Ho Boy: FDA May Rescind Approval Of Anti-Breast-Cancer Drug As Political Favor To Obama

That's my take. See if you don't agree.

The FDA is not supposed to consider costs of treatment. Their mandate is to determine if a drug is "safe and effective," period. If it's safe and effective, it gets approved. Period. That's their job. Officials there recently re-iterated that cost considerations are not part of their mandate.

Medicare and Medicaid, on the other hand, approve treatments according to whether they are "reasonable and necessary." Note that cost is implicated in that mandate. They can take notice of costs.

But this means, then, that some drugs approved by the FDA as "safe and effective" might also be ruled as non-reimbursable by Medicare/Medicaid as not "reasonable and necessary." This is an implicit thing, and no one's fault, really: Some drugs may be available, and "safe and effective" according to the FDA, and yet no reimbursable as "reasonable and necessary" by Medicare and Medicaid.

This presents a political problem for Obama in the case of anti-breast-cancer drug Avastin. Apparently it's quite expensive. His new head of Medicaid and Medicare, Berwick, who makes a point of talking up controlling costs by denying some treatments, is going to deny reimbursement for an anti-prostate-cancer drug, Provenge. Or, well, they're still mulling it over, which means they're considering not covering it.

And now there is the anti-breast-cancer drug Avastin. Like Provenge, it has already been approved by the FDA. But that creates a political problem -- how can Obama control costs and reassure the public that he's not, as maintained by his critics, denying useful and effective drugs to seniors in order to free up money for ObamaCare?

Oh -- here's a great idea! We'll just get the FDA to rescind its previous approval of the drug so that Medicare and Medicaid don't even have to consider reimbursing for it, thus sparing Obama a political headache, and merely at the cost of taking off the market, from anyone suffering from breast cancer, a drug already deemed "safe and effective" by the FDA.

Federal regulators are considering taking the highly unusual step of rescinding approval of a drug that patients with advanced breast cancer turn to as a last-ditch hope.

The debate over Avastin, prescribed to about 17,500 women with breast cancer a year, has become entangled in the politically explosive struggle over medical spending and effectiveness that flared during the battle over health-care reform: How should the government balance protecting patients and controlling costs without restricting access to cutting-edge, and often costly, treatments? …

The FDA is not supposed to consider costs in its decisions, but if the agency rescinds approval, insurers are likely to stop paying for treatment.

“It’s hard to talk about Avastin without talking about costs,” said Eric P. Winer, director of the Breast Oncology Center at the Dana-Farber Cancer Institute in Boston. “For better or worse, Avastin has become in many ways the poster child of high-priced anti-cancer drugs.”

This is criminal. To avoid a difficult political debate -- and the honest confession that "bending the curve" of Medicare costs to free up money for ObamaCare is going to require a lesser standard of treatment -- the FDA is killing a safe and effective drug and thereby outlawing for anyone, including those who can be helped by this drug and no other, and who are paying for the drug with their own private insurance or own out-of-pocket money.

In other words: He is doing exactly what he vowed he would not. He is "equalizing" health access not by bringing up care for those who have little, but by reducing care by full might of federal legal power for those who have "too much."

We'll all meet in the middle, I guess. Or somewhere a few rungs down from the middle.

There will be casualties.

“I’m very upset,” said Leslie Twohig, 48, of Lothian, Md., who has been taking Avastin for eight months and credits the drug with helping her survive. “How long will I be able to stay on Avastin? Are they going to take it away? I know it’s working for me. Right now I am able to enjoy my life. Every morning I wake up and wonder how long it’s going to go on.”

But these are Little People, Little People. Sometimes they will have to be sacrificed for the greater good.

But you know who will have access to Avastin and Provenge and similarly expensive and therefore outlawed drugs?

You know who.

The rules are different for the ruling class. Some lives are simply too precious to sacrifice for a broader principle.

There are people who count, and then there are people who count only as regards their presence in great numbers -- i.e., statistics.

You are a statistic. Know your place.

Watching the media spin why a safe, effective (though extremely expensive) drug for breast cancer - as well as for other hormonally mediated diseases, especially advanced ovarian cancer - should be de-licensed by the FDA, would be highly amusing, if it weren't so tragic.

64 There might be legitimate reasons for this, but I will say that in the last few months I have become extremely concerned that we are at the tipping point in regards to government officials being too deferential to wishes of elected officials.

The civil service must at the end of the day not consider itself an independent fiefdom--it is not, and elected officials have the right and obligation to dictate overall courses. But at the end of the day, the civil service must have the assurance that if it acts within the law, it need fear no elected official.

In other words, the civil service and military must act in the assurance that they will be backed up if squeeze is put on them, and they themselves must take a stand that forces that official to expend political capital if he wishes to act on the threat of that squeeze. We all must then back up that civil or military officer. I do not yet know the best way to prevent future retaliation of the "back of the hand" kind after the dust settles.

As an aside, this could also be a case where a fellow traveler in the FDA has decided the ends justifies the means, and illustrates the dangers of political faction. The interests of that faction begin to outweigh all else--for man has an infinite capacity to rationalize that the harm that accrues is more than compensated that by the good that will come.

Medicine is amazing these days. It's also fucking expensive. You don't have to spend tons of money on medicine, if you don't want to. But everything else is fucking cheap. You can get a car that would have stunned geniuses 50 years ago for $5000. You can live in a comfy A/C home and get fat from delicious food, living better than most kings in human history, playing Playstations or whatever.

But medicine costs more.

Decide if your life is worth a lot of money. Or maybe let Obama refuse to let you decide, so that his polls bottom at 40% instead of 39%. This week. That's what he's doing, playing with short term polls, at the expense of thousands of lives.

I'm sure they will be happy with all that cash they saved, when they are fucking dead.

I was in CA and on the fucking phone i knew he had congestive heart failure, but he cardiologist kept telling him it was the flue. Then his heart gave out at midnight mass and it was a miracle he survived long enough for Medicare to kill him

Exactly. Then there's the fact that men are actually at a slightly greater risk of contracting prostate cancer than women are of contracting breast cancer (1 in 6 for men vs. 1 in 8 for women iirc). Oh and did you know breast cancer isn't the leading cancer death among women? Last I knew, that was still lung cancer.

originally approved for metastatic breast cancer, the FDA advisory
committee recommended that the FDA not approve it, but the FDA overrode
them (somewhat rare). In studies that have been done over the last
several years Avastin has shown to extend progression free time (IIRC by
a few months), but not overall survival time (IIRC about 18 months for
those in study). So it would have some quality of life benefit. But
I think a full year of treatment costs $75k-$100k.



Avastin (inhibits angiogenisis) does appear to help in certain types of
colon and lung cancers and this decision does not effect that. Nor
does it affect the ability to still use the drug in breast cancer trials
(both late and early stage breast cancer). If trials indicate a
benefits in overall survival, or progression free period (longer) or
benefit for early stage the FDA could reconsider.



It is a tough call for these super expensive drugs for late stage
diseases. I think if the overall survival benefit needs to be compared
to cost. Now if I was the one needing it, would I change my tune? Who
knows, but in this case I doubt it. A family member (who I like) was
in an Avastin trial and from what I know about it, I would not have an
issue if it was only available via trials for now.

170 As someone who just got done with 16 rounds of chemo, three surgeries with more to come this is BS. There are certain types of breast cancer that only respond to chemo and this is in the arsenal. You can do a chemo drug once that's it. I have many friends who this has worked for . For some panel to say oh what's a few months and to put a price tag (they were looking at costs no matter what drivel they may spew) on someone's life is criminal for what they deem "clinical benefit" which they can't seem to define to anyone. Let's not forget that tricare goes by medicare standards so I am sure they will be taking this away from me too..grrrr

All those side effects brought up by the FDA are the same side effects of other chemo regimes they didn't mention that . This drug is used in combo with others so it's a bit hard to seperate out which one causes which SE as it's different in each person. This drug is also labeled for use in lung and colon cancer and is also used off label for ovarian cancers.

When the biased reviewer from the FDA presented the case to the board he did so in a scewed way (from a doc that was present he stated some on the board didn't seem to grasp the finding on the charts..doh) and the board had not used the drug themselves in practice so had not seen the benefits and we unable to figure out that the SE listed didn't effect overall quality of life and could be attributed to many other drugs and if they had seen in person the real life effects of this drug in a clinical setting they would have made a more informed decision. What is the risk/benefit ratio to someone who has exhausted all other options and this may keep them alive to spend time with the three young kids at home? We can spend money on a bridge for frogs but not to keep our mothers, wives, sisters alive??

The solution is actually simple. Pass a constitutional amendment barring the federal government from dealing with anything but a, b, c. No commerce clause, either. But the power to control all states will be greatly reduced.

Also, I say let the states collect taxes, however they wish to, an send the feds a portion of their tax revenue. Say, 50% until the national debt is brought under control. The fed will have to set the budget according to last years revenue, not next years, with paying the debt and national security being their two major priorities.

This requires 2/3s of the House and 2/3s of the Senate. Things will get bad enough that this is plausible.

Someone needs to take it into account and it won't be the doctors or the patients (if they have insurance). So it's either the FDA or the insurance companies.

This is a drug that does not show to extend overall survival of a breast cancer patients (it adds a few months of progression free time). So what is a few months of progression free time "worth"? $1 million, $100k, $2k?

If the doctors believe it will significantly extend overall survivals time they can prescribe it off label and the patient can pay for it out of their own pocket. Or is it only worth it if someone else is paying for it?

I'd prefer the FDA approve based on safety and publish stats on benefits and risks. But someone still needs to make the call on cost/benefit. I say whoever is paying for it is in the best position.

That would be the patient. How the patient comes up with the money is the patient's choice (cash, insurance, selling a kidney or small child, etc). It is not the FDA's responsibility to determine if the cost/benefit ratio is appropriate.

Also, when the hell was a drug only really great if it provides a cure or some kind of long term relief? (This isn't directed at you, doc, but at the other arguments being made that Avastin doesn't really have great long term effects) I'm on long term medication for a chronic condition that is fatal if I don't take my little pill every day. There is no cure but there is a treatment. Oh and my little pill? Is damn cheap now because advances in medical science have made the production of the medication far easier. In the 1920's, I would have died by the time I was 18. Now, my treatment process is part of my morning routine like brushing my teeth.

When she was first diagnosed with the tumor, the specialists here did the standard biopsy and determined that it was a two on the scale of one to four. Yes, it is extremely expensive. My father paid for the 25,000/bag treatments out of pocket for 6 months. Thankfully capitalism had been good to him and he was able to cover this treatment that had some amazingly positive results.

To think that this administration would for the purposes of political expediency remove from the market a drug that literally saved my mother's life, makes me angry in a way that I can't begin to express in words.

So research your policies very carefully up front.

As far as cure or long term relief, studies show Avastin adds NO extension in overall survival (let alone cure on long term survival) and only 2-3 months of progression free time. So for those who are ok with having the government or insurance pay $100k for 2-3 months of progression free time and no extension of overall survival need to keep their pieholes shut when it comes time to complain about socialized medicine or pony up a 30% increase in their insurance premiums every year.

The good news is I am done commenting on this topic. But remember the Dems will not always be in control and at some point someone is going to have to make tough decisions.

However, a "puzzling observation" in all 3 studies
is the total absence of a survival benefit - "the survival curves of the
control and bevacizumab arms were entirely superimposable," Dr.
Hortobagyi said. It is difficult to demonstrate a significant survival
benefit in first-line therapy of metastatic breast cancer, because such
benefit is often diluted by multiple subsequent treatments and crossover
designs, he explained, but "we often see some separation of the curves,
even if the difference doesn't reach statistical significance."

"In
the trials in question, and as you would expect simply by chance, some
parts of the bevacizumab curves were slightly above and others slightly
below the control-arm curves. While none of these differences (whether
positive or negative) were statistically significant, the FDA reviewer
elected to present them in an incredibly biased manner, where positive
(but nonsignificant) survival differences were labeled 'no difference,'
and negative (also nonsignificant) differences were labeled as favoring
the placebo arm," Dr. Hortobagyi explained.

"This either denotes
ignorance of common statistical methods or an underlying agenda to place
the agent in an unfavorable perspective. There were other surprising
statements made by the FDA reviewer attributing certain toxicities to
bevacizumab, when in fact those toxicities are well recognized as being
associated with the underlying chemotherapy. For instance, bowel
perforations are a well-recognized complication of taxanes, especially
docetaxel; angina and myocardial infarction are reported complications
of capecitabine; and congestive heart failure is a well-known
complication of anthracyclines (doxorubicin and epirubicin)," he
continued.

"The FDA reviewer continuously referred to these
complications as bevacizumab-related, creating an artificially high
bevacizumab-related mortality rate in the minds of ODAC members," Dr.
Hortobagyi said.


There are numerous studies ongoing for early stage / and mets treatment. The way it was fast tracked and FDA being unclear on what it expected to see from the studies and Genotech makes one wonder how other drugs in the pipeline will be treated.

Now, if you happened to live virtually anywhere in the world except the US, this new drug - and all other new drugs for that matter - would cost a mere fraction of what the buying public pays here. Here, however, we allow the various drug manufacturers to recoup "development costs" - even though We The People fund a huge proportion of those costs from the get go through various grants.

It is not the FDA's place to consider costs, but it IS the FDA's place to fully consider safety and efficacy - something that has been thrown to the four winds for the last 15+ years. What really needs to be done are two things -

1. Repeal the regulations that allows FDA fast-tracking of most drugs.

2. Change our laws that allow drug companies to force the American public to foot the entire bill for drug development. (Twice.)

292 My father died of colon cancer, but after a number of different treatments (that failed) he qualified for the first human studies of a new drug. Cost? $16,000 / WEEK. We're not rich, far from it, but I had already figured out how to get my hands on the money (legally, no less, and no nudity involved). It was made by two guys in a lab and it only "lasted" 90 minutes out of the fridge. That's why it was so expensive. The 9 months of treatment cost $624,000 just for the medicine. He was also a guinea pig and a pincushion the whole time. And although it didn't cure my father, and he was removed from the study, it gave him two years that he we know he wouldn't have had. People figure out how to get the money. You know what he said about the fact that its effects were unknown? That maybe they'd learn enough from him about the drug that other lives might be saved down the road.
But if O makes the drugs themselves illegal, then it's time to get my pitchfork, feathers and tar.

Thanks, k, for the information. Someone who is close to me is on avastin for breast cancer, and her life expectancy depends on having drugs available, both now and in the pipeline. This whole thing has me freaked out beyond belief. I'm so afraid for her, and everyone I know. Let me tell you about the hospital that "severely upcharged" my family for the treatment;
They are without question the premiere facility in this country, and the WORLD for dealing with tumors and cancers of the brain. The husband and wife that developed the avastin/cpt11 protocol practice there, and were directly involved with my mother's treatment. This isn't some flybynight clinic or chain store like Cancer Centers. These are the people that invented this shit. I thank God every single day that she had access to these people in the timely manner that she did. The protocol wasn't FDA approved at the point she was given access to it for her brain tumor, it was still in the evaluative and experimental stages and was scheduled for clinical trials at that time. I'm not sure where it is you're getting your info on the costs of Avastin. I've seen the billing, and talked at length with these doctors and the pharmacists who made the bags up for her treatments. This stuff is expensive. Your assertion that Avastin is dirt cheap is nonsense in the extreme, and I seriously think you should stop talking about what you have obviously had zero personal experience with.
