Self Proclaimed "Wise Latina", Um I Didn't Mean What I Actually Said

Senator Jeff Sessions took off after Sotomayor on her "Wise Latina" remark. Sotomayor's defense was to simply claim that despite saying it several time (7 by Sessions' count) it turns out she didn't mean it.

"My play on those words fell flat. It was bad," Sotomayor told Alabama Sen. Jeff Sessions, trying to defend her 2001 speech in which she suggested a "wise Latina" would usually reach better conclusions than a white man without similar experiences.

"I do not believe that any racial, ethnic or gendered group has an advantage in sound judgment," Sotomayor told the Senate Judiciary Committee on Tuesday, the second day of her confirmation hearing to become the first Hispanic to sit on the high court. "I do believe that every person has an equal opportunity to be a good and wise judge."

The federal appellate judge said her 2001 remarks to students at the University of California, Berkeley, were meant only to to "inspire them to believe that their life experiences would enrich the legal system" and not to suggest that any one group was more likely to reach a better conclusion.

But Sessions, the senior Republican on the committee, asked how Sotomayor could make such a claim Tuesday that she was "agreeing" with Supreme Court justice Sandra Day O'Connor that a "wise old man and wise old woman will reach the same conclusion in deciding cases.

It's good to see Sessions going directly after Sotomayor on this and briefly Ricci (my guess is Hatch or someone else will go into more detail on that).

She's basically playing hide the ball with her, "I can't talk about this", "due deference to precedent", "open mind on every case", blah, blah, blah answers.

Lindsay Graham is an annoying fool but he was right when he said baring a meltdown, Sotomayor is going to be confirmed. At this point the Republicans need to lay down markers on judicial philosophy that can be used in '10 and '12.

UPDATE: Hatch is going after her on the 2nd Amendment and Heller. He's getting into whether the 2nd Amendment is or should be incorporated against the state. She's dodging based on the fact that there are several cases working their way up to SCOTUS.

Fun moment...Orrin Hatch describing what nunchucks are.

He's moved on to Ricci. He's asking why she didn't issue a full opinion instead of just adopting the district court's analysis. Now he just talked past that question and instead is making a speech against People for the American way and she's getting a pass on that question. Damn. What the hell was that? I hope he comes back to that in his second round.

Now Lahey is doing rebuttal work before Feinstein gets to gush.

Sessions is now pointing out that Lahey is a lying sack of shit when it came to Miguel Estrada.

It's starting to get testy. Good.

She'll probably be confirmed, although the Repubs would be well within precedent to grill her on topics they consider limus tests, like her views on the second amendment right to bear arms. If she says anything other than "Americans have the right to own personal firearms", she should be denied the confirmation. I'd also ask her about the Kelo decision.

I do not even try to hide it anymore guys, I am a left wing hack that would agree with any Democrat nominee regardless if they slit puppies throats and bathed in human blood. I also loudly proclaim that SC nominees are simply partisan tools to try to rap up voting blocks, if there is a transexual Indian judge that will help Dems win a small county in southern Florida I am all for it. It is all to advance Dem policies that will help everyone out you will see. They will create jobs for all, free healthcare for all, free college for all, a "just" tax rate of 65%,  and affordable housing for all. You will see guys just wait it will all come true once people that vote for anyone with an R in front of their name just die or cease to vote. The politicians with a D in front of their names know what is best for everyone.

I just heard that 2 white men pulled up in a van and sprayed some Indian people standing outside an Indian restaurant with a mist of something. The reporter went on to say that this may be a hate crime. Undoubtedly liberals will characterize it as a hate crime. My question to the stupid latina: if a white commits a crime against a non white is it automatically a hate crime. What about a non white assaulting a white, is that a hate crime? If a black man kills a white and a homosexual is the crime against the homosexual greater [hate crime] than the crime committed against the white?

The GOP should re-brand as the "regular people" party or the "common sense" party.

The Republicans can't stop Soder Meyer.  What they can do is irrevocably brand her as a racist and a weak jurist, and then hang that on Obama and the Obamacrats, and make them defend her in perpetuity. 

Bob Beckel of all people made a great point on the wallbanger's show last night- this is not just about Soda Meyer, but about the nearly 1,000 district justices that Obama gets to appoint after the Democrat log jam of 2001-2008.  We need to make absolutely fucking sure everyone in the country knows that the Democrats back racists and pick people for affirmative action reasons and not for their judicial acumen.

So far this is working out okay----well, better than could be hoped for, what with neo-Marxists running the whole show.. We all know Obama is bound to nominate deconstructionists (anti-Constitutionalists) and that they are going to be confirmed.  But in this particular case the MSM is so tingly about the firsthispanicjusticeeverwowiezowieblahblah that they are actually giving the hearings attention.  That hasn't really happened with leftist appointees  before.

The GOP has been given the opportunity to score points against multi-cult bias as exemplified by Sotomayor and to get the message out about how judges should be.  As the post says, the object is to score some points and set up markers for the next election.  I think they're doing pretty well so far,....but let's see how they vote.

So blatant racism and exploitation of a SC nomination, or any nomination for that matter, is ok as long as it helps speed us along the lines to one party domination of the United States. Who cares about the qualifications for being a judge if it will help Dems win elections. See it is the same as when I and people like me demonize Palin and lied about her kids. We are doing it for her and your own good because WE CARE. It was ok to spread lies about Palin's child really being her daughters because we simply wanted the bad politicians to lose. The bad things you guys do like wars, racism, sexism, lying, and other such evil things make it ok to do things that are evil in other circumstances, but not in this super special one, to defeat you. The New Party, which is the name of the American Socialist Party (and the first party affiliation of our acting president, btw) shows what a third party can do.  They organize, they inform, and they lobby the party closer to their ideological bent.  After maybe 30 years, you get a radical main party- like the Democrats have now.  Even though the New Party never elected a major candidate, the Democrat party is essentially a socialist organization. 

We can rebuild the GOP in the same way with a decent third party which has no electoral aspirations.

I don't get this whole thing.  First, she's white.  She is.  If she grew up in Nebraska, she'd be just another kid whose parents have an accent.  Only in New York does she develop a racialist identity.  Maybe her parents spoke Spanish, but the child of a Thai immigrant family has the same "disadvantages" she did.  Maybe less, as they don't often go to private schools.  Ladies and gentlemen, this person overcame the "obstacle" of going to private schools.  I would have killed to go to a private high school.  But my parents couldn't afford it.

Second, what is "hispanic" anyway?  It's not a race, at best it's an ethnicity.  If I were of Mexican descent, I'd be a little annoyed that this person claims to speak for me even though her experience and her family's experience is vastly different from my own.

The two women in my life, aside from my daughter, who are close to me are part Hispanic.  They are both intelligent, and politically populist.  They have no problem with what Soda Meyer said.  They have no concept that it is racialist and bigoted.  They both say that it is true, that white men cannot judge as well as Hispanic women, and they are happy someone finally said so.

I think this is another cultural cleavage we have to look forward to- one in which we as a society collecitvely decide that justice shall not be blind, but rather judge on the basis of the identity of the parties involved, in order to achieve more "fairness".  I'm not happy.  I'm frightened that I'm married to an unapologetic racist, and that she's not alone.

Well my mom is Hispanic as well and she did not grow up in the States, and I tell you she will give you the shirt off her back to help you but some of the things she says are shocking. She is very gentle lady in her 70s and it's just ....I laugh and shake my head at certain situations. For example when Easter comes around she always states the Jews killed Jesus and I say okay, but no reason to have disdain now. I mean she holds a grudge I tell you it's unbelievable. Not reasonable at all. Oh and standing in line, it doesn't exist for her, it is frustrating. I do my best to explain but she is completely thick headed. The stories I could tell are just unbelievable to this age and time. My Dad uses her way as an explanation that their is no hope for South America. Yikes

Well I walk over the lady explains and I turn to my mom and say okay this carry on is too big to fit in the box and you have to pay for having 5 bags for 2 people. With Clinton, you were totally unsurprised when he rolled with the punch in '95 and proclaimed that the era of big government was over. Sure, it was completely disengenuous, but he had the moxey to do it, and the track record (Sistah Soulja et al) to back it up, so when welfare reform had to be passed over his veto, the moment had passed and he could carve out an area beyond which Gingrich dared not go. Clinton also got away with a lot because he had a booming economy to preside over (albeit less obviously before '96).

With Obama, he could do anything. My instinct tells me he's less of a Clintonian third-way policy wonk and more of a true-believer, like Carter. He'll get by on his media image for a while yet, but eventually chickens will come home to roost. However, I could be comepletely wrong about this.

Then 9/11 completely pulled me out my political ambiguity and I started to noticed how the left and the rest of the world cut and run on W when things got difficult. He's amusing, and a fairly sharp media critic, but there's a whole lot of preaching to the choir going on. I know the choir needs preaching sometimes, but I weary of it. Very few of the other talk-radio folk can I listen too (Hannity, for example, makes my head hurt).

As a matter of fact that is what I was saying is a bad thing that is going to happen if we do not do something to change the direction we are headed. It appears that that site is populated by the “self-styled” 3% people who say they will support violent revolution.

 

I advocated a third convention so that we could either take back the Constitution or form a third party who will actively oppose the Commiecrats.

 

A violent revolution in today’s world would only result in mass death and destruction with little hope of a good outcome. The most likely outcome would be establishment of a third world dictator for life here in this country.  The death toll for such a revolution would probably put the civil war to shame and that war claimed the largest death toll of any U.S. war in history. (Roughly 2% of the total population and that doesn’t count civilian casualties)

Vic, @190 I think you misunderstand the 3%. They don't want open revolution. They are fully aware it would be the most horrible thing one could imagine.

The author of Sipsey Street has described civil was as a dead baby torn in half and rotting in a ditch to express his distaste for the idea.

What the 3% are focused on is that the other side doesn't seem to care if they push things that far.

And don't think that it can't go that far. There has to be a line where you tell the enemy "this far and no further" or else you just keep backing up until you have no more ground to defend.

Im actually pleased about the recent outcome. but remember, the ruling isn't whether it was right, but whether the city had the right to pull the test after administering it.
