BP: Tax Write Off Nets Them $10 Billion Of The $20 Billion Compensation Fund

ArthurK, who does a bang up job in the headlines, has this in the sidebar but it's too fun to ignore.

Seems the most competent administration ever, let BP set up the compensation fund in a way that they can write about half of it off.

But the issue may raise red flags among federal officials, particularly in light of recent efforts by various other entities that have settled with the U.S.

One notable example is Goldman Sachs Group Inc., which agreed last month not to seek deductions for $535 million in penalties as part of its settlement with the Securities and Exchange Commission. The SEC had sued Goldman Sachs, alleging that it hid critical information from investors in mortgage securities.

SEC officials had come under fire from Congress for previously allowing tax deductions from penalties in other cases.

Another wrinkle, though, is that it appears no other entity in hot water with the U.S. has incurred costs on the scale that BP has. The company has agreed to put $20 billion in an escrow account to pay claims for oil-spill damages.

A goof?

But half of that may now come out of government coffers, and it could prove to be embarrassing for the Obama administration, presuming the president and Hayward did not discuss the issue at their recent meeting, says David Desser, managing director of Juris Capital, which invests in corporate litigation. It was after that meeting that Hayward announced the $20 billion escrow fund.

“You would have thought in advance of that meeting, they would have thought of all of those issues,” Desser said. “How do you un-ring that bell?”

"It looks to me like maybe the administration goofed here," he added.

By going on The View of course.

How connected do you have to be to get better treatment than Goldman Sachs, which is after all the company that runs the country or something?

I'm sure there's a distinction to be made between settlements where the party admits guilt and the BP case where they are setting aside money ahead of formal charges but the politics of it look awful for Team Obama.

A deduction isn't a rebate. It sounds like to me the $10 billion is deducted of the NIBT, which reduces their tax liability. I don't think they will actually get $10 billion from the government.

That's not to say this is another failure of the Obama admin. because they certainly promised to close all those nasty corporate loopholes.

Not at all.  The Precedent doesn't give a shit about any of this, or anything like this.  He never did.  He's just happy when chaos is being fomented, and this is just another step in that direction.  Having the administration look incompetent, or criminal, aids in taking the US down (which is the ONLY thing The Precedent cares about) since it saps more faith and trust out of our essential institutions.  If someone asks him, he'll just lie and say that they didn't know.  It worked last time this sort of thing happened (remember the Porkulus and how a little tidbit about ensuring bonuses for those getting TARP money was included in it - by Dodd, who claimed he didn't know how he had done that?).  The only reaction The Precedent had was to send a bunch of union goons to scare the crap out of some executives' families at their homes.

Actually seems like the right way to do it according to established tax principles. By the way, the cost is ultimately paid for by the final purchasers of the oil, consumers.

An interesting situation, because BP writes off the $20 billion slush fund and more, and thus reduces its tax liability by $10 billion.

But was the expected tax revenue the government's money or was it BP's money that the government merely expected to receive?

I wonder if structuring the $20 billion as a fine would have made it non-deductible?  I don't know what classes of business expenditure are non-deductible under the tax code.

39 The other $12B are the clean up costs.  So far.  The costs will get higher saving even more money on taxes.  But so far they are out of pocket a net $22B.

Why shouldn't BP be able to deduct their operating expenses like any other company?  The Goldman Sachs comparison is a straw man, GS paid government fines.  Government fines are not deductible under any circumstances.  The fines BP eventually pays will not be deductible either.  The cleanup costs and extorted amounts are deductible as normal operating expenses.  The only leg the IRS MIGHT have to stand on is the timing of the deduction.

Lots of other twists to this, but the article was VERY poorly written, attributing all tax savings to the slush fund and none to cleanup costs..  Then again, BP could have refused to pay for cleanup costs and slush funds until forced to and banked the net $22B for the next ten years.

No, but losses can be carried forward up to something like 7 years. This year is a guaranteed loss for BP, no taxes. Next year they will be able to deduct up to $10 bill on their taxes.

So it's not so much that the government has to pay them, but BP will get to keep $10 bill somewhere down the line.

The only potentially bad thing I see is the Oministration coming back to the table and demanding BP use next year's profit to set up BS enviro-crap programs.

46 First part of the post was about they have had $32B of operating expenses, including cleanup costs of $12B and the extorted $20B.  At the top federal rate of 35% they save roughly $10B in taxes.  They are so far out of pocket $22B.  Attributing the tax savings of the cleanup costs to the slush fund only is distortion.  On the $20B they would save roughly $7B in taxes, or a net $13B cost.  Anything higher is pure spin.

when the government puts a gun to your head, they can tell you that the payoff is deductible or not. Everyone that negotiated this had to consider deductibility.

no, they knew they had a choice and the choice they took a/ made the number look bigger than what it actually cost BP, b/ gave the government control of more money (indirectly it is a diversion of $10B or so from tax revenue to some bureaucrat, and c/ gave barry more money to inject into a region to buy votes - using it just like Clinton used FEMA.

the other choice would have been to make it a $10B (or whatever depending on the tax rate) but not deductible.

It's a shame, but they won't realize this is a ploy to grab more wealth to spend, regardless of it coming from taxpayers or BP, and have a huge number as 'penalty'. 


We are too stupid, hence how we got in this place.  Even if we elect a reform government, it is only going to prolong the inevitable.  People demand more entitlements from 'rich people'.  They have let the mask slip, but in the long wrong, they know they have won major fights like Obamacare, at the expense of taking a break from power.  They will get it back.

I doubt he even thought about it. From what I've heard it was a 20 minute closed door conversation. One for which Barry  was probably totally unprepared, with a tee time in a half hour. BP, meanwhile, had done a ton of research, had arrived at a 'most likely' final cost of cleanup, and offered a deal which made Barry look like the hero.

Sure he can.  I'm just convinced that he's not.  He seems to like ruling by fiat from a single, central authority - based on empathy, so that no actual law would ever really matter too much.  That is about the extent of his thoughts on governmental structure that I have been able to discern.

There's no question (in my mind) that he's on a third world revenge fantasy.  It was his having grown up in Indonesia (especially just after Sukarno was thrown out and the country was in particular chaos) that did it, I think.

He seems to know that he has power to win over people using the old tactics of being none threatening and telling them what they want to hear, but I think he knows that that is his only skill. He strikes me as extremely insecure and willing to go along with whatever someone smart says and he has surrounded himself with socialists his whole life.

2/ He's like a little boy who discovered his special toy and thinks he is the only one that has one. For him the toy is lying. He thinks he can lie, and no one notices. 78 When a company says in a press release that they are "taking a charge" or a "write-down" that means they are applying the full cost that quarter. What that effects is two things, the obvious first impact is calculated profit.

From that calculated profit then comes the impact on dividends (you know that thingy the UK pensioners were depending on).

If the calculated profit goes to zero or negative, guess what, no dividends. (usually)

Again, I have to part with you on this.  There is no desire on the Indonesian Imbecile's part, that I can see, to reshape America.  He just wants to screw the nation up so that it collapses.  I come to this view because of the way he has handled legislation, thus far.  The Precedent has not cared one iota what any of these grand programs have actually been, in the details.  He let Congress run hog wild on everything.  The reson he did this, by my reckoning, is because he never cared about any of these programs, nor if they would actually pass Congress, but only that he would do permanent damage to Congress, as an institution, in trying to ram this crap through.  He cared more about destroying the process than the process, itself.  If the legislation passed, then The Precedent is happy.  If it doesn't, then he's happy in causing so much chaos and sapping the faith and trust in our isntitutions.  He has done this with just about everything, from taht idiotic Copenhagen Olympic fiasco to his health scare to financial deform.

A true socialist would have been writing and guiding each of those massive pieces of legislation, with a tight rein on Congress.  Someone who seeks only destruction is the one who likes to try and ram through legislation that no one has even read, himself included.  He just doesn't care what anything says.  It's not what he's about.

So they paid out $22 billion instead of $750 million.  The government would have paid the cleanup costs over $750 million but instead refunds $10 billion in taxes.  The government has come out ahead of the game just based on the $12 billion cleanup costs so far. 

And yet, the newspapers report BP is making out while the government loses.  This is all fun house mirrors to me.

another view (my view) is that he does not get involved because he knows less about economics, health care, stimulus, etc, than a whore knows about Sunday. He avoids getting involved because he is in over his head, has no principles, is afraid of being found out, and figures the smart socialist he works with can do the job without revealing him to be a giant cockroach.

That doesn't mean he is not driven to some degree by the idea that socialism is better than what we have now.

I really think this is his main driver domestically, but I see some merit to your revenge theory in his international dealings.

Both of our views have merit - speaking domestically.  I can easily understand the view that he is driven, domestically, by a desire to move America to socialism.  There is much proof for that hypothesis.  The third world revenge theory, for his domestic policy, just seems to make more sense to me.  I became convinced of this back during the campaign and have not seen anything since that has served to even make me waver in it - though it occurs to me that he might decide that he likes the power he now has and could be moved in his basic goals from suicide bomber destruction to socialism/totalitarianism.  I don't think so, but that is always a possibility.

However, I'd be more hopeful if they'd retract the party-line of blaming their partners in the joint venture. I'm rather surprised people are more concerned about the tax write-off than BP's constant bashing of companies like Anadarko, which they repeated yesterday. While it's somewhat understandable (from a liability standpoint), the buck stops with them.

There was a headline on Drudge earlier this week, stating that North Dakota & Alaska lead the country in job creation.

Most agriculture in North Dakota does not require a lot of labor and can be managed by a family size operation. Grain crops and sunflowers don't need daily attention. One possible exception is potatoes, but irrigation is mostly automated.

It just really pisses me off.   As a former Eagle Scout, I appreciate the benefits of Scouting.  (Although they've screwed up the program in an attempt to be "contemporary".
