John Kerry's Daughter -- Busted

Police suspected she was DUI due to her high-beams being on in inappropriate situations. (NSFW explanation of high beams, here.)

Senator John Kerry's daughter, Alexandra Forbes Kerry, was arrested early this morning on suspicion of DUI ... law enforcement sources tell TMZ.
It went down in Hollywood at 12:40 AM. Alexandra, a 36-year-old film producer and director, was pulled over for a traffic stop, then arrested and booked at LAPD's Hollywood station. She was released at 5:25 AM.
Cops tell us Alexandra violated a traffic law which got their attention. They then conducted a field sobriety test and it appeared she was under the influence of an intoxicant. She was then placed under arrest. At that point, cops asked her to take a preliminary alcohol screening test in the field, but she refused.
Cops took her to the station and then conducted a formal blood alcohol test which showed a level of .06. Under California law, the legal limit is .08, but a driver can still be prosecuted -- even under a .08 reading -- if the vehicle is being operated unsafely due to alcohol.

Because she's a Democrat, she can expect her legal troubles to come without paparrazzi coverage and months-long smearing of her. She gets to live a human life, in other words.

45 Wasn't there a study recently that compared alcohol impaired drivers (.08 is not drunk, just go ask a hobo) to elderly drivers. I think the net is you were much safer on the road around someone who had one too many then you were around older or inexperienced drivers.

Luckily I only drive a shopping cart so my frequent impaired status isn't likely to hurt a car/driver but other hobos better keep a sharp eye.

Well what if she is showing signs of obvious impairment? The law is about impairment, not your blood level. the blood level is evidence of impairment, but there can be other evidence. Like swerving and blowing through red lights.

According to the only test I actually witnessed the data-gathering for, at the BAC for which you get automatically arrested, you're as much of a "drunk driver" as someone talking on a hands-free phone is. Drinking doesn't make you an above-average road hazard (like someone whose favorite song is on the radio, or someone who has to pee really bad) until you hit about .15, i.e., almost actually drunk.

The other thing is that California barely differentiates between drunk driving and "buzzed" driving. So in her case with .06 BAC, she will have all the same penalties as the guy who blows .24, the only difference being that she will have just 3 months of the lame schooling instead of 6.

There are, in fact, idiot ads on billboards paid for by the state that say "BUZZED DRIVING IS DRUNK DRIVING". Of course, this is simply idiotic. I think it is a combination of the ridiculous influence of MADD and the pandering of California politicians, but whatever the reason, California DUI laws are absolutely ridiculous.

I theorized a while ago that Lefties, who don't mind if maniac copkillers go free, like DUI and other laws that cast a broad net and ensnare otherwise law-abiding people - I think they like it that plenty of good people have a "criminal record" in order to dissuade those same people from supporting anti-(real) crime measures with the charge of "hypocrite."

79 I think the case is a non-starter. No way would I convict on less than the limit unless the cop had some good footage showing her in a diminished capacity while taking the sobriety test. It is a criminal charge, reasonable doubt still applies, and the prosecutor has got a big hill to climb trying to get 12 people to agree to punish her because she had a drink (max 2) and "flashed" her "headlights" inappropriately. So I doubt the DA of Liberales Angeles will waste political capital to try to burn a prominent Dem's daughter on an iffy case.

I agree with what Mama AJ said. I know that all this �drunk driving� nonsense is getting a bit out of control, but in this case my bet is the cops acted appropriately. She obviously did something illegal in her driving and failed her field sobriety test. And, as others have said, by the time they got her to the station and had her take the breathalyzer test there�d been time for her level to drop. So, she�s probably guilty. That said, because she is a Democrat, and a Hollywood hack, she will be treated with kid gloves, receive a slap on the wrist, and be free to go and eventually maim or kill someone with her behavior.

But, I agree, I think people talking on cell phones are just as much a hazard on the road as drunk drivers. Unfortunately, in a lot of states the law for cell phone usage is a secondary offense so the police have to catch you doing something else illegal first to bust you on your cell phone usage. I don�t know about where you live, but here in Washington State the law has had about zero effect on changing people�s behavior because of that.

True. My dad works where they process 'em in San Diego. Not only do they have to get her to the station, they have to find someone to draw her blood. That doesn't always happen instantaneously.
