Democrats Block ID Requirement for Obamacare UPDATE: Also Reject Anti-Abortion Provision

Democrats on Senate Finance unanimously blocked an amendment to the Baucus bill which would require applicants for the healthcare exchanges or healthcare subsidies show a photo ID before receiving benefits.

The President and Democrats have claimed that illegal immigrants will not be eligible for Obamacare, but every time Republicans have sought to introduce language which would actually require applicants to prove their identity and lawful status the Democrats have voted it down.

Without that requirement, the bill "remains dearly lacking when it comes to identification," Grassley said. "Frankly, I'm very perplexed as to why anyone would oppose this amendment," he said.

But Democratic Sen. Jeff Bingaman, who represents the border state of New Mexico, said that the type of fraud Grassley said he wants to prevent is highly uncommon. "The way I see the amendment, it's a solution without a problem," Bingaman said.

"Highly uncommon." How would he know?

UPDATE [DrewM.]: The committee also rejected an amendment sponsored by Orin Hatch that would have prevented money provided via tax credits to be used for plans that included abortion services.

Patients still have to provide an identity (eg name and address) when registering at ANY hospital. The patient in question may or may not have to provide documentation to actually confirm/prove that said identity is real, but they can't just check in anonymously.

(At worst, if the patient is unconscious and without any external means of identification, they may be registered temporarily as "John Doe #657" until someone identifies them).

So lack of ID doesn't stop ER workers/docs from reporting gunshot wounds, etc. If it turns out the given identity is false, that can be uncovered later by the investigators.

But the ER owes you no obligation other than simply evaluating/triaging you.

If they don't think there is anything wrong, they don't have to treat you. In fact, even if there *IS* something wrong they don't necessarily have to treat you unless they think it requires immediate treatment.

EG: Runny nose. . .here is a "prescription" for over the counter decongestants. Now GTFO of my ER and go follow up with your personal physician.

In practice, ERs will make every effort TO treat you, or at least to evaluate you to make absolutely sure there is nothing wrong. Nobody wants to be sued, or make the hospital look bad. . .but they don't have to.

"Can I have narcotics"?
"No, Mr. 'Smith'. . .if indeed that is your real name. . .you may not. Not GTFO of my ER or I'll have you tossed out, by those two burly men standing near the door".

Another standard ER "trick" to deal with non-sick patients is just to give them a few hours of observation (eg "FLT". . .fluorescent light therapy). . They'll just sit around waiting until magically, they feel better and leave, or get frustrated and leave "against medical advice", absolving the hospital of liability.

That's one potential solution that MIGHT work if, in fact, ICE would promptly come and deport illegals. It won't. While it has the legal ability to do that, it lacks the enforcement ability and more importantly the political mandate to actually do it.

Why not is complicated, but suffice it to say that if there were really that sort of strong national consensus against tolerating illegals, there wouldn't be any here to begin with.

Unreimbursed care at the level of the ER isn't limited to just illegal aliens, by the way.

There are plenty of individuals who don't have insurance for a number of reasons (including many who could afford, it, but choose not to buy it). That problem is just part of overall healthcare expenses, not necessarily the biggest part.

And this ER issue in particular is trivially easy to get rid of. Just let ER's turn away people with no ability to pay, the same way any other business (including most medical practices) can turn away potential customers who can't pay.

This will never happen, because its too politically incorrect, but if it DID happen, I think you'd not only see substantially lesser use of the ER as a primary clinic, but you'd also find lots of people (both citizens and illegals) who otherwise could afford insurance suddenly decide that they ought to actually do so. Remember, as it is right now, people of low income qualify for Medicare and other assisted programs.

Free care for indigents wouldn't go away, but in a true free market system without the gov't distorting natural economics, we might return to the "free clinic" system of voluntary charity care of yesteryear.

I am not talking about non-sick patients. Sickle Cell patients are often addicted to pain killers and will shop the ERs around town. The narc thing may be a bad point, it is just something I got tired of dealing with all the time during residency.

My first point is the important one. Why should I buy insurance when I do not have to give ID? If ill, just show up to the ER with an assumed name and get all the treatment I need. I'm not talking stabilization, like it is now. It sounds like they will not be requiring ID for any treatment whatsoever.

This is a variant of the problem with pre-existing conditions. My understanding of RommneyCare in Mass is that this is one of the things bankrupting the system. Why pay for insurance when you are well? Just buy it right before you need it and then cancel it when you're finished.

One solution would be to require insurance, but I don't see how they could legally do that. Car insurance is different because driving on public roads is a priveledge, not a right. Don't have car insurance, then you can't drive. But they can't force you to buy health insurance. I just don't see the courts going for that kind of scheme.

152 I may be completely wrong, but I believe there are other pieces of Federal Law that will directly contradict this. A law called FACTA was passed back in 2003 in an effort to combat identity theft. Among other things FACTA has increased the regulatory burden on the medical industry to verify the identity of a patient and make sure it matches their records. Not necessarily a bad thing. My doctor's office wanted to photocopy my driver's license and keep it on file (which I refused).

But as the hospital or doctor's office must verify the patient's identity what is the illegal going to say/do when asked for proof of identity?
