Eh... it's not blackmail. You are permitted to threaten to release documents or pictures directly and legitimately related to a bona-fide suit.

BUT... if I'm the pageant organization, and I have a contract with her, and that contract includes moral turpitude/embarrass the pageant clauses, now there is a direct evidentiary value to the tapes, and threatening to release them is NOT blackmail.

This may sound odd but it's written into the law.

I think the issue is that it looks like there were real grounds for firing her (regardless of the fact that malice was involved in the outing of the grounds), so she should have shut up about it.

Actually another issue I have with it in cases like these with young hot girls is that it is really at it's core a self-centered act.  If an army-wife sends some naked photos of herself to her hubby in Iraq or something like that... well then I guess she's just trying to make his day.  It is all about him and for him.  That guy will be turned on.

But in cases like these, it is all about a young, hot girl who has recently discovered her sexuality and the influence that it can have over men.  And they become intoxicated with this power.  It actually loses a lot of it's sex appeal for the guy because he kinda knows that she isn't doing it purely to make him happy or because she wants him so badly, but rather because she gets a bit of an ego-kick out of it.  (Okay, the guy is still thrilled, but I just mean less so than with my wife example above).

But from what I have seen young girls and mothers these days have different types of relationships than there were in the past. My point isn't to attempt to judge her personally or anything like that.  My point is simple:  she makes a poor spokeswoman for Christian family values.  Which is what she was beginning to become.  And yes, she really was.  She was on TV quite often talking about her views, became a high-profile member of many conservative/Christian family advocacy groups, and was invited to speak at conservative/Christian family conferences.

And most of this was basically due to people reacting to the fact that the left was so damn cruel to her.  It was a pendulum style reaction where conservatives hated the fact that the left was so evil towards her, and so some conservatives decided that they loved her.  Even though they knew nothing about her, and she was really just a ditsy 22 year old.

So as far as whether she has a good relationship with God or whatever her personal faith is... I don't care, that's not the point.  When one takes on the role that she did of advocacy, other things become important.

I think that the age of Ms. Prejean when she made the tapes is significant. And under-reported. You'll note that none of them have been made public. Under the law, a minor cannot give consent, this means she cannot consent to have sex. Making all sex with her non-consensual. This is the basis of statutory rape.

If Ms. Prejean produced one, seven, or a million videos when she was a minor, they cannot be legally distributed. They are kiddie porn. If you distribute them you are a felon. If you are in a lawyer's office and use them to coerce a settlement, this is criminal extortion. I think this displays why we have not seen these videos distributed.

Ms. Prejean is age 22 today and she said these videos were made when she was young. How much younger is significant. Ms. Prejean does not appear to be particularly bright. Or well represented.

I think we all do indiscreet stuff. I know I've kissed my fair share of frogs, (a LOT of frogs, make that), and had embarassing situations. It's one thing to personally review those events and roll your eyes at your own silliness, but if someone else were critiquing them I would be mortified. You think  they are personal and private. Having them paraded about for people to pass judgment on would be terrible. 

I'm sure a lot of us are naive enough to think that the guy you dated for 6 months isn't going to pop up the minute you're famous and sell the story of the first time you had sex with him. I just assume that most people realise we all do stupid and regrettable things, especially when we're young, and trying to publicly humiliate someone by parading stuff like this around is in poor taste, to say the least.

Remember a few years ago when Trump almost ousted Miss USA (Tara Conner?)  because there were pics of her partying wildly and even giving a girl a kiss? I could see why Prejean might feel a little singled out, considering that others have done embarassing things while holding the crown, and not been axed. It just happens that she ran afoul for espousing so called 'traditional' values.

Evening all.  I wouldn't get too hung up about this.  A couple of things to remember.  I gather she did this for her boyfriend (I think we can agree that if he leaked these he's a douche and if there is any justice the best he'll do for a woman for the rest of his life is Ruth Bader-Ginsberg) and she did it when she was 17.  Even though she's a child of the internet information age I'm pretty sure she thought that it was true love (and he probably asked her to do it to prove their love, really teenage guys are pigs and that included me way, way way back then) and this would never come back to haunt her.  It's been noted that these tapes really didn't have anything to do with the original pagent controversy and I think that's what should be kept in mind.

Look, I've never "defended" her.  Neither have I ever recognized her as any sort of spokesmodel for conservatives, Christianity, traditional family values, or anything else.

What she IS is a beauty contestant who dared to voice an opinion which is certainly mainstream in her state (judging by their statewide plebescite) and is shared by the Left's beloved Obama and many other top Democratic politicians.  For this offense, she was targeted for personal destruction.
