| Arizona Sheriff Says He Doesn't Know Why Loughner Shot Giffords And Others But He's Pretty Sure It's Because Of Republicans UPDATED With VideoThis clown, Pima County Sheriff Clarence Dupnik, just gave an interview to Megyn Kelly on Fox News where he admitted he had no evidence about the Arizona shooting but then went on to speculate it involved Republican opposition to Democrat legislation, unidentified donors to political issue groups and free speech. Keep in mind, Dupnik isn't just some guy or some local official...he's the lead investigator in this case. Why in the world is publicly speculating about this? It's political hackery and sheer incompetence of the highest order. He also talked about how much he misses the America that existed when he was younger. He's in his mid 70s. So he misses things like Puerto Rican nationalists shooting 5 members of the House on the House floor, John and Robert Kennedy, Martin Luther King and on and on. I don't have a link yet but it was quite a performance. He made similar remarks yesterday. Arizona Senator Jon Kyl smacked him around earlier today for yesterday's partisan attack. Frank J. from IMAO caught the interview as well and this quote from Dupnik.Just to reiterate, Sheriff Dupnik puts some of the blame of the shooting on "one party blocking another party from bettering this country."Here's the interview, if you can stomach it. Last night Olbermann's show took it to a new level. Keith interviewed the Pima County Arizona Sheriff, Clarence Dupnik. Sheriff Dupnik says he won't enforce the law because it's "racist". While explaining this, Dupnik made some strange statements.First of all, law enforcement people—state and local law enforcement people—now have the authority to stop and detain people who they believe are illegal immigrants and turn them over to the border patrol. We have been doing that for—I‘ve been a police officer here for 52Um, if it's something you've been doing all along, why exactly is it suddenly "racist"? Second and more troubling, is it really believable that this officer with over 50 years of law enforcement experience doesn't know what the standard for "reasonable suspicion" is? Even to my non-lawyer ears that sounded, um, wrong. "Reasonable suspicion" goes back to a case called Terry v. Ohio and led to something widely known as a "Terry Stop". 29 states have so-called Stop and Identify laws. One of them is, wait for it, Arizona. A. It is unlawful for a person, after being advised that the person's refusal to answer is unlawful, to fail or refuse to state the person's true full name on request of a peace officer who has lawfully detained the person based on reasonable suspicion that the person has committed, is committing or is about to commit a crime. A person detained under this section shall state the person's true full name, but shall not be compelled to answer any other inquiry of a peace officer. B. A person who violates this section is guilty of a class 2 misdemeanor.The emphasis is mine. My point isn't that these laws are exactly the same. There are whole lines of cases about when detention begins, what people's rights are at various stages of detention and arrest and on and on. Seems the sheriff may need to do some home work. If Sheriff Dupnik is still unclear on these points, perhaps he should consult Andy McCarthy's (a former federal prosecutor) post at The Corner. Brief detentions are known in the law as "Terry stops" — thanks to the famous Supreme Court case of Terry v. Ohio, 392 U.S. 1 (196Read the whole post, it's rather instructive. Unless you prefer name calling and ill-informed commentary, in that case, stick with Olbermann and the like. Are there reasonable points to be made against this law? Of course. The preemption objection clearly can be argued in good faith. Might it be abused by cowboy cops? Yes, it might. Just like every other law might be and probably has. There will be time for these "as applied" challenges later. If the idea is that laws can't be passed because they might be abused were to take hold, well, we might as well but every legislature out of business (which is a whole other discussion). Can on argue this is simply not good policy? Of course but that's a legislative issue, not a judicial one. Comments1

One of the guys that held the shooter down said he had a gun with him but didn't take it out because the guy was under control and he didn't want to frighten anybody. Dupnik is a Dem political hack. During the afternoon news conference with FBI Director Muller they kept Dip wade in the background. After Muller left Dupnik took questions, and it wasn't long that this a hole started accusing talk radio and gun legislation. I guess I'd ask the question, why did this happen on his watch? I can't tell if the comment provided with the link dismisses the idea completely or if the comment in the sidebar means that it is so obvious that drugs should be regulated that it doesn't need to be mentioned.
From Jared's videos it's obvious he is a complete loon and a person wonders how he functioned day to day. But, Jared also went to college so whatever went wrong in his head happened relatively recently. Looking at the Arizona Revised Statutes now, county and precinct officers are subject to removal "for wilful or corrupt misconduct in office" by the county grand jury, which in effect means by the county attorney, the elected prosecutor that other states call the district attorney or state attorney. The only thing I already know about Pima County Attorney Barbara LaWall is that she was elected by the same collection of geniuses who elected Dupnik, so good luck with that. Loughner killed six people, one of them a nine year old girl, and yet
he didn't even make sure the primary target was dead. Several others were wounded. It sounds to me that Loughner was looking for a reason to kill lots of people and Giffords was unlucky to be his representative. That's another point-- since the election in Nov., they have been trying to drive a wedge between the various factions who are currently supporting the Republicans. How many times have we seen false stories that are intended to anger us into moving away from them? Saw some of the same today, where the remarks of some on the talk shows wasn't even reported. They put-out what they could spin, but not much else. If we break into splintered factions, it just shows we believed the meme. I think it might be a good idea to send some assertive yet not aggressive messages to Congress, to praise them for their efforts so far and to remind them of what lies ahead, that we will hold their feet to the fire. People of all stripes didn't elect this Congress just so it could collapse due to a loony like Loughner.

And each side has links to back up their claims. Are they both correct? Why or why not? And how would anyone know who is right without tracking every single public comment and tracking a timeline to see who spoke first? Or is it whose comment is published first? I sent a message to the office of the Governor of AZ this morning, recommending that this Pima Cty Sheriff be pulled from the case in light of his obvious political agenda, and further emails will go to my Representative in Congress. (Granted, the means for pulling an elected Sheriff off a case must be extremely limited--that's why they're elected instead of appointed--but overwhelming popular sentiment might be used to force him to recuse himself from the case.)

Even more so, if I worked for one of the networks, I couldn't bring myself to call the father or mother and ask them for an interview while their child isn't even in the ground. I'm guessing the parents are dealing with the funeral arrangements which are hard renough to deal with even when someone dies somewhat expectedly, like an elderly parent. I knew the Leftist narrative had been with us for decades, but that moment was so crass and exploitative - and so patently so - that to get political news from the MFM any further would be stupid. That was the moment for me when I knew the media had jumped the shark the highest. It was surreal. I quit watching the MFM over a decade ago now. The bias and tabloid-ish nature made it intolerable. However, one still needs the news but the press is even more liberal than the monopoly of thought that is/was on-air media. So, one is pretty much resigned to cable news and the internet (and radio) if one prefers a less liberal or even-keeled analysis and commentary of news. The problem is that cable news operates under the assumption that most viewers have the attention span of a flea (which, sadly, might be true). Fortunately, those other avenues have opened despite their drawbacks. The MFM will carry on like it always has. Serious people will continue to abandon it. Not all people are serious people. Not all people will continue to abandon it. So that's where we are: some proportion of the public will remain ignorant and there's not a thing anyone can do about it other than to abandon those venues and educate those in one's own circle of contacts.
