The new hate crimes law creates yet another specially protected group under federal law. It demonstrates Democrats' disdain for the principle of equal treatment under the law. Like other hate crimes laws it criminalizes having the wrong thoughts rather than wrong conduct. It may subject individuals to double jeopardy. No “may” about it. It is left entirely up to the DOJ to determine if one of these “hate crimes” has been prosecuted adequately. If someone is found “innocent” in State court for a local crime they can be charged again for the SAME act under a federal crime. This, along with hate crime laws in general are unconstitutional as hell.

Hate crimes have nothing to do with crime and everything to do with promoting one "special" group over another. And while I am not usually an advocate of the slippery slope argument, in this case, I believe that is the goal here. First, you make the status of the victim relevant in the crime. Before, if you killed a person, it was irrelevant if that person was white, black, male, female, ect. ect. Now it matters. Second, once the status of the victim is relevant, next the feelings of the victim are relevant. Thus, if the feelings are relevant, than other acts that normally would not be considered criminal (e.g., telling that person you are full of crap) are suddenly criminalized because of the status of that person. Hate crimes are just another step in the long process of the political correct movement in this country to stiffle free speech and reign in dissent.

If there is a ray of hope in this BS it is the fact that SCOTUS has ruled that laws against “hate speech” are unconstitutional. In a different ruling they said that extra punishment for “hate crimes” was acceptable, provided that some crime had actually been committed. Actually the “black” hate crimes already existed and that was the law that this law amended to add gays to the list of “hate victims”.
The double jeopardy provisions were also revised in this law to make it far easier to make a new charge. If my memory serves correctly, the old law required a ruling by a federal court that a “hate crime” had been committed AND that the local prosecution had been inadequate. The new law only requires the DOJ to make that ruling. Read that as the A.G. r.e. Eric “don’t prosecute blacks” Holder can now say that Bubba must be tried for the same crime twice. One other thing to consider on the double jeopardy BS is the location of the trial. If the “crime” is committed in Podunk Smalltown, RedState, USA the original jury pool was most likely chosen from those small town and county people who are most likely conservatives. Now everyone knows conservatives are more likely to find real criminals guilty and to go for tough sentencing.
Based on that it is obviously racism and hate when they find a white guy innocent in a crime against a minority or homosexual. Therefore the A.G. will make a new charge and a new trial, this time in a federal court which are located in large urban areas chock full of liberals. One other unconstitutional aspect of this new law is the opening up of the “hate crimes law” to a much wider group of people. Under the old law one had to be involved in some “federally protected activity” such as our old mimesis “interstate commerce”.
The new law removed that requirement so all local laws against violent crime are now by definition, also potential federal crimes.

I am in no way religious, but about 4 or 5 years ago, before I had cable, i was flipping through and saw this guy on the cornerstone(christian) network giving a sermon on hate crimes. It was great. Best speech on the issue i've ever heard on the subject. I think the guy's name was Rod Parsley. I am not sure where one would get a clip of it, but i would recommend it. I find the irony of this amusing (in a bad way). The Left says that endemic racism is a social construction in this country. We're all immersed in it constantly, according to them.
