Holder to Appoint Prosecutor for CIA Abuse Claims
UPDATE: Gibbs Reacts

At least 10 and maybe 12 cases will be examined.

With an eye to jailing people, of course.

Attorney General Eric H. Holder Jr. has decided to appoint a prosecutor to examine nearly a dozen cases in which CIA interrogators and contractors may have violated anti-torture laws and other statutes when they allegedly threatened terrorism suspects, according to two sources familiar with the move.

Holder is poised to name John Durham, a career Justice Department prosecutor from Connecticut, to lead the inquiry, according to the sources, who spoke on condition of anonymity because the process is not complete.

Durham's mandate, the sources added, will be relatively narrow: to look at whether there is enough evidence to launch a full-scale criminal investigation of current and former CIA personnel who may have broken the law in their dealings with detainees. Many of the harshest CIA interrogation techniques have not been employed against terrorism suspects for four years or more.

Holder chose someone who seems to be on the hunt to "get" the CIA:

The attorney general selected Durham in part because the longtime prosecutor is familiar with the CIA and its past interrogation regime. For nearly two years, Durham has been probing whether laws against obstruction or false statements were violated in connection with the 2005 destruction of CIA videotapes. The tapes allegedly depicted brutal scenes including waterboarding of some of the agency's high value detainees. That inquiry is proceeding before a grand jury in Alexandria, although lawyers following the investigation have cast doubt on whether it will result in any criminal charges.

Obviously some object:

But nine GOP senators who occupy prominent roles on the Judiciary Committee last week urged Holder not to act at all, arguing that further investigation was both unnecessary and unwise.

"The intelligence community will be left to wonder whether actions taken today in the interest of national security will be subject to legal recriminations when the political winds shift," said the letter, signed by lawmakers including Sens. Jon Kyl (Ariz.), Jeff Sessions (Ala.), John Cornyn (Tex.), Orrin Hatch (Utah) and Charles Grassley (Iowa).

The IG report has been released. Among the horrors: Just after 9/11, Khalid Sheikh Mohammad was told that his children would be killed if "anything else happened" in the US. There are also claims that top terrorists were threatened with executions (mock executions), guns, and a power-drill.

Threats? We're going to prosecute people for threats?

In case you missed it, Leon Panetta threatened to quit in a "profanity-laced screaming match" regarding the released IG report.

From my reading the mock executions were simply having someone fire off a pistol in the adjacent room during an ongoing interrogation. I wouldn't consider any of this actual torture - it was more psychological theater, letting the detainee fill in the details with his own fears.

Letting someone be afraid of being tortured or killed != actually torturing or killing them. Huge difference.

I think most american felt this way because if  you recall the most memorable part of Bush's speech when he was standing on the rubble was the line, "i hear you and soon the people who did this will hear from all of us". Actually that line gave me chills, still does as I sit here and type it. I felt that day, and still do, the same way someone might feel if a family member was killed. The desire for brutal revenge the only thing pacing through my mind when i think about it.  I get really emotional(read:angry) every time i see footage from 9/11. I actually go out of my way to avoid it, except for once a year when MSNBC replays their coverage from that 9/11/01 on the anniversery(why they are the only network that does it I do not know, but i appreciate that they do).  It's really a primal hatred that i can't put to words, but it's something I think i will carry inside with me for life, and i honestly thought everyone else in this country would too.  When i see or hear people talk about it in a glib way or refer to it in a demeaning way i feel...well I guess the word disappointed will have to suffice .

Oh Dummy, a large part of combating an enemy force is performed by units known as PsyWar.  These are the psychological warfare men who are skilled at disinformation and misinformation purposely infused into the battlefield or civil environs for the purpose of putting fear or distrust in the enemy. 

It doesn't have to be on the battlefield, but can be very effective in villages or towns supportive of a counterinsurgency effort.  Either way Mr. Dum Dum, we zap their butts with prejudice.

What makes us "not them" is a helluva lot more than our aversion to torture.  The list is a long one, but let's start with basic civility and humanity.  Add to that our distaste for child rape, our dislike for throwing acid on women who dare to get an education, our ability to regard other human beings as roughly equal in value to ourselves (even if they don't worship the same God), and the fact that killing and torture aren't things that, as a culture, we do for fun.

 

Oh - and lets not forget basic hygene.

 

If Mulla Moohammed has to experience some physical discomfort to save the lives and limbs of Americans, then he needs to experience it.  Right before he's strangled and buried with a pile of pig intestines.

That's close but I'm not sure it's completely true.  I heard a while ago (in reference to the 'birth pangs' mentioned in Revelation) that there has been a major war fought, somewhere in the known world, in all but roughly 400 of the calendar years since Jesus left the earth.  So one in five years goes by without a blowup of some sort.

Though the still leaves Dummy plenty of opportunity to probe the history of war to find one fought on his delicate terms.

A threat to kill is not a mere threat when its carried out by the CIA. It prob violates moral codes.

And the last time I checked, violating a moral code is not necessarily criminal.  Morally, I should tithe to the church. Legally, if I don't - I don't wind up getting prosecuted. Also, dum-dum, did you see the threat, if something else happens, then this happens. Thus, it is not an immediate threat to harm someone, merely a threat to do something IF something else happens.  This is not legally actionable because it lacks the requisite mens rea to constitute an element of the crime. But, I only graduated law school, I didn't go to Harvard, like you. (insert your own snark about job hunting here).

And even a rather dim dum-dum like you would have to admit that the timing is curious.  Gee, health care is going in the tank and "The One" is facing an uprising from his left flank - so time to wheel out the war crimes! Thus, the timing undermines the very legitimacy any criminal proceeding needs, it looks political.

If you'll remember, on 9/11 al'Qaeda members slit the throats of unarmed civilians, hijacked four airplanes, and flew two of them into a building filled with unarmed civilians. Every dead civilian was a war crime committed -- on purpose -- by al'Qaeda.

There's no requirement in any of the laws of war to treat al'Qaeda and its associates according to the laws of war. It's arguable -- and I think it's a strong argument -- that extending the protection of the laws of war to al'Qaeda, etc. actually violates the laws of war.

This is a massive political miscalculation by Obama--if he thinks he's going to win over any of the 50-55% who now disapprove of him with this maneuver, his instincts are about as off-kilter as you'd expect from a state Senator who never had to campaign door to door.  In other words, I welcome this move and expect it to accelerate his negatives.

It was more than that.  CTU had the family in custody, but they were not threatening the actual family on closed circuit television.  They were threatening look alikes.  The suspect was made to believe they were threatening his family.  They weren't.

I know.  Let me lay it down:

First, if this were Bush, the Left would be H-O-W-L-I-N-G.  They would call it a secret police.  They would say that he's bringing it in-house, without even allowing the CIA to be involved so that he could personally put bamboo under fingernails.  Even responsible lefties (as opposed to the Olbermann types) would not stand for this, and for good reason.

Second, intelligence services are some of the most precisely delineated agencies in the government.  For example, the NSA gives small grants to encourage mathematics professors who do research in areas the NSA cares about.  The NSA cannot give the money to people without a green card or citizenship because the NSA is not permitted to give money to foreign assets.

Third, it sounds like this setup does not have Congressional oversight.  As we know from the Church commission, etc., the intelligence agencies are strictly overseen by Congress, if for no other reason than to be a whipping boy for the Left.

I do not think a personal secret police is too hysterical a way to describe this.  There is no check on this at all, but because Obama's a "good guy" and the CIA are "bad guys" then this is the way it should be done, donchaknow.

I am not an expert on this stuff, but I expect some righteous indignation coming soon.
