Rudy Goes Off Over Decision To Try KSM In Civilian Court In NYC

Why did Rudy have to be such a schmuck over abortion and run such an awful, awful campaign?

He runs through all of the problems with Obama's decision to try KSM in civilian court...they are war criminals, evidentiary challenges, venue problems, an unwillingness to call Hasan a Islamic Terrorist and more.

It's a long clip but worth it.

Rudy also points out that the KSM's volunteer, lefty attorneys will put the US government and by proxy Bush, on trial.

Andy McCarthy is thinking along the same lines and says it's a feature, not a bug of Obama's decision.

This summer, I theorized that Attorney General Eric Holder — and his boss — had a hidden agenda in ordering a re-investigation of the CIA for six-year-old alleged interrogation excesses that had already been scrutinized by non-partisan DOJ prosecutors who had found no basis for prosecution. The continuing investigations of Bush-era counterterrorism policies (i.e., the policies that kept us safe from more domestic terror attacks), coupled with the Holder Justice Department's obsession to disclose classified national-defense information from that period, enable Holder to give the hard Left the "reckoning" that he and Obama promised during the 2008 campaign. It would be too politically explosive for Obama/Holder to do the dirty work of charging Bush administration officials; but as new revelations from investigations and declassifications are churned out, Leftist lawyers use them to urge European and international tribunals to bring "torture" and "war crimes" indictments. Thus, administration cooperation gives Obama's base the reckoning it demands but Obama gets to deny responsibility for any actual prosecutions.

Today's announcement that KSM and other top al-Qaeda terrorists will be transferred to Manhattan federal court for civilian trials neatly fits this hidden agenda. Nothing results in more disclosures of government intelligence than civilian trials. They are a banquet of information, not just at the discovery stage but in the trial process itself, where witnesses — intelligence sources — must expose themselves and their secrets.

So now the scum that set in motion the plot that killed 3,000 people on American soil have the same rights as anyone else. Obama couches this as an expression of strength that will awe people around the world. The truth is it's a power play by a far left President who is looking for political payback. This decision will weaken the United States and endanger the lives of Americans.

Oh I suppose that in some fevered portion of the Holder/Obama 'brain' this might look to the deluded as a 'good thing' to 'get that F888^&* Bush and cabal. But I'm sure that vision disappeared when the 'brain' woke up.

I used to find the 'conspiracy' theory of Obama interesting until I discovered the 'Chancey' theory of Obama. Think of Mr. Gardiner with an elite edumacation. An idiot savant if you will.
This is yet another colossal mistake in a long line of Obama mistakes. But he's not engaged in 'payback' . He's just in EVERY situation in Way Over His Head, BUT his ego won't let him face that dire little fact.
So we get an endless parade of just really really Stupid Actions.
Just grab the popcorn and enjoy the show. It won't go on for all that much longer in the BIG scheme of things. Athough Obama Days DO seem to have the actual length of 6 or 7 'reality' days.

14 Not a lawyer, but if the charges are read and the defendants plead guilty, does the government have to enter evidence?  Andy McCarthy is a lawyer and I believe his concerns are valid, but if the government knows it has a deal with KSM et al to offer them the martyrdom they so fervently desire it's possible that this will work out well.

Of course, it's possible this will work out very poorly.  I prefer situations that limit the downside risk, and this seems like a situation with major downside risk.  KSM or his lawyers may be smart enough to just say, "I didn't say any of that, they tortured me into a confession, prove your case" -- at which point every intelligence method we own and every asset we have or ever hope to have is suddenly fair game, or the government drops its case.  Either way, we'll refer to the period before the trial as "when we had a national intelligence system."

If that happens, if KSM and his friends walk -- oh, man.  There is always someone to blame..."Under the inhumane and illegal practices of the former President..."  I don't believe that one will wash.  I bet you could find Buddhists to push the plungers on these guys, if Obama/Holder screw up and these guys walk, political life as the American hard-left knows it is over.

KSM walks. No doubt about it. I don't see how the evidence against him could possibly be allowed in a criminal court: I doubt if they read KSM his Miranda rights as they were screwing the information out of him.

Yeah, he's more interested in looking good and feeling good about himself to base a decision like this solely on payback, not that it's not one of the reasons.  A while back Uncle Jimbo wrote a nice post about the half-baked, sophomoric nature of O'Bama's political ideas.  He runs things like an arrogant brat would write a "great term paper."  His strongest motivator is the way her perceives his actions will make him appear in others' eyes.  It's kinda like Tom Wolfe's idea of radical chic.  It's more about O'Bama than the country, supporters, or anything else.

Why didn't the press corp ask Holder some of the obvious questions;

1: When was the Sheik Mirandized?
2:  What kind of evidence trail was kept?
3:  Can they make a case without resorting to information gained through questionable interrogation methods?
4:  Who has jusridiction?
5:  What intelligence methods and sources are we willing to give up for the purpose of giving the terrorists a forum to spill their bilge?
6:  What if the guy is found innocent?
7:  What if he walks on a technicality?

I am sure President Gardener did not think of any of these issues.  He simply is not capable of thinking things through in a rational manner.  I don't believe his attention span is long enough.

On the positive side in his mind, this will buy him some street cred with the left, it will embolden the conspiracy lunatics, it will provide a much needed distraction from his reign of terror over the economy, it will reward the lawyer's guild with preeminence of place and it will be a way to get back at Bush and at the allies who stuck with us when we were down.

Now that these terrorists have the identical rights that you and I have, set them free.I mean, I don't want the Government snatching me in the middle of the night for trying to skirt National Healthcare payments, tossing me in prison for 5 years before I get a trial, hence, trampling my constitutional rights.

What scares the Hell out of me the most about this is how our laws "need" to be altered to logically be able to hold a trial after bestowing our rights on them and actually put them in jail or execute them, it's a farce in the purest sense of the word.

Then of course, Obama could go the route of what I call the "Law and Order" routine, heck, many people watch the show and everyone knows that when some mean yahoo cop tramples a citizens rights, then that bad guy goes free and we are all left being pissed off at the yahoo cop.....AKA..... GWB.

Just remember, it wasn't the judge, it wasn't Bush or Cheney, it wasn't the CIA and it wasn't Holder.

It was Obama who set up this freak show, everything that comes next is on him.

Therein lies the problem for Obama - if he's not open to the possibility that Khalid may walk, then why exactly is he trying him? If he's granting him a trail on US soil, is he not innocent until proven guilty? And what happens if he's not found guilty BARD? Then what? This is a boneheaded decision all around and only makes sense if one assumes that Holder et al are a bunch of morons, or they really believe trying him in NY will somehow vicariously indict Bush and his approach to the GWOT. What it really says is that Obama and his crew are weak as hell and will fold easily. I'll say this, if he goes forward with this and we get hit at all in terms of terrorism, then his presidency is over. I guess he's willing to roll the dice on that one.

Experienced prosecutor here:

It will be interesting to see what SDNY charges KSM with. Remember, KSM is already under indictment in SDNY for the "Bojinka Plot" in '99.  SDNY will probably go big-- the entire 9-11 plot-- but it will be a tough prosecution. None of KSM's statements to US authorities come in as evidence because he was never read miranda warnings. Full stop there, folks. Nothing he's said will be used against him, torture or not. Miranda won't allow it. So, SDNY has to have a few cooperating witnesses, ideally one of the other slobs at Gtmo. These guys haven't exactly been falling over themselves to turn state's evidence though, have they? Hearsay statements from jihadis who won't or can't appear in court can't be used (thanks for US v Crawford, Nino!). My guess is SDNY is bettng KSM will formally plead guilty, or even better plead not guilty but brag about his role in planning/executing 9-11 in open court. I can't see how SDNY proves its case otherwise, with Miranda and Crawford standing in the way. If KSM just shuts his mouth, sits there and lets his defense counsel put Bush, Cheney, Yoo, Addington, etc on trial it could get very ugly for the prosecution. He's an alpha makle though, and will probably talk himself into a conviction. That's SDNY's gamble. They're not entirely screwed in the situation where he stays quiet though. They have him for Bojinka, which presumably was lined up for prosecution w/ good evidence long ago.  Remember, feds recently got al Marri, who was in the US for 9-11 follow on attacks on orders from UBL and KSM, on a credit card fraud guilty plea. Same thing w/ Padilla: overstying his visa, or some diminimus garbage like that. If the risk of embarassment and/or release of classified info becomes too great, they'll pull the plug on the big ticket prosecution-- 9-11, in this case-- and prosecute KSM for relatively piddling offenses.  The military tribunals cut short all of this stuff: a) crawford and miranda could be overcome with showings of reliability and voluntariness b) Gtmo's in the middle of nowhere and the media got sick of going down there just to give KSM publicity.  Now, he's a Broadway star. Incidentally, pity the  military prosecutors for Nashiri (USS Cole) and the other ones. First motion from defense counsel they're going to have to respond to: equal protection--a great argument, and I'll bet the miliatry judges-- who, if they aren't complete fools, see they're being set up-- dismiss on those grounds. Prediction-- in 2011, KSM convicted on lesser offense (Bojinka) the other guys get lessers as well (general material support for terrorism), the remaining military tribunal guys have charges dismissed and are evntaually repatriated. Will not be America's finest hour.

I love that Rudy pointed out how George W. Bush kept us safe from another terror attack on American soil, and how we got hit after he left. 

This whole thing pisses me off to no end.  These terrorists are not American citizens.  They are not presumed to be innocent, they've already admitted their culpability in bringing down the Towers. They are not entitled to a trial with a jury of their peers.  Are in jihadis from Syria and Pakistan going to be flown in to sit on the jury?  KSM et al. were not Mirandaized when they were captured.  This whole thing could be thrown out of court.  This is such a disgusting political ploy.  Obama is trying so hard to placate his far left base and this is an insidious, underhanded way to criminalize the Bush administration, but this could really backfire on him, especially if these guys are acquitted or receive a minimal sentence. Rudy is spot on in all of his arguments.  I like his analogy "This would be like trying those who attacked Pearl Harbor in a Hawaii court."

Political Correctness is going to get us all killed.  Thanks a lot 52%'ers.

Post #63 is why I think, in a sense, we would be even worse off if McLame had been elected. (btw, I did vote for him, left hand forcing the right to press that button, and managed that only because of Ms. Palin.)  Had McCain been the winner, an awful lot of us, myself included, would have merely relaxed and breathed a sigh of relief that ...whew, dodged another bullet there.  McSquishy and company would have continued leading us ever so gently down the path to pure socialism. Like the proverbial frog put into a pot of cold water.

Would anything short of the outcome of 2008's election and the resulting f**ckfest of insanity have woken so many of us up to the realization of what's happening to us and our freedom?   I think not.  We would have continued to give up our rights and freedoms...a little here, a little there, without even noticing them slipping away.  Slowly giving up the gift that rivers of blood have been and still are being shed to give us.

As it is, we may still have a chance to stop this runaway train.  I, for one, am glad to have been shaken out of my stupor and to see that I'm not alone in wanting to keep this country from becoming the USSA. 

No, it's not comfortable anymore. 114 This is about trying to find a way to get the past administration on trial.  If terrorist get released as a result of some action by the former administration they will be happy to release these terrorist back on society.  Rudy's point is that the trial will take the basis of sept 10th and look at laws in place that were never designed for foreign terrorists.  The first time the government tries to block release of any information, the judge will demand its release or information gained will not be admissable. This has nothing to do with the terrorist and everything to do with the left wing administration trying to shore up their radical left who want to see Bush and Cheney called as witnesses and forced to give up information on programs that kept us safe.  If this goes wrong in any way for any reason, the democrats should pay a terrible price for decades to come in every election even for local dog catcher.

Soooo tired of the left's insistance upon civilian courts in terrorism cases. first of all, military tribunals are not "unconstitutional," there is legal precedent for military tribunals. e.g., ex parte quiren was the case of 8 german spies that were tried as um...(gasp) spies. they snuck into the country, intent upon carrying out acts of sabotage against the U.S.; I believe all 8 of them were executed, and yes my friends, one of them was actually a US citizen. can you say, "jose padilla," anyone? anyone at all? any name? any finger? - sorry, i digress yet again into the world of the theatre, and given the ludicrous nature of the current white house administration i'd say my willing suspensioin of disbelief has about reached capacity. 134 In a capital case defendant's rights will be seen as extra important.  Remember you will need a unanimous verdict to get the execution, and that's if the judge doesn't throw it out when he/she hears they didn't have their rights read to them.  My guess is they will be acquitted and Obama will brag about how this vindicates the US legal system.  With his tin ear he probably thinks he can survive politically if that happens.  He makes such good speeches, you know.
