smart enough to say I will apply the law you give me to the facts and then follow the law.and I can set aside all of my prejudices and preconceived notions and judge the case on the evidence I hear in court your in. That leaves the prosecution with a limited number of preempratory challenges. And, if you 3 or 4 jurors before her who you find particularly offensive, you may be stuck with a situation of pick your poison.

251 The prosecutors often suck at picking the jury. They picked me for 2 girls who were going to old people's doors, gaining entry, and then stealing while acting nice. I was 19, and even, then would have easily given them the death penalty for that. They thought since I was 19, I would be more understanding of the other 19 year olds. I do think radio choice should be the new jury question.

256 I only had to sit one day for jury duty. Some civil suit where a lady was suing TGIFridays for a waitress slipping and exacerbating a pre-existing injury. So the attorney's are questioning everyone and most of the pool just nodded along until they asked if we agreed that if proven, do people deserve pain and suffering awards? I said no they should pay any past and future medical bills that arise from the "injury", but I can't put a dollar value on someone else's "pain and suffering".

Well that one got me immediately hauled into the judge's chambers where he dressed me down. Obviously, I got advice from a lawyer before I came in. I told him, I could apply the law, I was just answering the question honestly. He did not believe me.

I went back to the pool, didn't get picked for the jury, and the judge came in and gave those of us who didn't get picked a lecture on why I'm a bad person. After he left, several other jurors thanked me for being the only one who didn't act like cattle. I guess a few more of them spoke out while I was getting scolded.

But it is telling, principled people don't end up on juries.

It's conceivable that she might have shown enough bias to be struck for cause if she'd been examined closely during voir dire, but that's frankly unlikely.

I was under the impression that jurors were required to NOT discuss any aspect of the case in progress with anyone until the verdict was handed down, and required to NOT formulate an opinion as to guilt or innocent until testimony was concluded and both sides rested their cases. From that clause, it seems the juror in question deliberately violated those instructions, and deliberately threw the outcome.

Might some lawyer in the audience spell out for us amateurs what this makes her guilty of? Hmmm?

It depends. Fitz wasn't really the dominating presence in this case that he's been in many others, such as Libby's. He's got a lot of prosecutors below him. Should they have excluded her? Depends on who else was in the pool. Depends on how many other blacks were excluded. It's really hard to say for sure, but this looks like such an extreme example that I have to say they really screwed up and deserve a ton of criticism.

I believe in the bedrock of conservative beliefs: personal liberty and freedom (of religion, press, of freedom of tyranny from the government, and the importance of the Constitution). I believe in rational discussion and debate about the important issues our country faces.

WRONG, this was a mistrial. This woman fucked up our legal process. That's a simple fact. The rest of the jury thinks she was refusing to uphold her oath. This isn't about whether or not the evidence proved the charge to her.

Next, the constant (you've been doing it a LOT) pointing out of your own great posts, talking about how you worked hours and hours "honing" blog posts, immodestly talking about how funny and wonderful your posts are, well it makes you, again, look desperate and lame.

Penultimately, since you're attacking us on the blog level, as someone pointed out, we're all pretty tired of blogging. We did about 14 posts in the last month, among 7 people, and we still get about 1000 uniques a day, and we have zero bandwidth costs. How does that stack up to your 5-10 posts a day, bandwidth costs out the ass, a very busy comment section with lots of refreshes. We don't whore our comments section to get traffic and hits. That accounts for a lot of your hits.

Lastly, talking about "team experts"- I _do_ happen to write for a living. Not blogging, you can count the people who independently blog and actually make a living on one hand. I seriously doubt you do. Our blog is for fun and not meant to be a business: note the lack of ads. We don't give a shit if we get 1000000000 or 1 hit. We write for fun, and when it's not fun, we don't write.

You, on the other hand, obviously hope to make some money from your blog, so it's apples and oranges. I work a real job, a real WRITING job, and I make money, I don't scrape by with some fringe hobby like a vanity blog.

And btw, you can rant all you want about "star blogger" and our "team talent"- You try hard, you are earnest, but sorry, you're writing just isn't that great. It doesn't read well, it's not well organized, you just don't seem to have a knack for it, for all your honing. This isn't reciprocity for your cracks on me and our blog. It's just a fact. If you didn't have a comment community, crickets would be chirping here. You couldn't make it on your writing.

I, happily, have always been able to crank out writing easily, fluently and decently. I don't have to "hone" all weekend. If you do, unless it involved reams of data or acres of research papers, you're just not cut out for it.

Now you can rant and ban and delete and do what you do, but it's evident to anyone with half an eye you have some kind of problem going on internally, or you wouldn't have gone off with 20-30 comments attacking ms. for saying "must credit" and tweaking you for your silly "honing" comments. That wasn't the first one, you do it a lot lately.

You are a pretty good delegater and recognizer of decent writers (Dave in Texas is particularly good), why don't you just hire people who CAN write, then you can post a short one now and then and not have to work your ass off to try to crank out something that is obviously beyond you.

I've professionally written movie, music, computer and other reviews. I've been paid for my fiction. I presently write advertising copy and incidental copy for a security company. It pays very nicely, and I don't have to blog for a living. I pity anyone who does, because blogging is on the way out. It was nice while it lasted, but the fact that anyone CAN blog pretty soon meant that anyone DID blog, and it's killing the medium.
