It's On! ACORN Sues O'Keefe, Giles And Breitbart

I feel sorry for them personally but discovery is going to be a bitch for ACORN*.

The liberal group contends that the audio portion of the video was obtained illegally because Maryland requires two-party consent to create sound recordings.

The two employees seen in the video were fired after it was posted online. The lawsuit says the employees, Tonja Thompson and Shera Williams, suffered "extreme emotional distress."

No word yet on a defense fund but I'm guessing it will popular.

*There's some debate in the comments about what the extent of discovery might be in this case. That was just my first thought when I saw the story but we shouldn't be celebrating the idea that we are going to get a look at ACORN's books just yet.

43 IANAL, but if it's the fired employees suing, discovery won't be able to reach into ACORN. On the other hand, if it's the employees suing, the suit's a joke, a pure nuisance suit, and their lawyers should be disbarred.

For one thing, they're on tape facilitating multiple felonies. They're lucky they're not the ones facing criminal charges!

For another, if courts allow people to sue for "emotional distress" for the results of their own actions, then we've opened the doors for "she dumped me" lawsuits!

Finally, the defendants just have to show the video tape! Unless the jury is packed with ACORN staffers, they're gonna win in a walk, and the only result of the lawsuit will be more "emotional distress" for the thugs.

The fact that ACORN had no license to operate could stir up some dust.  That is, "how can I be illegally recording an organization that isn't legally here?"  I'm not even sure how far that will go.

They are getting sued for supposedly breaking the law and recording without consent (bogus in my opinion). The obvious countersuit is we didn't break the law and here is why but where is the discovery for anything else?

The trump card is that the ACORN thugs were facilitating criminal activity, and aren't suing over being recorded -- they're suing over the "emotional distress" caused by their actions being recorded.

90 If the suit is over the taping, not defamation or libel, then I doubt any judge would allow the kind of discovery folks have been talking about here.  A judge won't allow a fishing expedition for evidence that's not related to the specific charges of the suit.  How could any otherwise incriminating evidence in ACORN's possession be related to O'Keefe, Giles, and Breitbart's taping these employees without their consent?  And if the individuals are suing, not ACORN, ACORN's records wouldn't be relevant at all.

I wouldn't be surprised if the case gets thrown out, but I also don't see how ACORN is exposed on this one.

I'm not sure, but I would guess that they could argue that ACORN was facilitating criminal activity and any evidence of facilitation of actual criminal activity would be germane.

I do agree, though, if it ever makes it to trial, a judge will throw it out.

I think it's a bluff to prevent the release of more tapes and, I'm going to guess, that the next motion will be a motion to keep Breitbart from releasing more tapes.

I just think they want to stop the bleeding.

102 I'm curious how the two-party consent is enforced.  Do people really have to get everyone that happens to be in a crowd or background to give signed consent in order to make a recording?  I can't imagine that kind of thing is actually enforced, unless it's to specifically target someone who makes a recording that someone 'special' doesn't like.  If it were used as evidence in a legal case, I can see why it would be inadmissable, but making it illegal to even make a recording unless everyone appearing in it has consented?  That's crazy.

this is basically a seizure of privacy matter, so, all the have to do is show that they were there legally, as in not asked to leave and the recording was done within their scope of plain sight.

I'm not really qualified to opine but that was my reaction, too, which I was sharing with Confederate Yankee. Discovery is often broad and frequently abused, but I think at the end of the day you have to give a good answer to the question, "Assuming that this evidence you seek does in fact exist, how would this be relevant to you defense?"

I don't believe going through ACORN's records is going to be very relevant to a simple question about whether this taping was consented to or not.

They will have to scramble for some defense here. I'm not sure what it will be. I was speculating that the real defense will be as regards damages, arguing these people contibuted to their own "emotional distress" by behaving abominably. And using that as a pretext to play those tapes again and again, to show just how horrid their non-reactions to this were, so in the end the jury says, "Um, a technical tort occurred here, so here's your damages -- one American dollar."

But I don't think it's accurate to say this is going to be a discovery bonanza.

I have not seen the Maryland statute that is in play here. However, if there were some exception for public figures or public works, then any discovery request reasonably calculated to lead to the discovery of ACCORN funding from the government may lead to the discovery of admissible evidence that ACCORN was a public entity. This, of course, would be considered an affirmative defense against the ACCORN claim. Again, this is all guess work, I have not read the statute. But discovery rules are generally rather liberal. Would be very interesting.

Just looked at the statute (10-402) - no media/investigative journalist exception, so from where I'm sitting they likely violated the statute.

Disclaimer - I am not familiar with Maryland law and I'm extrapolating from the principles we follow in CA.

If this suit was brought under our laws, the fact that the terminated employees were actually engaged in illegal activity would likely void any claims they had against the employer for wrongful termination - essentially if you had no legal right to your job because of your own misconduct, they can't be held responsible for not continuing to employ you to commit illegal acts on their dime.

There may not be existing precedent for extending that same protection to a third party but it stands on the same basic equitable principle - one that likely applies just as strongly in MD as CA - "unclean hands." 

How can O'Keefe et al be held financially responsible to you (the felons) for causing you to lose a job that you should not have had in the first place due to the very acts they caught you committing ?

Someone more familiar with First Amendment law may know of some additional authority from one of 60 Minutes or 20-20's lawsuits in this vein - it's not my area.

I also assume that O'Keefe and the other defendants will ask for a stay in civil proceedings while the criminal investigation of ACORN is pending, as they will be called upon to testify in such proceedings.  I wouldn't expect a trial in this civil case until 2-3 years down the road (during which time it will quietly get dismissed after ACORN leans on the fired employees to drop this before more dirty linen gets trotted out for the neighbors to see).

 I wouldn't think Whistleblower laws would apply since O'Keefe is not an employee of ACORN. May want to check the MD laws but generally whistleblower statutes prevent a company from retaliating against an employee that exposes criminal conduct by the the company.

 There may be some press shield laws that apply. Though they may not be mentioned in the wiretapping statute they may be listed seperately. If not you could still raise a 1st ammendment defense and say the wire tapping statute does not apply to press activities as it violates the 1st ammendment. Worth pursuing if for no other reason to put the MSM in a bigger bind than they already are about the issue.

4. Can the defendants file a class action against ACORN across the nation, citing misappropriation of taxpayer funds? That would bring the broadest discovery.

While I'm not a lawyer, as I vigorously protested previously, that's not a fair cack on judges.  In my work I deal extensively with litigation, and I have found the vast majority of judges try to do the right thing.  Yes there are assholes, and yes there are hacks, but most are decent people with a lot of previous experience in private practice and interpret the law to the best of their ability.  Sometimes they're wrong, true, but painting with a broad brush like that is not valid.

Good question, Peaches.  Generally, you have to be a legally recognized entity to be able to sue in any court.  If the documentation posted at BigGovernment.com is to be believed, ACORN is not an entity in good standing in MD, and has not been since 2006, IIRC - and ACORN Housing has not been an entity in good standing in MD since 2008, again IIRC.  Since neither was a viable entity at the time of the "offense," I would think that this would be an issue easily resolved on a motion for summary disposition:  ACORN has no standing and has suffered no injury, because it wasn't even in existence in MD at the time the "injury" occurred.

 This would make their advice a Public Service and hence not under the purvey of privacy statutes designed to protect the (an) individual.

The defense merely has to establish that the services (Public) rendered by this office (Public Funded) and disseminated by these specific employees (Public Employed) was in fact a Public Service (which it claims to be). This would force the case out on merit.

I don't see how the kids could be charged with entrapment when to my knowledge no charges were filed by them or at their behest (or at all).  Yes, this was for the fool.

As for the census worker -- that was pretty harsh, but not an uncommon hazard when working in that sort of environment.  The tradition of moonshine, marijuana plantations, and meth labs is pretty hardcore in those areas (as in mine) and the folks don't like "feds".  It's been that way for generations now, and isn't going to change anytime soon -- I don't see a connection with the present political climate as much as with the past traditions of the area involved. 

We had a case of a census taker some years back getting attacked, killed, and eaten by some hillbilly family's pack of semi-feral dogs a few years ago.  All they ever found were her glasses and her clipboard.  Had nothing to do with anything other than census taker not taking situational awareness into consideration (folks around here thought it was a horrible thing and just awful, but she'd been damn foolish going up there alone and unarmed).

So they may be covered or they may not. Most shield laws cover sources but you would have to check the law and court cases to see if it was expanded.

394 As far as discovery goes, no one has mentioned the countersuit.  If they countersue, especially ACORN, for monetary damages then they have the right to discovery of income and assets.  I sued a company that broke a commercial lease, they countersued  -  discovery was a bitch; tax returns for three years, 1099's and W-2's, check stubs for the current year, bank records, maintenance, insurance, utility records for properties, etc.  It was just like working a second job for about 90 days getting this shit together.

I hate to argue with the host, but you are taking a too literal approach to discovery rules.  Specifically (and again, I can only speak as to Illinois and Missouir, I have not practiced elsewhere) you are allowed, by case law, to request non-admissible discovery information.  Best example: auto insurance. In your typical fender bender, the fact that the defendant had insurance is irrelevant. Not even allowed to even mention it in front of a jury. But you are allowed to obtain auuto insurance information during discovery - why, because the information of who the insurance company is may lead to the discovery of who investigated the claim, ect., which may lead to the discovery of non-priviledged statements. The calculus is it possible  some type of admissible evidence be discovered if the discovery request is permitted. A very low standard.

Additionally, the defendants would be permitted to assert various affirmative defenses in the case. In that situation, discovery is permitted not only to the claims of the Plaintiffs, but also as to the nature of the defenses that are asserted. Again, I have not seen the Maryland statutets, so anything more is, on my part, mere conjecture.
